Such administrator shall be a physician with a current license, an advanced practice registered nurse, a licensed nursing home administrator, a child day center director, or a registered nurse with at least five years of experience in pediatric medicine.B\n\nOperation of the Center shall include:1\n\nCoordination of emergency transportation arrangements with the emergency medical services of the locality where the Center is located, including the provision of an adult staff member of the Center who accompanies any child who requires emergency transportation;2\n\nCreation of a documented preventative maintenance program that emphasizes ensuring that all durable medical equipment functions correctly and safely;3\n\nMaintenance of medical records, data, and information related to the children and programs in the Center for inspection by the Commissioner;4\n\nProvision of appropriate and readily available emergency services that include (i) an emergency drug kit and (ii) a crash cart with a defibrillator appropriate for children;5\n\nCreation of a written disaster plan that addresses natural disasters, weather emergencies, bomb threats, emergency drills, manufactured disasters, and financial disasters;6\n\nDocumentation of all incidents and accidents;7\n\nA process for reporting to the Commissioner any incidents and accidents that affect the health, safety, or welfare of a child; and8\n\nCoordination and collaboration with other agencies that may serve the child.C\n\nEach Center shall have a medical director who is responsible for basic and supportive services, including medical, pharmaceutical, and nursing services. Such administrator shall be a physician with a current license, an advanced practice registered nurse, a licensed nursing home administrator, a child day <span class=\"dictionary\">center<\/span> director, or a registered nurse with at least five years of experience in pediatric medicine. <a id=\"paragraph-248376\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Operation of the <span class=\"dictionary\">Center<\/span> shall include: <a id=\"paragraph-248377\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Coordination of emergency transportation arrangements with the emergency medical services of the locality where the <span class=\"dictionary\">Center<\/span> is located, including the provision of an adult staff member of the <span class=\"dictionary\">Center<\/span> who accompanies any child who requires emergency transportation; <a id=\"paragraph-248378\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Creation of a documented preventative maintenance program that emphasizes ensuring that all durable medical equipment functions correctly and safely; <a id=\"paragraph-248379\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Maintenance of medical records, data, and information related to the children and programs in the <span class=\"dictionary\">Center<\/span> for inspection by the <span class=\"dictionary\">Commissioner<\/span>; <a id=\"paragraph-248380\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Provision of appropriate and readily available emergency services that include (i) an emergency drug kit and (ii) a crash cart with a defibrillator appropriate for children; <a id=\"paragraph-248381\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Creation of a written disaster plan that addresses natural disasters, weather emergencies, bomb threats, emergency drills, manufactured disasters, and financial disasters; <a id=\"paragraph-248382\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Documentation of all incidents and accidents; <a id=\"paragraph-248383\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> A process for reporting to the <span class=\"dictionary\">Commissioner<\/span> any incidents and accidents that affect the health, safety, or welfare of a child; and <a id=\"paragraph-248384\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Coordination and collaboration with other agencies that may serve the child. <a id=\"paragraph-248385\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Each <span class=\"dictionary\">Center<\/span> shall have a <span class=\"dictionary\">medical director<\/span> who is responsible for basic and supportive services, including medical, pharmaceutical, and nursing services. The <span class=\"dictionary\">medical director<\/span> shall be responsible for (i) the prevention, reporting, and investigation of abuse; (ii) the delivery of medical and therapeutic services; (iii) the control and delivery of pharmaceutical services; (iv) infection control; and (v) policies for prevention of incidents and accidents. The <span class=\"dictionary\">medical director<\/span> shall ensure compliance with any policies and procedures developed by the <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-248386\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Each <span class=\"dictionary\">Center<\/span> shall employ: <a id=\"paragraph-248387\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> A supervisor that holds a valid relevant professional license issued by the <span class=\"dictionary\">Board<\/span> of Medicine, <span class=\"dictionary\">Board<\/span> of Nursing, <span class=\"dictionary\">Board<\/span> of Pharmacy, <span class=\"dictionary\">Board<\/span> of Physical Therapy, or <span class=\"dictionary\">Board<\/span> of Audiology and Speech-Language Pathology. <a id=\"paragraph-248388\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> At least one direct care staff member who is qualified as a licensed advanced practice registered nurse, registered nurse, physical therapist, respiratory therapist, occupational therapist, or speech-language pathologist. <a id=\"paragraph-248389\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Each <span class=\"dictionary\">Center<\/span> shall abide by the following applicable staffing ratio: <a id=\"paragraph-248390\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> For a <span class=\"dictionary\">Center<\/span> with fewer than 13 children, the <span class=\"dictionary\">Center<\/span> shall be staffed by two registered nurses and two other staff members. <a id=\"paragraph-248391\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> For a <span class=\"dictionary\">Center<\/span> with no less than 13 and no more than 18 children, the <span class=\"dictionary\">Center<\/span> shall be staffed by two registered nurses, one licensed practical nurse, and three other staff members. <a id=\"paragraph-248392\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> For a <span class=\"dictionary\">Center<\/span> with no less than 19 and no more than 24 children, the <span class=\"dictionary\">Center<\/span> shall be staffed by two registered nurses, two licensed practical nurses, and four other staff members. <a id=\"paragraph-248393\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#E3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> For a <span class=\"dictionary\">Center<\/span> with more than 24 children, the number of licensed practical nurses and other staff members shall increase by one each for up to six additional children enrolled. <a id=\"paragraph-248394\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.12\/#E4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(EFFECTIVE JULY 1, 2026) OPERATION AND MANAGEMENT; STAFFING (\u00a7\n32.1-162.15:1.12)\n\nA. Creation of a written disaster plan that addresses natural disasters,\n   weather emergencies, bomb threats, emergency drills, manufactured disasters,\n   and financial disasters;\n\n   6. Documentation of all incidents and accidents;\n\n   7. A process for reporting to the Commissioner any incidents and accidents\n   that affect the health, safety, or welfare of a child; and\n\n   8. Coordination and collaboration with other agencies that may serve the\n   child.\n\nC.
