Such disciplinary action may be in addition to any penalty imposed by law for the violation.1\n\nAll requests for an opportunity to be heard following a notice of imposition of disciplinary action shall be received in writing within 15 days of the date of receipt of such notice.2\n\nAll administrative proceedings under this section shall be separate from the regulatory office of the Department that conducted the inspection, investigation, examination, or review.3\n\nThe presiding officer shall provide a recommendation to the Commissioner, including findings of fact, conclusions, and appropriate disciplinary action.4\n\nThe Commissioner may affirm, modify, or reverse such recommendation and shall issue a final case decision.E\n\nWhenever the Commissioner refuses to issue a license or to renew a license or revokes a license for a Center other than a Center operated by an agency of the Commonwealth, the provisions of the Administrative Process Act (&#xA7; 2.2-4000 et seq.) shall apply.F\n\nExcept as provided in &#xA7; 32.1-162.15:1.22, the Commissioner shall take no action to impose disciplinary action against a Center operated by an agency of the Commonwealth except after reasonable notice and an opportunity to be heard in accordance with &#xA7; 32.1-162.15:1.23.G\n\nAn appeal, taken as provided in this section, shall operate to stay any criminal prosecution for operation without a license.H\n\nA monetary penalty that is not appealed becomes due on the first day after the appeal period expires. The license of a Center that has failed to pay a civil penalty due under this section shall not be renewed until the civil penalty has been paid in full, with interest, provided that the Commissioner may renew a license when an unpaid monetary penalty is the subject of a pending appeal.I\n\nIf a license is revoked or refused renewal, a new license may be issued by the Commissioner after:1\n\nSatisfactory evidence is submitted to him that the conditions upon which the revocation or refusal was based have been corrected; and2\n\nProper inspection has been made and compliance with all provisions of this article, regulations promulgated pursuant to this article, and applicable state and federal law and regulations hereunder has been obtained.J\n\nThe Board shall promulgate regulations to implement the provisions of this section that include:1\n\nCriteria for when the imposition of disciplinary action or initiation of court proceedings as specified in &#xA7; 32.1-27, or a combination thereof, are appropriate in order to ensure prompt correction of violations involving noncompliance with requirements of any order of the Board or Commissioner or any provision of or regulation promulgated pursuant to this article;2\n\nCriteria for the imposition of disciplinary action based upon the severity, pervasiveness, duration, and degree of risk to the health, safety, or welfare of children;3\n\nProvisions allowing the Commissioner (i) to accept a plan of correction, including a schedule of compliance, from a Center prior to assessing a monetary penalty pursuant to subdivision B 6 or (ii) to reduce or abate the monetary penalty amount if the Center complies with the plan of correction within its terms; <a id=\"paragraph-265546\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Mandating training for the licensee or licensee&#8217;s employees or volunteers, with any costs to be borne by the licensee, when the <span class=\"dictionary\">Commissioner<\/span> concludes that the lack of such training has led directly to violations of regulations; however, no monetary <span class=\"dictionary\">penalty<\/span> shall be imposed pursuant to this subdivision on any <span class=\"dictionary\">Center<\/span> operated by an agency of the Commonwealth; <a id=\"paragraph-265548\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Requiring licensees to contact <span class=\"dictionary\">parents<\/span>, guardians, or other responsible <span class=\"dictionary\">persons<\/span> in writing regarding health and safety violations; and <a id=\"paragraph-265549\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Requiring submission of and compliance with plans of corrective action, with or without actions directed by the <span class=\"dictionary\">Commissioner<\/span>. <a id=\"paragraph-265550\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Any monetary penalties collected under this section shall be paid in equal portions to the Physician Loan Repayment Program established in &#xA7; <a class=\"law\" title=\"Physician Loan Repayment Program\" href=\"\/32.1-122.6_1\/\">32.1-122.6:1<\/a>, the Nurse Loan Repayment Program established in &#xA7; <a class=\"law\" title=\"Nurse Loan Repayment Program\" href=\"\/32.1-122.6_04\/\">32.1-122.6:04<\/a>, and the Nursing Scholarship and Loan Repayment Fund established in &#xA7; <a class=\"law\" title=\"Nursing Scholarship and Loan Repayment Fund\" href=\"\/54.1-3011.2\/\">54.1-3011.2<\/a> after deduction of the administrative costs of the <span class=\"dictionary\">Commissioner<\/span> and the <span class=\"dictionary\">Department<\/span> in furtherance of this section. <a id=\"paragraph-265551\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Except as provided in \u00a7&nbsp;<a class=\"law\" title=\"(Effective July 1, 2026) Summary suspension; privately operated Centers\" href=\"\/32.1-162.15_1.21\/\">32.1-162.15:1.21<\/a>, the <span class=\"dictionary\">Commissioner<\/span> shall take no action to impose disciplinary action against a <span class=\"dictionary\">Center<\/span> that is not operated by an agency of the Commonwealth except after reasonable notice and an opportunity to be heard in no fewer than 30 days by the <span class=\"dictionary\">Commissioner<\/span>&#8217;s presiding officer in accordance with \u00a7&nbsp;<a class=\"law\" title=\"Informal fact finding proceedings\" href=\"\/2.2-4019\/\">2.2-4019<\/a>. Such disciplinary action may be in addition to any <span class=\"dictionary\">penalty<\/span> imposed by <span class=\"dictionary\">law<\/span> for the violation. <a id=\"paragraph-265552\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> All requests for an opportunity to be heard following a notice of imposition of disciplinary action shall be received in writing within 15 days of the date of receipt of such notice. <a id=\"paragraph-265553\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> All administrative proceedings under this section shall be separate from the regulatory office of the <span class=\"dictionary\">Department<\/span> that conducted the inspection, investigation, examination, or review. <a id=\"paragraph-265554\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The presiding officer shall provide a recommendation to the <span class=\"dictionary\">Commissioner<\/span>, including <span class=\"dictionary\">findings<\/span> of <span class=\"dictionary\">fact<\/span>, conclusions, and appropriate disciplinary action. <a id=\"paragraph-265555\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The <span class=\"dictionary\">Commissioner<\/span> may <span class=\"dictionary\">affirm<\/span>, modify, or <span class=\"dictionary\">reverse<\/span> such recommendation and shall <span class=\"dictionary\">issue<\/span> a final case decision. <a id=\"paragraph-265556\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#D4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Whenever the <span class=\"dictionary\">Commissioner<\/span> refuses to <span class=\"dictionary\">issue<\/span> a license or to renew a license or revokes a license for a <span class=\"dictionary\">Center<\/span> other than a <span class=\"dictionary\">Center<\/span> operated by an agency of the Commonwealth, the provisions of the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.) shall apply. <a id=\"paragraph-265557\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Except as provided in &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Summary suspension; Centers operated by an agency of the Commonwealth\" href=\"\/32.1-162.15_1.22\/\">32.1-162.15:1.22<\/a>, the <span class=\"dictionary\">Commissioner<\/span> shall take no action to impose disciplinary action against a <span class=\"dictionary\">Center<\/span> operated by an agency of the Commonwealth except after reasonable notice and an opportunity to be heard in accordance with &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Right to appeal notice of imposition of disciplinary action; Centers operated by agencies of the Commonwealth\" href=\"\/32.1-162.15_1.23\/\">32.1-162.15:1.23<\/a>. <a id=\"paragraph-265558\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> An <span class=\"dictionary\">appeal<\/span>, taken as provided in this section, shall operate to <span class=\"dictionary\">stay<\/span> any criminal <span class=\"dictionary\">prosecution<\/span> for operation without a license. <a id=\"paragraph-265559\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> A monetary <span class=\"dictionary\">penalty<\/span> that is not appealed becomes due on the first day after the <span class=\"dictionary\">appeal<\/span> period expires. The license of a <span class=\"dictionary\">Center<\/span> that has failed to pay a civil <span class=\"dictionary\">penalty<\/span> due under this section shall not be renewed until the civil <span class=\"dictionary\">penalty<\/span> has been paid in full, with interest, provided that the <span class=\"dictionary\">Commissioner<\/span> may renew a license when an unpaid monetary <span class=\"dictionary\">penalty<\/span> is the subject of a pending <span class=\"dictionary\">appeal<\/span>. <a id=\"paragraph-265560\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> If a license is revoked or refused renewal, a new license may be issued by the <span class=\"dictionary\">Commissioner<\/span> after: <a id=\"paragraph-265561\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Satisfactory <span class=\"dictionary\">evidence<\/span> is submitted to him that the conditions upon which the <span class=\"dictionary\">revocation<\/span> or refusal was based have been corrected; and <a id=\"paragraph-265562\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#I1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Proper inspection has been made and compliance with all provisions of this article, regulations promulgated pursuant to this article, and applicable state and federal <span class=\"dictionary\">law<\/span> and regulations hereunder has been obtained. <a id=\"paragraph-265563\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#I2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> The <span class=\"dictionary\">Board<\/span> shall promulgate regulations to implement the provisions of this section that include: <a id=\"paragraph-265564\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Criteria for when the imposition of disciplinary action or initiation of <span class=\"dictionary\">court<\/span> proceedings as specified in &#xA7; <a class=\"law\" title=\"Penalties, injunctions, civil penalties and charges for violations\" href=\"\/32.1-27\/\">32.1-27<\/a>, or a combination thereof, are appropriate in <span class=\"dictionary\">order<\/span> to ensure prompt correction of violations involving noncompliance with requirements of any <span class=\"dictionary\">order<\/span> of the <span class=\"dictionary\">Board<\/span> or <span class=\"dictionary\">Commissioner<\/span> or any provision of or regulation promulgated pursuant to this article; <a id=\"paragraph-265565\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#J1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Criteria for the imposition of disciplinary action based upon the severity, pervasiveness, duration, and degree of risk to the health, safety, or welfare of children; <a id=\"paragraph-265566\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#J2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Provisions allowing the <span class=\"dictionary\">Commissioner<\/span> (i) to accept a plan of correction, including a schedule of compliance, from a <span class=\"dictionary\">Center<\/span> prior to assessing a monetary <span class=\"dictionary\">penalty<\/span> pursuant to subdivision B 6 or (ii) to reduce or abate the monetary <span class=\"dictionary\">penalty<\/span> amount if the <span class=\"dictionary\">Center<\/span> complies with the plan of correction within its terms; and <a id=\"paragraph-265567\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#J3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Procedures for imposition of disciplinary action consistent with the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.). <a id=\"paragraph-265568\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-162.15_1.20\/#J4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(EFFECTIVE JULY 1, 2026) DISCIPLINARY ACTION; Requiring submission of and compliance with plans of corrective action,\n   with or without actions directed by the Commissioner.\n\nC. Any monetary penalties collected under this section shall be paid in equal\nportions to the Physician Loan Repayment Program established in &#xA7;\n32.1-122.6:1, the Nurse Loan Repayment Program established in &#xA7;\n32.1-122.6:04, and the Nursing Scholarship and Loan Repayment Fund established\nin &#xA7; 54.1-3011.2 after deduction of the administrative costs of the\nCommissioner and the Department in furtherance of this section.\n\nD. Except as provided in \u00a7 32.1-162.15:1.21, the Commissioner shall take no\naction to impose disciplinary action against a Center that is not operated by an\nagency of the Commonwealth except after reasonable notice and an opportunity to\nbe heard in no fewer than 30 days by the Commissioner&#8217;s presiding officer\nin accordance with \u00a7 2.2-4019. Such disciplinary action may be in addition to\nany penalty imposed by law for the violation.\n\n   1. All requests for an opportunity to be heard following a notice of\n   imposition of disciplinary action shall be received in writing within 15 days\n   of the date of receipt of such notice.\n\n   2. All administrative proceedings under this section shall be separate from\n   the regulatory office of the Department that conducted the inspection,\n   investigation, examination, or review.\n\n   3. The presiding officer shall provide a recommendation to the Commissioner,\n   including findings of fact, conclusions, and appropriate disciplinary action.\n\n   4. The Commissioner may affirm, modify, or reverse such recommendation and\n   shall issue a final case decision.\n\nE. Whenever the Commissioner refuses to issue a license or to renew a license or\nrevokes a license for a Center other than a Center operated by an agency of the\nCommonwealth, the provisions of the Administrative Process Act (&#xA7; 2.2-4000\net seq.) shall apply.\n\nF. Except as provided in &#xA7; 32.1-162.15:1.22, the Commissioner shall take no\naction to impose disciplinary action against a Center operated by an agency of\nthe Commonwealth except after reasonable notice and an opportunity to be heard\nin accordance with &#xA7; 32.1-162.15:1.23.\n\nG. An appeal, taken as provided in this section, shall operate to stay any\ncriminal prosecution for operation without a license.\n\nH. A monetary penalty that is not appealed becomes due on the first day after\nthe appeal period expires. The license of a Center that has failed to pay a\ncivil penalty due under this section shall not be renewed until the civil\npenalty has been paid in full, with interest, provided that the Commissioner may\nrenew a license when an unpaid monetary penalty is the subject of a pending\nappeal.\n\nI. If a license is revoked or refused renewal, a new license may be issued by\nthe Commissioner after:\n\n   1. Satisfactory evidence is submitted to him that the conditions upon which\n   the revocation or refusal was based have been corrected; and\n\n   2. Proper inspection has been made and compliance with all provisions of this\n   article, regulations promulgated pursuant to this article, and applicable\n   state and federal law and regulations hereunder has been obtained.\n\nJ. The Board shall promulgate regulations to implement the provisions of this\nsection that include:\n\n   1. Criteria for when the imposition of disciplinary action or initiation of\n   court proceedings as specified in &#xA7; 32.1-27, or a combination thereof,\n   are appropriate in order to ensure prompt correction of violations involving\n   noncompliance with requirements of any order of the Board or Commissioner or\n   any provision of or regulation promulgated pursuant to this article;\n\n   2. Criteria for the imposition of disciplinary action based upon the severity,\n   pervasiveness, duration, and degree of risk to the health, safety, or welfare\n   of children;\n\n   3. Provisions allowing the Commissioner (i) to accept a plan of correction,\n   including a schedule of compliance, from a Center prior to assessing a\n   monetary penalty pursuant to subdivision B 6 or (ii) to reduce or abate the\n   monetary penalty amount if the Center complies with the plan of correction\n   within its terms; and\n\n   4.
