and <a id=\"paragraph-253980\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-291.9\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Any other <span class=\"dictionary\">person<\/span> having the authority to dispose of the decedent&#8217;s body. <a id=\"paragraph-253981\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-291.9\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> If there is more than one member of a class listed in subdivisions A 1, A 2, A 4, A 5, A 6, A 7, or A 8 entitled to make an anatomical gift, an anatomical gift may be made by a member of the class unless that member or a <span class=\"dictionary\">person<\/span> to which the gift may pass under &#xA7; <a class=\"law\" title=\"Persons that may receive anatomical gift; purpose of anatomical gift\" href=\"\/32.1-291.11\/\">32.1-291.11<\/a> knows of an objection by another member of the class. If an objection is known, the gift may be made only by those members who constitute at least 50 percent of the class who are reasonably available. <a id=\"paragraph-253982\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-291.9\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> A <span class=\"dictionary\">person<\/span> may not make an anatomical gift if, at the time of the decedent&#8217;s death, a <span class=\"dictionary\">person<\/span> in a prior class under subsection A is reasonably available to make or to <span class=\"dictionary\">object<\/span> to the making of an anatomical gift. <a id=\"paragraph-253983\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-291.9\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nWHO MAY MAKE ANATOMICAL GIFT OF DECEDENT&#8217;S BODY OR PART (\u00a7 32.1-291.9)\n\nA. Subject to subsections B and C and unless barred by \u00a7 32.1-291.7 or\n32.1-291.8, an anatomical gift of a decedent&#8217;s body or part for purpose of\ntransplantation, therapy, research, or education may be made by any member of\nthe following classes of persons who is reasonably available, in the order of\npriority listed:\n\n   1. An agent of the decedent at the time of death who could have made an\n   anatomical gift under subdivision 2 of &#xA7; 32.1-291.4 immediately before\n   the decedent&#8217;s death;\n\n   2. The persons who were acting as the guardians of the person of the decedent\n   at the time of death;\n\n   3. The spouse of the decedent;\n\n   4. Adult children of the decedent;\n\n   5. Parents of the decedent;\n\n   6. Adult siblings of the decedent;\n\n   7. Adult grandchildren of the decedent;\n\n   8. Grandparents of the decedent;\n\n   9. An adult who exhibited special care and concern for the decedent; and\n\n   10. Any other person having the authority to dispose of the decedent&#8217;s\n   body.\n\nB. If there is more than one member of a class listed in subdivisions A 1, A 2,\nA 4, A 5, A 6, A 7, or A 8 entitled to make an anatomical gift, an anatomical\ngift may be made by a member of the class unless that member or a person to\nwhich the gift may pass under &#xA7; 32.1-291.11 knows of an objection by\nanother member of the class.
