If, after reviewing the facts and after medical consultation, the agency concludes it is reasonable to believe an exposure prone incident involving the person and the employee may have occurred, (i) the agency shall request the employee whose body fluids were involved to give consent to submit to testing for hepatitis B or C virus and human immunodeficiency virus and to authorize disclosure of the test results or (ii) if the employee is deceased, the agency shall request the custodian of the remains to preserve a specimen of blood and shall request the decedent&#8217;s next of kin to provide consent, as provided in &#xA7; 32.1-37.2, to such testing and to authorize disclosure of the test results.E\n\nIf consent is refused under subsection C, the public safety agency or the employee may petition the general district court of the city or county in which the person resides or resided, or in the case of a nonresident, the city or county of the public safety agency&#8217;s principal office, to determine whether an exposure prone incident has occurred and to order testing and disclosure of the test results.\n\t\t\tIf consent is refused under subsection D, the person involved in the possible exposure prone incident may petition the general district court of the city or county of the public safety agency&#8217;s principal office to determine whether an exposure prone incident has occurred and to order testing and disclosure of the test results.F\n\nIf the court finds by a preponderance of the evidence that an exposure prone incident has occurred, it shall order testing for hepatitis B or C virus and human immunodeficiency virus and disclosure of the test results. The court shall be advised by the Commissioner or his designee in making this finding. The hearing shall be held in camera as soon as practicable after the petition is filed. The record shall be sealed.G\n\nA party may appeal an order of the general district court to the circuit court of the same jurisdiction within ten days from the date of the order. Any such appeal shall be de novo, in camera, and shall be heard as soon as possible by the circuit court. The circuit court shall be advised by the Commissioner or his designee. The record shall be sealed. The order of the circuit court shall be final and nonappealable.H\n\nDisclosure of any test results provided by this section shall be made to the district health director of the jurisdiction in which the petition was brought or the district in which the person or employee was tested. The district health director or his designee shall inform the parties of the test results and counsel them in accordance with subsection B of &#xA7; 32.1-37.2.I\n\nThe results of the tests shall be confidential as provided in &#xA7; 32.1-36.1.J\n\nNo person known or suspected to be positive for infection with hepatitis B or C virus or human immunodeficiency virus shall be refused services for that reason by any public safety agency personnel.K\n\nFor the purpose of this section and for no other purpose, the term &#8220;employee&#8221; shall include: (i) any person providing assistance to a person employed by a public safety agency who is directly affected by a possible exposure prone incident as a result of the specific crime or specific circumstances involved in the assistance and (ii) any victim of or witness to a crime who is directly affected by a possible exposure prone incident as a result of the specific crime.L\n\nThis section shall not be deemed to create any duty on the part of any person where none exists otherwise, and a cause of action shall not arise from any failure to request consent or to consent to testing under this section. <a class=\"law\" title=\"Consent for testing for human immunodeficiency virus; condition on disclosure of test results; counseling required; exceptions\" href=\"\/32.1-37.2\/\">32.1-37.2<\/a> and to authorize disclosure of the test results. <a id=\"paragraph-248174\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> If a <span class=\"dictionary\">person<\/span> is involved in a possible <span class=\"dictionary\">exposure prone incident<\/span> involving the body fluids of an employee of a <span class=\"dictionary\">public safety agency<\/span>, the <span class=\"dictionary\">person<\/span> may request the agency to review the <span class=\"dictionary\">facts<\/span> of the possible <span class=\"dictionary\">exposure prone incident<\/span> for purposes of obtaining the employee&#8217;s consent to test for hepatitis B or C virus and human immunodeficiency virus as provided in &#xA7; <a class=\"law\" title=\"Consent for testing for human immunodeficiency virus; condition on disclosure of test results; counseling required; exceptions\" href=\"\/32.1-37.2\/\">32.1-37.2<\/a> and to authorize disclosure of the test results. If, after reviewing the <span class=\"dictionary\">facts<\/span> and after medical consultation, the agency concludes it is reasonable to believe an <span class=\"dictionary\">exposure prone incident<\/span> involving the <span class=\"dictionary\">person<\/span> and the employee may have occurred, (i) the agency shall request the employee whose body fluids were involved to give consent to submit to testing for hepatitis B or C virus and human immunodeficiency virus and to authorize disclosure of the test results or (ii) if the employee is deceased, the agency shall request the custodian of the remains to preserve a specimen of blood and shall request the decedent&#8217;s next of kin to provide consent, as provided in &#xA7; <a class=\"law\" title=\"Consent for testing for human immunodeficiency virus; condition on disclosure of test results; counseling required; exceptions\" href=\"\/32.1-37.2\/\">32.1-37.2<\/a>, to such testing and to authorize disclosure of the test results. <a id=\"paragraph-248175\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> If consent is refused under subsection C, the <span class=\"dictionary\">public safety agency<\/span> or the employee may <span class=\"dictionary\">petition<\/span> the general district <span class=\"dictionary\">court<\/span> of the city or county in which the <span class=\"dictionary\">person<\/span> resides or resided, or in the case of a nonresident, the city or county of the <span class=\"dictionary\">public safety agency<\/span>&#8217;s principal office, to determine whether an <span class=\"dictionary\">exposure prone incident<\/span> has occurred and to <span class=\"dictionary\">order<\/span> testing and disclosure of the test results.\n\t\t\tIf consent is refused under subsection D, the <span class=\"dictionary\">person<\/span> involved in the possible <span class=\"dictionary\">exposure prone incident<\/span> may <span class=\"dictionary\">petition<\/span> the general district <span class=\"dictionary\">court<\/span> of the city or county of the <span class=\"dictionary\">public safety agency<\/span>&#8217;s principal office to determine whether an <span class=\"dictionary\">exposure prone incident<\/span> has occurred and to <span class=\"dictionary\">order<\/span> testing and disclosure of the test results. <a id=\"paragraph-248176\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> If the <span class=\"dictionary\">court<\/span> finds by a <span class=\"dictionary\">preponderance of the evidence<\/span> that an <span class=\"dictionary\">exposure prone incident<\/span> has occurred, it shall <span class=\"dictionary\">order<\/span> testing for hepatitis B or C virus and human immunodeficiency virus and disclosure of the test results. The <span class=\"dictionary\">court<\/span> shall be advised by the <span class=\"dictionary\">Commissioner<\/span> or his designee in making this <span class=\"dictionary\">finding<\/span>. The <span class=\"dictionary\">hearing<\/span> shall be held <span class=\"dictionary\">in camera<\/span> as soon as practicable after the <span class=\"dictionary\">petition<\/span> is filed. The record shall be <span class=\"dictionary\">sealed<\/span>. <a id=\"paragraph-248177\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> A <span class=\"dictionary\">party<\/span> may <span class=\"dictionary\">appeal<\/span> an <span class=\"dictionary\">order<\/span> of the general district <span class=\"dictionary\">court<\/span> to the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> of the same <span class=\"dictionary\">jurisdiction<\/span> within ten days from the date of the <span class=\"dictionary\">order<\/span>. Any such <span class=\"dictionary\">appeal<\/span> shall be <span class=\"dictionary\">de novo<\/span>, <span class=\"dictionary\">in camera<\/span>, and shall be heard as soon as possible by the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span>. The <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> shall be advised by the <span class=\"dictionary\">Commissioner<\/span> or his designee. The record shall be <span class=\"dictionary\">sealed<\/span>. The <span class=\"dictionary\">order<\/span> of the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> shall be final and nonappealable. <a id=\"paragraph-248178\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Disclosure of any test results provided by this section shall be made to the district health director of the <span class=\"dictionary\">jurisdiction<\/span> in which the <span class=\"dictionary\">petition<\/span> was brought or the district in which the <span class=\"dictionary\">person<\/span> or employee was tested. The district health director or his designee shall inform the parties of the test results and <span class=\"dictionary\">counsel<\/span> them in accordance with subsection B of &#xA7; <a class=\"law\" title=\"Consent for testing for human immunodeficiency virus; condition on disclosure of test results; counseling required; exceptions\" href=\"\/32.1-37.2\/\">32.1-37.2<\/a>. <a id=\"paragraph-248179\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> The results of the tests shall be confidential as provided in &#xA7; <a class=\"law\" title=\"Confidentiality of test for human immunodeficiency virus; civil penalty; individual action for damages or penalty\" href=\"\/32.1-36.1\/\">32.1-36.1<\/a>. <a id=\"paragraph-248180\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> No <span class=\"dictionary\">person<\/span> known or suspected to be positive for infection with hepatitis B or C virus or human immunodeficiency virus shall be refused services for that reason by any <span class=\"dictionary\">public safety agency<\/span> personnel. <a id=\"paragraph-248181\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> For the purpose of this section and for no other purpose, the term &#8220;employee&#8221; shall include: (i) any <span class=\"dictionary\">person<\/span> providing assistance to a <span class=\"dictionary\">person<\/span> employed by a <span class=\"dictionary\">public safety agency<\/span> who is directly affected by a possible <span class=\"dictionary\">exposure prone incident<\/span> as a result of the specific <span class=\"dictionary\">crime<\/span> or specific circumstances involved in the assistance and (ii) any victim of or <span class=\"dictionary\">witness<\/span> to a <span class=\"dictionary\">crime<\/span> who is directly affected by a possible <span class=\"dictionary\">exposure prone incident<\/span> as a result of the specific <span class=\"dictionary\">crime<\/span>. <a id=\"paragraph-248182\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"L\"><p><span class=\"prefix-number\">L.<\/span> This section shall not be deemed to create any duty on the part of any <span class=\"dictionary\">person<\/span> where none exists otherwise, and a <span class=\"dictionary\">cause of action<\/span> shall not arise from any failure to request consent or to consent to testing under this section. The remedies available under this section shall be exclusive. <a id=\"paragraph-248183\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#L\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"M\"><p><span class=\"prefix-number\">M.<\/span> For the purposes of this section:\n\t\t\t&#8220;<span class=\"dictionary\">Exposure prone incident<\/span>&#8221; means a direct exposure to body fluids of another <span class=\"dictionary\">person<\/span> in a manner which may, according to the then current guidelines of the Centers for Disease Control and Prevention, transmit hepatitis B or C virus or human immunodeficiency virus and which occurred during the commission of a criminal act, during the performance of emergency procedures, care or assistance, or in the course of public safety or <span class=\"dictionary\">law<\/span>-enforcement duties.\n\t\t\t&#8220;<span class=\"dictionary\">Public safety agency<\/span>&#8221; means any sheriff&#8217;s office; any adult or youth correctional, <span class=\"dictionary\">law<\/span>-enforcement, or fire safety organization; the <span class=\"dictionary\">Department<\/span> of Forensic Science; or any agency or <span class=\"dictionary\">department<\/span> that employs <span class=\"dictionary\">persons<\/span> who have <span class=\"dictionary\">law<\/span>-enforcement authority and which is under the direction and control of the Commonwealth or any local governing body. <a id=\"paragraph-248184\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/32.1-45.2\/#M\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPUBLIC SAFETY EMPLOYEES; TESTING FOR BLOOD-BORNE PATHOGENS; PROCEDURE AVAILABLE\nFOR CERTAIN CITIZENS; DEFINITIONS (\u00a7 32.1-45.2)\n\nA. If, in the course of employment, an employee of a public safety agency is\ninvolved in a possible exposure prone incident, the employee shall immediately,\nor as soon thereafter as practicable, notify the agency of the incident in\naccordance with the agency&#8217;s procedures for reporting workplace accidents.\n\nB. If, after reviewing the facts of the possible exposure prone incident with\nthe employee and after medical consultation, the agency concludes that it is\nreasonable to believe that an exposure prone incident may have occurred, and the\nperson whose body fluids were involved in the exposure prone incident is\ndeceased, the agency shall (i) immediately contact the custodian of the remains\nand request that a specimen of blood be preserved for testing and (ii) contact\nthe next of kin of the decedent and inform the next of kin that the specimen\nwill be tested for hepatitis B or C viruses and human immunodeficiency virus and\nthe results of such testing released to the person who was exposed.\n\nC. If, after reviewing the facts of the possible exposure prone incident with\nthe employee and after medical consultation, the agency concludes that it is\nreasonable to believe that an exposure prone incident may have occurred and the\nperson whose body fluids were involved in the exposure prone incident is alive,\nthe agency shall request the person whose body fluids were involved to submit to\ntesting for hepatitis B or C virus and human immunodeficiency virus as provided\nin &#xA7; 32.1-37.2 and to authorize disclosure of the test results.\n\nD. If a person is involved in a possible exposure prone incident involving the\nbody fluids of an employee of a public safety agency, the person may request the\nagency to review the facts of the possible exposure prone incident for purposes\nof obtaining the employee&#8217;s consent to test for hepatitis B or C virus and\nhuman immunodeficiency virus as provided in &#xA7; 32.1-37.2 and to authorize\ndisclosure of the test results. If, after reviewing the facts and after medical\nconsultation, the agency concludes it is reasonable to believe an exposure prone\nincident involving the person and the employee may have occurred, (i) the agency\nshall request the employee whose body fluids were involved to give consent to\nsubmit to testing for hepatitis B or C virus and human immunodeficiency virus\nand to authorize disclosure of the test results or (ii) if the employee is\ndeceased, the agency shall request the custodian of the remains to preserve a\nspecimen of blood and shall request the decedent&#8217;s next of kin to provide\nconsent, as provided in &#xA7; 32.1-37.2, to such testing and to authorize\ndisclosure of the test results.\n\nE. If consent is refused under subsection C, the public safety agency or the\nemployee may petition the general district court of the city or county in which\nthe person resides or resided, or in the case of a nonresident, the city or\ncounty of the public safety agency&#8217;s principal office, to determine\nwhether an exposure prone incident has occurred and to order testing and\ndisclosure of the test results.\n\t\t\tIf consent is refused under subsection D, the person involved in the possible\nexposure prone incident may petition the general district court of the city or\ncounty of the public safety agency&#8217;s principal office to determine whether\nan exposure prone incident has occurred and to order testing and disclosure of\nthe test results.\n\nF. If the court finds by a preponderance of the evidence that an exposure prone\nincident has occurred, it shall order testing for hepatitis B or C virus and\nhuman immunodeficiency virus and disclosure of the test results. The court shall\nbe advised by the Commissioner or his designee in making this finding. The\nhearing shall be held in camera as soon as practicable after the petition is\nfiled. The record shall be sealed.\n\nG. A party may appeal an order of the general district court to the circuit\ncourt of the same jurisdiction within ten days from the date of the order. Any\nsuch appeal shall be de novo, in camera, and shall be heard as soon as possible\nby the circuit court. The circuit court shall be advised by the Commissioner or\nhis designee. The record shall be sealed. The order of the circuit court shall\nbe final and nonappealable.\n\nH. Disclosure of any test results provided by this section shall be made to the\ndistrict health director of the jurisdiction in which the petition was brought\nor the district in which the person or employee was tested. The district health\ndirector or his designee shall inform the parties of the test results and\ncounsel them in accordance with subsection B of &#xA7; 32.1-37.2.\n\nI. The results of the tests shall be confidential as provided in &#xA7;\n32.1-36.1.\n\nJ. No person known or suspected to be positive for infection with hepatitis B or\nC virus or human immunodeficiency virus shall be refused services for that\nreason by any public safety agency personnel.\n\nK. For the purpose of this section and for no other purpose, the term\n&#8220;employee&#8221; shall include: (i) any person providing assistance to a\nperson employed by a public safety agency who is directly affected by a possible\nexposure prone incident as a result of the specific crime or specific\ncircumstances involved in the assistance and (ii) any victim of or witness to a\ncrime who is directly affected by a possible exposure prone incident as a result\nof the specific crime.\n\nL. This section shall not be deemed to create any duty on the part of any person\nwhere none exists otherwise, and a cause of action shall not arise from any\nfailure to request consent or to consent to testing under this section. The\nremedies available under this section shall be exclusive.\n\nM.
