If the Committee makes an affirmative determination, as evidenced by an affirmative vote of a majority of the members of the Committee, the Department of Transportation or the Department of Rail and Public Transportation may proceed with the procurement pursuant to &#xA7; 33.2-1803.D\n\nMeetings of the Committee shall be open to the public, and meetings will be scheduled on an as-needed basis. and <a id=\"paragraph-289524\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-1803.2\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The terms sheet developed for the proposed procurement contains all necessary elements. <a id=\"paragraph-289525\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-1803.2\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> After receipt of responses to the request for qualifications, but prior to the issuance of the first draft request for proposals, the Committee shall meet to determine that the <span class=\"dictionary\">development<\/span> and\/or <span class=\"dictionary\">operation<\/span> of the transportation facility or facilities as a <span class=\"dictionary\">qualifying transportation facility<\/span> serves the public interest pursuant to &#xA7; There is hereby established the Transportation Public-Private Partnership\nSteering Committee (the Committee) to evaluate and review financing options for\nthe development and\/or operation of transportation facility or facilities.\n\t\t\tThe Committee shall consist of the following members:\n\n   1. Two members of the Commonwealth Transportation Board;\n\n   2. The staff director of the House Committee on Appropriations, or his\n   designee, and the staff director of the Senate Committee on Finance and\n   Appropriations, or his designee;\n\n   3. A Deputy Secretary of Transportation who shall serve as the chairman;\n\n   4. The chief financial officer of either the Department of Transportation or\n   the Department of Rail and Public Transportation, as appropriate; and\n\n   5. A nonagency public financial expert, as selected by the Secretary of\n   Transportation.\n\nB. Prior to the initiation of any procurement pursuant to \u00a7 33.2-1803 by the\nDepartment of Transportation, the Virginia Passenger Rail Authority, or the\nDepartment of Rail and Public Transportation, the Committee shall meet to review\nthe public sector analysis and competition developed pursuant to \u00a7\n33.2-1803.1:1 and concur that:\n\n   1. The assumptions regarding the project scope, benefits, and costs of the\n   public sector option developed pursuant to &#xA7; 33.2-1803.1:1 were fully and\n   reasonably developed;\n\n   2. The assumed financing costs and valuation of both financial and\n   construction risk mitigation included in the public sector option are\n   financially sound and reflect the best interest of the public; and\n\n   3. The terms sheet developed for the proposed procurement contains all\n   necessary elements.\n\nC.
