To allocate funds for these needs pursuant to &#xA7; 33.2-358 and Chapter 15 (&#xA7; 33.2-1500 et seq.), the Board shall adopt a Six-Year Improvement Program of anticipated projects and programs by July 1 of each year. This program shall be based on the most recent official Commonwealth Transportation Fund revenue forecast and shall be consistent with a debt management policy adopted by the Board in consultation with the Debt Capacity Advisory Committee and the Department of the Treasury.C\n\nThe Board shall have the power and duty to enter into contracts with local districts, commissions, agencies, or other entities created for transportation purposes.D\n\nThe Board shall have the power and duty to promote increasing private investment in the Commonwealth&#8217;s transportation infrastructure, including acquisition of causeways, bridges, tunnels, highways, and other transportation facilities.E\n\nThe Board shall only include a project or program wholly or partially funded with funds from the State of Good Repair Program pursuant to &#xA7; 33.2-369, the High Priority Projects Program pursuant to &#xA7; 33.2-370, the Highway Construction District Grant Programs pursuant to &#xA7; 33.2-371, or the Interstate Operations and Enhancement Program pursuant to &#xA7; 33.2-372, or capital projects funded through the Virginia Highway Safety Improvement Program pursuant to &#xA7; 33.2-373 in the Six-Year Improvement Program if the allocation of funds from those programs and other funding committed to such project or program within the six-year horizon of the Six-Year Improvement Program is sufficient to complete the project or program. The provisions of this subsection shall not apply to any project (i) the design and construction of which cannot be completed within six years, (ii) the estimated costs of which exceed $2 billion, and (iii) that requires the Board to exercise its authority to waive the funding cap pursuant to subsection B of &#xA7; 33.2-369.F\n\nThe Board shall have the power and duty to integrate land use with transportation planning and programming, consistent with the efficient and economical use of public funds. If the Board determines that a local transportation plan described in &#xA7; 15.2-2223 or any amendment as described in &#xA7; 15.2-2229 or a metropolitan regional long-range transportation plan or regional Transportation Improvement Program as described in &#xA7; 33.2-3201 is not consistent with the Board&#8217;s Statewide Transportation Plan developed pursuant to &#xA7; 33.2-353, the Six-Year Improvement Program adopted pursuant to subsection B, and the location of routes to be followed by roads comprising systems of state highways pursuant to subsection A of &#xA7; 33.2-208, the Board shall notify the locality of such inconsistency and request that the applicable plan or program be amended accordingly. If, after a reasonable time, the Board determines that there is a refusal to amend the plan or program, then the Board may reallocate funds that were allocated to the nonconforming project as permitted by state or federal law. However, the Board shall not reallocate any funds allocated pursuant to &#xA7; 33.2-319 or 33.2-366, based on a determination of inconsistency with the Board&#8217;s Statewide Transportation Plan or the Six-Year Improvement Program nor shall the Board reallocate any funds, allocated pursuant to subsection C or D of &#xA7; 33.2-358, from any projects on highways controlled by any county that has withdrawn, or elects to withdraw, from the secondary system of state highways based on a determination of inconsistency with the Board&#8217;s Statewide Transportation Plan or the Six-Year Improvement Program. If a locality or metropolitan planning organization requests the termination of a project, and the Department does not agree to the termination, or if a locality or metropolitan planning organization does not advance a project to the next phase of construction when requested by the Board and the Department has expended state or federal funds, the locality or the localities within the metropolitan planning organization may be required to reimburse the Department for all funds expended on the project. Six-Year Improvement Program","Type":"Text","Format":"text\/html","Identifier":"\u00a7 33.2-214","Relation":"Code of Virginia"},"html":"\n\t\t\t\t\t\t<section id=\"A\"><p><span class=\"prefix-number\">A.<\/span> The <span class=\"dictionary\">Board<\/span> shall have the power and duty to monitor and, where necessary, approve actions taken by the <span class=\"dictionary\">Department<\/span> of Rail and <span class=\"dictionary\">Public Transportation<\/span> pursuant to Article 5 (&#xA7; <a class=\"law\" title=\"Policy\" href=\"\/33.2-281\/\">33.2-281<\/a> et seq.) in <span class=\"dictionary\">order<\/span> to ensure the efficient and economical development of <span class=\"dictionary\">public transportation<\/span>, the enhancement of rail transportation, and the coordination of such rail and <span class=\"dictionary\">public transportation<\/span> plans with <span class=\"dictionary\">highway<\/span> programs. <a id=\"paragraph-209929\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-214\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The <span class=\"dictionary\">Board<\/span> shall have the power and duty to coordinate the planning for financing of transportation needs, including needs for <span class=\"dictionary\">highways<\/span>, railways, seaports, airports, and <span class=\"dictionary\">public transportation<\/span> and set aside funds as provided in &#xA7; <a class=\"law\" title=\"Transportation Trust Fund\" href=\"\/33.2-1524.1\/\">33.2-1524.1<\/a>. To allocate funds for these needs pursuant to &#xA7; <a class=\"law\" title=\"Allocation of funds to programs\" href=\"\/33.2-358\/\">33.2-358<\/a> and Chapter 15 (&#xA7; <a class=\"law\" title=\"Legislative findings and purposes\" href=\"\/33.2-1500\/\">33.2-1500<\/a> et seq.), the <span class=\"dictionary\">Board<\/span> shall adopt a Six-Year Improvement Program of anticipated projects and programs by July 1 of each year. This program shall be based on the most recent official Commonwealth Transportation Fund revenue forecast and shall be consistent with a debt management policy adopted by the <span class=\"dictionary\">Board<\/span> in consultation with the Debt Capacity Advisory Committee and the <span class=\"dictionary\">Department<\/span> of the Treasury. <a id=\"paragraph-209930\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-214\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The <span class=\"dictionary\">Board<\/span> shall have the power and duty to enter into <span class=\"dictionary\">contracts<\/span> with local districts, commissions, agencies, or other entities created for transportation purposes. <a id=\"paragraph-209931\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-214\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">Board<\/span> shall have the power and duty to promote increasing private investment in the Commonwealth&#8217;s transportation infrastructure, including acquisition of causeways, bridges, tunnels, <span class=\"dictionary\">highways<\/span>, and other transportation facilities. <a id=\"paragraph-209932\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-214\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Board<\/span> shall only include a project or program wholly or partially funded with funds from the State of Good Repair Program pursuant to &#xA7; <a class=\"law\" title=\"State of good repair\" href=\"\/33.2-369\/\">33.2-369<\/a>, the High Priority Projects Program pursuant to &#xA7; <a class=\"law\" title=\"High-priority projects program\" href=\"\/33.2-370\/\">33.2-370<\/a>, the <span class=\"dictionary\">Highway Construction<\/span> District Grant Programs pursuant to &#xA7; <a class=\"law\" title=\"Highway construction district grant programs\" href=\"\/33.2-371\/\">33.2-371<\/a>, or the Interstate Operations and Enhancement Program pursuant to &#xA7; <a class=\"law\" title=\"Interstate Operations and Enhancement Program\" href=\"\/33.2-372\/\">33.2-372<\/a>, or capital projects funded through the Virginia Highway Safety Improvement Program pursuant to &#xA7; <a class=\"law\" title=\"Virginia Highway Safety Improvement Program\" href=\"\/33.2-373\/\">33.2-373<\/a> in the Six-Year Improvement Program if the allocation of funds from those programs and other funding committed to such project or program within the six-year horizon of the Six-Year Improvement Program is sufficient to complete the project or program. The provisions of this subsection shall not apply to any project (i) the design and construction of which cannot be completed within six years, (ii) the estimated costs of which exceed $2 billion, and (iii) that requires the <span class=\"dictionary\">Board<\/span> to exercise its authority to <span class=\"dictionary\">waive<\/span> the funding cap pursuant to subsection B of &#xA7; <a class=\"law\" title=\"State of good repair\" href=\"\/33.2-369\/\">33.2-369<\/a>. <a id=\"paragraph-209933\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-214\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The <span class=\"dictionary\">Board<\/span> shall have the power and duty to integrate land use with transportation planning and programming, consistent with the efficient and economical use of public funds. If the <span class=\"dictionary\">Board<\/span> determines that a local transportation plan described in &#xA7; <a class=\"law\" title=\"Comprehensive plan to be prepared and adopted; scope and purpose\" href=\"\/15.2-2223\/\">15.2-2223<\/a> or any amendment as described in &#xA7; <a class=\"law\" title=\"Amendments\" href=\"\/15.2-2229\/\">15.2-2229<\/a> or a metropolitan regional long-range transportation plan or regional Transportation Improvement Program as described in &#xA7; <a class=\"law\" title=\"Transportation planning duties and responsibilities of Metropolitan planning organizations\" href=\"\/33.2-3201\/\">33.2-3201<\/a> is not consistent with the <span class=\"dictionary\">Board<\/span>&#8217;s Statewide Transportation Plan developed pursuant to &#xA7; <a class=\"law\" title=\"Commonwealth Transportation Board to develop and update Statewide Transportation Plan\" href=\"\/33.2-353\/\">33.2-353<\/a>, the Six-Year Improvement Program adopted pursuant to subsection B, and the location of routes to be followed by roads comprising systems of state <span class=\"dictionary\">highways<\/span> pursuant to subsection A of &#xA7; <a class=\"law\" title=\"Location of routes\" href=\"\/33.2-208\/\">33.2-208<\/a>, the <span class=\"dictionary\">Board<\/span> shall notify the locality of such inconsistency and request that the applicable plan or program be amended accordingly. If, after a reasonable time, the <span class=\"dictionary\">Board<\/span> determines that there is a refusal to <span class=\"dictionary\">amend<\/span> the plan or program, then the <span class=\"dictionary\">Board<\/span> may reallocate funds that were allocated to the nonconforming project as permitted by state or federal <span class=\"dictionary\">law<\/span>. However, the <span class=\"dictionary\">Board<\/span> shall not reallocate any funds allocated pursuant to &#xA7; <a class=\"law\" title=\"Payments to cities and certain towns for maintenance of certain highways\" href=\"\/33.2-319\/\">33.2-319<\/a> or <a class=\"law\" title=\"Funds for counties that have withdrawn or elect to withdraw from the secondary state highway system\" href=\"\/33.2-366\/\">33.2-366<\/a>, based on a determination of inconsistency with the <span class=\"dictionary\">Board<\/span>&#8217;s Statewide Transportation Plan or the Six-Year Improvement Program nor shall the <span class=\"dictionary\">Board<\/span> reallocate any funds, allocated pursuant to subsection C or D of &#xA7; <a class=\"law\" title=\"Allocation of funds to programs\" href=\"\/33.2-358\/\">33.2-358<\/a>, from any projects on <span class=\"dictionary\">highways<\/span> controlled by any county that has withdrawn, or elects to withdraw, from the secondary system of state <span class=\"dictionary\">highways<\/span> based on a determination of inconsistency with the <span class=\"dictionary\">Board<\/span>&#8217;s Statewide Transportation Plan or the Six-Year Improvement Program. If a locality or metropolitan planning organization requests the termination of a project, and the <span class=\"dictionary\">Department<\/span> does not agree to the termination, or if a locality or metropolitan planning organization does not advance a project to the next phase of construction when requested by the <span class=\"dictionary\">Board<\/span> and the <span class=\"dictionary\">Department<\/span> has expended state or federal funds, the locality or the localities within the metropolitan planning organization may be required to reimburse the <span class=\"dictionary\">Department<\/span> for all funds expended on the project. If, after design approval by the Chief Engineer of the <span class=\"dictionary\">Department<\/span>, a locality or metropolitan planning organization requests alterations to a project that, in the aggregate, exceeds 10 percent of the total project costs, the locality or the localities within the metropolitan planning organization may be required to reimburse the <span class=\"dictionary\">Department<\/span> for the additional project costs above the original estimates for making such alterations. <a id=\"paragraph-209934\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/33.2-214\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nTRANSPORTATION; SIX-YEAR IMPROVEMENT PROGRAM (\u00a7 33.2-214)\n\nA.
