Upon receipt of any <span class=\"dictionary\">order<\/span> from a commitment <span class=\"dictionary\">hearing<\/span> issued pursuant to this chapter for mandatory outpatient treatment, the <span class=\"dictionary\">clerk of court<\/span> shall, prior to the close of that business day, certify and forward to the Central Criminal Records Exchange, on a form provided by the Exchange, a copy of the <span class=\"dictionary\">order<\/span>. <a id=\"paragraph-271643\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/37.2-819\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The <span class=\"dictionary\">clerk of court<\/span> shall also, as soon as practicable but no later than the close of business on the next following business day, forward upon receipt to the Central Criminal Records Exchange, on a form provided by the Exchange, certification of any person who has been the subject of a temporary detention <span class=\"dictionary\">order<\/span> pursuant to &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Involuntary temporary detention; issuance and execution of order\" href=\"\/37.2-809\/\">37.2-809<\/a>, and who, after being advised by the <span class=\"dictionary\">judge<\/span> or <span class=\"dictionary\">special justice<\/span> that he will be prohibited from possessing a firearm pursuant to &#xA7; <a class=\"law\" title=\"Purchase, possession, or transportation of firearm by persons involuntarily admitted or ordered to outpatient treatment; penalty\" href=\"\/18.2-308.1_3\/\">18.2-308.1:3<\/a>, subsequently agreed to voluntary admission pursuant to &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Voluntary admission\" href=\"\/37.2-805\/\">37.2-805<\/a>. <a id=\"paragraph-271644\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/37.2-819\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Except as provided in subdivision A 1 of &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Dissemination of criminal history record information\" href=\"\/19.2-389\/\">19.2-389<\/a>, the copy of the forms and <span class=\"dictionary\">orders<\/span> sent to the Central Criminal Records Exchange pursuant to subsection B, and the forms and certifications sent to the Central Criminal Records Exchange regarding voluntary admission pursuant to subsection C, shall be kept confidential in a separate file and used only to determine a person&#8217;s eligibility to possess, purchase, or transfer a firearm. No medical records shall be forwarded to the Central Criminal Records Exchange with any form, <span class=\"dictionary\">order<\/span>, or certification required by subsection B or C. The <span class=\"dictionary\">Department<\/span> of <span class=\"dictionary\">State<\/span> Police shall forward only a person&#8217;s eligibility to possess, purchase, or transfer a firearm to the National Instant Criminal Background Check System. <a id=\"paragraph-271645\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/37.2-819\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nORDER OF INVOLUNTARY ADMISSION OR MANDATORY OUTPATIENT TREATMENT FORWARDED TO\nCCRE; CERTAIN VOLUNTARY ADMISSIONS FORWARDED TO CCRE; FIREARM BACKGROUND CHECK\n(\u00a7 37.2-819)\n\nA. The order from a commitment hearing issued pursuant to this chapter for\ninvoluntary admission or mandatory outpatient treatment and the certification of\nany person who has been the subject of a temporary detention order pursuant to\n&#xA7; 37.2-809 and who, after being advised by the judge or special justice\nthat he will be prohibited from possessing a firearm pursuant to &#xA7;\n18.2-308.1:3, subsequently agreed to voluntary admission pursuant to &#xA7;\n37.2-805 shall be filed by the judge or special justice with the clerk of the\ndistrict court for the county or city where the hearing took place as soon as\npracticable but no later than the close of business on the next business day\nfollowing the completion of the hearing.\n\nB. Upon receipt of any order from a commitment hearing issued pursuant to this\nchapter for involuntary admission to a facility, the clerk of court shall, as\nsoon as practicable but not later than the close of business on the next\nfollowing business day, certify and forward to the Central Criminal Records\nExchange, on a form provided by the Exchange, a copy of the order. Upon receipt\nof any order from a commitment hearing issued pursuant to this chapter for\nmandatory outpatient treatment, the clerk of court shall, prior to the close of\nthat business day, certify and forward to the Central Criminal Records Exchange,\non a form provided by the Exchange, a copy of the order.\n\nC. The clerk of court shall also, as soon as practicable but no later than the\nclose of business on the next following business day, forward upon receipt to\nthe Central Criminal Records Exchange, on a form provided by the Exchange,\ncertification of any person who has been the subject of a temporary detention\norder pursuant to &#xA7; 37.2-809, and who, after being advised by the judge or\nspecial justice that he will be prohibited from possessing a firearm pursuant to\n&#xA7; 18.2-308.1:3, subsequently agreed to voluntary admission pursuant to\n&#xA7; 37.2-805.\n\nD. Except as provided in subdivision A 1 of &#xA7; 19.2-389, the copy of the\nforms and orders sent to the Central Criminal Records Exchange pursuant to\nsubsection B, and the forms and certifications sent to the Central Criminal\nRecords Exchange regarding voluntary admission pursuant to subsection C, shall\nbe kept confidential in a separate file and used only to determine a\nperson&#8217;s eligibility to possess, purchase, or transfer a firearm.
