{"formats":[{"name":"JSON","format":"json","url":"\/downloads\/2025\/code-json\/38.2-1800.json"},{"name":"Plain Text","format":"text","url":"\/downloads\/2025\/code-text\/38.2-1800.txt"},{"name":"XML","format":"xml","url":"\/downloads\/2025\/code-xml\/38.2-1800.xml"},{"name":"HTML","format":"html","url":"\/downloads\/2025\/code-html\/38.2-1800.html"}],"law_id":67482,"edition_id":1,"section_id":67482,"structure_id":14103,"section_number":"38.2-1800","catch_line":"Definitions","history":"1979, c. 513, \u00a7 38.1-327.1; 1981, c. 604; 1983, c. 480; 1984, c. 719; 1986, c. 562; 1987, cc. 520, 521; 1992, c. 586; 1994, cc. 106, 316; 1995, c. 167; 1998, cc. 16, 47, 164; 1999, cc. 86, 490, 493, 586; 2000, c. 526; 2001, c. 706; 2003, cc. 412, 717, 979; 2004, cc. 460, 668, 784; 2006, c. 410; 2011, c. 222; 2012, c. 447; 2013, cc. 203, 497; 2016, c. 250; 2022, cc. 131, 132; 2023, cc. 338, 339.","full_text":"As used in this chapter:\n\t\t&#8220;Agent,&#8221; &#8220;insurance agent,&#8221; &#8220;producer,&#8221; or &#8220;insurance producer,&#8221; when used without qualification, means an individual or business entity that sells, solicits, or negotiates contracts of insurance or annuity in the Commonwealth.\n\t\t&#8220;Appointed agent,&#8221; &#8220;appointed insurance agent,&#8221; &#8220;appointed producer,&#8221; or &#8220;appointed insurance producer,&#8221; when used without qualification, means an individual or business entity licensed in the Commonwealth to sell, solicit, or negotiate contracts of insurance or annuity of the classes authorized within the scope of such license and who is appointed by a company licensed in the Commonwealth to sell, solicit, or negotiate on its behalf contracts of insurance of the classes authorized within the scope of such license and, if authorized by the company, may collect premiums on those contracts.\n\t\t&#8220;Business entity&#8221; means a partnership, limited partnership, limited liability company, corporation, or other legal entity other than a sole proprietorship.\n\t\t&#8220;Dental plan organization authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate dental benefit contracts on behalf of dental plan organizations licensed under Chapter 61 (\u00a7 38.2-6100 et seq.).\n\t\t&#8220;Dental services authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate dental services plan contracts on behalf of dental services plans licensed under Chapter 45 (\u00a7 38.2-4500 et seq.).\n\t\t&#8220;Filed&#8221; means received by the Commission.\n\t\t&#8220;Health agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate insurance as defined in \u00a7\u00a7  38.2-107.2, 38.2-108, and 38.2-109, and including contracts issued by insurers, health services plans, health maintenance organizations, dental services plans, optometric services plans, and dental plan organizations licensed in the Commonwealth.\n\t\t&#8220;Home protection insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate home protection insurance as defined in \u00a7 38.2-129 on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Home state&#8221; means the District of Columbia and any state or territory of the United States, except Virginia, or any province of Canada, in which an insurance producer maintains such person&#8217;s principal place of residence or principal place of business and is licensed by that jurisdiction to act as a resident insurance producer.\n\t\t&#8220;Legal services insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate legal services insurance as defined in \u00a7 38.2-127 on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;License&#8221; means a document issued by the Commission authorizing an individual or business entity to act as an insurance producer for the lines of authority specified in the document. Except as provided in \u00a7 38.2-1833, the license itself does not create any authority, actual, apparent or inherent, in the licensee to represent, commit, or bind an insurer.\n\t\t&#8220;Licensed agent,&#8221; &#8220;licensed insurance agent,&#8221; &#8220;licensed producer,&#8221; or &#8220;licensed insurance producer,&#8221; when used without qualification, means an individual or business entity licensed in the Commonwealth to sell, solicit, or negotiate contracts of insurance or annuity of the classes authorized within the scope of such license.\n\t\t&#8220;Life and annuities insurance agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate life insurance and annuity contracts as defined in \u00a7\u00a7 38.2-102, 38.2-103, 38.2-104, 38.2-105.1, 38.2-106, and 38.2-107.1, respectively, and family leave insurance as defined in \u00a7 38.2-107.2, on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Limited burial insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate burial insurance society membership where the certificates of membership are used solely to fund preneed funeral contracts on any individual, on behalf of insurers licensed under Chapter 40 (\u00a7 38.2-4000 et seq.); or to represent an association referred to in \u00a7 38.2-3318.1, limited to soliciting members of that association for association group life insurance certificates where the funds are used solely to fund preneed funeral contracts.\n\t\t&#8220;Limited lines credit insurance agent&#8221; means an agent licensed in the Commonwealth whose authority is restricted to selling, soliciting, or negotiating, on behalf of insurers licensed in the Commonwealth, one or more of the following coverages to individuals through a master, corporate, group or individual policy: (i) credit life insurance and credit accident and sickness insurance, but only to the extent authorized in Chapter 37.1 (\u00a7 38.2-3717 et seq.); (ii) credit involuntary unemployment insurance as defined in \u00a7 38.2-122.1; (iii) credit property insurance, as defined in \u00a7 38.2-122.2; (iv) mortgage accident and sickness insurance; (v) mortgage redemption insurance; (vi) mortgage guaranty insurance; and (vii) any other form of insurance offered in connection with an extension of credit that is limited to partially or wholly extinguishing that credit obligation and that the Commission specifically determines may be sold, solicited, or negotiated by those holding a limited lines credit insurance agent license. Each insurer that sells, solicits or negotiates any of the coverages set forth in this definition shall provide to each individual whose duties will include selling, soliciting or negotiating such coverages a program of instruction that may, at the discretion of the Commission, be submitted for approval by the Commission or reviewed by the Commission subsequent to its implementation.\n\t\t&#8220;Limited lines life and health agent&#8221; means an individual or business entity authorized by the Commission whose license authority to sell, solicit, or negotiate is limited to the following, or any other type of authority that the Commission may deem it necessary to recognize for the purposes of complying with \u00a7 38.2-1836: dental services authority; limited burial insurance authority; mutual assessment life and health insurance authority; optometric services authority; and dental plan organization authority. Limited lines life and health insurance shall not include life insurance, health insurance, property insurance, casualty insurance, private family leave insurance, and title insurance.\n\t\t&#8220;Limited lines property and casualty agent&#8221; means an individual or business entity authorized by the Commission whose license authority to sell, solicit, or negotiate is limited to the following, or any other type of authority that the Commission may deem it necessary to recognize for the purposes of complying with \u00a7 38.2-1836: home protection insurance authority; legal services insurance authority; mutual assessment property and casualty insurance authority; ocean marine insurance authority; pet accident, sickness and hospitalization insurance authority; portable electronics insurance authority; self storage insurance authority; and travel insurance. Unless otherwise defined, &#8220;limited lines property and casualty insurance&#8221; shall not include life insurance, health insurance, property insurance, casualty insurance, private family leave insurance, and title insurance.\n\t\t&#8220;Mortgage accident and sickness insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate mortgage accident and sickness insurance on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Mortgage guaranty insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate mortgage guaranty insurance on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Mortgage redemption insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate mortgage redemption insurance on behalf of insurers licensed in the Commonwealth. As used in this chapter, &#8220;mortgage redemption insurance&#8221; means a nonrenewable, nonconvertible, decreasing term life insurance policy written in connection with a mortgage transaction for a period of time coinciding with the term of the mortgage. The initial sum shall not exceed the amount of the indebtedness outstanding at the time the insurance becomes effective, rounded up to the next $1,000.\n\t\t&#8220;Motor vehicle rental contract enroller&#8221; means an unlicensed hourly or salaried employee of a motor vehicle rental company that is in the business of providing primarily private motor vehicles to the public under a rental agreement for a period of less than six months, and receives no direct or indirect commission from the insurer, the renter or the vehicle rental company.\n\t\t&#8220;Motor vehicle rental contract insurance agent&#8221; means a person who (i) is a selling agent of a motor vehicle rental company that is in the business of providing primarily private passenger motor vehicles to the public under a rental agreement for a period of less than six months and (ii) whose license in the Commonwealth is restricted to selling, soliciting, or negotiating only the following insurance coverages, and solely in connection with and incidental to the rental contract:\n\n1\n\nPersonal accident insurance that provides benefits in the event of accidental death or injury occurring during the rental period;2\n\nLiability coverage sold to the renter in excess of the rental company&#8217;s obligations under &#xA7; 38.2-2204, 38.2-2205, or Title 46.2, as applicable;3\n\nPersonal effects insurance that provides coverages for the loss of or damage to the personal effects of the renter and other vehicle occupants while such personal effects are in or upon the rental vehicle during the rental period;4\n\nRoadside assistance and emergency sickness protection programs; and5\n\nOther travel-related or vehicle-related insurance coverage that a motor vehicle rental company offers in connection with and incidental to the rental of vehicles.\n\t\t\tThe term &#8220;motor vehicle rental contract insurance agent&#8221; does not include motor vehicle rental contract enrollers.\n\t\t\t&#8220;Mutual assessment life and health insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate mutual assessment life and accident and sickness insurance on behalf of insurers licensed under Chapter 39 (&#xA7; 38.2-3900 et seq.), but only to the extent permitted under &#xA7; 38.2-3919.\n\t\t\t&#8220;Mutual assessment property and casualty insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate mutual assessment property and casualty insurance on behalf of insurers licensed under Chapter 25 (&#xA7; 38.2-2500 et seq.), but only to the extent permitted under &#xA7; 38.2-2525.\n\t\t\t&#8220;NAIC&#8221; means the National Association of Insurance Commissioners.\n\t\t\t&#8220;Negotiate&#8221; means the act of conferring directly with or offering advice directly to a purchaser or prospective purchaser of a particular contract of insurance concerning any of the substantive benefits, terms or conditions of the contract, provided that the person engaged in that act either sells insurance or obtains insurance from insurers for purchasers.\n\t\t\t&#8220;Ocean marine insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate those classes of insurance classified in &#xA7; 38.2-126, except those classes specifically classified as inland marine insurance, on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Optometric services authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate optometric services plan contracts on behalf of optometric services plans licensed under Chapter 45 (&#xA7; 38.2-4500 et seq.).\n\t\t\t&#8220;Personal lines agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate insurance as defined in &#xA7;&#xA7; 38.2-110 through 38.2-114, 38.2-116, 38.2-117, 38.2-118, 38.2-124, 38.2-125, 38.2-126, 38.2-129, 38.2-130, and 38.2-131 for transactions involving insurance primarily for personal, family, or household needs rather than for business or professional needs.\n\t\t\t&#8220;Pet accident, sickness and hospitalization insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate pet accident, sickness and hospitalization insurance on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Property and casualty insurance agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate both personal and commercial lines of insurance as defined in &#xA7;&#xA7;  38.2-107.2, 38.2-110 through 38.2-122.2, and 38.2-124 through 38.2-134 on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Resident&#8221; means (i) an individual residing in Virginia; (ii) an individual residing outside of Virginia whose principal place of business is in Virginia, who is able to demonstrate to the satisfaction of the Commission that the laws of his home state prevent him from obtaining a resident agent license in that state, and who affirmatively chooses to qualify as and be treated as a resident of Virginia for purposes of licensing and continuing education, both in Virginia and in the state in which the individual resides, if applicable; (iii) a partnership duly formed and recorded in Virginia; (iv) a corporation incorporated and existing under the laws of Virginia; (v) a limited liability company organized and existing under the laws of Virginia; or (vi) a foreign business entity that is not licensed as a resident agent in any other jurisdiction, and that demonstrates to the satisfaction of the Commission that its principal place of business is within the Commonwealth of Virginia.\n\t\t\t&#8220;Restricted nonresident health agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a health agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident life and annuities agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a life and annuities agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident personal lines agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a personal lines agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident property and casualty agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a property and casualty agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Sell&#8221; means to exchange a contract of insurance by any means, for money or its equivalent, on behalf of an insurer.\n\t\t\t&#8220;Settlement agent&#8221; means a person licensed as a title insurance agent and registered with the Virginia State Bar pursuant to Chapter 10 (&#xA7; 55.1-1000 et seq.) of Title 55.1.\n\t\t\t&#8220;Solicit&#8221; means attempting to sell insurance or asking or urging a person to apply for a particular class of insurance from one or more insurers.\n\t\t\t&#8220;Surety bail bondsman&#8221; means a person licensed as a surety bail bondsman pursuant to Article 11 (&#xA7; 9.1-185 et seq.) of Chapter 1 of Title 9.1.\n\t\t\t&#8220;Surplus lines broker&#8221; means a person licensed pursuant to Article 5.1 (&#xA7; 38.2-1857.1 et seq.) of this chapter, and who is thereby authorized to engage in the activities set forth in Chapter 48 (&#xA7; 38.2-4805.1 et seq.).\n\t\t\t&#8220;Terminate&#8221; means the cancellation of the relationship between an insurance producer and the insurer, or the termination of an insurance producer&#8217;s authority to transact insurance.\n\t\t\t&#8220;Title insurance agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate title insurance, and performing all of the services set forth in &#xA7; 38.2-4601.1, on behalf of title insurance companies licensed under Chapter 46 (&#xA7; 38.2-4600 et seq.).\n\t\t\t&#8220;Uniform Application&#8221; means the current version of the NAIC Uniform Application for resident and nonresident producer licensing.\n\t\t\t&#8220;Uniform Business Entity Application&#8221; means the current version of the NAIC Uniform Business Entity Application for resident and nonresident business entities.\n\t\t\t&#8220;Variable contract agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate variable life insurance and variable annuity contracts on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Viatical settlement broker&#8221; means a person licensed pursuant to Chapter 60 (&#xA7; 38.2-6000 et seq.), in accordance with Article 6.1 (&#xA7; 38.2-1865.1 et seq.) of this chapter, and who is thereby authorized to engage in the activities set forth in Chapter 60 (&#xA7; As used in this chapter, &#8220;mortgage redemption insurance&#8221; means a nonrenewable, nonconvertible, decreasing term life insurance policy written in connection with a mortgage transaction for a period of time coinciding with the term of the mortgage. means an unlicensed hourly or salaried employee of a motor vehicle rental company that is in the business of providing primarily private motor vehicles to the public under a rental agreement for a period of less than six months, and receives no direct or indirect commission from the insurer, the renter or the vehicle rental company.\n\t\t&#8220;Motor vehicle rental contract insurance agent&#8221; means a person who (i) is a selling agent of a motor vehicle rental company that is in the business of providing primarily private passenger motor vehicles to the public under a rental agreement for a period of less than six months and (ii) whose license in the Commonwealth is restricted to selling, soliciting, or negotiating only the following insurance coverages, and solely in connection with and incidental to the rental contract:","type":"section","prefixes":[""],"prefix":"","entire_prefix":"","prefix_anchor":"","level":1,"next_prefix":"1"},"1":{"id":244513,"text":"Personal accident insurance that provides benefits in the event of accidental death or injury occurring during the rental period;","type":"section","prefixes":["1"],"prefix":"1","entire_prefix":"1","prefix_anchor":"1","level":1,"prior_prefix":"","next_prefix":"2"},"2":{"id":244514,"text":"Liability coverage sold to the renter in excess of the rental company&#8217;s obligations under &#xA7; 38.2-2204, 38.2-2205, or Title 46.2, as applicable;","type":"section","prefixes":["2"],"prefix":"2","entire_prefix":"2","prefix_anchor":"2","level":1,"prior_prefix":"1","next_prefix":"3"},"3":{"id":244515,"text":"Personal effects insurance that provides coverages for the loss of or damage to the personal effects of the renter and other vehicle occupants while such personal effects are in or upon the rental vehicle during the rental period;","type":"section","prefixes":["3"],"prefix":"3","entire_prefix":"3","prefix_anchor":"3","level":1,"prior_prefix":"2","next_prefix":"4"},"4":{"id":244516,"text":"Roadside assistance and emergency sickness protection programs; and","type":"section","prefixes":["4"],"prefix":"4","entire_prefix":"4","prefix_anchor":"4","level":1,"prior_prefix":"3","next_prefix":"5"},"5":{"id":244517,"text":"Other travel-related or vehicle-related insurance coverage that a motor vehicle rental company offers in connection with and incidental to the rental of vehicles.\n\t\t\tThe term &#8220;motor vehicle rental contract insurance agent&#8221; does not include motor vehicle rental contract enrollers.\n\t\t\t&#8220;Mutual assessment life and health insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate mutual assessment life and accident and sickness insurance on behalf of insurers licensed under Chapter 39 (&#xA7; 38.2-3900 et seq.), but only to the extent permitted under &#xA7; 38.2-3919.\n\t\t\t&#8220;Mutual assessment property and casualty insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate mutual assessment property and casualty insurance on behalf of insurers licensed under Chapter 25 (&#xA7; 38.2-2500 et seq.), but only to the extent permitted under &#xA7; 38.2-2525.\n\t\t\t&#8220;NAIC&#8221; means the National Association of Insurance Commissioners.\n\t\t\t&#8220;Negotiate&#8221; means the act of conferring directly with or offering advice directly to a purchaser or prospective purchaser of a particular contract of insurance concerning any of the substantive benefits, terms or conditions of the contract, provided that the person engaged in that act either sells insurance or obtains insurance from insurers for purchasers.\n\t\t\t&#8220;Ocean marine insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate those classes of insurance classified in &#xA7; 38.2-126, except those classes specifically classified as inland marine insurance, on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Optometric services authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate optometric services plan contracts on behalf of optometric services plans licensed under Chapter 45 (&#xA7; 38.2-4500 et seq.).\n\t\t\t&#8220;Personal lines agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate insurance as defined in &#xA7;&#xA7; 38.2-110 through 38.2-114, 38.2-116, 38.2-117, 38.2-118, 38.2-124, 38.2-125, 38.2-126, 38.2-129, 38.2-130, and 38.2-131 for transactions involving insurance primarily for personal, family, or household needs rather than for business or professional needs.\n\t\t\t&#8220;Pet accident, sickness and hospitalization insurance authority&#8221; means the authority in the Commonwealth to sell, solicit, or negotiate pet accident, sickness and hospitalization insurance on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Property and casualty insurance agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate both personal and commercial lines of insurance as defined in &#xA7;&#xA7;  38.2-107.2, 38.2-110 through 38.2-122.2, and 38.2-124 through 38.2-134 on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Resident&#8221; means (i) an individual residing in Virginia; (ii) an individual residing outside of Virginia whose principal place of business is in Virginia, who is able to demonstrate to the satisfaction of the Commission that the laws of his home state prevent him from obtaining a resident agent license in that state, and who affirmatively chooses to qualify as and be treated as a resident of Virginia for purposes of licensing and continuing education, both in Virginia and in the state in which the individual resides, if applicable; (iii) a partnership duly formed and recorded in Virginia; (iv) a corporation incorporated and existing under the laws of Virginia; (v) a limited liability company organized and existing under the laws of Virginia; or (vi) a foreign business entity that is not licensed as a resident agent in any other jurisdiction, and that demonstrates to the satisfaction of the Commission that its principal place of business is within the Commonwealth of Virginia.\n\t\t\t&#8220;Restricted nonresident health agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a health agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident life and annuities agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a life and annuities agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident personal lines agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a personal lines agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident property and casualty agent&#8221; means a nonresident agent whose license authority in his home state does not include all of the authority granted under a property and casualty agent license in Virginia. The license issued to such agent shall authorize the agent to sell, solicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Sell&#8221; means to exchange a contract of insurance by any means, for money or its equivalent, on behalf of an insurer.\n\t\t\t&#8220;Settlement agent&#8221; means a person licensed as a title insurance agent and registered with the Virginia State Bar pursuant to Chapter 10 (&#xA7; 55.1-1000 et seq.) of Title 55.1.\n\t\t\t&#8220;Solicit&#8221; means attempting to sell insurance or asking or urging a person to apply for a particular class of insurance from one or more insurers.\n\t\t\t&#8220;Surety bail bondsman&#8221; means a person licensed as a surety bail bondsman pursuant to Article 11 (&#xA7; 9.1-185 et seq.) of Chapter 1 of Title 9.1.\n\t\t\t&#8220;Surplus lines broker&#8221; means a person licensed pursuant to Article 5.1 (&#xA7; 38.2-1857.1 et seq.) of this chapter, and who is thereby authorized to engage in the activities set forth in Chapter 48 (&#xA7; 38.2-4805.1 et seq.).\n\t\t\t&#8220;Terminate&#8221; means the cancellation of the relationship between an insurance producer and the insurer, or the termination of an insurance producer&#8217;s authority to transact insurance.\n\t\t\t&#8220;Title insurance agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate title insurance, and performing all of the services set forth in &#xA7; 38.2-4601.1, on behalf of title insurance companies licensed under Chapter 46 (&#xA7; 38.2-4600 et seq.).\n\t\t\t&#8220;Uniform Application&#8221; means the current version of the NAIC Uniform Application for resident and nonresident producer licensing.\n\t\t\t&#8220;Uniform Business Entity Application&#8221; means the current version of the NAIC Uniform Business Entity Application for resident and nonresident business entities.\n\t\t\t&#8220;Variable contract agent&#8221; means an agent licensed in the Commonwealth to sell, solicit, or negotiate variable life insurance and variable annuity contracts on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Viatical settlement broker&#8221; means a person licensed pursuant to Chapter 60 (&#xA7; 38.2-6000 et seq.), in accordance with Article 6.1 (&#xA7; 38.2-1865.1 et seq.) of this chapter, and who is thereby authorized to engage in the activities set forth in Chapter 60 (&#xA7; &#8220;appointed insurance agent,&#8221; &#8220;appointed producer,&#8221; or &#8220;appointed insurance producer,&#8221; when used without qualification, means an individual or <span class=\"dictionary\">business entity<\/span> licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> <span class=\"dictionary\">contracts<\/span> of insurance or annuity of the classes authorized within the scope of such <span class=\"dictionary\">license<\/span> and who is appointed by a <span class=\"dictionary\">company<\/span> licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> on its behalf <span class=\"dictionary\">contracts<\/span> of insurance of the classes authorized within the scope of such <span class=\"dictionary\">license<\/span> and, if authorized by the <span class=\"dictionary\">company<\/span>, may collect premiums on those <span class=\"dictionary\">contracts<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Business entity<\/span>&#8221; means a partnership, limited partnership, limited liability <span class=\"dictionary\">company<\/span>, corporation, or other legal entity other than a sole proprietorship.\n\t\t&#8220;<span class=\"dictionary\">Dental plan organization authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> dental benefit <span class=\"dictionary\">contracts<\/span> on behalf of dental plan organizations licensed under Chapter 61 (\u00a7&nbsp;<a class=\"law\" title=\"Applicability of chapter\" href=\"\/38.2-6100\/\">38.2-6100<\/a> et seq.).\n\t\t&#8220;<span class=\"dictionary\">Dental services authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> dental services plan <span class=\"dictionary\">contracts<\/span> on behalf of dental services plans licensed under Chapter 45 (\u00a7&nbsp;<a class=\"law\" title=\"Applicability of chapter\" href=\"\/38.2-4500\/\">38.2-4500<\/a> et seq.).\n\t\t&#8220;<span class=\"dictionary\">Filed<\/span>&#8221; means received by the <span class=\"dictionary\">Commission<\/span>.\n\t\t&#8220;Health agent&#8221; means an agent licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> insurance as defined in \u00a7\u00a7&nbsp; <a class=\"law\" title=\"Private family leave insurance\" href=\"\/38.2-107.2\/\">38.2-107.2<\/a>, <a class=\"law\" title=\"Credit accident and sickness\" href=\"\/38.2-108\/\">38.2-108<\/a>, and <a class=\"law\" title=\"Accident and sickness\" href=\"\/38.2-109\/\">38.2-109<\/a>, and including <span class=\"dictionary\">contracts<\/span> issued by <span class=\"dictionary\">insurers<\/span>, <span class=\"dictionary\">health services plans<\/span>, health maintenance organizations, dental services plans, optometric services plans, and dental plan organizations licensed in the Commonwealth.\n\t\t&#8220;<span class=\"dictionary\">Home protection insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> home protection insurance as defined in \u00a7&nbsp;<a class=\"law\" title=\"Home protection insurance\" href=\"\/38.2-129\/\">38.2-129<\/a> on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t&#8220;<span class=\"dictionary\">Home state<\/span>&#8221; means the District of Columbia and any state or territory of the United <span class=\"dictionary\">States<\/span>, except Virginia, or any province of Canada, in which an insurance producer maintains such <span class=\"dictionary\">person<\/span>&#8217;s principal place of residence or principal place of business and is licensed by that <span class=\"dictionary\">jurisdiction<\/span> to act as a <span class=\"dictionary\">resident<\/span> insurance producer.\n\t\t&#8220;<span class=\"dictionary\">Legal services insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> legal services insurance as defined in \u00a7&nbsp;<a class=\"law\" title=\"Legal services insurance\" href=\"\/38.2-127\/\">38.2-127<\/a> on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t&#8220;<span class=\"dictionary\">License<\/span>&#8221; means a document issued by the <span class=\"dictionary\">Commission<\/span> authorizing an individual or <span class=\"dictionary\">business entity<\/span> to act as an insurance producer for the lines of authority specified in the document. Except as provided in \u00a7&nbsp;<a class=\"law\" title=\"Appointments of agents\" href=\"\/38.2-1833\/\">38.2-1833<\/a>, the <span class=\"dictionary\">license<\/span> itself does not create any authority, actual, apparent or inherent, in the licensee to represent, commit, or bind an <span class=\"dictionary\">insurer<\/span>.\n\t\t&#8220;Licensed agent,&#8221; &#8220;licensed insurance agent,&#8221; &#8220;licensed producer,&#8221; or &#8220;licensed insurance producer,&#8221; when used without qualification, means an individual or <span class=\"dictionary\">business entity<\/span> licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> <span class=\"dictionary\">contracts<\/span> of insurance or annuity of the classes authorized within the scope of such <span class=\"dictionary\">license<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Life and annuities insurance agent<\/span>&#8221; means an agent licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> life insurance and annuity <span class=\"dictionary\">contracts<\/span> as defined in \u00a7\u00a7&nbsp;<a class=\"law\" title=\"Life\" href=\"\/38.2-102\/\">38.2-102<\/a>, <a class=\"law\" title=\"Credit life\" href=\"\/38.2-103\/\">38.2-103<\/a>, <a class=\"law\" title=\"Industrial life\" href=\"\/38.2-104\/\">38.2-104<\/a>, <a class=\"law\" title=\"Modified guaranteed life insurance\" href=\"\/38.2-105.1\/\">38.2-105.1<\/a>, <a class=\"law\" title=\"Annuities\" href=\"\/38.2-106\/\">38.2-106<\/a>, and <a class=\"law\" title=\"Modified guaranteed annuity\" href=\"\/38.2-107.1\/\">38.2-107.1<\/a>, respectively, and family leave insurance as defined in \u00a7&nbsp;<a class=\"law\" title=\"Private family leave insurance\" href=\"\/38.2-107.2\/\">38.2-107.2<\/a>, on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t&#8220;<span class=\"dictionary\">Limited burial insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> burial insurance society membership where the certificates of membership are used solely to fund preneed funeral <span class=\"dictionary\">contracts<\/span> on any individual, on behalf of <span class=\"dictionary\">insurers<\/span> licensed under Chapter 40 (\u00a7&nbsp;<a class=\"law\" title=\"Societies to which chapter applies\" href=\"\/38.2-4000\/\">38.2-4000<\/a> et seq.); or to represent an association referred to in \u00a7&nbsp;<a class=\"law\" title=\"Group life insurance requirements\" href=\"\/38.2-3318.1\/\">38.2-3318.1<\/a>, limited to soliciting members of that association for association group life insurance certificates where the funds are used solely to fund preneed funeral <span class=\"dictionary\">contracts<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Limited lines credit insurance agent<\/span>&#8221; means an agent licensed in the Commonwealth whose authority is restricted to selling, soliciting, or negotiating, on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth, one or more of the following coverages to individuals through a master, corporate, group or individual policy: (i) credit life insurance and credit accident and sickness insurance, but only to the extent authorized in Chapter 37.1 (\u00a7&nbsp;<a class=\"law\" title=\"Scope\" href=\"\/38.2-3717\/\">38.2-3717<\/a> et seq.); (ii) credit involuntary unemployment insurance as defined in \u00a7&nbsp;<a class=\"law\" title=\"Credit involuntary unemployment insurance\" href=\"\/38.2-122.1\/\">38.2-122.1<\/a>; (iii) credit property insurance, as defined in \u00a7&nbsp;<a class=\"law\" title=\"Credit property insurance\" href=\"\/38.2-122.2\/\">38.2-122.2<\/a>; (iv) mortgage accident and sickness insurance; (v) <span class=\"dictionary\">mortgage redemption insurance<\/span>; (vi) mortgage guaranty insurance; and (vii) any other form of insurance offered in connection with an extension of credit that is limited to partially or wholly extinguishing that credit obligation and that the <span class=\"dictionary\">Commission<\/span> specifically determines may be sold, solicited, or negotiated by those holding a <span class=\"dictionary\">limited lines credit insurance agent<\/span> <span class=\"dictionary\">license<\/span>. Each <span class=\"dictionary\">insurer<\/span> that <span class=\"dictionary\">sells<\/span>, <span class=\"dictionary\">solicits<\/span> or <span class=\"dictionary\">negotiates<\/span> any of the coverages set forth in this definition shall provide to each individual whose duties will include selling, soliciting or negotiating such coverages a program of instruction that may, at the discretion of the <span class=\"dictionary\">Commission<\/span>, be submitted for approval by the <span class=\"dictionary\">Commission<\/span> or reviewed by the <span class=\"dictionary\">Commission<\/span> subsequent to its implementation.\n\t\t&#8220;<span class=\"dictionary\">Limited lines life and health agent<\/span>&#8221; means an individual or <span class=\"dictionary\">business entity<\/span> authorized by the <span class=\"dictionary\">Commission<\/span> whose <span class=\"dictionary\">license<\/span> authority to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> is limited to the following, or any other type of authority that the <span class=\"dictionary\">Commission<\/span> may deem it necessary to recognize for the purposes of complying with \u00a7&nbsp;<a class=\"law\" title=\"Licensing nonresidents; reciprocal agreements with other states and Canadian provinces\" href=\"\/38.2-1836\/\">38.2-1836<\/a>: <span class=\"dictionary\">dental services authority<\/span>; <span class=\"dictionary\">limited burial insurance authority<\/span>; <span class=\"dictionary\">mutual assessment life and health insurance authority<\/span>; <span class=\"dictionary\">optometric services authority<\/span>; and <span class=\"dictionary\">dental plan organization authority<\/span>. Limited lines life and health insurance shall not include life insurance, health insurance, property insurance, casualty insurance, private family leave insurance, and title insurance.\n\t\t&#8220;<span class=\"dictionary\">Limited lines property and casualty agent<\/span>&#8221; means an individual or <span class=\"dictionary\">business entity<\/span> authorized by the <span class=\"dictionary\">Commission<\/span> whose <span class=\"dictionary\">license<\/span> authority to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> is limited to the following, or any other type of authority that the <span class=\"dictionary\">Commission<\/span> may deem it necessary to recognize for the purposes of complying with \u00a7&nbsp;<a class=\"law\" title=\"Licensing nonresidents; reciprocal agreements with other states and Canadian provinces\" href=\"\/38.2-1836\/\">38.2-1836<\/a>: <span class=\"dictionary\">home protection insurance authority<\/span>; <span class=\"dictionary\">legal services insurance authority<\/span>; <span class=\"dictionary\">mutual assessment property and casualty insurance authority<\/span>; <span class=\"dictionary\">ocean marine insurance authority<\/span>; <span class=\"dictionary\">pet accident, sickness and hospitalization insurance authority<\/span>; portable electronics insurance authority; self storage insurance authority; and travel insurance. Unless otherwise defined, &#8220;<span class=\"dictionary\">limited lines property and casualty insurance<\/span>&#8221; shall not include life insurance, health insurance, property insurance, casualty insurance, private family leave insurance, and title insurance.\n\t\t&#8220;<span class=\"dictionary\">Mortgage accident and sickness insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> mortgage accident and sickness insurance on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t&#8220;<span class=\"dictionary\">Mortgage guaranty insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> mortgage guaranty insurance on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t&#8220;<span class=\"dictionary\"><span class=\"dictionary\">Mortgage redemption insurance<\/span> authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> <span class=\"dictionary\">mortgage redemption insurance<\/span> on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth. As used in this chapter, &#8220;<span class=\"dictionary\">mortgage redemption insurance<\/span>&#8221; means a nonrenewable, nonconvertible, decreasing term life insurance policy written in connection with a mortgage transaction for a period of time coinciding with the term of the mortgage. The initial sum shall not exceed the amount of the indebtedness outstanding at the time the insurance becomes effective, rounded up to the next $1,000.\n\t\t&#8220;<span class=\"dictionary\">Motor vehicle rental contract enroller<\/span>&#8221; means an unlicensed hourly or salaried employee of a motor vehicle rental <span class=\"dictionary\">company<\/span> that is in the business of providing primarily private motor vehicles to the public under a rental agreement for a period of less than six months, and receives no direct or indirect <span class=\"dictionary\">commission<\/span> from the <span class=\"dictionary\">insurer<\/span>, the renter or the vehicle rental <span class=\"dictionary\">company<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Motor vehicle rental contract insurance agent<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> who (i) is a selling agent of a motor vehicle rental <span class=\"dictionary\">company<\/span> that is in the business of providing primarily private passenger motor vehicles to the public under a rental agreement for a period of less than six months and (ii) whose <span class=\"dictionary\">license<\/span> in the Commonwealth is restricted to selling, soliciting, or negotiating only the following insurance coverages, and solely in connection with and incidental to the rental contract:<\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> Personal accident insurance that provides benefits in the event of accidental death or injury occurring during the rental period; <a id=\"paragraph-244513\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1800\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> Liability coverage sold to the renter in excess of the rental <span class=\"dictionary\">company<\/span>&#8217;s obligations under &#xA7; <a class=\"law\" title=\"Liability insurance on motor vehicles, aircraft, and watercraft; standard provisions; &quot;omnibus clause.&quot;\" href=\"\/38.2-2204\/\">38.2-2204<\/a>, <a class=\"law\" title=\"Liability insurance on motor vehicles; standard provisions; applicability of other valid and collectible insurance\" href=\"\/38.2-2205\/\">38.2-2205<\/a>, or Title 46.2, as applicable; <a id=\"paragraph-244514\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1800\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> Personal effects insurance that provides coverages for the loss of or damage to the personal effects of the renter and other vehicle occupants while such personal effects are in or upon the rental vehicle during the rental period; <a id=\"paragraph-244515\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1800\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> Roadside assistance and emergency sickness protection programs; and <a id=\"paragraph-244516\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1800\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> Other travel-related or vehicle-related insurance coverage that a motor vehicle rental <span class=\"dictionary\">company<\/span> offers in connection with and incidental to the rental of vehicles.\n\t\t\tThe term &#8220;<span class=\"dictionary\">motor vehicle rental contract insurance agent<\/span>&#8221; does not include <span class=\"dictionary\">motor vehicle rental contract enrollers<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Mutual assessment life and health insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> mutual assessment life and accident and sickness insurance on behalf of <span class=\"dictionary\">insurers<\/span> licensed under Chapter 39 (&#xA7; <a class=\"law\" title=\"Scope of chapter\" href=\"\/38.2-3900\/\">38.2-3900<\/a> et seq.), but only to the extent permitted under &#xA7; <a class=\"law\" title=\"Agents&#039; licenses required\" href=\"\/38.2-3919\/\">38.2-3919<\/a>.\n\t\t\t&#8220;<span class=\"dictionary\">Mutual assessment property and casualty insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> mutual assessment property and casualty insurance on behalf of <span class=\"dictionary\">insurers<\/span> licensed under Chapter 25 (&#xA7; <a class=\"law\" title=\"Scope of chapter\" href=\"\/38.2-2500\/\">38.2-2500<\/a> et seq.), but only to the extent permitted under &#xA7; <a class=\"law\" title=\"Agents licenses required\" href=\"\/38.2-2525\/\">38.2-2525<\/a>.\n\t\t\t&#8220;<span class=\"dictionary\">NAIC<\/span>&#8221; means the National Association of Insurance <span class=\"dictionary\">Commissioners<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Negotiate<\/span>&#8221; means the act of conferring directly with or offering advice directly to a purchaser or prospective purchaser of a particular contract of insurance concerning any of the substantive benefits, terms or conditions of the contract, provided that the <span class=\"dictionary\">person<\/span> engaged in that act either <span class=\"dictionary\">sells<\/span> insurance or obtains insurance from <span class=\"dictionary\">insurers<\/span> for purchasers.\n\t\t\t&#8220;<span class=\"dictionary\">Ocean marine insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> those classes of insurance classified in &#xA7; <a class=\"law\" title=\"Marine\" href=\"\/38.2-126\/\">38.2-126<\/a>, except those classes specifically classified as inland marine insurance, on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t\t&#8220;<span class=\"dictionary\">Optometric services authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> optometric services plan <span class=\"dictionary\">contracts<\/span> on behalf of optometric services plans licensed under Chapter 45 (&#xA7; <a class=\"law\" title=\"Applicability of chapter\" href=\"\/38.2-4500\/\">38.2-4500<\/a> et seq.).\n\t\t\t&#8220;<span class=\"dictionary\">Personal lines agent<\/span>&#8221; means an agent licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> insurance as defined in &#xA7;&#xA7; <a class=\"law\" title=\"Fire\" href=\"\/38.2-110\/\">38.2-110<\/a> through <a class=\"law\" title=\"Glass insurance\" href=\"\/38.2-114\/\">38.2-114<\/a>, <a class=\"law\" title=\"Animal\" href=\"\/38.2-116\/\">38.2-116<\/a>, <a class=\"law\" title=\"Personal injury liability\" href=\"\/38.2-117\/\">38.2-117<\/a>, <a class=\"law\" title=\"Property damage liability\" href=\"\/38.2-118\/\">38.2-118<\/a>, <a class=\"law\" title=\"Motor vehicle\" href=\"\/38.2-124\/\">38.2-124<\/a>, <a class=\"law\" title=\"Aircraft\" href=\"\/38.2-125\/\">38.2-125<\/a>, <a class=\"law\" title=\"Marine\" href=\"\/38.2-126\/\">38.2-126<\/a>, <a class=\"law\" title=\"Home protection insurance\" href=\"\/38.2-129\/\">38.2-129<\/a>, <a class=\"law\" title=\"Homeowners insurance\" href=\"\/38.2-130\/\">38.2-130<\/a>, and <a class=\"law\" title=\"Farmowners insurance\" href=\"\/38.2-131\/\">38.2-131<\/a> for transactions involving insurance primarily for personal, family, or household needs rather than for business or professional needs.\n\t\t\t&#8220;<span class=\"dictionary\">Pet accident, sickness and hospitalization insurance authority<\/span>&#8221; means the authority in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> pet accident, sickness and hospitalization insurance on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t\t&#8220;<span class=\"dictionary\">Property and casualty insurance agent<\/span>&#8221; means an agent licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> both personal and commercial lines of insurance as defined in &#xA7;&#xA7;  <a class=\"law\" title=\"Private family leave insurance\" href=\"\/38.2-107.2\/\">38.2-107.2<\/a>, <a class=\"law\" title=\"Fire\" href=\"\/38.2-110\/\">38.2-110<\/a> through <a class=\"law\" title=\"Credit property insurance\" href=\"\/38.2-122.2\/\">38.2-122.2<\/a>, and <a class=\"law\" title=\"Motor vehicle\" href=\"\/38.2-124\/\">38.2-124<\/a> through <a class=\"law\" title=\"Definitions to include other insurance of same general kind\" href=\"\/38.2-134\/\">38.2-134<\/a> on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t\t&#8220;<span class=\"dictionary\">Resident<\/span>&#8221; means (i) an individual residing in Virginia; (ii) an individual residing outside of Virginia whose principal place of business is in Virginia, who is able to demonstrate to the satisfaction of the <span class=\"dictionary\">Commission<\/span> that the <span class=\"dictionary\">laws<\/span> of his <span class=\"dictionary\">home state<\/span> prevent him from obtaining a <span class=\"dictionary\">resident<\/span> agent <span class=\"dictionary\">license<\/span> in that state, and who affirmatively chooses to qualify as and be treated as a <span class=\"dictionary\">resident<\/span> of Virginia for purposes of licensing and continuing education, both in Virginia and in the state in which the individual resides, if applicable; (iii) a partnership duly formed and recorded in Virginia; (iv) a corporation incorporated and existing under the <span class=\"dictionary\">laws<\/span> of Virginia; (v) a limited liability <span class=\"dictionary\">company<\/span> organized and existing under the <span class=\"dictionary\">laws<\/span> of Virginia; or (vi) a foreign business entity that is not licensed as a <span class=\"dictionary\">resident<\/span> agent in any other <span class=\"dictionary\">jurisdiction<\/span>, and that demonstrates to the satisfaction of the <span class=\"dictionary\">Commission<\/span> that its principal place of business is within the Commonwealth of Virginia.\n\t\t\t&#8220;<span class=\"dictionary\">Restricted nonresident health agent<\/span>&#8221; means a nonresident agent whose <span class=\"dictionary\">license<\/span> authority in his <span class=\"dictionary\">home state<\/span> does not include all of the authority granted under a health agent <span class=\"dictionary\">license<\/span> in Virginia. The <span class=\"dictionary\">license<\/span> issued to such agent shall authorize the agent to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> in Virginia, on behalf of <span class=\"dictionary\">insurers<\/span> licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his <span class=\"dictionary\">home state<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Restricted nonresident life and annuities agent<\/span>&#8221; means a nonresident agent whose <span class=\"dictionary\">license<\/span> authority in his <span class=\"dictionary\">home state<\/span> does not include all of the authority granted under a life and annuities agent <span class=\"dictionary\">license<\/span> in Virginia. The <span class=\"dictionary\">license<\/span> issued to such agent shall authorize the agent to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> in Virginia, on behalf of <span class=\"dictionary\">insurers<\/span> licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his <span class=\"dictionary\">home state<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Restricted nonresident <span class=\"dictionary\">personal lines agent<\/span><\/span>&#8221; means a nonresident agent whose <span class=\"dictionary\">license<\/span> authority in his <span class=\"dictionary\">home state<\/span> does not include all of the authority granted under a <span class=\"dictionary\">personal lines agent<\/span> <span class=\"dictionary\">license<\/span> in Virginia. The <span class=\"dictionary\">license<\/span> issued to such agent shall authorize the agent to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> in Virginia, on behalf of <span class=\"dictionary\">insurers<\/span> licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his <span class=\"dictionary\">home state<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Restricted nonresident property and casualty agent<\/span>&#8221; means a nonresident agent whose <span class=\"dictionary\">license<\/span> authority in his <span class=\"dictionary\">home state<\/span> does not include all of the authority granted under a property and casualty agent <span class=\"dictionary\">license<\/span> in Virginia. The <span class=\"dictionary\">license<\/span> issued to such agent shall authorize the agent to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> in Virginia, on behalf of <span class=\"dictionary\">insurers<\/span> licensed in Virginia, only those kinds or classes of insurance for which the agent is authorized in his <span class=\"dictionary\">home state<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Sell<\/span>&#8221; means to exchange a contract of insurance by any means, for money or its equivalent, on behalf of an <span class=\"dictionary\">insurer<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Settlement agent<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> licensed as a <span class=\"dictionary\">title insurance agent<\/span> and registered with the Virginia State Bar pursuant to Chapter 10 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-1000\/\">55.1-1000<\/a> et seq.) of Title 55.1.\n\t\t\t&#8220;<span class=\"dictionary\">Solicit<\/span>&#8221; means attempting to <span class=\"dictionary\">sell<\/span> insurance or asking or urging a <span class=\"dictionary\">person<\/span> to apply for a particular class of insurance from one or more <span class=\"dictionary\">insurers<\/span>.\n\t\t\t&#8220;<span class=\"dictionary\">Surety bail bondsman<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> licensed as a <span class=\"dictionary\">surety bail bondsman<\/span> pursuant to Article 11 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/9.1-185\/\">9.1-185<\/a> et seq.) of Chapter 1 of Title 9.1.\n\t\t\t&#8220;<span class=\"dictionary\">Surplus lines broker<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> licensed pursuant to Article 5.1 (&#xA7; <a class=\"law\" title=\"Property and casualty insurance agents may be licensed as surplus lines brokers for certain insurance from eligible nonadmitted insurers\" href=\"\/38.2-1857.1\/\">38.2-1857.1<\/a> et seq.) of this chapter, and who is thereby authorized to engage in the activities set forth in Chapter 48 (&#xA7; <a class=\"law\" title=\"Application of chapter\" href=\"\/38.2-4805.1\/\">38.2-4805.1<\/a> et seq.).\n\t\t\t&#8220;<span class=\"dictionary\">Terminate<\/span>&#8221; means the cancellation of the relationship between an insurance producer and the <span class=\"dictionary\">insurer<\/span>, or the termination of an insurance producer&#8217;s authority to transact insurance.\n\t\t\t&#8220;<span class=\"dictionary\">Title insurance agent<\/span>&#8221; means an agent licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> title insurance, and performing all of the services set forth in &#xA7; <a class=\"law\" title=\"Title insurance agency or agent defined\" href=\"\/38.2-4601.1\/\">38.2-4601.1<\/a>, on behalf of title insurance companies licensed under Chapter 46 (&#xA7; <a class=\"law\" title=\"Class of insurance and insurance companies to which chapter applies\" href=\"\/38.2-4600\/\">38.2-4600<\/a> et seq.).\n\t\t\t&#8220;<span class=\"dictionary\">Uniform Application<\/span>&#8221; means the current version of the <span class=\"dictionary\">NAIC<\/span> <span class=\"dictionary\">Uniform Application<\/span> for <span class=\"dictionary\">resident<\/span> and nonresident producer licensing.\n\t\t\t&#8220;<span class=\"dictionary\">Uniform Business Entity Application<\/span>&#8221; means the current version of the <span class=\"dictionary\">NAIC<\/span> <span class=\"dictionary\">Uniform Business Entity Application<\/span> for <span class=\"dictionary\">resident<\/span> and nonresident business entities.\n\t\t\t&#8220;<span class=\"dictionary\">Variable contract agent<\/span>&#8221; means an agent licensed in the Commonwealth to <span class=\"dictionary\">sell<\/span>, <span class=\"dictionary\">solicit<\/span>, or <span class=\"dictionary\">negotiate<\/span> variable life insurance and variable annuity <span class=\"dictionary\">contracts<\/span> on behalf of <span class=\"dictionary\">insurers<\/span> licensed in the Commonwealth.\n\t\t\t&#8220;<span class=\"dictionary\">Viatical settlement broker<\/span>&#8221; means a <span class=\"dictionary\">person<\/span> licensed pursuant to Chapter 60 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-6000\/\">38.2-6000<\/a> et seq.), in accordance with Article 6.1 (&#xA7; <a class=\"law\" title=\"License required for viatical settlement brokers; Commission&#039;s authority; conditions; renewal application and fee; reinstatement; waiver; fingerprinting\" href=\"\/38.2-1865.1\/\">38.2-1865.1<\/a> et seq.) of this chapter, and who is thereby authorized to engage in the activities set forth in Chapter 60 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-6000\/\">38.2-6000<\/a> et seq.). <a id=\"paragraph-244517\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1800\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 38.2-1800)\n\nAs used in this chapter:\n\t\t&#8220;Agent,&#8221; &#8220;insurance agent,&#8221; &#8220;producer,&#8221; or\n&#8220;insurance producer,&#8221; when used without qualification, means an\nindividual or business entity that sells, solicits, or negotiates contracts of\ninsurance or annuity in the Commonwealth.\n\t\t&#8220;Appointed agent,&#8221; &#8220;appointed insurance agent,&#8221;\n&#8220;appointed producer,&#8221; or &#8220;appointed insurance producer,&#8221;\nwhen used without qualification, means an individual or business entity licensed\nin the Commonwealth to sell, solicit, or negotiate contracts of insurance or\nannuity of the classes authorized within the scope of such license and who is\nappointed by a company licensed in the Commonwealth to sell, solicit, or\nnegotiate on its behalf contracts of insurance of the classes authorized within\nthe scope of such license and, if authorized by the company, may collect\npremiums on those contracts.\n\t\t&#8220;Business entity&#8221; means a partnership, limited partnership,\nlimited liability company, corporation, or other legal entity other than a sole\nproprietorship.\n\t\t&#8220;Dental plan organization authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate dental benefit contracts on behalf\nof dental plan organizations licensed under Chapter 61 (\u00a7 38.2-6100 et seq.).\n\t\t&#8220;Dental services authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate dental services plan contracts on\nbehalf of dental services plans licensed under Chapter 45 (\u00a7 38.2-4500 et\nseq.).\n\t\t&#8220;Filed&#8221; means received by the Commission.\n\t\t&#8220;Health agent&#8221; means an agent licensed in the Commonwealth to\nsell, solicit, or negotiate insurance as defined in \u00a7\u00a7  38.2-107.2, 38.2-108,\nand 38.2-109, and including contracts issued by insurers, health services plans,\nhealth maintenance organizations, dental services plans, optometric services\nplans, and dental plan organizations licensed in the Commonwealth.\n\t\t&#8220;Home protection insurance authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate home protection insurance as defined\nin \u00a7 38.2-129 on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Home state&#8221; means the District of Columbia and any state or\nterritory of the United States, except Virginia, or any province of Canada, in\nwhich an insurance producer maintains such person&#8217;s principal place of\nresidence or principal place of business and is licensed by that jurisdiction to\nact as a resident insurance producer.\n\t\t&#8220;Legal services insurance authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate legal services insurance as defined\nin \u00a7 38.2-127 on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;License&#8221; means a document issued by the Commission authorizing an\nindividual or business entity to act as an insurance producer for the lines of\nauthority specified in the document. Except as provided in \u00a7 38.2-1833, the\nlicense itself does not create any authority, actual, apparent or inherent, in\nthe licensee to represent, commit, or bind an insurer.\n\t\t&#8220;Licensed agent,&#8221; &#8220;licensed insurance agent,&#8221;\n&#8220;licensed producer,&#8221; or &#8220;licensed insurance producer,&#8221;\nwhen used without qualification, means an individual or business entity licensed\nin the Commonwealth to sell, solicit, or negotiate contracts of insurance or\nannuity of the classes authorized within the scope of such license.\n\t\t&#8220;Life and annuities insurance agent&#8221; means an agent licensed in\nthe Commonwealth to sell, solicit, or negotiate life insurance and annuity\ncontracts as defined in \u00a7\u00a7 38.2-102, 38.2-103, 38.2-104, 38.2-105.1, 38.2-106,\nand 38.2-107.1, respectively, and family leave insurance as defined in \u00a7\n38.2-107.2, on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Limited burial insurance authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate burial insurance society membership\nwhere the certificates of membership are used solely to fund preneed funeral\ncontracts on any individual, on behalf of insurers licensed under Chapter 40 (\u00a7\n38.2-4000 et seq.); or to represent an association referred to in \u00a7\n38.2-3318.1, limited to soliciting members of that association for association\ngroup life insurance certificates where the funds are used solely to fund\npreneed funeral contracts.\n\t\t&#8220;Limited lines credit insurance agent&#8221; means an agent licensed in\nthe Commonwealth whose authority is restricted to selling, soliciting, or\nnegotiating, on behalf of insurers licensed in the Commonwealth, one or more of\nthe following coverages to individuals through a master, corporate, group or\nindividual policy: (i) credit life insurance and credit accident and sickness\ninsurance, but only to the extent authorized in Chapter 37.1 (\u00a7 38.2-3717 et\nseq.); (ii) credit involuntary unemployment insurance as defined in \u00a7\n38.2-122.1; (iii) credit property insurance, as defined in \u00a7 38.2-122.2; (iv)\nmortgage accident and sickness insurance; (v) mortgage redemption insurance;\n(vi) mortgage guaranty insurance; and (vii) any other form of insurance offered\nin connection with an extension of credit that is limited to partially or wholly\nextinguishing that credit obligation and that the Commission specifically\ndetermines may be sold, solicited, or negotiated by those holding a limited\nlines credit insurance agent license. Each insurer that sells, solicits or\nnegotiates any of the coverages set forth in this definition shall provide to\neach individual whose duties will include selling, soliciting or negotiating\nsuch coverages a program of instruction that may, at the discretion of the\nCommission, be submitted for approval by the Commission or reviewed by the\nCommission subsequent to its implementation.\n\t\t&#8220;Limited lines life and health agent&#8221; means an individual or\nbusiness entity authorized by the Commission whose license authority to sell,\nsolicit, or negotiate is limited to the following, or any other type of\nauthority that the Commission may deem it necessary to recognize for the\npurposes of complying with \u00a7 38.2-1836: dental services authority; limited\nburial insurance authority; mutual assessment life and health insurance\nauthority; optometric services authority; and dental plan organization\nauthority. Limited lines life and health insurance shall not include life\ninsurance, health insurance, property insurance, casualty insurance, private\nfamily leave insurance, and title insurance.\n\t\t&#8220;Limited lines property and casualty agent&#8221; means an individual or\nbusiness entity authorized by the Commission whose license authority to sell,\nsolicit, or negotiate is limited to the following, or any other type of\nauthority that the Commission may deem it necessary to recognize for the\npurposes of complying with \u00a7 38.2-1836: home protection insurance authority;\nlegal services insurance authority; mutual assessment property and casualty\ninsurance authority; ocean marine insurance authority; pet accident, sickness\nand hospitalization insurance authority; portable electronics insurance\nauthority; self storage insurance authority; and travel insurance. Unless\notherwise defined, &#8220;limited lines property and casualty insurance&#8221;\nshall not include life insurance, health insurance, property insurance, casualty\ninsurance, private family leave insurance, and title insurance.\n\t\t&#8220;Mortgage accident and sickness insurance authority&#8221; means the\nauthority in the Commonwealth to sell, solicit, or negotiate mortgage accident\nand sickness insurance on behalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Mortgage guaranty insurance authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate mortgage guaranty insurance on\nbehalf of insurers licensed in the Commonwealth.\n\t\t&#8220;Mortgage redemption insurance authority&#8221; means the authority in\nthe Commonwealth to sell, solicit, or negotiate mortgage redemption insurance on\nbehalf of insurers licensed in the Commonwealth. As used in this chapter,\n&#8220;mortgage redemption insurance&#8221; means a nonrenewable,\nnonconvertible, decreasing term life insurance policy written in connection with\na mortgage transaction for a period of time coinciding with the term of the\nmortgage. The initial sum shall not exceed the amount of the indebtedness\noutstanding at the time the insurance becomes effective, rounded up to the next\n$1,000.\n\t\t&#8220;Motor vehicle rental contract enroller&#8221; means an unlicensed\nhourly or salaried employee of a motor vehicle rental company that is in the\nbusiness of providing primarily private motor vehicles to the public under a\nrental agreement for a period of less than six months, and receives no direct or\nindirect commission from the insurer, the renter or the vehicle rental company.\n\t\t&#8220;Motor vehicle rental contract insurance agent&#8221; means a person who\n(i) is a selling agent of a motor vehicle rental company that is in the business\nof providing primarily private passenger motor vehicles to the public under a\nrental agreement for a period of less than six months and (ii) whose license in\nthe Commonwealth is restricted to selling, soliciting, or negotiating only the\nfollowing insurance coverages, and solely in connection with and incidental to\nthe rental contract:\n\n1. Personal accident insurance that provides benefits in the event of accidental\ndeath or injury occurring during the rental period;\n\n2. Liability coverage sold to the renter in excess of the rental company&#8217;s\nobligations under &#xA7; 38.2-2204, 38.2-2205, or Title 46.2, as applicable;\n\n3. Personal effects insurance that provides coverages for the loss of or damage\nto the personal effects of the renter and other vehicle occupants while such\npersonal effects are in or upon the rental vehicle during the rental period;\n\n4. Roadside assistance and emergency sickness protection programs; and\n\n5. Other travel-related or vehicle-related insurance coverage that a motor\nvehicle rental company offers in connection with and incidental to the rental of\nvehicles.\n\t\t\tThe term &#8220;motor vehicle rental contract insurance agent&#8221; does not\ninclude motor vehicle rental contract enrollers.\n\t\t\t&#8220;Mutual assessment life and health insurance authority&#8221; means the\nauthority in the Commonwealth to sell, solicit, or negotiate mutual assessment\nlife and accident and sickness insurance on behalf of insurers licensed under\nChapter 39 (&#xA7; 38.2-3900 et seq.), but only to the extent permitted under\n&#xA7; 38.2-3919.\n\t\t\t&#8220;Mutual assessment property and casualty insurance authority&#8221;\nmeans the authority in the Commonwealth to sell, solicit, or negotiate mutual\nassessment property and casualty insurance on behalf of insurers licensed under\nChapter 25 (&#xA7; 38.2-2500 et seq.), but only to the extent permitted under\n&#xA7; 38.2-2525.\n\t\t\t&#8220;NAIC&#8221; means the National Association of Insurance Commissioners.\n\t\t\t&#8220;Negotiate&#8221; means the act of conferring directly with or offering\nadvice directly to a purchaser or prospective purchaser of a particular contract\nof insurance concerning any of the substantive benefits, terms or conditions of\nthe contract, provided that the person engaged in that act either sells\ninsurance or obtains insurance from insurers for purchasers.\n\t\t\t&#8220;Ocean marine insurance authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate those classes of insurance\nclassified in &#xA7; 38.2-126, except those classes specifically classified as\ninland marine insurance, on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Optometric services authority&#8221; means the authority in the\nCommonwealth to sell, solicit, or negotiate optometric services plan contracts\non behalf of optometric services plans licensed under Chapter 45 (&#xA7;\n38.2-4500 et seq.).\n\t\t\t&#8220;Personal lines agent&#8221; means an agent licensed in the\nCommonwealth to sell, solicit, or negotiate insurance as defined in &#xA7;&#xA7;\n38.2-110 through 38.2-114, 38.2-116, 38.2-117, 38.2-118, 38.2-124, 38.2-125,\n38.2-126, 38.2-129, 38.2-130, and 38.2-131 for transactions involving insurance\nprimarily for personal, family, or household needs rather than for business or\nprofessional needs.\n\t\t\t&#8220;Pet accident, sickness and hospitalization insurance authority&#8221;\nmeans the authority in the Commonwealth to sell, solicit, or negotiate pet\naccident, sickness and hospitalization insurance on behalf of insurers licensed\nin the Commonwealth.\n\t\t\t&#8220;Property and casualty insurance agent&#8221; means an agent licensed\nin the Commonwealth to sell, solicit, or negotiate both personal and commercial\nlines of insurance as defined in &#xA7;&#xA7;  38.2-107.2, 38.2-110 through\n38.2-122.2, and 38.2-124 through 38.2-134 on behalf of insurers licensed in the\nCommonwealth.\n\t\t\t&#8220;Resident&#8221; means (i) an individual residing in Virginia; (ii) an\nindividual residing outside of Virginia whose principal place of business is in\nVirginia, who is able to demonstrate to the satisfaction of the Commission that\nthe laws of his home state prevent him from obtaining a resident agent license\nin that state, and who affirmatively chooses to qualify as and be treated as a\nresident of Virginia for purposes of licensing and continuing education, both in\nVirginia and in the state in which the individual resides, if applicable; (iii)\na partnership duly formed and recorded in Virginia; (iv) a corporation\nincorporated and existing under the laws of Virginia; (v) a limited liability\ncompany organized and existing under the laws of Virginia; or (vi) a foreign\nbusiness entity that is not licensed as a resident agent in any other\njurisdiction, and that demonstrates to the satisfaction of the Commission that\nits principal place of business is within the Commonwealth of Virginia.\n\t\t\t&#8220;Restricted nonresident health agent&#8221; means a nonresident agent\nwhose license authority in his home state does not include all of the authority\ngranted under a health agent license in Virginia. The license issued to such\nagent shall authorize the agent to sell, solicit, or negotiate in Virginia, on\nbehalf of insurers licensed in Virginia, only those kinds or classes of\ninsurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident life and annuities agent&#8221; means a\nnonresident agent whose license authority in his home state does not include all\nof the authority granted under a life and annuities agent license in Virginia.\nThe license issued to such agent shall authorize the agent to sell, solicit, or\nnegotiate in Virginia, on behalf of insurers licensed in Virginia, only those\nkinds or classes of insurance for which the agent is authorized in his home\nstate.\n\t\t\t&#8220;Restricted nonresident personal lines agent&#8221; means a nonresident\nagent whose license authority in his home state does not include all of the\nauthority granted under a personal lines agent license in Virginia. The license\nissued to such agent shall authorize the agent to sell, solicit, or negotiate in\nVirginia, on behalf of insurers licensed in Virginia, only those kinds or\nclasses of insurance for which the agent is authorized in his home state.\n\t\t\t&#8220;Restricted nonresident property and casualty agent&#8221; means a\nnonresident agent whose license authority in his home state does not include all\nof the authority granted under a property and casualty agent license in\nVirginia. The license issued to such agent shall authorize the agent to sell,\nsolicit, or negotiate in Virginia, on behalf of insurers licensed in Virginia,\nonly those kinds or classes of insurance for which the agent is authorized in\nhis home state.\n\t\t\t&#8220;Sell&#8221; means to exchange a contract of insurance by any means,\nfor money or its equivalent, on behalf of an insurer.\n\t\t\t&#8220;Settlement agent&#8221; means a person licensed as a title insurance\nagent and registered with the Virginia State Bar pursuant to Chapter 10 (&#xA7;\n55.1-1000 et seq.) of Title 55.1.\n\t\t\t&#8220;Solicit&#8221; means attempting to sell insurance or asking or urging\na person to apply for a particular class of insurance from one or more insurers.\n\t\t\t&#8220;Surety bail bondsman&#8221; means a person licensed as a surety bail\nbondsman pursuant to Article 11 (&#xA7; 9.1-185 et seq.) of Chapter 1 of Title\n9.1.\n\t\t\t&#8220;Surplus lines broker&#8221; means a person licensed pursuant to\nArticle 5.1 (&#xA7; 38.2-1857.1 et seq.) of this chapter, and who is thereby\nauthorized to engage in the activities set forth in Chapter 48 (&#xA7;\n38.2-4805.1 et seq.).\n\t\t\t&#8220;Terminate&#8221; means the cancellation of the relationship between an\ninsurance producer and the insurer, or the termination of an insurance\nproducer&#8217;s authority to transact insurance.\n\t\t\t&#8220;Title insurance agent&#8221; means an agent licensed in the\nCommonwealth to sell, solicit, or negotiate title insurance, and performing all\nof the services set forth in &#xA7; 38.2-4601.1, on behalf of title insurance\ncompanies licensed under Chapter 46 (&#xA7; 38.2-4600 et seq.).\n\t\t\t&#8220;Uniform Application&#8221; means the current version of the NAIC\nUniform Application for resident and nonresident producer licensing.\n\t\t\t&#8220;Uniform Business Entity Application&#8221; means the current version\nof the NAIC Uniform Business Entity Application for resident and nonresident\nbusiness entities.\n\t\t\t&#8220;Variable contract agent&#8221; means an agent licensed in the\nCommonwealth to sell, solicit, or negotiate variable life insurance and variable\nannuity contracts on behalf of insurers licensed in the Commonwealth.\n\t\t\t&#8220;Viatical settlement broker&#8221; means a person licensed pursuant to\nChapter 60 (&#xA7; 38.2-6000 et seq.), in accordance with Article 6.1 (&#xA7;\n38.2-1865.1 et seq.) of this chapter, and who is thereby authorized to engage in\nthe activities set forth in Chapter 60 (&#xA7; 38.2-6000 et seq.).\n\nHISTORY: 1979, c. 513, \u00a7 38.1-327.1; 1981, c. 604; 1983, c. 480; 1984, c. 719;\n1986, c. 562; 1987, cc. 520, 521; 1992, c. 586; 1994, cc. 106, 316; 1995, c.\n167; 1998, cc. 16, 47, 164; 1999, cc. 86, 490, 493, 586; 2000, c. 526; 2001, c.\n706; 2003, cc. 412, 717, 979; 2004, cc. 460, 668, 784; 2006, c. 410; 2011, c.\n222; 2012, c. 447; 2013, cc. 203, 497; 2016, c. 250; 2022, cc. 131, 132; 2023,\ncc. 338, 339.","edition":{"id":1,"name":"2025","slug":"2025","date_created":"2026-06-21 22:39:22","date_modified":"2026-06-21 22:39:22","current":1,"order_by":1,"last_import":null}}
