I, c. 441.","full_text":"A\n\nFailure of an agent or public adjuster to complete all continuing education course or waiver requirements, pay any fee imposed by the Board, or otherwise furnish proof of compliance during the two-year period set forth in subsection B of &#xA7; 38.2-1868.1, or to complete the license renewal requirements set forth in &#xA7; 38.2-1825.1, 38.2-1840, or 38.2-1845.8, shall result in the termination, pursuant to &#xA7; 38.2-1825.1, 38.2-1840, or 38.2-1845.8, of each license held by the agent or public adjuster for which the requirements of this article were not satisfied.B\n\nNeither the Board, its administrator, nor the Commission shall have the power to grant an agent or public adjuster additional time for completing the continuing education credits required by &#xA7; 38.2-1866, or additional time for seeking waivers or submitting proof of compliance as required by &#xA7; 38.2-1868.1.C\n\nAn agent or public adjuster whose license has been terminated pursuant to &#xA7; 38.2-1825.1, 38.2-1840, or 38.2-1845.8 for failure to satisfy the continuing education requirements of this article may appeal the determination of noncompliance to the Board. <a id=\"paragraph-302347\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1869\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> A <span class=\"dictionary\">resident<\/span> agent holding a <span class=\"dictionary\">license<\/span> as a <span class=\"dictionary\">surplus lines broker<\/span> whose <span class=\"dictionary\">property and casualty insurance agent<\/span> <span class=\"dictionary\">license<\/span> is terminated for failure to satisfy the requirements of this article shall also have such <span class=\"dictionary\">surplus lines broker<\/span> <span class=\"dictionary\">license<\/span> terminated by the <span class=\"dictionary\">Commission<\/span>; and <a id=\"paragraph-302348\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1869\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> An agent holding a registration as a title <span class=\"dictionary\">settlement agent<\/span> whose <span class=\"dictionary\">title insurance agent<\/span> <span class=\"dictionary\">license<\/span> is terminated for failure to satisfy the requirements of this article shall also have such registration as a title <span class=\"dictionary\">settlement agent<\/span> terminated by the <span class=\"dictionary\">Commission<\/span>.\n\t\t\t\tAny such <span class=\"dictionary\">license<\/span> or registration so terminated may be applied for again after the agent has obtained, respectively, a new <span class=\"dictionary\">life and annuities insurance agent<\/span>&#8217;s <span class=\"dictionary\">license<\/span>, a new <span class=\"dictionary\">property and casualty insurance agent<\/span>&#8217;s <span class=\"dictionary\">license<\/span>, or a new <span class=\"dictionary\">title insurance agent<\/span>&#8217;s <span class=\"dictionary\">license<\/span> and appointment, if appointment is required. <a id=\"paragraph-302349\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1869\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> An insurance consultant who fails to renew his insurance consultant <span class=\"dictionary\">license<\/span> by the date specified in &#xA7; <a class=\"law\" title=\"Renewal application and fee; compliance with continuing education requirements; reinstatement; waiver\" href=\"\/38.2-1840\/\">38.2-1840<\/a>, but who reinstates his insurance consultant <span class=\"dictionary\">license<\/span> within 12 months following such renewal date shall be treated, for purposes of determining exemption from continuing education requirements pursuant to &#xA7; <a class=\"law\" title=\"Licensees not subject to the continuing education requirements of this article\" href=\"\/38.2-1871\/\">38.2-1871<\/a>, as if such insurance consultant <span class=\"dictionary\">license<\/span> had been renewed in a timely manner. <a id=\"paragraph-302350\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1869\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> A <span class=\"dictionary\">resident<\/span> public adjuster whose <span class=\"dictionary\">license<\/span> has been terminated under the terms of this section and whose <span class=\"dictionary\">license<\/span> is not reinstated pursuant to &#xA7; <a class=\"law\" title=\"Renewal application and fee; reinstatement; waiver\" href=\"\/38.2-1845.8\/\">38.2-1845.8<\/a> shall be permitted to make application for a new <span class=\"dictionary\">license<\/span> if all of the requirements of &#xA7; <a class=\"law\" title=\"License required of resident public adjusters\" href=\"\/38.2-1845.2\/\">38.2-1845.2<\/a> are met. <a id=\"paragraph-302351\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1869\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nFAILURE TO SATISFY REQUIREMENTS; TERMINATION OF LICENSE (\u00a7 38.2-1869)\n\nA. Failure of an agent or public adjuster to complete all continuing education\ncourse or waiver requirements, pay any fee imposed by the Board, or otherwise\nfurnish proof of compliance during the two-year period set forth in subsection B\nof &#xA7; 38.2-1868.1, or to complete the license renewal requirements set forth\nin &#xA7; 38.2-1825.1, 38.2-1840, or 38.2-1845.8, shall result in the\ntermination, pursuant to &#xA7; 38.2-1825.1, 38.2-1840, or 38.2-1845.8, of each\nlicense held by the agent or public adjuster for which the requirements of this\narticle were not satisfied.\n\nB. Neither the Board, its administrator, nor the Commission shall have the power\nto grant an agent or public adjuster additional time for completing the\ncontinuing education credits required by &#xA7; 38.2-1866, or additional time\nfor seeking waivers or submitting proof of compliance as required by &#xA7;\n38.2-1868.1.\n\nC. An agent or public adjuster whose license has been terminated pursuant to\n&#xA7; 38.2-1825.1, 38.2-1840, or 38.2-1845.8 for failure to satisfy the\ncontinuing education requirements of this article may appeal the determination\nof noncompliance to the Board. However, failure of an agent or public adjuster\nto provide notice of appeal in the form and manner prescribed by the Board\nwithin 30 calendar days following expiration of the two-year period set forth in\nsubsection B of &#xA7; 38.2-1868.1 and in &#xA7;&#xA7; 38.2-1825.1, 38.2-1840,\nand 38.2-1845.8 shall be deemed a waiver by such agent or public adjuster of the\nright to appeal the determination of noncompliance with the Board.\n\nD. Pursuant to the requirements of subsection C of \u00a7 38.2-1815 and \u00a7\u00a7\n38.2-1857.1 and 55.1-1003, respectively:\n\n   1. A resident variable contract agent whose life and annuities insurance agent\n   license is terminated for failure to satisfy the requirements of this article\n   shall also have such variable contract license terminated by the Commission;\n\n   2. A resident agent holding a license as a surplus lines broker whose property\n   and casualty insurance agent license is terminated for failure to satisfy the\n   requirements of this article shall also have such surplus lines broker license\n   terminated by the Commission; and\n\n   3. An agent holding a registration as a title settlement agent whose title\n   insurance agent license is terminated for failure to satisfy the requirements\n   of this article shall also have such registration as a title settlement agent\n   terminated by the Commission.\n   \t\t\t\tAny such license or registration so terminated may be applied for again\n   after the agent has obtained, respectively, a new life and annuities insurance\n   agent&#8217;s license, a new property and casualty insurance agent&#8217;s\n   license, or a new title insurance agent&#8217;s license and appointment, if\n   appointment is required.\n\nE. An insurance consultant who fails to renew his insurance consultant license\nby the date specified in &#xA7; 38.2-1840, but who reinstates his insurance\nconsultant license within 12 months following such renewal date shall be\ntreated, for purposes of determining exemption from continuing education\nrequirements pursuant to &#xA7; 38.2-1871, as if such insurance consultant\nlicense had been renewed in a timely manner.\n\nF.
