Prospective loss costs do not include provisions for profit or expenses other than loss adjustment expenses.\n\t\t&#8220;Rate service organization&#8221; means any entity, including its affiliates or subsidiaries, which either has two or more member insurers or is controlled either directly or indirectly by two or more insurers, other than a joint underwriting association under \u00a7 38.2-1915, which assists insurers in ratemaking or filing by (i) collecting, compiling, and furnishing loss statistics; (ii) recommending, making, or filing prospective loss costs or supplementary rate information; or (iii) advising about rate questions, except as an attorney giving legal advice. Two or more <span class=\"dictionary\">insurers<\/span> having a common ownership or operating in this Commonwealth under common management or control constitute a single <span class=\"dictionary\">insurer<\/span> for purposes of this definition.\n\t\t&#8220;<span class=\"dictionary\">Retrospective rating plan<\/span>&#8221; means a rating plan that adjusts the premium for the <span class=\"dictionary\">insurance<\/span> to which it applies on the basis of losses incurred during the period covered by that <span class=\"dictionary\">insurance<\/span>.\n\t\t&#8220;<span class=\"dictionary\">Statistical plan<\/span>&#8221; means the plan, system, or arrangement used in collecting data for rate making or other purposes.\n\t\t&#8220;<span class=\"dictionary\">Supplementary rate information<\/span>&#8221; includes any manual or plan of <span class=\"dictionary\"><span class=\"dictionary\">rates<\/span><\/span>, <span class=\"dictionary\">experience rating<\/span> plan, <span class=\"dictionary\">statistical plan<\/span>, classification, rating schedule, minimum premium, or minimum premium rule, policy fee, rating rule, rate-related underwriting rule, and any other information not otherwise inconsistent with the purposes of this chapter required by the <span class=\"dictionary\">Commission<\/span>.\n\t\t&#8220;Supporting data&#8221; includes:<\/p><\/section>\n\t\t\t\t\t\t<section id=\"1\"><p><span class=\"prefix-number\">1.<\/span> The experience and <span class=\"dictionary\">judgment<\/span> of the filer and, to the extent the filer wishes or the <span class=\"dictionary\">Commission<\/span> requires, the experience and <span class=\"dictionary\">judgment<\/span> of other <span class=\"dictionary\">insurers<\/span> or <span class=\"dictionary\">rate service organizations<\/span>; <a id=\"paragraph-210811\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1901\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> The filer&#8217;s interpretation of any statistical data relied upon; <a id=\"paragraph-210812\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1901\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> Descriptions of the actuarial and statistical methods employed in setting the <span class=\"dictionary\"><span class=\"dictionary\">rates<\/span><\/span>; and <a id=\"paragraph-210813\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1901\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> Any other relevant information required by the <span class=\"dictionary\">Commission<\/span>. <a id=\"paragraph-210814\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-1901\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEFINITIONS (\u00a7 38.2-1901)\n\nAs used in this chapter:\n\t\t&#8220;Classification system&#8221; or &#8220;classification&#8221; means the\nplan, system, or arrangement for grouping risks with similar characteristics or\na specified class of risk by recognizing differences in exposure to hazards.\n\t\t&#8220;Client company&#8221; shall have the same meaning ascribed to it in \u00a7\n65.2-101.\n\t\t&#8220;Coemployee&#8221; shall have the same meaning ascribed to it in \u00a7\n65.2-101.\n\t\t&#8220;Experience rating&#8221; means a statistical procedure utilizing past\nrisk experience to produce a prospective premium credit, debit, or unity\nmodification.\n\t\t&#8220;Market segment&#8221; means any line or class of insurance or, if it is\ndescribed in general terms, any subdivision of insurance or any class of risks\nor combination of classes.\n\t\t&#8220;Professional employer organization&#8221; shall have the same meaning\nascribed to it in \u00a7 65.2-101.\n\t\t&#8220;Professional employer services&#8221; means services provided to a\nclient company pursuant to a written agreement with a professional employer\norganization, including, at a minimum, the payment of wages of the coemployees,\nthe reservation of the right of direction and control over the coemployees, and\nthe responsibility for the withholding and payment of payroll taxes of the\ncoemployees.\n\t\t&#8220;Prospective loss costs&#8221; means historical aggregate losses and\nloss adjustment expenses projected through development to their ultimate value\nand through trending to a future point in time. Prospective loss costs do not\ninclude provisions for profit or expenses other than loss adjustment expenses.\n\t\t&#8220;Rate service organization&#8221; means any entity, including its\naffiliates or subsidiaries, which either has two or more member insurers or is\ncontrolled either directly or indirectly by two or more insurers, other than a\njoint underwriting association under \u00a7 38.2-1915, which assists insurers in\nratemaking or filing by (i) collecting, compiling, and furnishing loss\nstatistics; (ii) recommending, making, or filing prospective loss costs or\nsupplementary rate information; or (iii) advising about rate questions, except\nas an attorney giving legal advice.
