Coverage also does not include <span class=\"dictionary\">prosthetic devices<\/span> designed primarily for an athletic purpose. <a id=\"paragraph-259308\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.15\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> An <span class=\"dictionary\">insurer<\/span> shall not impose any annual or lifetime dollar maximum on coverage for <span class=\"dictionary\">prosthetic devices<\/span> other than an annual or lifetime dollar maximum that applies in the aggregate to all items and services covered under the policy. The coverage may be made subject to, and no more restrictive than, the provisions of a health insurance policy that apply to other benefits under the policy. <a id=\"paragraph-259309\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.15\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> An <span class=\"dictionary\">insurer<\/span> shall not apply amounts paid for <span class=\"dictionary\">prosthetic devices<\/span> to any annual or lifetime dollar maximum applicable to other durable medical equipment covered under the policy other than an annual or lifetime dollar maximum that applies in the aggregate to all items and services covered under the policy. <a id=\"paragraph-259310\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.15\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> No <span class=\"dictionary\">insurer<\/span>, corporation, or health maintenance organization shall impose upon any <span class=\"dictionary\">person<\/span> receiving benefits pursuant to this section any coinsurance in excess of 30 percent of the carrier&#8217;s allowable charge for such <span class=\"dictionary\">prosthetic device<\/span> or services when such device or service is provided by an in-network provider. <a id=\"paragraph-259311\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.15\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> An <span class=\"dictionary\">insurer<\/span>, corporation, or health maintenance organization may require preauthorization to determine medical necessity and the eligibility of benefits for <span class=\"dictionary\">prosthetic devices<\/span> and <span class=\"dictionary\">components<\/span>, in the same manner that prior authorization is required for any other covered benefit. <a id=\"paragraph-259312\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.15\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The requirements of this section shall apply to all <span class=\"dictionary\">insurance policies<\/span>, <span class=\"dictionary\">contracts<\/span>, and plans delivered, issued for delivery, reissued, or extended in the Commonwealth on and after January 1, 2010, or at any time thereafter when any term of the policy, <span class=\"dictionary\">contract<\/span>, or plan is changed or any premium adjustment is made. <a id=\"paragraph-259313\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.15\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> This section shall not apply to short-term travel, accident-only, or limited or specified disease policies or <span class=\"dictionary\">contracts<\/span>, nor to policies or <span class=\"dictionary\">contracts<\/span> designed for issuance to <span class=\"dictionary\">persons<\/span> eligible for coverage under Title XVIII of the Social Security Act, known as <span class=\"dictionary\">Medicare<\/span>, or any other similar coverage under <span class=\"dictionary\">state<\/span> or federal governmental plans. <a id=\"paragraph-259314\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.15\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCOVERAGE FOR PROSTHETIC DEVICES AND COMPONENTS (\u00a7 38.2-3418.15)\n\nA. Notwithstanding the provisions of \u00a7 38.2-3419, each insurer proposing to\nissue individual or group accident and sickness insurance policies providing\nhospital, medical and surgical, or major medical coverage on an expense-incurred\nbasis; each corporation providing individual or group accident and sickness\nsubscription contracts; and each health maintenance organization providing a\nhealth care plan for health care services shall offer and make available\ncoverage for medically necessary prosthetic devices, their repair, fitting,\nreplacement, and components, as follows:\n\n   1. As used in this section:\n   \t\t\t\t&#8220;Component&#8221; means the materials and equipment needed to ensure\n   the comfort and functioning of a prosthetic device.\n   \t\t\t\t&#8220;Limb&#8221; means an arm, a hand, a leg, a foot, or any portion of\n   an arm, a hand, a leg, or a foot.\n   \t\t\t\t&#8220;Prosthetic device&#8221; means an artificial device to replace, in\n   whole or in part, a limb.\n\n   2. Prosthetic device coverage does not include repair and replacement due to\n   enrollee neglect, misuse, or abuse. Coverage also does not include prosthetic\n   devices designed primarily for an athletic purpose.\n\n   3. An insurer shall not impose any annual or lifetime dollar maximum on\n   coverage for prosthetic devices other than an annual or lifetime dollar\n   maximum that applies in the aggregate to all items and services covered under\n   the policy.
