That modification is as follows: in 2023, chapters <a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?231+ful+CHAP0271\">271<\/a> and <a href=\"https:\/\/legacylis.virginia.gov\/cgi-bin\/legp604.exe?231+ful+CHAP0272\">272<\/a>.<\/p>","references":false,"refers_to":[{"id":66144,"section_number":"38.2-3419","catch_line":"Additional mandated coverage made optional to group policy or contract holder","order_by":null,"url":"\/38.2-3419\/"}],"permalink":{"id":215257,"object_type":"law","relational_id":60567,"identifier":"38.2-3418.18","token":"38.2\/34\/2\/38.2-3418.18","url":"\/38.2-3418.18\/","edition_id":1,"permalink":0,"preferred":1},"url":"\/38.2-3418.18\/","token":"38.2\/34\/2\/38.2-3418.18","dublin_core":{"Title":"Coverage for formula and enteral nutrition products as medicine","Type":"Text","Format":"text\/html","Identifier":"\u00a7 38.2-3418.18","Relation":"Code of Virginia"},"html":"\n\t\t\t\t\t\t<section id=\"A\"><p><span class=\"prefix-number\">A.<\/span> Notwithstanding the provisions of \u00a7&nbsp;<a class=\"law\" title=\"Additional mandated coverage made optional to group policy or contract holder\" href=\"\/38.2-3419\/\">38.2-3419<\/a>, each <span class=\"dictionary\">insurer<\/span> proposing to <span class=\"dictionary\">issue<\/span> individual or group accident and sickness <span class=\"dictionary\">insurance policies<\/span> providing hospital, medical and surgical, or major medical coverage on an expense-incurred basis; each corporation providing individual or group accident and sickness subscription <span class=\"dictionary\">contracts<\/span>; and each health maintenance organization providing a health care plan for health care services, whose policy, <span class=\"dictionary\">contract<\/span>, or plan, including any certificate or <span class=\"dictionary\">evidence<\/span> of coverage issued in connection with such policy, <span class=\"dictionary\">contract<\/span>, or plan, includes coverage for medicines shall: <a id=\"paragraph-221390\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Classify <span class=\"dictionary\">medically necessary formula and enteral nutrition products<\/span> as medicine; and <a id=\"paragraph-221391\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Include coverage for <span class=\"dictionary\">medically necessary formula and enteral nutrition products<\/span> on the same terms and subject to the same conditions imposed on other medicines covered under the policy, <span class=\"dictionary\">contract<\/span>, or plan. <a id=\"paragraph-221392\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> As used in this section:\n\t\t\t&#8220;<span class=\"dictionary\">Inherited metabolic disorder<\/span>&#8221; means an inherited enzymatic disorder caused by single gene defects involved in the metabolism of amino, organic, or fatty acids.\n\t\t\t&#8220;<span class=\"dictionary\">Medically necessary formula and enteral nutrition products<\/span>&#8221; means any liquid or solid formulation of formula and enteral nutrition products for covered individuals requiring treatment for an <span class=\"dictionary\">inherited metabolic disorder<\/span> and for which the covered individual&#8217;s physician has issued a written <span class=\"dictionary\">order<\/span> stating that the formula or enteral nutrition product is medically necessary and has been proven effective as a treatment regimen for the covered individual and that the formula or enteral nutrition product is a critical source of nutrition as certified by the physician by diagnosis. The medically necessary formula or enteral products do not need to be the covered individual&#8217;s primary source of nutrition. <a id=\"paragraph-221393\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The coverage required by this section shall: <a id=\"paragraph-221394\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Apply to the partial or exclusive feeding of a covered individual by means of oral intake or enteral feeding by tube; <a id=\"paragraph-221395\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Include coverage for any medical equipment, supplies, and services that are required to administer the covered formula or enteral nutrition products; <a id=\"paragraph-221396\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Apply only when the formula and enteral nutrition products are (i) furnished pursuant to the prescription or <span class=\"dictionary\">order<\/span> of a physician or other health care professional qualified to make such prescription or <span class=\"dictionary\">order<\/span> for the management of an <span class=\"dictionary\">inherited metabolic disorder<\/span> and (ii) used under medical supervision, which may include a home setting; and <a id=\"paragraph-221397\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Not apply to nutritional supplements taken electively. <a id=\"paragraph-221398\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> No <span class=\"dictionary\">insurer<\/span>, corporation, or health maintenance organization shall impose upon any <span class=\"dictionary\">person<\/span> receiving benefits for any formula and enteral nutrition products pursuant to this section any (i) copayment, coinsurance payment, or fee that is not equally imposed upon all individuals in the same benefit category, class, coinsurance level, or copayment level receiving benefits for medicines or (ii) reduction in allowable reimbursement for medicine. <a id=\"paragraph-221399\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The provisions of this section shall apply to any policy, <span class=\"dictionary\">contract<\/span>, or plan delivered, issued for delivery, or renewed in the Commonwealth on and after January 1, 2021. <a id=\"paragraph-221400\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The provisions of this section shall not apply to short-term travel, accident-only, or limited or specified disease policies, <span class=\"dictionary\">contracts<\/span> designed for issuance to <span class=\"dictionary\">persons<\/span> eligible for coverage under Title XVIII of the Social Security Act, known as <span class=\"dictionary\">Medicare<\/span>, or any other similar coverage under <span class=\"dictionary\">state<\/span> or federal governmental plans, or short-term nonrenewable policies of not more than six months&#8217; duration. The provisions of this section shall not apply to policies, <span class=\"dictionary\">contracts<\/span>, or plans issued in the individual market or small group markets. <a id=\"paragraph-221401\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-3418.18\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCOVERAGE FOR FORMULA AND ENTERAL NUTRITION PRODUCTS AS MEDICINE (\u00a7\n38.2-3418.18)\n\nA.
