Notwithstanding the provisions of &#xA7; 38.2-3419, each insurer proposing to\nissue individual or group accident and sickness insurance policies providing\nhospital, medical and surgical, or major medical coverage on an expense-incurred\nbasis; each corporation providing individual or group accident and sickness\nsubscription contracts; and each health maintenance organization providing a\nhealth care plan for health care services shall provide coverage for hemophilia\nand congenital bleeding disorders under such policy, contract or plan delivered,\nissued for delivery or renewed in this Commonwealth on and after July 1, 1998.\n\nB. For the purpose of this section:\n\t\t\t&#8220;Blood infusion equipment&#8221; includes, but is not limited to,\nsyringes and needles.\n\t\t\t&#8220;Blood product&#8221; includes, but is not limited to, Factor VII,\nFactor VIII, Factor IX, and cryoprecipitate.\n\t\t\t&#8220;Hemophilia&#8221; means a lifelong hereditary bleeding disorder\nusually affecting males that results in prolonged bleeding primarily into joints\nand muscles.\n\t\t\t&#8220;Home treatment program&#8221; means a program where individuals or\nfamily members are trained to provide infusion therapy at home in order to\nachieve optimal health and cost effectiveness.\n\t\t\t&#8220;State-approved hemophilia treatment center&#8221; means a hospital or\nclinic which receives federal or state Maternal and Child Health Bureau, and\/or\nCenters for Disease Control funds to conduct comprehensive care for persons with\nhemophilia and other congenital bleeding disorders.\n\nC. The benefits to be provided shall include coverage for expenses incurred in\nconnection with the treatment of routine bleeding episodes associated with\nhemophilia and other congenital bleeding disorders. The benefits to be provided\nshall include coverage for the purchase of blood products and blood infusion\nequipment required for home treatment of routine bleeding episodes associated\nwith hemophilia and other congenital bleeding disorders when the home treatment\nprogram is under the supervision of the state-approved hemophilia treatment\ncenter.\n\nD. The provisions of this section shall not apply to short-term travel, accident\nonly, limited or specified disease policies, policies or contracts designed for\nissuance to persons eligible for coverage under Title XVIII of the Social\nSecurity Act, known as Medicare, or to any other similar coverage under state or\nfederal governmental plans, or to short-term nonrenewable policies of not more\nthan six months&#8217; duration.\n\nHISTORY: 1998, cc. 43, 120.","edition":{"id":1,"name":"2025","slug":"2025","date_created":"2026-06-21 22:39:22","date_modified":"2026-06-21 22:39:22","current":1,"order_by":1,"last_import":null}}
