<a class=\"law\" title=\"Other provisions\" href=\"\/38.2-3504\/\">38.2-3504<\/a>, &#xA7;&#xA7; <a class=\"law\" title=\"Preexisting conditions provisions\" href=\"\/38.2-3514.1\/\">38.2-3514.1<\/a>, <a class=\"law\" title=\"Renewability of coverage\" href=\"\/38.2-3514.2\/\">38.2-3514.2<\/a>, <a class=\"law\" title=\"Limits of group accident and sickness insurance\" href=\"\/38.2-3522.1\/\">38.2-3522.1<\/a> through <a class=\"law\" title=\"Minimum number of persons covered\" href=\"\/38.2-3523.4\/\">38.2-3523.4<\/a>, <a class=\"law\" title=\"Group accident and sickness insurance coverages of spouses, dependent children or other persons\" href=\"\/38.2-3525\/\">38.2-3525<\/a>, <a class=\"law\" title=\"Claims experience\" href=\"\/38.2-3540.1\/\">38.2-3540.1<\/a>, <a class=\"law\" title=\"Employee wellness program\" href=\"\/38.2-3540.2\/\">38.2-3540.2<\/a>, <a class=\"law\" title=\"Enrollment following change in eligibility status under assistance programs\" href=\"\/38.2-3541.2\/\">38.2-3541.2<\/a>, <a class=\"law\" title=\"Notice to employees upon termination of coverage; penalty for failure to remit funds\" href=\"\/38.2-3542\/\">38.2-3542<\/a>, and <a class=\"law\" title=\"Applicability of laws\" href=\"\/38.2-3543.2\/\">38.2-3543.2<\/a>, Article 5 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-3551\/\">38.2-3551<\/a> et seq.) of Chapter 35, Chapter 35.1 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-3556\/\">38.2-3556<\/a> et seq.), &#xA7; <a class=\"law\" title=\"Medicare supplement policies for persons eligible by reason of disability\" href=\"\/38.2-3610\/\">38.2-3610<\/a>, Chapter 52 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-5200\/\">38.2-5200<\/a> et seq.), Chapter 55 (&#xA7; <a class=\"law\" title=\"Applicability\" href=\"\/38.2-5500\/\">38.2-5500<\/a> et seq.), Chapter 58 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-5800\/\">38.2-5800<\/a> et seq.), Chapter 65 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-6500\/\">38.2-6500<\/a> et seq.), and Chapter 66 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-6600\/\">38.2-6600<\/a> et seq.) shall be applicable to any <span class=\"dictionary\">health maintenance organization<\/span> granted a license under this chapter. This chapter shall not apply to an <span class=\"dictionary\">insurer<\/span> or <span class=\"dictionary\">health services plan<\/span> licensed and regulated in conformance with the <span class=\"dictionary\">insurance<\/span> <span class=\"dictionary\">laws<\/span> or Chapter 42 (&#xA7; <a class=\"law\" title=\"Applicability of chapter\" href=\"\/38.2-4200\/\">38.2-4200<\/a> et seq.) except with respect to the activities of its <span class=\"dictionary\">health maintenance organization<\/span>. <a id=\"paragraph-246071\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-4319\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> For plans administered by the Department of Medical Assistance Services that provide benefits pursuant to Title XIX or Title XXI of the Social Security Act, as amended, no provisions of this title except this chapter and, insofar as they are not inconsistent with this chapter, &#xA7;&#xA7; penalty for failure to remit funds\" href=\"\/38.2-3542\/\">38.2-3542<\/a>, and <a class=\"law\" title=\"Applicability of laws\" href=\"\/38.2-3543.2\/\">38.2-3543.2<\/a>, Chapter 52 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-5200\/\">38.2-5200<\/a> et seq.), Chapter 55 (&#xA7; <a class=\"law\" title=\"Applicability\" href=\"\/38.2-5500\/\">38.2-5500<\/a> et seq.), Chapter 58 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-5800\/\">38.2-5800<\/a> et seq.), Chapter 65 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-6500\/\">38.2-6500<\/a> et seq.), and Chapter 66 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-6600\/\">38.2-6600<\/a> et seq.) shall be applicable to any <span class=\"dictionary\">health maintenance organization<\/span> granted a license under this chapter. This chapter shall not apply to an <span class=\"dictionary\">insurer<\/span> or <span class=\"dictionary\">health services plan<\/span> licensed and regulated in conformance with the <span class=\"dictionary\">insurance<\/span> <span class=\"dictionary\">laws<\/span> or Chapter 42 (&#xA7; <a class=\"law\" title=\"Applicability of chapter\" href=\"\/38.2-4200\/\">38.2-4200<\/a> et seq.) except with respect to the activities of its <span class=\"dictionary\">health maintenance organization<\/span>. <a id=\"paragraph-246072\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-4319\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Solicitation of <span class=\"dictionary\">enrollees<\/span> by a licensed <span class=\"dictionary\">health maintenance organization<\/span> or by its representatives shall not be construed to violate any provisions of <span class=\"dictionary\">law<\/span> relating to solicitation or advertising by health professionals. <a id=\"paragraph-246073\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-4319\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> A licensed <span class=\"dictionary\">health maintenance organization<\/span> shall not be deemed to be engaged in the unlawful practice of medicine. All <span class=\"dictionary\">health care providers<\/span> associated with a <span class=\"dictionary\">health maintenance organization<\/span> shall be subject to all provisions of <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-246074\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-4319\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Notwithstanding the definition of an eligible employee as set forth in &#xA7; <a class=\"law\" title=\"Application of article; definitions\" href=\"\/38.2-3431\/\">38.2-3431<\/a>, a <span class=\"dictionary\">health maintenance organization<\/span> providing <span class=\"dictionary\">health care plans<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Application of article; definitions\" href=\"\/38.2-3431\/\">38.2-3431<\/a> shall not be required to offer coverage to or accept applications from an employee who does not reside within the <span class=\"dictionary\">health maintenance organization<\/span>&#8217;s service area. <a id=\"paragraph-246075\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-4319\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> For purposes of applying this section, &#8220;<span class=\"dictionary\">insurer<\/span>&#8221; when used in a section cited in subsections A and B shall be construed to mean and include &#8220;<span class=\"dictionary\"><span class=\"dictionary\">health maintenance organizations<\/span><\/span>&#8221; unless the section cited clearly applies to <span class=\"dictionary\"><span class=\"dictionary\">health maintenance organizations<\/span><\/span> without such construction. <a id=\"paragraph-246076\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-4319\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nSTATUTORY CONSTRUCTION AND RELATIONSHIP TO OTHER LAWS (\u00a7 38.2-4319)\n\nA. For plans administered by the Department of Medical Assistance Services that\nprovide benefits pursuant to Title XIX or Title XXI of the Social Security Act,\nas amended, no provisions of this title except this chapter and, insofar as they\nare not inconsistent with this chapter, &#xA7;&#xA7; 38.2-100, 38.2-136,\n38.2-200, 38.2-203, 38.2-209 through 38.2-213, 38.2-216, 38.2-218 through\n38.2-225, 38.2-229, 38.2-232, 38.2-322, 38.2-325, 38.2-400, 38.2-402 through\n38.2-413, 38.2-500 through 38.2-515, and 38.2-600 through 38.2-629, Chapter 9\n(&#xA7; 38.2-900 et seq.), &#xA7;&#xA7; 38.2-1016.1 through 38.2-1023,\n38.2-1057, and 38.2-1306.1, Article 2 (&#xA7; 38.2-1306.2 et seq.), &#xA7;\n38.2-1315.1, Articles 3.1 (&#xA7; 38.2-1316.1 et seq.), 4 (&#xA7; 38.2-1317 et\nseq.), 5 (&#xA7; 38.2-1322 et seq.), 5.1 (&#xA7; 38.2-1334.3 et seq.), and 5.2\n(&#xA7; 38.2-1334.11 et seq.) of Chapter 13, Articles 1 (&#xA7; 38.2-1400 et\nseq.), 2 (&#xA7; 38.2-1412 et seq.), and 4 (&#xA7; 38.2-1446 et seq.) of Chapter\n14, &#xA7;&#xA7; 38.2-3401, 38.2-3405, 38.2-3407.2 through 38.2-3407.5,\n38.2-3407.6, 38.2-3407.6:1, 38.2-3407.9, 38.2-3407.9:01, and 38.2-3407.9:02,\nsubsection E of &#xA7; 38.2-3407.10, &#xA7;&#xA7; 38.2-3407.10:1, 38.2-3407.11,\n38.2-3407.11:3, 38.2-3407.13, 38.2-3407.13:1, 38.2-3407.14, 38.2-3411.2,\n38.2-3418.1, 38.2-3418.2, 38.2-3418.16, 38.2-3419.1, 38.2-3430.1 through\n38.2-3437, and 38.2-3500, subdivision 13 of &#xA7; 38.2-3503, subdivision 8 of\n&#xA7; 38.2-3504, &#xA7;&#xA7; 38.2-3514.1, 38.2-3514.2, 38.2-3522.1 through\n38.2-3523.4, 38.2-3525, 38.2-3540.1, 38.2-3540.2, 38.2-3541.2, 38.2-3542, and\n38.2-3543.2, Chapter 52 (&#xA7; 38.2-5200 et seq.), Chapter 55 (&#xA7; 38.2-5500\net seq.), Chapter 58 (&#xA7; 38.2-5800 et seq.), Chapter 65 (&#xA7; 38.2-6500 et\nseq.), and Chapter 66 (&#xA7; 38.2-6600 et seq.) shall be applicable to any\nhealth maintenance organization granted a license under this chapter. This\nchapter shall not apply to an insurer or health services plan licensed and\nregulated in conformance with the insurance laws or Chapter 42 (&#xA7; 38.2-4200\net seq.) except with respect to the activities of its health maintenance\norganization.\n\nC. Solicitation of enrollees by a licensed health maintenance organization or by\nits representatives shall not be construed to violate any provisions of law\nrelating to solicitation or advertising by health professionals.\n\nD. A licensed health maintenance organization shall not be deemed to be engaged\nin the unlawful practice of medicine. All health care providers associated with\na health maintenance organization shall be subject to all provisions of law.\n\nE. Notwithstanding the definition of an eligible employee as set forth in &#xA7;\n38.2-3431, a health maintenance organization providing health care plans\npursuant to &#xA7; 38.2-3431 shall not be required to offer coverage to or\naccept applications from an employee who does not reside within the health\nmaintenance organization&#8217;s service area.\n\nF.
