A person shall not knowingly or intentionally interfere with the enforcement of the provisions of this chapter or Article 6.1 (&#xA7; 38.2-1865.1 et seq.) of Chapter 18 of this title or investigations of suspected or actual violations of this chapter or Article 6.1 (&#xA7; 38.2-1865.1 et seq.) of Chapter 18 of this title. A person in the business of viatical settlements shall not knowingly or intentionally permit any person convicted of a felony involving dishonesty or breach of trust to participate in the business of viatical settlements.B\n\nViatical settlement contracts and applications for viatical settlements, regardless of the form of transmission, shall contain the following statement or a substantially similar statement: &#8220;Any person who knowingly presents false information in an application for insurance or viatical settlement contract may be guilty of a crime and subject to prosecution.&#8221; The lack of the required statement does not constitute a defense in any prosecution for a fraudulent viatical settlement act.C\n\nAny person engaged in the business of viatical settlements having knowledge or a reasonable belief that a fraudulent viatical settlement act is being, will be, or has been committed shall provide to the Commission the information required by, and in a manner prescribed by, the Commission. Any other person having knowledge or a reasonable belief that a fraudulent viatical settlement act is being, will be, or has been committed may provide to the Commission the information required by, and in a manner prescribed by, the Commission.D\n\nThis chapter shall not:1\n\nPreempt the authority or relieve the duty of other law enforcement or regulatory agencies to investigate, examine, and prosecute suspected violations of law;2\n\nPrevent or prohibit a person from disclosing voluntarily information concerning viatical settlement fraud to a law enforcement or regulatory agency other than the insurance department; or3\n\nLimit the powers granted elsewhere by the laws of this Commonwealth to the Commission or an insurance fraud unit to investigate and examine possible violations of law and to take appropriate action against wrongdoers.E\n\n1. A viatical settlement provider shall within 60 days of licensure and annually thereafter by March 1 of each year certify to the Commission implementation of anti-fraud initiatives reasonably calculated to detect, prosecute, and prevent fraudulent viatical settlement acts.2\n\nA viatical settlement broker shall within 60 days of licensure affirm to the Commission implementation of fraud initiatives reasonably calculated to detect, prosecute, and prevent fraudulent viatical settlement acts. Upon renewal of such license, a viatical settlement broker shall affirm to the Commission that such fraud initiatives remain in place. A viatical settlement broker shall make its anti-fraud plan available to the Commission upon request.3\n\nAnti-fraud initiatives shall include:\n\t\t\t\ta. Fraud investigators, who may be viatical settlement providers or viatical settlement broker employees or independent contractors; and\n\t\t\t\tb. An anti-fraud plan that includes all of the following:1\n\nA description of the procedures for detecting and investigating possible fraudulent viatical settlement acts and procedures for resolving material inconsistencies between medical records and insurance applications;2\n\nA description of the procedures for reporting possible fraudulent viatical settlement acts to the Commission;3\n\nA description of the plan for anti-fraud education and training of underwriters and other personnel; and4\n\nA description or chart outlining the organizational arrangement of the anti-fraud personnel who are responsible for the investigation and reporting of possible fraudulent viatical settlement acts and investigating unresolved material inconsistencies between medical records and insurance applications.F\n\nAnti-fraud plans submitted to or obtained by the Commission and in the control or possession of the Commission shall be privileged and confidential, shall not be subject to inspection or review by the general public, shall not be subject to subpoena, and shall not be subject to discovery or admissible in evidence in any private civil or criminal action. A <span class=\"dictionary\">viatical settlement broker<\/span> shall make its anti-<span class=\"dictionary\">fraud<\/span> plan available to the <span class=\"dictionary\">Commission<\/span> upon request. <a id=\"paragraph-302484\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-6011\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Anti-<span class=\"dictionary\">fraud<\/span> initiatives shall include:\n\t\t\t\ta. <span class=\"dictionary\">Fraud<\/span> investigators, who may be <span class=\"dictionary\">viatical settlement providers<\/span> or <span class=\"dictionary\">viatical settlement broker<\/span> employees or independent contractors; and\n\t\t\t\tb. An anti-<span class=\"dictionary\">fraud<\/span> plan that includes all of the following: <a id=\"paragraph-302485\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-6011\/#E3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E31\" class=\"indent-2\"><p><span class=\"prefix-number\">1.<\/span> A description of the procedures for detecting and investigating possible fraudulent viatical settlement acts and procedures for resolving <span class=\"dictionary\">material<\/span> inconsistencies between medical records and <span class=\"dictionary\">insurance<\/span> applications; <a id=\"paragraph-302486\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-6011\/#E31\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E32\" class=\"indent-2\"><p><span class=\"prefix-number\">2.<\/span> A description of the procedures for reporting possible fraudulent viatical settlement acts to the <span class=\"dictionary\">Commission<\/span>; <a id=\"paragraph-302487\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-6011\/#E32\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E33\" class=\"indent-2\"><p><span class=\"prefix-number\">3.<\/span> A description of the plan for anti-<span class=\"dictionary\">fraud<\/span> education and training of underwriters and other personnel; and <a id=\"paragraph-302488\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-6011\/#E33\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E34\" class=\"indent-2\"><p><span class=\"prefix-number\">4.<\/span> A description or chart outlining the organizational arrangement of the anti-<span class=\"dictionary\">fraud<\/span> personnel who are responsible for the investigation and reporting of possible fraudulent viatical settlement acts and investigating unresolved <span class=\"dictionary\">material<\/span> inconsistencies between medical records and <span class=\"dictionary\">insurance<\/span> applications. <a id=\"paragraph-302489\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-6011\/#E34\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Anti-<span class=\"dictionary\">fraud<\/span> plans submitted to or obtained by the <span class=\"dictionary\">Commission<\/span> and in the control or <span class=\"dictionary\">possession<\/span> of the <span class=\"dictionary\">Commission<\/span> shall be privileged and confidential, shall not be subject to inspection or review by the general public, shall not be subject to <span class=\"dictionary\">subpoena<\/span>, and shall not be subject to <span class=\"dictionary\">discovery<\/span> or <span class=\"dictionary\">admissible<\/span> in <span class=\"dictionary\">evidence<\/span> in any private civil or criminal action. However, the <span class=\"dictionary\">Commission<\/span> is authorized to use the anti-<span class=\"dictionary\">fraud<\/span> plans in the furtherance of any regulatory or legal action brought as a part of the <span class=\"dictionary\">Commission<\/span>&#8217;s duties. <a id=\"paragraph-302490\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/38.2-6011\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nFRAUD PREVENTION AND CONTROL (\u00a7 38.2-6011)\n\nA. A person shall not commit a fraudulent viatical settlement act. A person\nshall not knowingly or intentionally interfere with the enforcement of the\nprovisions of this chapter or Article 6.1 (&#xA7; 38.2-1865.1 et seq.) of\nChapter 18 of this title or investigations of suspected or actual violations of\nthis chapter or Article 6.1 (&#xA7; 38.2-1865.1 et seq.) of Chapter 18 of this\ntitle. A person in the business of viatical settlements shall not knowingly or\nintentionally permit any person convicted of a felony involving dishonesty or\nbreach of trust to participate in the business of viatical settlements.\n\nB. Viatical settlement contracts and applications for viatical settlements,\nregardless of the form of transmission, shall contain the following statement or\na substantially similar statement: &#8220;Any person who knowingly presents\nfalse information in an application for insurance or viatical settlement\ncontract may be guilty of a crime and subject to prosecution.&#8221; The lack of\nthe required statement does not constitute a defense in any prosecution for a\nfraudulent viatical settlement act.\n\nC. Any person engaged in the business of viatical settlements having knowledge\nor a reasonable belief that a fraudulent viatical settlement act is being, will\nbe, or has been committed shall provide to the Commission the information\nrequired by, and in a manner prescribed by, the Commission. Any other person\nhaving knowledge or a reasonable belief that a fraudulent viatical settlement\nact is being, will be, or has been committed may provide to the Commission the\ninformation required by, and in a manner prescribed by, the Commission.\n\nD. This chapter shall not:\n\n   1. Preempt the authority or relieve the duty of other law enforcement or\n   regulatory agencies to investigate, examine, and prosecute suspected\n   violations of law;\n\n   2. Prevent or prohibit a person from disclosing voluntarily information\n   concerning viatical settlement fraud to a law enforcement or regulatory agency\n   other than the insurance department; or\n\n   3. Limit the powers granted elsewhere by the laws of this Commonwealth to the\n   Commission or an insurance fraud unit to investigate and examine possible\n   violations of law and to take appropriate action against wrongdoers.\n\nE. 1. A viatical settlement provider shall within 60 days of licensure and\nannually thereafter by March 1 of each year certify to the Commission\nimplementation of anti-fraud initiatives reasonably calculated to detect,\nprosecute, and prevent fraudulent viatical settlement acts.\n\n   2. A viatical settlement broker shall within 60 days of licensure affirm to\n   the Commission implementation of fraud initiatives reasonably calculated to\n   detect, prosecute, and prevent fraudulent viatical settlement acts. Upon\n   renewal of such license, a viatical settlement broker shall affirm to the\n   Commission that such fraud initiatives remain in place. A viatical settlement\n   broker shall make its anti-fraud plan available to the Commission upon\n   request.\n\n   3. Anti-fraud initiatives shall include:\n   \t\t\t\ta. Fraud investigators, who may be viatical settlement providers or\n   viatical settlement broker employees or independent contractors; and\n   \t\t\t\tb. An anti-fraud plan that includes all of the following:\n\n      1. A description of the procedures for detecting and investigating possible\n      fraudulent viatical settlement acts and procedures for resolving material\n      inconsistencies between medical records and insurance applications;\n\n      2. A description of the procedures for reporting possible fraudulent\n      viatical settlement acts to the Commission;\n\n      3. A description of the plan for anti-fraud education and training of\n      underwriters and other personnel; and\n\n      4. A description or chart outlining the organizational arrangement of the\n      anti-fraud personnel who are responsible for the investigation and reporting\n      of possible fraudulent viatical settlement acts and investigating unresolved\n      material inconsistencies between medical records and insurance applications.\n\nF. Anti-fraud plans submitted to or obtained by the Commission and in the\ncontrol or possession of the Commission shall be privileged and confidential,\nshall not be subject to inspection or review by the general public, shall not be\nsubject to subpoena, and shall not be subject to discovery or admissible in\nevidence in any private civil or criminal action.
