The Virginia Alcoholic Beverage Control <span class=\"dictionary\">Authority<\/span> shall be deemed successor in interest to the Department of Alcoholic Beverage Control and the Alcoholic Beverage Control <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-200490\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-101\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Nothing contained in this subtitle shall be construed as a restriction or limitation upon any powers that the <span class=\"dictionary\">Board<\/span> of Directors of the <span class=\"dictionary\">Authority<\/span> might otherwise have under any other <span class=\"dictionary\">law<\/span> of the Commonwealth. <a id=\"paragraph-200491\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-101\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nVIRGINIA ALCOHOLIC BEVERAGE CONTROL AUTHORITY CREATED; PUBLIC PURPOSE (\u00a7\n4.1-101)\n\nA. The General Assembly has determined that there exists in the Commonwealth a\nneed to control the possession, sale, transportation, distribution, and delivery\nof alcoholic beverages in the Commonwealth. Further, the General Assembly\ndetermines that the creation of an authority for this purpose is in the public\ninterest, serves a public purpose, and will promote the health, safety, welfare,\nconvenience, and prosperity of the people of the Commonwealth. To achieve this\nobjective, there is hereby created an independent political subdivision of the\nCommonwealth, exclusive of the legislative, executive, or judicial branches of\nstate government, to be known as the Virginia Alcoholic Beverage Control\nAuthority. The Authority&#8217;s exercise of powers and duties conferred by this\nsubtitle shall be deemed the performance of an essential governmental function\nand a matter of public necessity for which public moneys may be spent. The Board\nof Directors of the Authority is vested with control of the possession, sale,\ntransportation, distribution, and delivery of alcoholic beverages in the\nCommonwealth, with plenary power to prescribe and enforce regulations and\nconditions under which alcoholic beverages are possessed, sold, transported,\ndistributed, and delivered, so as to prevent any corrupt, incompetent,\ndishonest, or unprincipled practices and to promote the health, safety, welfare,\nconvenience, and prosperity of the people of the Commonwealth. The exercise of\nthe powers granted by this subtitle shall be in all respects for the benefit of\nthe citizens of the Commonwealth and for the promotion of their safety, health,\nwelfare, and convenience. No part of the assets or net earnings of the Authority\nshall inure to the benefit of, or be distributable to, any private individual,\nexcept that reasonable compensation may be paid for services rendered to or for\nthe Authority affecting one or more of its purposes, and benefits may be\nconferred that are in conformity with said purposes, and no private individual\nshall be entitled to share in the distribution of any of the corporate assets on\ndissolution of the Authority.\n\nB. The Virginia Alcoholic Beverage Control Authority shall consist of the\nVirginia Alcoholic Beverage Control Board of Directors, the Chief Executive\nOfficer, and the agents and employees of the Authority.
