Legal services for the Authority shall be provided by the Attorney General in accordance with Chapter 5 (&#xA7; 2.2-500 et seq.) of Title 2.2;6\n\nReceive and accept from any federal or private agency, foundation, corporation, association, or person grants or other aid to be expended in accomplishing the objectives of the Authority, and receive and accept from the Commonwealth or any state and any municipality, county, or other political subdivision thereof or from any other source aid or contributions of either money, property, or other things of value, to be held, used, and applied only for the purposes for which such grants and contributions may be made. All federal moneys accepted under this section shall be accepted and expended by the Authority upon such terms and conditions as are prescribed by the United States and as are consistent with state law, and all state moneys accepted under this section shall be expended by the Authority upon such terms and conditions as are prescribed by the Commonwealth;7\n\nAdopt, alter, and repeal bylaws, rules, and regulations governing the manner in which its business shall be transacted and the manner in which the powers of the Authority shall be exercised and its duties performed. The Board may delegate or assign any duty or task to be performed by the Authority to any officer or employee of the Authority. The Board shall remain responsible for the performance of any such duties or tasks. Any delegation pursuant to this subdivision shall, where appropriate, be accompanied by written guidelines for the exercise of the duties or tasks delegated. Where appropriate, the guidelines shall require that the Board receive summaries of actions taken. Such delegation or assignment shall not relieve the Board of the responsibility to ensure faithful performance of the duties and tasks;8\n\nConduct or engage in any lawful business, activity, effort, or project consistent with the Authority&#8217;s purposes or necessary or convenient to exercise its powers;9\n\nDevelop policies and procedures generally applicable to the procurement of goods, services, and construction, based upon competitive principles;10\n\nDevelop policies and procedures consistent with Article 4 (&#xA7; 2.2-4347 et seq.) of Chapter 43 of Title 2.2;11\n\nBuy, import and sell alcoholic beverages other than beer and wine not produced by farm wineries, and to have alcoholic beverages other than beer and wine not produced by farm wineries in its possession for sale;12\n\nBuy and sell any mixers;13\n\nBuy and sell products licensed by the Virginia Tourism Corporation that are within international trademark classes 16 (paper goods and printer matters), 18 (leather goods), 21 (housewares and glass), and 25 (clothing);14\n\nControl the possession, sale, transportation, and delivery of alcoholic beverages;15\n\nDetermine, subject to &#xA7; 4.1-121, the localities within which government stores shall be established or operated and the location of such stores;16\n\nMaintain warehouses for alcoholic beverages and control the storage and delivery of alcoholic beverages to and from such warehouses;17\n\nAcquire, purchase, hold, use, lease, or otherwise dispose of any property, real, personal or mixed, tangible or intangible, or any interest therein necessary or desirable for carrying out the purposes of the Authority; lease as lessee any property, real, personal or mixed, tangible or intangible, or any interest therein, at such annual rental and on such terms and conditions as may be determined by the Board; lease as lessor to any person any property, real, personal or mixed, tangible or intangible, or any interest therein, at any time acquired by the Authority, whether wholly or partially completed, at such annual rental and on such terms and conditions as may be determined by the Board; sell, transfer, or convey any property, real, personal or mixed, tangible or intangible, or any interest therein, at any time acquired or held by the Authority on such terms and conditions as may be determined by the Board; and occupy and improve any land or building required for the purposes of this subtitle;18\n\nPurchase, lease, or acquire the use of, by any manner, any plant or equipment that may be considered necessary or useful in carrying into effect the purposes of this subtitle, including rectifying, blending, and processing plants. The Board may purchase, build, lease, and operate distilleries and manufacture alcoholic beverages;19\n\nDetermine the nature, form and capacity of all containers used for holding alcoholic beverages to be kept or sold under this subtitle, and prescribe the form and content of all labels and seals to be placed thereon; however, no container sold in or shipped into the Commonwealth shall include powdered or crystalline alcohol;20\n\nAppoint every agent and employee required for its operations; require any or all of them to give bonds payable to the Commonwealth in such penalty as shall be fixed by the Board; and engage the services of experts and professionals;21\n\nHold and conduct hearings; issue subpoenas requiring the attendance of witnesses and the production of records, memoranda, papers and other documents before the Board or any agent of the Board; and administer oaths and take testimony thereunder. The Board may authorize any Board member or agent of the Board to hold and conduct hearings, issue subpoenas, administer oaths and take testimony thereunder, and decide cases, subject to final decision by the Board, on application of any party aggrieved. The Board may enter into consent agreements and may request and accept from any applicant or licensee a consent agreement in lieu of proceedings on (i) objections to the issuance of a license or (ii) disciplinary action. Any such consent agreement shall include findings of fact and may include an admission or a finding of a violation. All federal moneys accepted under this section shall be accepted and expended by the <span class=\"dictionary\">Authority<\/span> upon such terms and conditions as are prescribed by the United States and as are consistent with state <span class=\"dictionary\">law<\/span>, and all state moneys accepted under this section shall be expended by the <span class=\"dictionary\">Authority<\/span> upon such terms and conditions as are prescribed by the Commonwealth; <a id=\"paragraph-245949\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> Adopt, alter, and repeal bylaws, rules, and regulations governing the manner in which its business shall be transacted and the manner in which the powers of the <span class=\"dictionary\">Authority<\/span> shall be exercised and its duties performed. The <span class=\"dictionary\">Board<\/span> may delegate or assign any duty or task to be performed by the <span class=\"dictionary\">Authority<\/span> to any officer or employee of the <span class=\"dictionary\">Authority<\/span>. The <span class=\"dictionary\">Board<\/span> shall remain responsible for the performance of any such duties or tasks. Any delegation pursuant to this subdivision shall, where appropriate, be accompanied by written guidelines for the exercise of the duties or tasks delegated. Where appropriate, the guidelines shall require that the <span class=\"dictionary\">Board<\/span> receive summaries of actions taken. <a id=\"paragraph-245955\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"13\"><p><span class=\"prefix-number\">13.<\/span> Buy and <span class=\"dictionary\">sell<\/span> products <span class=\"dictionary\">licensed<\/span> by the Virginia Tourism Corporation that are within international trademark classes 16 (paper goods and printer matters), 18 (leather goods), 21 (housewares and glass), and 25 (clothing); <a id=\"paragraph-245956\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"14\"><p><span class=\"prefix-number\">14.<\/span> Control the <span class=\"dictionary\">possession<\/span>, <span class=\"dictionary\">sale<\/span>, transportation, and delivery of <span class=\"dictionary\">alcoholic beverages<\/span>; <a id=\"paragraph-245957\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"15\"><p><span class=\"prefix-number\">15.<\/span> Determine, subject to &#xA7; <a class=\"law\" title=\"Referendum on establishment of government stores\" href=\"\/4.1-121\/\">4.1-121<\/a>, the localities within which <span class=\"dictionary\">government stores<\/span> shall be established or operated and the location of such stores; <a id=\"paragraph-245958\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"16\"><p><span class=\"prefix-number\">16.<\/span> Maintain warehouses for <span class=\"dictionary\">alcoholic beverages<\/span> and control the storage and delivery of <span class=\"dictionary\">alcoholic beverages<\/span> to and from such warehouses; <a id=\"paragraph-245959\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"17\"><p><span class=\"prefix-number\">17.<\/span> Acquire, purchase, hold, use, lease, or otherwise dispose of any property, real, personal or mixed, tangible or intangible, or any interest therein necessary or desirable for carrying out the purposes of the <span class=\"dictionary\">Authority<\/span>; lease as lessee any property, real, personal or mixed, tangible or intangible, or any interest therein, at such annual rental and on such terms and conditions as may be determined by the <span class=\"dictionary\">Board<\/span>; lease as lessor to any person any property, real, personal or mixed, tangible or intangible, or any interest therein, at any time acquired by the <span class=\"dictionary\">Authority<\/span>, whether wholly or partially completed, at such annual rental and on such terms and conditions as may be determined by the <span class=\"dictionary\">Board<\/span>; <span class=\"dictionary\">sell<\/span>, transfer, or convey any property, real, personal or mixed, tangible or intangible, or any interest therein, at any time acquired or held by the <span class=\"dictionary\">Authority<\/span> on such terms and conditions as may be determined by the <span class=\"dictionary\">Board<\/span>; and occupy and improve any land or building required for the purposes of this subtitle; <a id=\"paragraph-245960\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"18\"><p><span class=\"prefix-number\">18.<\/span> Purchase, lease, or acquire the use of, by any manner, any plant or equipment that may be considered necessary or useful in carrying into effect the purposes of this subtitle, including rectifying, blending, and processing plants. The <span class=\"dictionary\">Board<\/span> may purchase, build, lease, and operate distilleries and manufacture <span class=\"dictionary\">alcoholic beverages<\/span>; <a id=\"paragraph-245961\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#18\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"19\"><p><span class=\"prefix-number\">19.<\/span> Determine the nature, form and capacity of all <span class=\"dictionary\">containers<\/span> used for holding <span class=\"dictionary\">alcoholic beverages<\/span> to be kept or sold under this subtitle, and prescribe the form and content of all labels and seals to be placed thereon; however, no <span class=\"dictionary\">container<\/span> sold in or shipped into the Commonwealth shall include powdered or crystalline <span class=\"dictionary\">alcohol<\/span>; <a id=\"paragraph-245962\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#19\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"20\"><p><span class=\"prefix-number\">20.<\/span> Appoint every agent and employee required for its operations; require any or all of them to give <span class=\"dictionary\">bonds<\/span> payable to the Commonwealth in such <span class=\"dictionary\">penalty<\/span> as shall be fixed by the <span class=\"dictionary\">Board<\/span>; and engage the services of experts and professionals; <a id=\"paragraph-245963\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#20\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"21\"><p><span class=\"prefix-number\">21.<\/span> Hold and conduct <span class=\"dictionary\">hearings<\/span>; <span class=\"dictionary\">issue<\/span> <span class=\"dictionary\">subpoenas<\/span> requiring the attendance of witnesses and the production of records, memoranda, papers and other documents before the <span class=\"dictionary\">Board<\/span> or any agent of the <span class=\"dictionary\">Board<\/span>; and administer <span class=\"dictionary\">oaths<\/span> and take <span class=\"dictionary\">testimony<\/span> thereunder. The <span class=\"dictionary\">Board<\/span> may authorize any <span class=\"dictionary\">Board<\/span> member or agent of the <span class=\"dictionary\">Board<\/span> to hold and conduct <span class=\"dictionary\">hearings<\/span>, <span class=\"dictionary\">issue<\/span> <span class=\"dictionary\">subpoenas<\/span>, administer <span class=\"dictionary\">oaths<\/span> and take <span class=\"dictionary\">testimony<\/span> thereunder, and decide cases, subject to final decision by the <span class=\"dictionary\">Board<\/span>, on application of any <span class=\"dictionary\">party<\/span> aggrieved. The <span class=\"dictionary\">Board<\/span> may enter into consent agreements and may request and accept from any applicant or <span class=\"dictionary\">licensee<\/span> a consent agreement in lieu of proceedings on (i) objections to the issuance of a license or (ii) disciplinary action. Any such consent agreement shall include <span class=\"dictionary\">findings<\/span> of <span class=\"dictionary\">fact<\/span> and may include an admission or a <span class=\"dictionary\">finding<\/span> of a violation. A consent agreement shall not be considered a case decision of the <span class=\"dictionary\">Board<\/span> and shall not be subject to judicial review under the provisions of the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.), but may be considered by the <span class=\"dictionary\">Board<\/span> in future disciplinary proceedings; <a id=\"paragraph-245964\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#21\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"22\"><p><span class=\"prefix-number\">22.<\/span> Make a reasonable charge for preparing and furnishing statistical information and compilations to persons other than (i) officials, including <span class=\"dictionary\">court<\/span> and police officials, of the Commonwealth and of its subdivisions if the information requested is for official use and (ii) persons who have a personal or legal interest in obtaining the information requested if such information is not to be used for commercial or trade purposes; <a id=\"paragraph-245965\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#22\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"23\"><p><span class=\"prefix-number\">23.<\/span> Promulgate regulations in accordance with the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.) and &#xA7; <a class=\"law\" title=\"Regulations of Board\" href=\"\/4.1-111\/\">4.1-111<\/a>; <a id=\"paragraph-245966\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#23\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"24\"><p><span class=\"prefix-number\">24.<\/span> Grant, suspend, and revoke licenses for the manufacture, bottling, distribution, importation, and <span class=\"dictionary\">sale<\/span> of <span class=\"dictionary\">alcoholic beverages<\/span>; <a id=\"paragraph-245967\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#24\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"25\"><p><span class=\"prefix-number\">25.<\/span> Assess and collect civil penalties and civil charges for violations of this subtitle and <span class=\"dictionary\">Board<\/span> regulations; <a id=\"paragraph-245968\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#25\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"26\"><p><span class=\"prefix-number\">26.<\/span> Maintain actions to enjoin common nuisances as defined in &#xA7; <a class=\"law\" title=\"Maintaining common nuisances; penalties\" href=\"\/4.1-317\/\">4.1-317<\/a>; <a id=\"paragraph-245969\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#26\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"27\"><p><span class=\"prefix-number\">27.<\/span> Establish minimum food <span class=\"dictionary\">sale<\/span> requirements for all retail <span class=\"dictionary\">licensees<\/span>; <a id=\"paragraph-245970\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#27\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"28\"><p><span class=\"prefix-number\">28.<\/span> Review and approve any proposed legislative or regulatory changes suggested by the Chief Executive Officer as the <span class=\"dictionary\">Board<\/span> deems appropriate; <a id=\"paragraph-245971\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#28\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"29\"><p><span class=\"prefix-number\">29.<\/span> Report quarterly to the Secretary of Public Safety and Homeland Security on the <span class=\"dictionary\">law<\/span>-enforcement activities undertaken to enforce the provisions of this subtitle; <a id=\"paragraph-245972\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#29\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"30\"><p><span class=\"prefix-number\">30.<\/span> Establish and collect fees for all permits set forth in this subtitle, including fees associated with applications for such permits; <a id=\"paragraph-245973\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#30\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"31\"><p><span class=\"prefix-number\">31.<\/span> Impose a requirement that a <span class=\"dictionary\">mixed beverage<\/span> casino <span class=\"dictionary\">licensee<\/span> pursuant to subdivision A 14 of &#xA7; <a class=\"law\" title=\"Retail licenses\" href=\"\/4.1-206.3\/\">4.1-206.3<\/a> pay for any cost incurred by the <span class=\"dictionary\">Board<\/span> to enforce such license in excess of the applicable state license fee; and <a id=\"paragraph-245974\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#31\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"32\"><p><span class=\"prefix-number\">32.<\/span> Do all acts necessary or advisable to carry out the purposes of this subtitle. <a id=\"paragraph-245975\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-103\/#32\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nGENERAL POWERS OF BOARD (\u00a7 4.1-103)\n\nThe Board shall have the power to:\n\n1. Sue and be sued, implead and be impleaded, and complain and defend in all\ncourts;\n\n2. Adopt, use, and alter at will a common seal;\n\n3. Fix, alter, charge, and collect rates, rentals, fees, and other charges for\nthe use of property of, the sale of products of, or services rendered by the\nAuthority at rates to be determined by the Authority for the purpose of\nproviding for the payment of the expenses of the Authority;\n\n4. Make and enter into all contracts and agreements necessary or incidental to\nthe performance of its duties, the furtherance of its purposes, and the\nexecution of its powers under this subtitle, including agreements with any\nperson or federal agency;\n\n5. Employ, at its discretion, consultants, researchers, architects, engineers,\naccountants, financial experts, investment bankers, superintendents, managers,\nand such other employees and special agents as may be necessary and fix their\ncompensation to be payable from funds made available to the Authority. Legal\nservices for the Authority shall be provided by the Attorney General in\naccordance with Chapter 5 (&#xA7; 2.2-500 et seq.) of Title 2.2;\n\n6. Receive and accept from any federal or private agency, foundation,\ncorporation, association, or person grants or other aid to be expended in\naccomplishing the objectives of the Authority, and receive and accept from the\nCommonwealth or any state and any municipality, county, or other political\nsubdivision thereof or from any other source aid or contributions of either\nmoney, property, or other things of value, to be held, used, and applied only\nfor the purposes for which such grants and contributions may be made. All\nfederal moneys accepted under this section shall be accepted and expended by the\nAuthority upon such terms and conditions as are prescribed by the United States\nand as are consistent with state law, and all state moneys accepted under this\nsection shall be expended by the Authority upon such terms and conditions as are\nprescribed by the Commonwealth;\n\n7. Adopt, alter, and repeal bylaws, rules, and regulations governing the manner\nin which its business shall be transacted and the manner in which the powers of\nthe Authority shall be exercised and its duties performed. The Board may\ndelegate or assign any duty or task to be performed by the Authority to any\nofficer or employee of the Authority. The Board shall remain responsible for the\nperformance of any such duties or tasks. Any delegation pursuant to this\nsubdivision shall, where appropriate, be accompanied by written guidelines for\nthe exercise of the duties or tasks delegated. Where appropriate, the guidelines\nshall require that the Board receive summaries of actions taken. Such delegation\nor assignment shall not relieve the Board of the responsibility to ensure\nfaithful performance of the duties and tasks;\n\n8. Conduct or engage in any lawful business, activity, effort, or project\nconsistent with the Authority&#8217;s purposes or necessary or convenient to\nexercise its powers;\n\n9. Develop policies and procedures generally applicable to the procurement of\ngoods, services, and construction, based upon competitive principles;\n\n10. Develop policies and procedures consistent with Article 4 (&#xA7; 2.2-4347\net seq.) of Chapter 43 of Title 2.2;\n\n11. Buy, import and sell alcoholic beverages other than beer and wine not\nproduced by farm wineries, and to have alcoholic beverages other than beer and\nwine not produced by farm wineries in its possession for sale;\n\n12. Buy and sell any mixers;\n\n13. Buy and sell products licensed by the Virginia Tourism Corporation that are\nwithin international trademark classes 16 (paper goods and printer matters), 18\n(leather goods), 21 (housewares and glass), and 25 (clothing);\n\n14. Control the possession, sale, transportation, and delivery of alcoholic\nbeverages;\n\n15. Determine, subject to &#xA7; 4.1-121, the localities within which government\nstores shall be established or operated and the location of such stores;\n\n16. Maintain warehouses for alcoholic beverages and control the storage and\ndelivery of alcoholic beverages to and from such warehouses;\n\n17. Acquire, purchase, hold, use, lease, or otherwise dispose of any property,\nreal, personal or mixed, tangible or intangible, or any interest therein\nnecessary or desirable for carrying out the purposes of the Authority; lease as\nlessee any property, real, personal or mixed, tangible or intangible, or any\ninterest therein, at such annual rental and on such terms and conditions as may\nbe determined by the Board; lease as lessor to any person any property, real,\npersonal or mixed, tangible or intangible, or any interest therein, at any time\nacquired by the Authority, whether wholly or partially completed, at such annual\nrental and on such terms and conditions as may be determined by the Board; sell,\ntransfer, or convey any property, real, personal or mixed, tangible or\nintangible, or any interest therein, at any time acquired or held by the\nAuthority on such terms and conditions as may be determined by the Board; and\noccupy and improve any land or building required for the purposes of this\nsubtitle;\n\n18. Purchase, lease, or acquire the use of, by any manner, any plant or\nequipment that may be considered necessary or useful in carrying into effect the\npurposes of this subtitle, including rectifying, blending, and processing\nplants. Determine the nature, form and capacity of all containers used for holding\nalcoholic beverages to be kept or sold under this subtitle, and prescribe the\nform and content of all labels and seals to be placed thereon; however, no\ncontainer sold in or shipped into the Commonwealth shall include powdered or\ncrystalline alcohol;\n\n20. Appoint every agent and employee required for its operations; require any or\nall of them to give bonds payable to the Commonwealth in such penalty as shall\nbe fixed by the Board; and engage the services of experts and professionals;\n\n21. Hold and conduct hearings; issue subpoenas requiring the attendance of\nwitnesses and the production of records, memoranda, papers and other documents\nbefore the Board or any agent of the Board; and administer oaths and take\ntestimony thereunder. The Board may authorize any Board member or agent of the\nBoard to hold and conduct hearings, issue subpoenas, administer oaths and take\ntestimony thereunder, and decide cases, subject to final decision by the Board,\non application of any party aggrieved. The Board may enter into consent\nagreements and may request and accept from any applicant or licensee a consent\nagreement in lieu of proceedings on (i) objections to the issuance of a license\nor (ii) disciplinary action. Impose a requirement that a mixed beverage casino licensee pursuant to\nsubdivision A 14 of &#xA7; 4.1-206.3 pay for any cost incurred by the Board to\nenforce such license in excess of the applicable state license fee; and\n\n32.
