This subsection shall not apply to common carriers of passengers by train, boat or airplane selling <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">beer<\/span> to bona fide passengers. <a id=\"paragraph-297526\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-122\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> If in any such <span class=\"dictionary\">referendum<\/span> held in any county, city, or town in which a majority of the qualified voters have previously voted to prohibit the <span class=\"dictionary\">sale<\/span> of <span class=\"dictionary\">alcoholic beverages<\/span> by the <span class=\"dictionary\">Board<\/span> and in a subsequent election a majority of the voters of the county, city, or town vote &#8220;No&#8221; on the question stated in &#xA7; <a class=\"law\" title=\"Referendum on establishment of government stores\" href=\"\/4.1-121\/\">4.1-121<\/a>, then such <span class=\"dictionary\">alcoholic beverages<\/span> may, in accordance with this subtitle, be sold within the county, city, or town on and after 60 days from the day on which the <span class=\"dictionary\">order<\/span> of the <span class=\"dictionary\">court<\/span> setting forth the results of such election is entered of record. <a id=\"paragraph-297527\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-122\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> If any <span class=\"dictionary\">referendum<\/span> is held under the provisions of &#xA7; <a class=\"law\" title=\"Referendum on the sale of mixed beverages\" href=\"\/4.1-124\/\">4.1-124<\/a> in any county, town, or supervisor&#8217;s election district of a county and the majority of voters voting in such <span class=\"dictionary\">referendum<\/span> voted &#8220;Yes,&#8221; the <span class=\"dictionary\">sale<\/span> by the <span class=\"dictionary\">Board<\/span> of <span class=\"dictionary\">alcoholic beverages<\/span>, other than <span class=\"dictionary\">beer<\/span> and <span class=\"dictionary\">wine<\/span> not produced by farm wineries, shall be prohibited in such county, town, or supervisor&#8217;s election district of a county. Notwithstanding this section and any <span class=\"dictionary\">referendum<\/span> held under &#xA7; <a class=\"law\" title=\"Referendum on establishment of government stores\" href=\"\/4.1-121\/\">4.1-121<\/a> to the contrary, persons <span class=\"dictionary\">licensed<\/span> to <span class=\"dictionary\">sell<\/span> <span class=\"dictionary\">mixed beverages<\/span> in such county, town, or supervisor&#8217;s election district of a county shall also be permitted to <span class=\"dictionary\">sell<\/span> <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">beer<\/span> for on-premises consumption, provided the appropriate license fees are paid for the <span class=\"dictionary\">privilege<\/span>. <a id=\"paragraph-297528\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-122\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The provisions of this section shall not prevent in any county, city, or town, the <span class=\"dictionary\">sale<\/span> and delivery or shipment of <span class=\"dictionary\">alcoholic beverages<\/span> specified in &#xA7; <a class=\"law\" title=\"Exemptions from licensure\" href=\"\/4.1-200\/\">4.1-200<\/a> to and by persons therein authorized to <span class=\"dictionary\">sell<\/span> <span class=\"dictionary\">alcoholic beverages<\/span>, nor prevent the delivery or shipment of <span class=\"dictionary\">alcoholic beverages<\/span> under <span class=\"dictionary\">Board<\/span> regulations into any county, city, or town, except as otherwise prohibited by this subtitle. <a id=\"paragraph-297529\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-122\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> For the purpose of this section, when any <span class=\"dictionary\">referendum<\/span> is held in any town, separate and apart from the county in which such town or a part thereof is located, such town shall be treated as being separate and apart from such county. <a id=\"paragraph-297530\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-122\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nEFFECT OF LOCAL OPTION REFERENDA (\u00a7 4.1-122)\n\nA. If in any referendum held under the provisions of &#xA7; 4.1-121 in any\ncounty, city, or town a majority of the qualified voters vote &#8220;Yes&#8221;\non the question, then on and after 60 days from the date on which the order of\nthe court, setting forth the results of such referendum was entered of record,\nnone of the alcoholic beverages voted against shall be sold in such county,\ncity, or town except for delivery or shipment to persons outside of such county,\ncity, or town authorized under this subtitle to acquire the alcoholic beverages\nfor resale. This subsection shall not apply to common carriers of passengers by\ntrain, boat or airplane selling wine and beer to bona fide passengers.\n\nB. If in any such referendum held in any county, city, or town in which a\nmajority of the qualified voters have previously voted to prohibit the sale of\nalcoholic beverages by the Board and in a subsequent election a majority of the\nvoters of the county, city, or town vote &#8220;No&#8221; on the question stated\nin &#xA7; 4.1-121, then such alcoholic beverages may, in accordance with this\nsubtitle, be sold within the county, city, or town on and after 60 days from the\nday on which the order of the court setting forth the results of such election\nis entered of record.\n\nC. If any referendum is held under the provisions of &#xA7; 4.1-124 in any\ncounty, town, or supervisor&#8217;s election district of a county and the\nmajority of voters voting in such referendum voted &#8220;Yes,&#8221; the sale\nby the Board of alcoholic beverages, other than beer and wine not produced by\nfarm wineries, shall be prohibited in such county, town, or supervisor&#8217;s\nelection district of a county. Notwithstanding this section and any referendum\nheld under &#xA7; 4.1-121 to the contrary, persons licensed to sell mixed\nbeverages in such county, town, or supervisor&#8217;s election district of a\ncounty shall also be permitted to sell wine and beer for on-premises\nconsumption, provided the appropriate license fees are paid for the privilege.\n\nD. The provisions of this section shall not prevent in any county, city, or\ntown, the sale and delivery or shipment of alcoholic beverages specified in\n&#xA7; 4.1-200 to and by persons therein authorized to sell alcoholic beverages,\nnor prevent the delivery or shipment of alcoholic beverages under Board\nregulations into any county, city, or town, except as otherwise prohibited by\nthis subtitle.\n\nE.
