I, cc. 281, 282; 2023, c. 731.","full_text":"The Board may grant the following manufacturer licenses:\n\n1\n\nDistiller&#8217;s licenses, which shall authorize the licensee to manufacture alcoholic beverages other than wine and beer, and to sell and deliver or ship the same, in accordance with Board regulations, in closed containers, to the Board and to persons outside the Commonwealth for resale outside the Commonwealth. When the Board has established a government store on the distiller&#8217;s licensed premises pursuant to subsection D of &#xA7; 4.1-119, such license shall also authorize the licensee to make a charge to consumers to participate in an organized tasting event conducted in accordance with subsection G of &#xA7; 4.1-119 and Board regulations.2\n\nLimited distiller&#8217;s licenses, to distilleries that (i) are located on a farm in the Commonwealth on land zoned agricultural and owned or leased by such distillery or its owner and (ii) use agricultural products that are grown on the farm in the manufacture of their alcoholic beverages. Limited distiller&#8217;s licensees shall be treated as distillers for all purposes of this title except as otherwise provided in this subdivision. For purposes of this subdivision, &#8220;land zoned agricultural&#8221; means (a) land zoned as an agricultural district or classification or (b) land otherwise permitted by a locality for limited distillery use. For purposes of this subdivision, &#8220;land zoned agricultural&#8221; does not include land zoned &#8220;residential conservation.&#8221; Except for the limitation on land zoned &#8220;residential conservation,&#8221; nothing in this definition shall otherwise limit or affect local zoning authority.3\n\nBrewery licenses, which shall authorize the licensee to manufacture beer and to sell and deliver or ship the beer so manufactured, in accordance with Board regulations, in closed containers to (i) persons licensed to sell the beer at wholesale and (ii) persons outside the Commonwealth for resale outside the Commonwealth. Such license shall also authorize the licensee to sell at retail at premises described in the brewery license (a) the brands of beer that the brewery owns for on-premises consumption, provided that not less than 20 percent of the volume of beer sold for on-premises consumption in any calendar year is manufactured on the licensed premises, and (b) beer in closed containers, which shall include growlers and other reusable containers, for off-premises consumption.4\n\nLimited brewery licenses, to breweries that manufacture no more than 15,000 barrels of beer per calendar year, provided that (i) the brewery is located on a farm in the Commonwealth on land zoned agricultural and owned or leased by such brewery or its owner and (ii) agricultural products, including barley, other grains, hops, or fruit, used by such brewery in the manufacture of its beer are grown on the farm. The licensed premises shall be limited to the portion of the farm on which agricultural products, including barley, other grains, hops, or fruit, used by such brewery in the manufacture of its beer are grown and that is contiguous to the premises of such brewery where the beer is manufactured, exclusive of any residence and the curtilage thereof. However, the Board may, with notice to the local governing body in accordance with the provisions of &#xA7; 4.1-230, also approve other portions of the farm to be included as part of the licensed premises. For purposes of this subdivision, &#8220;land zoned agricultural&#8221; means (a) land zoned as an agricultural district or classification or (b) land otherwise permitted by a locality for limited brewery use. For purposes of this subdivision, &#8220;land zoned agricultural&#8221; does not include land zoned &#8220;residential conservation.&#8221; Except for the limitation on land zoned &#8220;residential conservation,&#8221; nothing in this definition shall otherwise limit or affect local zoning authority.\n\t\t\tLimited brewery licensees shall be treated as breweries for all purposes of this title except as otherwise provided in this subdivision.5\n\nWinery licenses, which shall authorize the licensee to (i) manufacture wine and to sell and deliver or ship such wine, in accordance with Board regulations, in closed containers, to persons licensed to sell the wine so manufactured at wholesale for the purpose of resale, and to persons outside the Commonwealth for resale outside the Commonwealth; (ii) operate distilling equipment on the premises of the licensee in the manufacture of spirits from fruit or fruit juices only, which shall be used only for the fortification of wine produced by the licensee; (iii) operate a contract winemaking facility on the premises of the licensee in accordance with Board regulations; (iv) store wine in bonded warehouses on or off the licensed premises upon permit issued by the Board; and (v) sell wine at retail at the place of business designated in the winery license for on-premises consumption or in closed containers for off-premises consumption, provided that any brand of wine not owned by the winery licensee is purchased from a wholesale wine licensee and no less than 20 percent of the wine sold for on-premises consumption is manufactured on the licensed premises.6\n\nFarm winery licenses, which shall authorize the licensee to (i) manufacture wine containing 21 percent or less of alcohol by volume and to sell, deliver, or ship such wine, in accordance with Board regulations, in closed containers, to the Board, persons licensed to sell the wine so manufactured at wholesale for the purpose of resale, or persons outside the Commonwealth; (ii) acquire and receive deliveries and shipments of wine and sell and deliver or ship such wine, in accordance with Board regulations, to the Board, persons licensed to sell wine at wholesale for the purpose of resale, or persons outside the Commonwealth; (iii) operate a contract winemaking facility on the premises of the licensee in accordance with the provisions of this subtitle and Board regulations; (iv) enter into an agreement with a contract winemaking facility in accordance with the provisions of this subtitle and Board regulations; and (v) store wine in bonded warehouses located on or off the licensed premises upon permits issued by the Board. For the purposes of this title, a farm winery license shall be designated either as a Class I, Class II, Class III, or Class IV farm winery license in accordance with the limitations set forth in &#xA7; 4.1-219.\n\t\t\tSuch licenses shall also authorize the licensee to sell wine at retail for on-premises consumptions or in closed containers for off-premises consumption at the places of business designated in the licenses, which may include no more than five additional retail establishments of the licensee. The licensee may sell at these places of business wine manufactured by such licensee, wine manufactured by a contract winemaking facility with which the licensee has entered into an agreement pursuant to the provisions of this subtitle and Board regulations, and wine purchased from a wholesale wine licensee. When the <span class=\"dictionary\">Board<\/span> has established a <span class=\"dictionary\">government store<\/span> on the distiller&#8217;s <span class=\"dictionary\">licensed<\/span> premises pursuant to subsection D of &#xA7; <a class=\"law\" title=\"Operation of government stores\" href=\"\/4.1-119\/\">4.1-119<\/a>, such license shall also authorize the <span class=\"dictionary\">licensee<\/span> to make a charge to consumers to participate in an organized tasting event conducted in accordance with subsection G of &#xA7; <a class=\"law\" title=\"Operation of government stores\" href=\"\/4.1-119\/\">4.1-119<\/a> and <span class=\"dictionary\">Board<\/span> regulations. <a id=\"paragraph-306579\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> Limited distiller&#8217;s licenses, to distilleries that (i) are located on a farm in the Commonwealth on <span class=\"dictionary\">land zoned agricultural<\/span> and owned or leased by such distillery or its owner and (ii) use agricultural products that are grown on the farm in the manufacture of their <span class=\"dictionary\">alcoholic beverages<\/span>. Limited distiller&#8217;s <span class=\"dictionary\">licensees<\/span> shall be treated as distillers for all purposes of this title except as otherwise provided in this subdivision. For purposes of this subdivision, &#8220;<span class=\"dictionary\">land zoned agricultural<\/span>&#8221; means (a) land zoned as an agricultural district or classification or (b) land otherwise permitted by a locality for limited distillery use. For purposes of this subdivision, &#8220;<span class=\"dictionary\">land zoned agricultural<\/span>&#8221; does not include land zoned &#8220;residential conservation.&#8221; Except for the limitation on land zoned &#8220;residential conservation,&#8221; nothing in this definition shall otherwise limit or affect local zoning <span class=\"dictionary\">authority<\/span>. <a id=\"paragraph-306580\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> Brewery licenses, which shall authorize the <span class=\"dictionary\">licensee<\/span> to manufacture <span class=\"dictionary\">beer<\/span> and to <span class=\"dictionary\">sell<\/span> and deliver or ship the <span class=\"dictionary\">beer<\/span> so manufactured, in accordance with <span class=\"dictionary\">Board<\/span> regulations, in closed <span class=\"dictionary\">containers<\/span> to (i) persons <span class=\"dictionary\">licensed<\/span> to <span class=\"dictionary\">sell<\/span> the <span class=\"dictionary\">beer<\/span> at wholesale and (ii) persons outside the Commonwealth for resale outside the Commonwealth. Such license shall also authorize the <span class=\"dictionary\">licensee<\/span> to <span class=\"dictionary\">sell<\/span> at retail at premises described in the brewery license (a) the brands of <span class=\"dictionary\">beer<\/span> that the brewery owns for on-premises consumption, provided that not less than 20 percent of the volume of <span class=\"dictionary\">beer<\/span> sold for on-premises consumption in any calendar year is manufactured on the <span class=\"dictionary\">licensed<\/span> premises, and (b) <span class=\"dictionary\">beer<\/span> in closed <span class=\"dictionary\">containers<\/span>, which shall include growlers and other reusable <span class=\"dictionary\">containers<\/span>, for off-premises consumption. <a id=\"paragraph-306581\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> Limited brewery licenses, to breweries that manufacture no more than 15,000 <span class=\"dictionary\">barrels<\/span> of <span class=\"dictionary\">beer<\/span> per calendar year, provided that (i) the brewery is located on a farm in the Commonwealth on <span class=\"dictionary\">land zoned agricultural<\/span> and owned or leased by such brewery or its owner and (ii) agricultural products, including barley, other grains, hops, or fruit, used by such brewery in the manufacture of its <span class=\"dictionary\">beer<\/span> are grown on the farm. The <span class=\"dictionary\">licensed<\/span> premises shall be limited to the portion of the farm on which agricultural products, including barley, other grains, hops, or fruit, used by such brewery in the manufacture of its <span class=\"dictionary\">beer<\/span> are grown and that is contiguous to the premises of such brewery where the <span class=\"dictionary\">beer<\/span> is manufactured, exclusive of any <span class=\"dictionary\">residence<\/span> and the curtilage thereof. However, the <span class=\"dictionary\">Board<\/span> may, with notice to the local governing body in accordance with the provisions of &#xA7; <a class=\"law\" title=\"Applications for licenses; publication; notice to localities; fees; permits\" href=\"\/4.1-230\/\">4.1-230<\/a>, also approve other portions of the farm to be included as part of the <span class=\"dictionary\">licensed<\/span> premises. For purposes of this subdivision, &#8220;<span class=\"dictionary\">land zoned agricultural<\/span>&#8221; means (a) land zoned as an agricultural district or classification or (b) land otherwise permitted by a locality for limited brewery use. For purposes of this subdivision, &#8220;<span class=\"dictionary\">land zoned agricultural<\/span>&#8221; does not include land zoned &#8220;residential conservation.&#8221; Except for the limitation on land zoned &#8220;residential conservation,&#8221; nothing in this definition shall otherwise limit or affect local zoning <span class=\"dictionary\">authority<\/span>.\n\t\t\tLimited brewery <span class=\"dictionary\">licensees<\/span> shall be treated as breweries for all purposes of this title except as otherwise provided in this subdivision. <a id=\"paragraph-306582\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> Winery licenses, which shall authorize the <span class=\"dictionary\">licensee<\/span> to (i) manufacture <span class=\"dictionary\">wine<\/span> and to <span class=\"dictionary\">sell<\/span> and deliver or ship such <span class=\"dictionary\">wine<\/span>, in accordance with <span class=\"dictionary\">Board<\/span> regulations, in closed <span class=\"dictionary\">containers<\/span>, to persons <span class=\"dictionary\">licensed<\/span> to <span class=\"dictionary\">sell<\/span> the <span class=\"dictionary\">wine<\/span> so manufactured at wholesale for the purpose of resale, and to persons outside the Commonwealth for resale outside the Commonwealth; (ii) operate distilling equipment on the premises of the <span class=\"dictionary\">licensee<\/span> in the manufacture of <span class=\"dictionary\">spirits<\/span> from fruit or fruit juices only, which shall be used only for the fortification of <span class=\"dictionary\">wine<\/span> produced by the <span class=\"dictionary\">licensee<\/span>; (iii) operate a <span class=\"dictionary\">contract winemaking facility<\/span> on the premises of the <span class=\"dictionary\">licensee<\/span> in accordance with <span class=\"dictionary\">Board<\/span> regulations; (iv) store <span class=\"dictionary\">wine<\/span> in bonded warehouses on or off the <span class=\"dictionary\">licensed<\/span> premises upon permit issued by the <span class=\"dictionary\">Board<\/span>; and (v) <span class=\"dictionary\">sell<\/span> <span class=\"dictionary\">wine<\/span> at retail at the place of business designated in the winery license for on-premises consumption or in closed <span class=\"dictionary\">containers<\/span> for off-premises consumption, provided that any brand of <span class=\"dictionary\">wine<\/span> not owned by the winery <span class=\"dictionary\">licensee<\/span> is purchased from a wholesale <span class=\"dictionary\">wine<\/span> <span class=\"dictionary\">licensee<\/span> and no less than 20 percent of the <span class=\"dictionary\">wine<\/span> sold for on-premises consumption is manufactured on the <span class=\"dictionary\">licensed<\/span> premises. <a id=\"paragraph-306583\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"6\"><p><span class=\"prefix-number\">6.<\/span> <span class=\"dictionary\">Farm winery<\/span> licenses, which shall authorize the <span class=\"dictionary\">licensee<\/span> to (i) manufacture <span class=\"dictionary\">wine<\/span> containing 21 percent or less of <span class=\"dictionary\">alcohol<\/span> by volume and to <span class=\"dictionary\">sell<\/span>, deliver, or ship such <span class=\"dictionary\">wine<\/span>, in accordance with <span class=\"dictionary\">Board<\/span> regulations, in closed <span class=\"dictionary\">containers<\/span>, to the <span class=\"dictionary\">Board<\/span>, persons <span class=\"dictionary\">licensed<\/span> to <span class=\"dictionary\">sell<\/span> the <span class=\"dictionary\">wine<\/span> so manufactured at wholesale for the purpose of resale, or persons outside the Commonwealth; (ii) acquire and receive deliveries and shipments of <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">sell<\/span> and deliver or ship such <span class=\"dictionary\">wine<\/span>, in accordance with <span class=\"dictionary\">Board<\/span> regulations, to the <span class=\"dictionary\">Board<\/span>, persons <span class=\"dictionary\">licensed<\/span> to <span class=\"dictionary\">sell<\/span> <span class=\"dictionary\">wine<\/span> at wholesale for the purpose of resale, or persons outside the Commonwealth; (iii) operate a <span class=\"dictionary\">contract winemaking facility<\/span> on the premises of the <span class=\"dictionary\">licensee<\/span> in accordance with the provisions of this subtitle and <span class=\"dictionary\">Board<\/span> regulations; (iv) enter into an agreement with a <span class=\"dictionary\">contract winemaking facility<\/span> in accordance with the provisions of this subtitle and <span class=\"dictionary\">Board<\/span> regulations; and (v) store <span class=\"dictionary\">wine<\/span> in bonded warehouses located on or off the <span class=\"dictionary\">licensed<\/span> premises upon permits issued by the <span class=\"dictionary\">Board<\/span>. For the purposes of this title, a <span class=\"dictionary\">farm winery<\/span> license shall be designated either as a Class I, Class II, Class III, or Class IV <span class=\"dictionary\">farm winery<\/span> license in accordance with the limitations set forth in &#xA7; <a class=\"law\" title=\"Limitations on Class I, II, III, and IV farm wineries\" href=\"\/4.1-219\/\">4.1-219<\/a>.\n\t\t\tSuch licenses shall also authorize the <span class=\"dictionary\">licensee<\/span> to <span class=\"dictionary\">sell<\/span> <span class=\"dictionary\">wine<\/span> at retail for on-premises consumptions or in closed <span class=\"dictionary\">containers<\/span> for off-premises consumption at the places of business designated in the licenses, which may include no more than five additional retail <span class=\"dictionary\">establishments<\/span> of the <span class=\"dictionary\">licensee<\/span>. The <span class=\"dictionary\">licensee<\/span> may <span class=\"dictionary\">sell<\/span> at these places of business <span class=\"dictionary\">wine<\/span> manufactured by such <span class=\"dictionary\">licensee<\/span>, <span class=\"dictionary\">wine<\/span> manufactured by a <span class=\"dictionary\">contract winemaking facility<\/span> with which the <span class=\"dictionary\">licensee<\/span> has entered into an agreement pursuant to the provisions of this subtitle and <span class=\"dictionary\">Board<\/span> regulations, and <span class=\"dictionary\">wine<\/span> purchased from a wholesale <span class=\"dictionary\">wine<\/span> <span class=\"dictionary\">licensee<\/span>. In addition, the <span class=\"dictionary\">licensee<\/span> may pre-mix <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">sell<\/span> such <span class=\"dictionary\">wine<\/span> at these places of business. <a id=\"paragraph-306584\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> <span class=\"dictionary\">Wine<\/span> importer&#8217;s licenses, which shall authorize persons located within or outside the Commonwealth to <span class=\"dictionary\">sell<\/span> and deliver or ship <span class=\"dictionary\">wine<\/span>, in accordance with <span class=\"dictionary\">Board<\/span> regulations, in closed <span class=\"dictionary\">containers<\/span>, to persons in the Commonwealth <span class=\"dictionary\">licensed<\/span> to <span class=\"dictionary\">sell<\/span> such <span class=\"dictionary\">wine<\/span> at wholesale for the purpose of resale, and to persons outside the Commonwealth for resale outside the Commonwealth. <a id=\"paragraph-306585\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"8\"><p><span class=\"prefix-number\">8.<\/span> <span class=\"dictionary\">Beer<\/span> importer&#8217;s licenses, which shall authorize persons located within or outside the Commonwealth to <span class=\"dictionary\">sell<\/span> and deliver or ship <span class=\"dictionary\">beer<\/span>, in accordance with <span class=\"dictionary\">Board<\/span> regulations, in closed <span class=\"dictionary\">containers<\/span>, to persons in the Commonwealth <span class=\"dictionary\">licensed<\/span> to <span class=\"dictionary\">sell<\/span> such <span class=\"dictionary\">beer<\/span> at wholesale for the purpose of resale and to persons outside the Commonwealth for resale outside the Commonwealth. <a id=\"paragraph-306586\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-206.1\/#8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nMANUFACTURER LICENSES (\u00a7 4.1-206.1)\n\nThe Board may grant the following manufacturer licenses:\n\n1. Distiller&#8217;s licenses, which shall authorize the licensee to manufacture\nalcoholic beverages other than wine and beer, and to sell and deliver or ship\nthe same, in accordance with Board regulations, in closed containers, to the\nBoard and to persons outside the Commonwealth for resale outside the\nCommonwealth. When the Board has established a government store on the\ndistiller&#8217;s licensed premises pursuant to subsection D of &#xA7; 4.1-119,\nsuch license shall also authorize the licensee to make a charge to consumers to\nparticipate in an organized tasting event conducted in accordance with\nsubsection G of &#xA7; 4.1-119 and Board regulations.\n\n2. Limited distiller&#8217;s licenses, to distilleries that (i) are located on a\nfarm in the Commonwealth on land zoned agricultural and owned or leased by such\ndistillery or its owner and (ii) use agricultural products that are grown on the\nfarm in the manufacture of their alcoholic beverages. Limited distiller&#8217;s\nlicensees shall be treated as distillers for all purposes of this title except\nas otherwise provided in this subdivision. For purposes of this subdivision,\n&#8220;land zoned agricultural&#8221; means (a) land zoned as an agricultural\ndistrict or classification or (b) land otherwise permitted by a locality for\nlimited distillery use. For purposes of this subdivision, &#8220;land zoned\nagricultural&#8221; does not include land zoned &#8220;residential\nconservation.&#8221; Except for the limitation on land zoned &#8220;residential\nconservation,&#8221; nothing in this definition shall otherwise limit or affect\nlocal zoning authority.\n\n3. Brewery licenses, which shall authorize the licensee to manufacture beer and\nto sell and deliver or ship the beer so manufactured, in accordance with Board\nregulations, in closed containers to (i) persons licensed to sell the beer at\nwholesale and (ii) persons outside the Commonwealth for resale outside the\nCommonwealth. Such license shall also authorize the licensee to sell at retail\nat premises described in the brewery license (a) the brands of beer that the\nbrewery owns for on-premises consumption, provided that not less than 20 percent\nof the volume of beer sold for on-premises consumption in any calendar year is\nmanufactured on the licensed premises, and (b) beer in closed containers, which\nshall include growlers and other reusable containers, for off-premises\nconsumption.\n\n4. Limited brewery licenses, to breweries that manufacture no more than 15,000\nbarrels of beer per calendar year, provided that (i) the brewery is located on a\nfarm in the Commonwealth on land zoned agricultural and owned or leased by such\nbrewery or its owner and (ii) agricultural products, including barley, other\ngrains, hops, or fruit, used by such brewery in the manufacture of its beer are\ngrown on the farm. The licensed premises shall be limited to the portion of the\nfarm on which agricultural products, including barley, other grains, hops, or\nfruit, used by such brewery in the manufacture of its beer are grown and that is\ncontiguous to the premises of such brewery where the beer is manufactured,\nexclusive of any residence and the curtilage thereof. However, the Board may,\nwith notice to the local governing body in accordance with the provisions of\n&#xA7; 4.1-230, also approve other portions of the farm to be included as part\nof the licensed premises. For purposes of this subdivision, &#8220;land zoned\nagricultural&#8221; means (a) land zoned as an agricultural district or\nclassification or (b) land otherwise permitted by a locality for limited brewery\nuse. For purposes of this subdivision, &#8220;land zoned agricultural&#8221;\ndoes not include land zoned &#8220;residential conservation.&#8221; Except for\nthe limitation on land zoned &#8220;residential conservation,&#8221; nothing in\nthis definition shall otherwise limit or affect local zoning authority.\n\t\t\tLimited brewery licensees shall be treated as breweries for all purposes of\nthis title except as otherwise provided in this subdivision.\n\n5. Winery licenses, which shall authorize the licensee to (i) manufacture wine\nand to sell and deliver or ship such wine, in accordance with Board regulations,\nin closed containers, to persons licensed to sell the wine so manufactured at\nwholesale for the purpose of resale, and to persons outside the Commonwealth for\nresale outside the Commonwealth; (ii) operate distilling equipment on the\npremises of the licensee in the manufacture of spirits from fruit or fruit\njuices only, which shall be used only for the fortification of wine produced by\nthe licensee; (iii) operate a contract winemaking facility on the premises of\nthe licensee in accordance with Board regulations; (iv) store wine in bonded\nwarehouses on or off the licensed premises upon permit issued by the Board; and\n(v) sell wine at retail at the place of business designated in the winery\nlicense for on-premises consumption or in closed containers for off-premises\nconsumption, provided that any brand of wine not owned by the winery licensee is\npurchased from a wholesale wine licensee and no less than 20 percent of the wine\nsold for on-premises consumption is manufactured on the licensed premises.\n\n6. Farm winery licenses, which shall authorize the licensee to (i) manufacture\nwine containing 21 percent or less of alcohol by volume and to sell, deliver, or\nship such wine, in accordance with Board regulations, in closed containers, to\nthe Board, persons licensed to sell the wine so manufactured at wholesale for\nthe purpose of resale, or persons outside the Commonwealth; (ii) acquire and\nreceive deliveries and shipments of wine and sell and deliver or ship such wine,\nin accordance with Board regulations, to the Board, persons licensed to sell\nwine at wholesale for the purpose of resale, or persons outside the\nCommonwealth; (iii) operate a contract winemaking facility on the premises of\nthe licensee in accordance with the provisions of this subtitle and Board\nregulations; (iv) enter into an agreement with a contract winemaking facility in\naccordance with the provisions of this subtitle and Board regulations; and (v)\nstore wine in bonded warehouses located on or off the licensed premises upon\npermits issued by the Board. For the purposes of this title, a farm winery\nlicense shall be designated either as a Class I, Class II, Class III, or Class\nIV farm winery license in accordance with the limitations set forth in &#xA7;\n4.1-219.\n\t\t\tSuch licenses shall also authorize the licensee to sell wine at retail for\non-premises consumptions or in closed containers for off-premises consumption at\nthe places of business designated in the licenses, which may include no more\nthan five additional retail establishments of the licensee. The licensee may\nsell at these places of business wine manufactured by such licensee, wine\nmanufactured by a contract winemaking facility with which the licensee has\nentered into an agreement pursuant to the provisions of this subtitle and Board\nregulations, and wine purchased from a wholesale wine licensee. In addition, the\nlicensee may pre-mix wine and sell such wine at these places of business.\n\n7. Wine importer&#8217;s licenses, which shall authorize persons located within\nor outside the Commonwealth to sell and deliver or ship wine, in accordance with\nBoard regulations, in closed containers, to persons in the Commonwealth licensed\nto sell such wine at wholesale for the purpose of resale, and to persons outside\nthe Commonwealth for resale outside the Commonwealth.\n\n8. Beer importer&#8217;s licenses, which shall authorize persons located within\nor outside the Commonwealth to sell and deliver or ship beer, in accordance with\nBoard regulations, in closed containers, to persons in the Commonwealth licensed\nto sell such beer at wholesale for the purpose of resale and to persons outside\nthe Commonwealth for resale outside the Commonwealth.\n\nHISTORY: 2020, cc. 756, 1008, 1113, 1114; 2021, Sp.
