Nothing in this subsection shall prohibit the placement of nonalcoholic wine or beer in or near a display of alcoholic beverages that contain the same or similar brand name, logo, or packaging as the nonalcoholic wine or beer.C\n\nPersons granted retail on-and-off-premises wine and beer licenses pursuant to the following provisions may conduct wine or beer tastings sponsored by the licensee for its customers for on-premises consumption:1\n\nSubdivision A 1, 4, 5, 6, 7, 8, or 13 of &#xA7; 4.1-206.3;2\n\nSubdivision B 1, 2, 4, 5, 6, 7, or 8 of &#xA7; 4.1-206.3;3\n\nSubdivision C 1 or 2 of &#xA7; 4.1-206.3;4\n\nSubdivision D 1 a, b, or d or 2 a of &#xA7; 4.1-206.3; or5\n\nSubdivision F 4 or 5 of &#xA7; 4.1-206.3.\n\t\t\t\tSuch licensees may sell or give samples of wine and beer in designated areas at events held by the licensee for the purpose of featuring and educating the consuming public about the alcoholic beverages being tasted. Additionally, with the consent of the licensee, farm wineries, wineries, and breweries may participate in tastings held by licensees authorized to conduct tastings, including the pouring of samples to any person to whom alcoholic beverages may be lawfully sold. <a class=\"law\" title=\"Retail licenses\" href=\"\/4.1-206.3\/\">4.1-206.3<\/a> may display within their <span class=\"dictionary\">licensed<\/span> premises point-of-<span class=\"dictionary\">sale<\/span> advertising <span class=\"dictionary\">materials<\/span> that incorporate the use of any professional athlete or athletic team, provided that such advertising <span class=\"dictionary\">materials<\/span> (i) otherwise comply with the applicable regulations of the federal Bureau of <span class=\"dictionary\">Alcohol<\/span>, Tobacco and Firearms and (ii) do not depict any athlete consuming or about to consume <span class=\"dictionary\">alcohol<\/span> prior to or while engaged in an athletic activity, do not depict an athlete consuming <span class=\"dictionary\">alcohol<\/span> while the athlete is operating or about to operate a motor vehicle or other machinery, and do not imply that the alcoholic beverage so advertised enhances athletic prowess. <a id=\"paragraph-250199\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Persons granted a license to <span class=\"dictionary\">sell<\/span> <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">beer<\/span> for off-premises consumption that display such <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">beer<\/span> outside a clearly discernible location reserved for <span class=\"dictionary\">alcoholic beverages<\/span> shall (i) not place <span class=\"dictionary\">wine<\/span> or <span class=\"dictionary\">beer<\/span> in an area immediately adjacent to nonalcoholic beverages containing the same or similar brand name, logo, or packaging as an alcoholic beverage and (ii) equip any such display with signage that indicates the product is an alcoholic beverage, is clearly visible to consumers, and is of sufficient size to notify the consumer that the product contains <span class=\"dictionary\">alcohol<\/span>. Nothing in this subsection shall prohibit the placement of nonalcoholic <span class=\"dictionary\">wine<\/span> or <span class=\"dictionary\">beer<\/span> in or near a display of <span class=\"dictionary\">alcoholic beverages<\/span> that contain the same or similar brand name, logo, or packaging as the nonalcoholic <span class=\"dictionary\">wine<\/span> or <span class=\"dictionary\">beer<\/span>. <a id=\"paragraph-250200\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Persons granted retail on-and-off-premises <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">beer<\/span> licenses pursuant to the following provisions may conduct <span class=\"dictionary\">wine<\/span> or <span class=\"dictionary\">beer<\/span> tastings sponsored by the <span class=\"dictionary\">licensee<\/span> for its customers for on-premises consumption: <a id=\"paragraph-250201\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Subdivision A 1, 4, 5, 6, 7, 8, or 13 of &#xA7; <a class=\"law\" title=\"Retail licenses\" href=\"\/4.1-206.3\/\">4.1-206.3<\/a>; <a id=\"paragraph-250202\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Subdivision B 1, 2, 4, 5, 6, 7, or 8 of &#xA7; <a class=\"law\" title=\"Retail licenses\" href=\"\/4.1-206.3\/\">4.1-206.3<\/a>; <a id=\"paragraph-250203\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Subdivision C 1 or 2 of &#xA7; <a class=\"law\" title=\"Retail licenses\" href=\"\/4.1-206.3\/\">4.1-206.3<\/a>; <a id=\"paragraph-250204\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Subdivision D 1 a, b, or d or 2 a of &#xA7; <a class=\"law\" title=\"Retail licenses\" href=\"\/4.1-206.3\/\">4.1-206.3<\/a>; or <a id=\"paragraph-250205\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Subdivision F 4 or 5 of &#xA7; <a class=\"law\" title=\"Retail licenses\" href=\"\/4.1-206.3\/\">4.1-206.3<\/a>.\n\t\t\t\tSuch <span class=\"dictionary\">licensees<\/span> may <span class=\"dictionary\">sell<\/span> or give samples of <span class=\"dictionary\">wine<\/span> and <span class=\"dictionary\">beer<\/span> in <span class=\"dictionary\">designated areas<\/span> at events held by the <span class=\"dictionary\">licensee<\/span> for the purpose of featuring and educating the consuming public about the <span class=\"dictionary\">alcoholic beverages<\/span> being tasted. Additionally, with the consent of the <span class=\"dictionary\">licensee<\/span>, farm wineries, wineries, and breweries may participate in tastings held by <span class=\"dictionary\">licensees<\/span> authorized to conduct tastings, including the pouring of samples to any person to whom <span class=\"dictionary\">alcoholic beverages<\/span> may be lawfully sold. No single sample shall exceed four ounces of <span class=\"dictionary\">beer<\/span> or two ounces of <span class=\"dictionary\">wine<\/span>, and no more than 12 ounces of <span class=\"dictionary\">beer<\/span> or five ounces of <span class=\"dictionary\">wine<\/span> shall be given or sold to any person per day. <a id=\"paragraph-250206\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-209\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nWINE AND BEER LICENSE PRIVILEGES; ADVERTISING; DISPLAYS; TASTINGS (\u00a7 4.1-209)\n\nA. Notwithstanding any provision of law to the contrary, persons granted a wine\nand beer license pursuant to &#xA7; 4.1-206.3 may display within their licensed\npremises point-of-sale advertising materials that incorporate the use of any\nprofessional athlete or athletic team, provided that such advertising materials\n(i) otherwise comply with the applicable regulations of the federal Bureau of\nAlcohol, Tobacco and Firearms and (ii) do not depict any athlete consuming or\nabout to consume alcohol prior to or while engaged in an athletic activity, do\nnot depict an athlete consuming alcohol while the athlete is operating or about\nto operate a motor vehicle or other machinery, and do not imply that the\nalcoholic beverage so advertised enhances athletic prowess.\n\nB. Persons granted a license to sell wine and beer for off-premises consumption\nthat display such wine and beer outside a clearly discernible location reserved\nfor alcoholic beverages shall (i) not place wine or beer in an area immediately\nadjacent to nonalcoholic beverages containing the same or similar brand name,\nlogo, or packaging as an alcoholic beverage and (ii) equip any such display with\nsignage that indicates the product is an alcoholic beverage, is clearly visible\nto consumers, and is of sufficient size to notify the consumer that the product\ncontains alcohol. Nothing in this subsection shall prohibit the placement of\nnonalcoholic wine or beer in or near a display of alcoholic beverages that\ncontain the same or similar brand name, logo, or packaging as the nonalcoholic\nwine or beer.\n\nC. Persons granted retail on-and-off-premises wine and beer licenses pursuant to\nthe following provisions may conduct wine or beer tastings sponsored by the\nlicensee for its customers for on-premises consumption:\n\n   1. Subdivision A 1, 4, 5, 6, 7, 8, or 13 of &#xA7; 4.1-206.3;\n\n   2. Subdivision B 1, 2, 4, 5, 6, 7, or 8 of &#xA7; 4.1-206.3;\n\n   3. Subdivision C 1 or 2 of &#xA7; 4.1-206.3;\n\n   4. Subdivision D 1 a, b, or d or 2 a of &#xA7; 4.1-206.3; or\n\n   5. Subdivision F 4 or 5 of &#xA7; 4.1-206.3.\n   \t\t\t\tSuch licensees may sell or give samples of wine and beer in designated\n   areas at events held by the licensee for the purpose of featuring and\n   educating the consuming public about the alcoholic beverages being tasted.\n   Additionally, with the consent of the licensee, farm wineries, wineries, and\n   breweries may participate in tastings held by licensees authorized to conduct\n   tastings, including the pouring of samples to any person to whom alcoholic\n   beverages may be lawfully sold.
