If the Board determines suspension is warranted, it shall immediately notify the licensee of its intention to temporarily suspend his license pending the outcome of a formal investigation. Such temporary suspension shall remain effective for a minimum of 48 hours. After the 48-hour period, the licensee may petition the Board for a restricted license pending the results of the formal investigation and proceedings for disciplinary review. If the Board determines that a restricted license is warranted, the Board shall have discretion to impose appropriate restrictions based on the facts presented.C\n\nUpon a determination to temporarily suspend a license, the Board shall immediately commence a formal investigation. The formal investigation shall be completed within 10 days of its commencement and the findings reported immediately to the Secretary of the Board. If, following the formal investigation, the Secretary of the Board determines that suspension of the license is warranted, a hearing shall be held within five days of the completion of the formal investigation. A decision shall be rendered within 10 days of conclusion of the hearing. If a decision is not rendered within 10 days of the conclusion of the hearing, the order of suspension shall be vacated and the license reinstated. Any appeal by the licensee shall be filed within 10 days of the decision and heard by the Board within 20 days of the decision. Any <span class=\"dictionary\">appeal<\/span> by the <span class=\"dictionary\">licensee<\/span> shall be filed within 10 days of the decision and heard by the <span class=\"dictionary\">Board<\/span> within 20 days of the decision. The <span class=\"dictionary\">Board<\/span> shall render a decision on the <span class=\"dictionary\">appeal<\/span> within 10 days of the conclusion of the <span class=\"dictionary\">appeal<\/span> <span class=\"dictionary\">hearing<\/span>. <a id=\"paragraph-216942\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Service of any <span class=\"dictionary\">order<\/span> of suspension issued pursuant to this section shall be made by a <span class=\"dictionary\">special agent<\/span> of the <span class=\"dictionary\">Board<\/span> in person and by certified mail to the <span class=\"dictionary\">licensee<\/span>. The <span class=\"dictionary\">order<\/span> of suspension shall take effect immediately upon service. <a id=\"paragraph-216943\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225.1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> This section shall not apply to (i) temporary licenses granted under &#xA7; <a class=\"law\" title=\"Temporary licenses\" href=\"\/4.1-211\/\">4.1-211<\/a> or temporary permits granted under &#xA7; <a class=\"law\" title=\"Permits required in certain instances\" href=\"\/4.1-212\/\">4.1-212<\/a>, either of which may be revoked summarily in accordance with &#xA7; <a class=\"law\" title=\"Temporary licenses\" href=\"\/4.1-211\/\">4.1-211<\/a>, or (ii) licenses granted pursuant to subdivision 7 or 8 of &#xA7; <a class=\"law\" title=\"Manufacturer licenses\" href=\"\/4.1-206.1\/\">4.1-206.1<\/a> or subdivision 1 or 3 of &#xA7; <a class=\"law\" title=\"Wholesale licenses\" href=\"\/4.1-206.2\/\">4.1-206.2<\/a>. <a id=\"paragraph-216944\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225.1\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nSUMMARY SUSPENSION IN EMERGENCY CIRCUMSTANCES; GROUNDS; NOTICE AND HEARING (\u00a7\n4.1-225.1)\n\nA. Notwithstanding any provisions to the contrary in Article 3 (&#xA7; 2.2-4018\net seq.) of the Administrative Process Act or &#xA7; 4.1-227 or 4.1-229, the\nBoard may summarily suspend any license or permit if it has reasonable cause to\nbelieve that an act of violence resulting in death or serious bodily injury, or\na recurrence of such acts, has occurred on (i) the licensed premises, (ii) any\npremises immediately adjacent to the licensed premises that is owned or leased\nby the licensee, or (iii) any portion of public property immediately adjacent to\nthe licensed premises, and the Board finds that there exists a continuing threat\nto public safety and that summary suspension of the license or permit is\njustified to protect the health, safety, or welfare of the public.\n\nB. Prior to issuing an order of suspension pursuant to this section, special\nagents of the Board shall conduct an initial investigation and submit all\nfindings to the Secretary of the Board within 48 hours of any such act of\nviolence; however, if the 48-hour period terminates on a Saturday, Sunday, or\nlegal holiday, the initial investigation findings may be submitted to the\nSecretary of the Board any time prior to the close of business on the next day\nthat is not a Saturday, Sunday, or legal holiday. If the Board determines\nsuspension is warranted, it shall immediately notify the licensee of its\nintention to temporarily suspend his license pending the outcome of a formal\ninvestigation. Such temporary suspension shall remain effective for a minimum of\n48 hours. After the 48-hour period, the licensee may petition the Board for a\nrestricted license pending the results of the formal investigation and\nproceedings for disciplinary review. If the Board determines that a restricted\nlicense is warranted, the Board shall have discretion to impose appropriate\nrestrictions based on the facts presented.\n\nC. Upon a determination to temporarily suspend a license, the Board shall\nimmediately commence a formal investigation. The formal investigation shall be\ncompleted within 10 days of its commencement and the findings reported\nimmediately to the Secretary of the Board. If, following the formal\ninvestigation, the Secretary of the Board determines that suspension of the\nlicense is warranted, a hearing shall be held within five days of the completion\nof the formal investigation. A decision shall be rendered within 10 days of\nconclusion of the hearing. If a decision is not rendered within 10 days of the\nconclusion of the hearing, the order of suspension shall be vacated and the\nlicense reinstated. Any appeal by the licensee shall be filed within 10 days of\nthe decision and heard by the Board within 20 days of the decision. The Board\nshall render a decision on the appeal within 10 days of the conclusion of the\nappeal hearing.\n\nD.
