Has misrepresented a material fact in applying to the Board for such license;\n\t\t\t\tb. Within the five years immediately preceding the date of the hearing held in accordance with &#xA7; 4.1-227, has (i) been convicted of a violation of any law, ordinance, or regulation of the Commonwealth, of any county, city, or town in the Commonwealth, of any state, or of the United States, applicable to the manufacture, transportation, possession, use, or sale of alcoholic beverages; (ii) violated any provision of Chapter 3 (&#xA7; 4.1-300 et seq.); (iii) committed a violation of the Wine Franchise Act (&#xA7; 4.1-400 et seq.) or the Beer Franchise Act (&#xA7; 4.1-500 et seq.) in bad faith; (iv) violated or failed or refused to comply with any regulation, rule, or order of the Board; or (v) failed or refused to comply with any of the conditions or restrictions of the license granted by the Board;\n\t\t\t\tc. Has been convicted in any court of a felony or of any crime or offense involving moral turpitude under the laws of any state, or of the United States;\n\t\t\t\td. Is not the legitimate owner of the business conducted under the license granted by the Board, or other persons have ownership interests in the business which have not been disclosed;\n\t\t\t\te. Cannot demonstrate financial responsibility sufficient to meet the requirements of the business conducted under the license granted by the Board;\n\t\t\t\tf. Has been intoxicated or under the influence of some self-administered drug while upon the licensed premises;\n\t\t\t\tg. Has maintained the licensed premises in an unsanitary condition, or allowed such premises to become a meeting place or rendezvous for members of a criminal street gang as defined in &#xA7; 18.2-46.1 or persons of ill repute, or has allowed any form of illegal gambling to take place upon such premises;\n\t\t\t\th. Knowingly employs in the business conducted under such license, as agent, servant, or employee, other than a busboy, cook, or other kitchen help, any person who has been convicted in any court of a felony or of any crime or offense involving moral turpitude, or who has violated the laws of the Commonwealth, of any other state, or of the United States, applicable to the manufacture, transportation, possession, use, or sale of alcoholic beverages;\n\t\t\t\ti. Subsequent to the granting of his original license, has demonstrated by his police record a lack of respect for law and order;\n\t\t\t\tj. Has allowed the consumption of alcoholic beverages upon the licensed premises by any person whom he knew or had reason to believe was (i) less than 21 years of age, (ii) interdicted, or (iii) intoxicated, or has allowed any person whom he knew or had reason to believe was intoxicated to loiter upon such licensed premises;\n\t\t\t\tk. Has allowed any person to consume upon the licensed premises any alcoholic beverages except as provided under this subtitle;\n\t\t\t\tl. Is physically unable to carry on the business conducted under such license or has been adjudicated incapacitated;\n\t\t\t\tm. Has allowed any obscene literature, pictures, or materials upon the licensed premises;\n\t\t\t\tn. Has possessed any illegal gambling apparatus, machine, or device upon the licensed premises;\n\t\t\t\to. Has upon the licensed premises (i) illegally possessed, distributed, sold, or used, or has knowingly allowed any employee or agent, or any other person, to illegally possess, distribute, sell, or use marijuana, controlled substances, imitation controlled substances, drug paraphernalia, or controlled paraphernalia as those terms are defined in Articles 1 (&#xA7; 18.2-247 et seq.) and 1.1 (&#xA7; 18.2-265.1 et seq.) of Chapter 7 of Title 18.2 and the Drug Control Act (&#xA7; 54.1-3400 et seq.); (ii) laundered money in violation of &#xA7; 18.2-246.3; or (iii) conspired to commit any drug-related offense in violation of Article 1 or 1.1 of Chapter 7 of Title 18.2 or the Drug Control Act. The provisions of this subdivision shall also apply to any conduct related to the operation of the licensed business that facilitates the commission of any of the offenses set forth herein;\n\t\t\t\tp. Has failed to take reasonable measures to prevent (i) the licensed premises, (ii) any premises immediately adjacent to the licensed premises that are owned or leased by the licensee, or (iii) any portion of public property immediately adjacent to the licensed premises from becoming a place where patrons of the establishment commit criminal violations of Article 1 (&#xA7; 18.2-30 et seq.), 2 (&#xA7; 18.2-38 et seq.), 2.1 (&#xA7; 18.2-46.1 et seq.), 2.2 (&#xA7; 18.2-46.4 et seq.), 3 (&#xA7; 18.2-47 et seq.), 4 (&#xA7; 18.2-51 et seq.), 5 (&#xA7; 18.2-58 et seq.), 6 (&#xA7; 18.2-59 et seq.), or 7 (&#xA7; 18.2-61 et seq.) of Chapter 4 of Title 18.2; Article 2 (&#xA7; 18.2-266 et seq.) of Chapter 7 of Title 18.2; Article 3 (&#xA7; 18.2-346 et seq.) or 5 (&#xA7; 18.2-372 et seq.) of Chapter 8 of Title 18.2; or Article 1 (&#xA7; 18.2-404 et seq.), 2 (&#xA7; 18.2-415), or 3 (&#xA7; 18.2-416 et seq.) of Chapter 9 of Title 18.2 and such violations lead to arrests that are so frequent and serious as to reasonably be deemed a continuing threat to the public safety; or\n\t\t\t\tq. Has failed to take reasonable measures to prevent an act of violence resulting in death or serious bodily injury, or a recurrence of such acts, from occurring on (i) the licensed premises, (ii) any premises immediately adjacent to the licensed premises that is owned or leased by the licensee, or (iii) any portion of public property immediately adjacent to the licensed premises.2\n\nThe place occupied by the licensee:\n\t\t\t\ta. Does not conform to the requirements of the governing body of the county, city, or town in which such establishment is located, with respect to sanitation, health, construction, or equipment, or to any similar requirements established by the laws of the Commonwealth or by Board regulations;\n\t\t\t\tb. Has been adjudicated a common nuisance under the provisions of this subtitle or &#xA7; 18.2-258; or\n\t\t\t\tc. Has become a meeting place or rendezvous for illegal gambling, illegal users of narcotics, drunks, prostitutes, pimps, panderers, or habitual law violators or has become a place where illegal drugs are regularly used or distributed. notice and hearings; imposition of penalties\" href=\"\/4.1-227\/\">4.1-227<\/a>, if it has reasonable cause to believe that: <a id=\"paragraph-207778\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The <span class=\"dictionary\">licensee<\/span>, or if the <span class=\"dictionary\">licensee<\/span> is a partnership, any general partner thereof, or if the <span class=\"dictionary\">licensee<\/span> is an association, any member thereof, or a limited partner of 10 percent or more with voting rights, or if the <span class=\"dictionary\">licensee<\/span> is a corporation, any officer, director, or shareholder owning 10 percent or more of its capital stock, or if the <span class=\"dictionary\">licensee<\/span> is a limited liability company, any member-manager or any member owning 10 percent or more of the membership interest of the limited liability company:\n\t\t\t\ta. Has misrepresented a <span class=\"dictionary\">material<\/span> <span class=\"dictionary\">fact<\/span> in applying to the <span class=\"dictionary\">Board<\/span> for such license;\n\t\t\t\tb. Within the five years immediately preceding the date of the <span class=\"dictionary\">hearing<\/span> held in accordance with &#xA7; <a class=\"law\" title=\"Suspension or revocation of licenses; notice and hearings; imposition of penalties\" href=\"\/4.1-227\/\">4.1-227<\/a>, has (i) been convicted of a violation of any <span class=\"dictionary\">law<\/span>, <span class=\"dictionary\">ordinance<\/span>, or regulation of the Commonwealth, of any county, city, or town in the Commonwealth, of any state, or of the United States, applicable to the manufacture, transportation, <span class=\"dictionary\">possession<\/span>, use, or <span class=\"dictionary\">sale<\/span> of <span class=\"dictionary\">alcoholic beverages<\/span>; (ii) violated any provision of Chapter 3 (&#xA7; <a class=\"law\" title=\"Illegal manufacture and bottling; penalty\" href=\"\/4.1-300\/\">4.1-300<\/a> et seq.); (iii) committed a violation of the <span class=\"dictionary\">Wine<\/span> Franchise Act (&#xA7; <a class=\"law\" title=\"Construction and purpose\" href=\"\/4.1-400\/\">4.1-400<\/a> et seq.) or the <span class=\"dictionary\">Beer<\/span> Franchise Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/4.1-500\/\">4.1-500<\/a> et seq.) in bad faith; (iv) violated or failed or refused to comply with any regulation, rule, or <span class=\"dictionary\">order<\/span> of the <span class=\"dictionary\">Board<\/span>; or (v) failed or refused to comply with any of the conditions or restrictions of the license granted by the <span class=\"dictionary\">Board<\/span>;\n\t\t\t\tc. Has been convicted in any <span class=\"dictionary\">court<\/span> of a <span class=\"dictionary\">felony<\/span> or of any <span class=\"dictionary\">crime<\/span> or <span class=\"dictionary\">offense<\/span> involving <span class=\"dictionary\">moral turpitude<\/span> under the <span class=\"dictionary\">laws<\/span> of any state, or of the United States;\n\t\t\t\td. Is not the legitimate owner of the business conducted under the license granted by the <span class=\"dictionary\">Board<\/span>, or other persons have ownership interests in the business which have not been disclosed;\n\t\t\t\te. Cannot demonstrate financial responsibility sufficient to meet the requirements of the business conducted under the license granted by the <span class=\"dictionary\">Board<\/span>;\n\t\t\t\tf. Has been <span class=\"dictionary\">intoxicated<\/span> or under the influence of some self-administered drug while upon the <span class=\"dictionary\">licensed<\/span> premises;\n\t\t\t\tg. Has maintained the <span class=\"dictionary\">licensed<\/span> premises in an unsanitary condition, or allowed such premises to become a meeting place or rendezvous for members of a criminal street gang as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/18.2-46.1\/\">18.2-46.1<\/a> or persons of ill repute, or has allowed any form of illegal gambling to take place upon such premises;\n\t\t\t\th. Knowingly employs in the business conducted under such license, as agent, servant, or employee, other than a busboy, cook, or other kitchen help, any person who has been convicted in any <span class=\"dictionary\">court<\/span> of a <span class=\"dictionary\">felony<\/span> or of any <span class=\"dictionary\">crime<\/span> or <span class=\"dictionary\">offense<\/span> involving <span class=\"dictionary\">moral turpitude<\/span>, or who has violated the <span class=\"dictionary\">laws<\/span> of the Commonwealth, of any other state, or of the United States, applicable to the manufacture, transportation, <span class=\"dictionary\">possession<\/span>, use, or <span class=\"dictionary\">sale<\/span> of <span class=\"dictionary\">alcoholic beverages<\/span>;\n\t\t\t\ti. Subsequent to the granting of his original license, has demonstrated by his police record a lack of respect for <span class=\"dictionary\">law<\/span> and <span class=\"dictionary\">order<\/span>;\n\t\t\t\tj. Has allowed the consumption of <span class=\"dictionary\">alcoholic beverages<\/span> upon the <span class=\"dictionary\">licensed<\/span> premises by any person whom he knew or had reason to believe was (i) less than 21 years of age, (ii) interdicted, or (iii) <span class=\"dictionary\">intoxicated<\/span>, or has allowed any person whom he knew or had reason to believe was <span class=\"dictionary\">intoxicated<\/span> to loiter upon such <span class=\"dictionary\">licensed<\/span> premises;\n\t\t\t\tk. Has allowed any person to consume upon the <span class=\"dictionary\">licensed<\/span> premises any <span class=\"dictionary\">alcoholic beverages<\/span> except as provided under this subtitle;\n\t\t\t\tl. Is physically unable to carry on the business conducted under such license or has been adjudicated incapacitated;\n\t\t\t\tm. Has allowed any obscene literature, pictures, or <span class=\"dictionary\">materials<\/span> upon the <span class=\"dictionary\">licensed<\/span> premises;\n\t\t\t\tn. Has possessed any illegal gambling apparatus, machine, or device upon the <span class=\"dictionary\">licensed<\/span> premises;\n\t\t\t\to. Has upon the <span class=\"dictionary\">licensed<\/span> premises (i) illegally possessed, distributed, sold, or used, or has knowingly allowed any employee or agent, or any other person, to illegally possess, distribute, <span class=\"dictionary\">sell<\/span>, or use marijuana, controlled substances, imitation controlled substances, drug paraphernalia, or controlled paraphernalia as those terms are defined in Articles 1 (&#xA7; <a class=\"law\" title=\"Use of terms &quot;controlled substances,&quot; &quot;marijuana,&quot; &quot;Schedules I, II, III, IV, V, and VI,&quot; &quot;imitation controlled substance,&quot; and &quot;counterfeit controlled substance&quot; in Title 18.2\" href=\"\/18.2-247\/\">18.2-247<\/a> et seq.) and 1.1 (&#xA7; <a class=\"law\" title=\"Definition\" href=\"\/18.2-265.1\/\">18.2-265.1<\/a> et seq.) of Chapter 7 of Title 18.2 and the Drug Control Act (&#xA7; <a class=\"law\" title=\"Citation\" href=\"\/54.1-3400\/\">54.1-3400<\/a> et seq.); (ii) laundered money in violation of &#xA7; <a class=\"law\" title=\"Money laundering; penalties\" href=\"\/18.2-246.3\/\">18.2-246.3<\/a>; or (iii) conspired to commit any drug-related <span class=\"dictionary\">offense<\/span> in violation of Article 1 or 1.1 of Chapter 7 of Title 18.2 or the Drug Control Act. The provisions of this subdivision shall also apply to any conduct related to the operation of the <span class=\"dictionary\">licensed<\/span> business that facilitates the commission of any of the <span class=\"dictionary\">offenses<\/span> set forth herein;\n\t\t\t\tp. Has failed to take reasonable measures to prevent (i) the <span class=\"dictionary\">licensed<\/span> premises, (ii) any premises immediately adjacent to the <span class=\"dictionary\">licensed<\/span> premises that are owned or leased by the <span class=\"dictionary\">licensee<\/span>, or (iii) any portion of public property immediately adjacent to the <span class=\"dictionary\">licensed<\/span> premises from becoming a place where patrons of the <span class=\"dictionary\">establishment<\/span> commit criminal violations of Article 1 (&#xA7; <a class=\"law\" title=\"Murder and manslaughter declared felonies\" href=\"\/18.2-30\/\">18.2-30<\/a> et seq.), 2 (&#xA7; <a class=\"law\" title=\"&quot;Mob&quot; defined\" href=\"\/18.2-38\/\">18.2-38<\/a> et seq.), 2.1 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/18.2-46.1\/\">18.2-46.1<\/a> et seq.), 2.2 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/18.2-46.4\/\">18.2-46.4<\/a> et seq.), 3 (&#xA7; <a class=\"law\" title=\"Abduction and kidnapping defined; forced labor; punishment\" href=\"\/18.2-47\/\">18.2-47<\/a> et seq.), 4 (&#xA7; <a class=\"law\" title=\"Shooting, stabbing, etc., with intent to maim, kill, etc\" href=\"\/18.2-51\/\">18.2-51<\/a> et seq.), 5 (&#xA7; <a class=\"law\" title=\"Robbery; penalties\" href=\"\/18.2-58\/\">18.2-58<\/a> et seq.), 6 (&#xA7; <a class=\"law\" title=\"Extortion of money, property or pecuniary benefit\" href=\"\/18.2-59\/\">18.2-59<\/a> et seq.), or 7 (&#xA7; <a class=\"law\" title=\"Rape\" href=\"\/18.2-61\/\">18.2-61<\/a> et seq.) of Chapter 4 of Title 18.2; Article 2 (&#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a> et seq.) of Chapter 7 of Title 18.2; Article 3 (&#xA7; <a class=\"law\" title=\"Prostitution; commercial sexual conduct; penalties\" href=\"\/18.2-346\/\">18.2-346<\/a> et seq.) or 5 (&#xA7; <a class=\"law\" title=\"&quot;Obscene&quot; defined\" href=\"\/18.2-372\/\">18.2-372<\/a> et seq.) of Chapter 8 of Title 18.2; or Article 1 (&#xA7; <a class=\"law\" title=\"Obstructing free passage of others\" href=\"\/18.2-404\/\">18.2-404<\/a> et seq.), 2 (&#xA7; <a class=\"law\" title=\"Disorderly conduct in public places\" href=\"\/18.2-415\/\">18.2-415<\/a>), or 3 (&#xA7; <a class=\"law\" title=\"Punishment for using abusive language to another\" href=\"\/18.2-416\/\">18.2-416<\/a> et seq.) of Chapter 9 of Title 18.2 and such violations lead to <span class=\"dictionary\">arrests<\/span> that are so frequent and serious as to reasonably be deemed a continuing threat to the public safety; or\n\t\t\t\tq. Has failed to take reasonable measures to prevent an act of violence resulting in death or serious bodily injury, or a recurrence of such acts, from occurring on (i) the <span class=\"dictionary\">licensed<\/span> premises, (ii) any premises immediately adjacent to the <span class=\"dictionary\">licensed<\/span> premises that is owned or leased by the <span class=\"dictionary\">licensee<\/span>, or (iii) any portion of public property immediately adjacent to the <span class=\"dictionary\">licensed<\/span> premises. <a id=\"paragraph-207779\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The place occupied by the <span class=\"dictionary\">licensee<\/span>:\n\t\t\t\ta. Does not conform to the requirements of the governing body of the county, city, or town in which such <span class=\"dictionary\">establishment<\/span> is located, with respect to sanitation, health, construction, or equipment, or to any similar requirements established by the <span class=\"dictionary\">laws<\/span> of the Commonwealth or by <span class=\"dictionary\">Board<\/span> regulations;\n\t\t\t\tb. Has been adjudicated a common nuisance under the provisions of this subtitle or &#xA7; <a class=\"law\" title=\"Certain premises deemed common nuisance; penalty\" href=\"\/18.2-258\/\">18.2-258<\/a>; or\n\t\t\t\tc. Has become a meeting place or rendezvous for illegal gambling, illegal users of narcotics, drunks, prostitutes, pimps, panderers, or habitual <span class=\"dictionary\">law<\/span> violators or has become a place where illegal drugs are regularly used or distributed. The <span class=\"dictionary\">Board<\/span> may consider the general reputation in the community of such <span class=\"dictionary\">establishment<\/span> in addition to any other competent <span class=\"dictionary\">evidence<\/span> in making such determination. <a id=\"paragraph-207780\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The <span class=\"dictionary\">licensee<\/span> or any employee of the <span class=\"dictionary\">licensee<\/span> discriminated against any member of the armed forces of the United States by prices charged or otherwise. <a id=\"paragraph-207781\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The <span class=\"dictionary\">licensee<\/span>, his employees, or any entertainer performing on the <span class=\"dictionary\">licensed<\/span> premises has been convicted of a violation of a local public nudity <span class=\"dictionary\">ordinance<\/span> for conduct occurring on the <span class=\"dictionary\">licensed<\/span> premises and the <span class=\"dictionary\">licensee<\/span> allowed such conduct to occur. <a id=\"paragraph-207782\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Any cause exists for which the <span class=\"dictionary\">Board<\/span> would have been entitled to refuse to grant such license had the <span class=\"dictionary\">facts<\/span> been known. <a id=\"paragraph-207783\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> The <span class=\"dictionary\">licensee<\/span> is delinquent for a period of 90 days or more in the payment of any taxes, or any penalties or interest related thereto, lawfully imposed by the locality where the <span class=\"dictionary\">licensed<\/span> business is located, as certified by the treasurer, commissioner of the revenue, or finance director of such locality, unless (i) the outstanding amount is de minimis; (ii) the <span class=\"dictionary\">licensee<\/span> has pending a bona fide application for correction or <span class=\"dictionary\">appeal<\/span> with respect to such taxes, penalties, or interest; or (iii) the <span class=\"dictionary\">licensee<\/span> has entered into a payment plan approved by the same locality to settle the outstanding liability. <a id=\"paragraph-207784\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Any other cause authorized by this subtitle. <a id=\"paragraph-207785\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Notwithstanding the provisions of subdivision A 1 h, a <span class=\"dictionary\">licensee<\/span> may employ a person who has been convicted of a <span class=\"dictionary\">felony<\/span> or a <span class=\"dictionary\">crime<\/span> involving <span class=\"dictionary\">moral turpitude<\/span> if (i) except for violations of &#xA7; <a class=\"law\" title=\"Attempts to poison\" href=\"\/18.2-54.1\/\">18.2-54.1<\/a> or <a class=\"law\" title=\"Adulteration of food, drink, drugs, cosmetics, etc.; penalty\" href=\"\/18.2-54.2\/\">18.2-54.2<\/a>, two years have elapsed following the <span class=\"dictionary\">conviction<\/span> and the person has completed and been released from the term of any <span class=\"dictionary\">probation<\/span> or <span class=\"dictionary\">parole<\/span>, if applicable, or (ii) the <span class=\"dictionary\">licensee<\/span> has obtained written approval for such employment from the <span class=\"dictionary\">Authority<\/span> and, in instances in which the person has not completed or been released from the term of any <span class=\"dictionary\">probation<\/span> or <span class=\"dictionary\">parole<\/span>, the <span class=\"dictionary\">Authority<\/span> has consulted with the person&#8217;s <span class=\"dictionary\">probation<\/span> and <span class=\"dictionary\">parole<\/span> officer. <a id=\"paragraph-207786\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/4.1-225\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nGROUNDS FOR WHICH BOARD MAY SUSPEND OR REVOKE LICENSES; EXCEPTION (\u00a7 4.1-225)\n\nA. The Board may suspend or revoke any license other than a brewery license, in\nwhich case the Board may impose penalties as provided in \u00a7 4.1-227, if it has\nreasonable cause to believe that:\n\n   1. The licensee, or if the licensee is a partnership, any general partner\n   thereof, or if the licensee is an association, any member thereof, or a\n   limited partner of 10 percent or more with voting rights, or if the licensee\n   is a corporation, any officer, director, or shareholder owning 10 percent or\n   more of its capital stock, or if the licensee is a limited liability company,\n   any member-manager or any member owning 10 percent or more of the membership\n   interest of the limited liability company:\n   \t\t\t\ta. Has misrepresented a material fact in applying to the Board for such\n   license;\n   \t\t\t\tb. Within the five years immediately preceding the date of the hearing\n   held in accordance with &#xA7; 4.1-227, has (i) been convicted of a violation\n   of any law, ordinance, or regulation of the Commonwealth, of any county, city,\n   or town in the Commonwealth, of any state, or of the United States, applicable\n   to the manufacture, transportation, possession, use, or sale of alcoholic\n   beverages; (ii) violated any provision of Chapter 3 (&#xA7; 4.1-300 et seq.);\n   (iii) committed a violation of the Wine Franchise Act (&#xA7; 4.1-400 et seq.)\n   or the Beer Franchise Act (&#xA7; 4.1-500 et seq.) in bad faith; (iv) violated\n   or failed or refused to comply with any regulation, rule, or order of the\n   Board; or (v) failed or refused to comply with any of the conditions or\n   restrictions of the license granted by the Board;\n   \t\t\t\tc. Has been convicted in any court of a felony or of any crime or offense\n   involving moral turpitude under the laws of any state, or of the United\n   States;\n   \t\t\t\td. Is not the legitimate owner of the business conducted under the license\n   granted by the Board, or other persons have ownership interests in the\n   business which have not been disclosed;\n   \t\t\t\te. Cannot demonstrate financial responsibility sufficient to meet the\n   requirements of the business conducted under the license granted by the Board;\n   \t\t\t\tf. Has been intoxicated or under the influence of some self-administered\n   drug while upon the licensed premises;\n   \t\t\t\tg. Has maintained the licensed premises in an unsanitary condition, or\n   allowed such premises to become a meeting place or rendezvous for members of a\n   criminal street gang as defined in &#xA7; 18.2-46.1 or persons of ill repute,\n   or has allowed any form of illegal gambling to take place upon such premises;\n   \t\t\t\th. Knowingly employs in the business conducted under such license, as\n   agent, servant, or employee, other than a busboy, cook, or other kitchen help,\n   any person who has been convicted in any court of a felony or of any crime or\n   offense involving moral turpitude, or who has violated the laws of the\n   Commonwealth, of any other state, or of the United States, applicable to the\n   manufacture, transportation, possession, use, or sale of alcoholic beverages;\n   \t\t\t\ti. Subsequent to the granting of his original license, has demonstrated by\n   his police record a lack of respect for law and order;\n   \t\t\t\tj. Has allowed the consumption of alcoholic beverages upon the licensed\n   premises by any person whom he knew or had reason to believe was (i) less than\n   21 years of age, (ii) interdicted, or (iii) intoxicated, or has allowed any\n   person whom he knew or had reason to believe was intoxicated to loiter upon\n   such licensed premises;\n   \t\t\t\tk. Has allowed any person to consume upon the licensed premises any\n   alcoholic beverages except as provided under this subtitle;\n   \t\t\t\tl. Is physically unable to carry on the business conducted under such\n   license or has been adjudicated incapacitated;\n   \t\t\t\tm. Has allowed any obscene literature, pictures, or materials upon the\n   licensed premises;\n   \t\t\t\tn. Has possessed any illegal gambling apparatus, machine, or device upon\n   the licensed premises;\n   \t\t\t\to. Has upon the licensed premises (i) illegally possessed, distributed,\n   sold, or used, or has knowingly allowed any employee or agent, or any other\n   person, to illegally possess, distribute, sell, or use marijuana, controlled\n   substances, imitation controlled substances, drug paraphernalia, or controlled\n   paraphernalia as those terms are defined in Articles 1 (&#xA7; 18.2-247 et\n   seq.) and 1.1 (&#xA7; 18.2-265.1 et seq.) of Chapter 7 of Title 18.2 and the\n   Drug Control Act (&#xA7; 54.1-3400 et seq.); (ii) laundered money in violation\n   of &#xA7; 18.2-246.3; or (iii) conspired to commit any drug-related offense in\n   violation of Article 1 or 1.1 of Chapter 7 of Title 18.2 or the Drug Control\n   Act. The provisions of this subdivision shall also apply to any conduct\n   related to the operation of the licensed business that facilitates the\n   commission of any of the offenses set forth herein;\n   \t\t\t\tp. Has failed to take reasonable measures to prevent (i) the licensed\n   premises, (ii) any premises immediately adjacent to the licensed premises that\n   are owned or leased by the licensee, or (iii) any portion of public property\n   immediately adjacent to the licensed premises from becoming a place where\n   patrons of the establishment commit criminal violations of Article 1 (&#xA7;\n   18.2-30 et seq.), 2 (&#xA7; 18.2-38 et seq.), 2.1 (&#xA7; 18.2-46.1 et seq.),\n   2.2 (&#xA7; 18.2-46.4 et seq.), 3 (&#xA7; 18.2-47 et seq.), 4 (&#xA7; 18.2-51\n   et seq.), 5 (&#xA7; 18.2-58 et seq.), 6 (&#xA7; 18.2-59 et seq.), or 7 (&#xA7;\n   18.2-61 et seq.) of Chapter 4 of Title 18.2; Article 2 (&#xA7; 18.2-266 et\n   seq.) of Chapter 7 of Title 18.2; Article 3 (&#xA7; 18.2-346 et seq.) or 5\n   (&#xA7; 18.2-372 et seq.) of Chapter 8 of Title 18.2; or Article 1 (&#xA7;\n   18.2-404 et seq.), 2 (&#xA7; 18.2-415), or 3 (&#xA7; 18.2-416 et seq.) of\n   Chapter 9 of Title 18.2 and such violations lead to arrests that are so\n   frequent and serious as to reasonably be deemed a continuing threat to the\n   public safety; or\n   \t\t\t\tq. Has failed to take reasonable measures to prevent an act of violence\n   resulting in death or serious bodily injury, or a recurrence of such acts,\n   from occurring on (i) the licensed premises, (ii) any premises immediately\n   adjacent to the licensed premises that is owned or leased by the licensee, or\n   (iii) any portion of public property immediately adjacent to the licensed\n   premises.\n\n   2. The place occupied by the licensee:\n   \t\t\t\ta. Does not conform to the requirements of the governing body of the\n   county, city, or town in which such establishment is located, with respect to\n   sanitation, health, construction, or equipment, or to any similar requirements\n   established by the laws of the Commonwealth or by Board regulations;\n   \t\t\t\tb. Has been adjudicated a common nuisance under the provisions of this\n   subtitle or &#xA7; 18.2-258; or\n   \t\t\t\tc. Has become a meeting place or rendezvous for illegal gambling, illegal\n   users of narcotics, drunks, prostitutes, pimps, panderers, or habitual law\n   violators or has become a place where illegal drugs are regularly used or\n   distributed. The Board may consider the general reputation in the community of\n   such establishment in addition to any other competent evidence in making such\n   determination.\n\n   3. The licensee or any employee of the licensee discriminated against any\n   member of the armed forces of the United States by prices charged or\n   otherwise.\n\n   4. The licensee, his employees, or any entertainer performing on the licensed\n   premises has been convicted of a violation of a local public nudity ordinance\n   for conduct occurring on the licensed premises and the licensee allowed such\n   conduct to occur.\n\n   5. Any cause exists for which the Board would have been entitled to refuse to\n   grant such license had the facts been known.\n\n   6. The licensee is delinquent for a period of 90 days or more in the payment\n   of any taxes, or any penalties or interest related thereto, lawfully imposed\n   by the locality where the licensed business is located, as certified by the\n   treasurer, commissioner of the revenue, or finance director of such locality,\n   unless (i) the outstanding amount is de minimis; (ii) the licensee has pending\n   a bona fide application for correction or appeal with respect to such taxes,\n   penalties, or interest; or (iii) the licensee has entered into a payment plan\n   approved by the same locality to settle the outstanding liability.\n\n   7. Any other cause authorized by this subtitle.\n\nB.
