A fee as set under subsection A of &#xA7; 40.1-51.15 shall be charged for each inspection certificate issued. In lieu of such fees both for certification and recertification, an authorized owner-user inspection agency shall be charged annual filing fees as set under subsection A of &#xA7; 40.1-51.15.C\n\nRecertification shall be required as follows:1\n\nPower boilers and high pressure, high temperature water boilers shall receive a certificate inspection annually and shall also be externally inspected annually while under pressure if possible;2\n\nHeating boilers shall receive a certificate inspection biennially;3\n\nPressure vessels subject to internal corrosion shall receive a certificate inspection biennially;4\n\nPressure vessels not subject to internal corrosion shall receive a certificate inspection at intervals set by the Board, but internal inspection shall not be required of pressure vessels, the content of which are known to be noncorrosive to the material of which the shell, heads or fittings are constructed, either from the chemical composition of the contents or from evidence that the contents are adequately treated with a corrosion inhibitor, provided that such vessels are constructed in accordance with the rules and regulations of the Board;5\n\nNuclear vessels within the scope of this chapter shall be inspected and reported in such form and with such appropriate information as the Board shall designate;6\n\nA grace period of two months beyond the periods specified in subdivisions 1, 2, 3 and 4 of this subsection may elapse between certificate inspections. In lieu of such fees both for certification and recertification, an authorized <span class=\"dictionary\">owner-user inspection agency<\/span> shall be charged annual filing fees as set under subsection A of &#xA7; <a class=\"law\" title=\"Fees\" href=\"\/40.1-51.15\/\">40.1-51.15<\/a>. <a id=\"paragraph-245015\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Recertification shall be required as follows: <a id=\"paragraph-245016\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> <span class=\"dictionary\">Power boilers<\/span> and <span class=\"dictionary\">high pressure, high temperature water boilers<\/span> shall receive a <span class=\"dictionary\">certificate inspection<\/span> annually and shall also be externally inspected annually while under pressure if possible; <a id=\"paragraph-245017\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> <span class=\"dictionary\">Heating boilers<\/span> shall receive a <span class=\"dictionary\">certificate inspection<\/span> biennially; <a id=\"paragraph-245018\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Pressure vessels subject to internal corrosion shall receive a <span class=\"dictionary\">certificate inspection<\/span> biennially; <a id=\"paragraph-245019\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Pressure vessels not subject to internal corrosion shall receive a <span class=\"dictionary\">certificate inspection<\/span> at intervals set by the <span class=\"dictionary\">Board<\/span>, but internal inspection shall not be required of pressure vessels, the <span class=\"dictionary\">content<\/span> of which are known to be noncorrosive to the <span class=\"dictionary\">material<\/span> of which the shell, heads or fittings are constructed, either from the chemical composition of the <span class=\"dictionary\">contents<\/span> or from <span class=\"dictionary\">evidence<\/span> that the <span class=\"dictionary\">contents<\/span> are adequately treated with a corrosion inhibitor, provided that such vessels are constructed in accordance with the rules and regulations of the <span class=\"dictionary\">Board<\/span>; <a id=\"paragraph-245020\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Nuclear vessels within the scope of this chapter shall be inspected and reported in such form and with such appropriate information as the <span class=\"dictionary\">Board<\/span> shall designate; <a id=\"paragraph-245021\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> A grace period of two months beyond the periods specified in subdivisions 1, 2, 3 and 4 of this subsection may elapse between <span class=\"dictionary\">certificate inspections<\/span>. The Chief Inspector may extend a certificate for up to three additional months beyond such grace period subject to a satisfactory external inspection of the <span class=\"dictionary\">object<\/span> and receipt of a fee as set under subsection A of &#xA7; <a class=\"law\" title=\"Fees\" href=\"\/40.1-51.15\/\">40.1-51.15<\/a> for each month of inspection beyond the grace period. <a id=\"paragraph-245022\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#C6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Inspection requirements for operating equipment shall be in accordance with generally accepted practice and compatible with the actual service conditions and shall include but not be limited to the following criteria: <a id=\"paragraph-245023\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Previous experience, based on records of inspection, performance and maintenance; <a id=\"paragraph-245024\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Location, with respect to personnel hazard; <a id=\"paragraph-245025\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Qualifications and competency of inspection and operating personnel; <a id=\"paragraph-245026\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Provision for related safe operation controls; and <a id=\"paragraph-245027\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#D4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Interrelation with other operations outside of the scope of this chapter. <a id=\"paragraph-245028\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#D5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Based upon documentation of such actual service conditions by the owner or user of the operating equipment, the <span class=\"dictionary\">Board<\/span> may, in its discretion, permit variations in the inspection requirements as provided in this section. <a id=\"paragraph-245029\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> If, at the discretion of the <span class=\"dictionary\">Commissioner<\/span>, a hydrostatic test shall be deemed necessary, it shall be made by the owner or user of the <span class=\"dictionary\">boiler<\/span> or pressure vessel. <a id=\"paragraph-245030\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> All boilers, other than cast iron sectional boilers, and pressure vessels to be installed in this Commonwealth after the six-month period from the date upon which the rules and regulations of the <span class=\"dictionary\">Board<\/span> shall become effective shall be inspected during construction as required by the applicable rules and regulations of the <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-245031\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Ninety-one days after expiration of a certificate for any <span class=\"dictionary\">boiler<\/span> or pressure vessel subject to this section, the <span class=\"dictionary\">Commissioner<\/span> may assign an agent or special inspector to inspect such <span class=\"dictionary\">boiler<\/span> or pressure vessel, and its owner or operator shall be assessed a fee for such inspection. The fee shall be established in accordance with subsection A of &#xA7; <a class=\"law\" title=\"Fees\" href=\"\/40.1-51.15\/\">40.1-51.15<\/a>. <a id=\"paragraph-245032\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/40.1-51.10\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nRIGHT OF ACCESS TO PREMISES; CERTIFICATION AND RECERTIFICATION; INSPECTION\nREQUIREMENTS (\u00a7 40.1-51.10)\n\nA. The Commissioner, his agents or special inspectors shall have free access,\nduring reasonable hours to any premises in the Commonwealth where a boiler or\npressure vessel is being constructed, operated or maintained, or is being\ninstalled to conduct a variance review, an owner-user inspection agency audit,\nan emergency repair review, an accident investigation, a violation follow-up,\nand a secondhand or used boiler review for the purpose of ascertaining whether\nsuch boiler or pressure vessel is being constructed, operated or maintained in\naccordance with this chapter.\n\nB. On and after January 1, 1973, no boiler or pressure vessel used or proposed\nto be used within this Commonwealth, except boilers or pressure vessels exempted\nby this chapter, shall be installed, operated or maintained unless it has been\ninspected by the Commissioner, his agents or special inspectors as to\nconstruction, installation and condition and shall be certified. A fee as set\nunder subsection A of &#xA7; 40.1-51.15 shall be charged for each inspection\ncertificate issued. Nuclear vessels within the scope of this chapter shall be inspected and\n   reported in such form and with such appropriate information as the Board shall\n   designate;\n\n   6. A grace period of two months beyond the periods specified in subdivisions\n   1, 2, 3 and 4 of this subsection may elapse between certificate inspections.\n   The Chief Inspector may extend a certificate for up to three additional months\n   beyond such grace period subject to a satisfactory external inspection of the\n   object and receipt of a fee as set under subsection A of &#xA7; 40.1-51.15 for\n   each month of inspection beyond the grace period.\n\nD.
