Sess. I, c. 455.","full_text":"A\n\nThe State Office of Emergency Services is continued and shall hereafter be known as the Department of Emergency Management (the Department). Wherever the words &#8220;State Department of Emergency Services&#8221; are used in any law of the Commonwealth, they shall mean the Department of Emergency Management. During a declared emergency this Department shall revert to the operational control of the Governor. The Department shall have a coordinator who shall be appointed by and serve at the pleasure of the Governor and also serve as State Emergency Planning Director. The Department shall employ the professional, technical, secretarial, and clerical employees necessary for the performance of its functions.B\n\nThe Department shall in the administration of emergency services and disaster preparedness programs:1\n\nIn coordination with political subdivisions and state agencies, ensure that the Commonwealth has up-to-date assessments and preparedness plans to prevent, respond to, and recover from all disasters including acts of terrorism;2\n\nConduct a statewide emergency management assessment in cooperation with political subdivisions, private industry, and other public and private entities deemed vital to preparedness, public safety, and security. The assessment shall include a review of emergency response plans, which include the variety of hazards, natural and man-made. The assessment shall be updated annually;3\n\nPromulgate plans and programs that are conducive to adequate disaster mitigation preparedness, response, and recovery programs;4\n\nPrepare and maintain a State Emergency Operations Plan for disaster response and recovery operations that assigns primary and support responsibilities for basic emergency services functions to state agencies, organizations, and personnel as appropriate;5\n\nCoordinate and administer disaster mitigation, preparedness, response, and recovery plans and programs with the proponent federal, state, and local government agencies and related groups;6\n\nProvide guidance and assistance to state agencies and units of local government in developing and maintaining emergency management and continuity of operations (COOP) programs, plans, and systems;7\n\nMake necessary recommendations to agencies of the federal, state, or local governments on preventive and preparedness measures designed to eliminate or reduce disasters and their impact;8\n\nDetermine requirements of the Commonwealth and its political subdivisions for those necessities needed in the event of a declared emergency which are not otherwise readily available;9\n\nAssist state agencies and political subdivisions in establishing and operating training programs and programs of public information and education regarding emergency services and disaster preparedness activities;10\n\nConsult with the Board of Education regarding the development and revision of a model school crisis and emergency management plan for the purpose of assisting public schools in establishing, operating, and maintaining emergency services and disaster preparedness activities;11\n\nConsult with the State Council of Higher Education in the development and revision of a model institutional crisis and emergency management plan for the purpose of assisting public and private two-year and four-year institutions of higher education in establishing, operating, and maintaining emergency services and disaster preparedness activities and, as needed, in developing an institutional crisis and emergency management plan pursuant to &#xA7; 23.1-804;12\n\nDevelop standards, provide guidance, and encourage the maintenance of local and state agency emergency operations plans, which shall include the requirement for a provision that the Department of Criminal Justice Services and the Virginia Criminal Injuries Compensation Fund be contacted immediately to deploy assistance in the event of an emergency as defined in the emergency response plan when there are victims as defined in &#xA7; 19.2-11.01. The Department of Criminal Justice Services and the Virginia Criminal Injuries Compensation Fund shall be the lead coordinating agencies for those individuals determined to be victims, and the plan shall also contain current contact information for both agencies;13\n\nPrepare, maintain, coordinate, or implement emergency resource management plans and programs with federal, state, and local government agencies and related groups, and make such surveys of industries, resources, and facilities within the Commonwealth, both public and private, as are necessary to carry out the purposes of this chapter;14\n\nCoordinate with the federal government and any public or private agency or entity in achieving any purpose of this chapter and in implementing programs for disaster prevention, mitigation, preparation, response, and recovery;15\n\nEstablish guidelines pursuant to &#xA7; 44-146.28, and administer payments to eligible applicants as authorized by the Governor;16\n\nCoordinate and be responsible for the receipt, evaluation, and dissemination of emergency services intelligence pertaining to all probable hazards affecting the Commonwealth;17\n\nCoordinate intelligence activities relating to terrorism with the Department of State Police;18\n\nDevelop an emergency response plan to address the needs of individuals with household pets and service animals in the event of a disaster and assist and coordinate with local agencies in developing an emergency response plan for household pets and service animals; and19\n\nEstablish and maintain an Emergency Management Equity Working Group (the Working Group) to ensure that emergency management programs and plans provide support to at-risk individuals and populations disproportionately impacted by disasters. The Working Group shall include experts from (i) the Governor&#8217;s Office of Diversity, Equity, and Inclusion and other state agencies; (ii) the public at large; and (iii) the private sector who have expertise related to at-risk and vulnerable populations and the threats faced by such populations during a disaster.\n\t\t\t\tThe Department of Emergency Management shall ensure that all such plans, assessments, and programs required by this subsection include specific preparedness for, and response to, disasters resulting from electromagnetic pulses and geomagnetic disturbances.C\n\nThe Department of Emergency Management shall during a period of impending emergency or declared emergency be responsible for:1\n\nThe receipt, evaluation, and dissemination of intelligence pertaining to an impending or actual disaster;2\n\nProviding facilities from which state agencies and supporting organizations may conduct emergency operations;3\n\nProviding an adequate communications and warning system capable of notifying all political subdivisions in the Commonwealth of an impending disaster within a reasonable time;4\n\nEstablishing and maintaining liaison with affected political subdivisions;5\n\nDetermining requirements for disaster relief and recovery assistance;6\n\nCoordinating disaster response actions of federal, state and volunteer relief agencies; and7\n\nCoordinating and providing guidance and assistance to affected political subdivisions to ensure orderly and timely response to and recovery from disaster effects.D\n\nThe Department of Emergency Management shall be provided the necessary facilities and equipment needed to perform its normal day-to-day activities and coordinate disaster-related activities of the various federal, state, and other agencies during a state of emergency declaration by the Governor or following a major disaster declaration by the President.E\n\nThe Department of Emergency Management is authorized to enter into all contracts and agreements necessary or incidental to performance of any of its duties stated in this section or otherwise assigned to it by law, including contracts with the United States, other states, agencies and government subdivisions of the Commonwealth, and other appropriate public and private entities.F\n\nThe Department of Emergency Management shall encourage private industries whose goods and services are deemed vital to the public good to provide annually updated preparedness assessments to the local coordinator of emergency management on or before April 1 of each year, to facilitate overall Commonwealth preparedness. For the purposes of this section, &#8220;private industry&#8221; means companies, private hospitals, and other businesses or organizations deemed by the State Coordinator of Emergency Management to be essential to the public safety and well-being of the citizens of the Commonwealth.G\n\nThe Department of Emergency Management shall establish a Coordinator of Search and Rescue. Powers and duties of the Coordinator shall include:1\n\nCoordinating the search and rescue function of the Department of Emergency Management;2\n\nCoordinating with local, state, and federal agencies involved in search and rescue;3\n\nCoordinating the activities of search and rescue organizations involved in search and rescue;4\n\nMaintaining a register of search and rescue certifications, training, and responses;5\n\nEstablishing a memorandum of understanding with the Virginia Search and Rescue Council and its respective member agencies regarding search and rescue efforts;6\n\nProviding on-scene search and rescue coordination when requested by an authorized person;7\n\nProviding specialized search and rescue training to police, fire-rescue, EMS, emergency managers, volunteer search and rescue responders, and others who might have a duty to respond to a search and rescue emergency;8\n\nGathering and maintaining statistics on search and rescue in the Commonwealth;9\n\nCompiling, maintaining, and making available an inventory of search and rescue resources available in the Commonwealth; and10\n\nPeriodically reviewing search and rescue cases and developing best professional practices.\n\t\t\t\tNothing in this chapter shall be construed as authorizing the Department of Emergency Management to take direct operational responsibilities from local, state, or federal law enforcement in the course of search and rescue or missing person cases.","order_by":null,"text":{"0":{"id":203679,"text":"The State Office of Emergency Services is continued and shall hereafter be known as the Department of Emergency Management (the Department). The Department shall employ the professional, technical, secretarial, and clerical employees necessary for the performance of its functions. <a id=\"paragraph-203679\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The Department shall in the administration of emergency services and <span class=\"dictionary\">disaster<\/span> preparedness programs: <a id=\"paragraph-203680\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> In coordination with <span class=\"dictionary\">political subdivisions<\/span> and state agencies, ensure that the Commonwealth has up-to-date assessments and preparedness plans to prevent, respond to, and recover from all <span class=\"dictionary\">disasters<\/span> including acts of terrorism; <a id=\"paragraph-203681\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Conduct a statewide emergency management assessment in cooperation with <span class=\"dictionary\">political subdivisions<\/span>, <span class=\"dictionary\">private industry<\/span>, and other public and private entities deemed vital to preparedness, public safety, and security. The assessment shall include a review of emergency response plans, which include the variety of hazards, natural and man-made. The assessment shall be updated annually; <a id=\"paragraph-203682\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Promulgate plans and programs that are conducive to adequate <span class=\"dictionary\">disaster<\/span> mitigation preparedness, response, and recovery programs; <a id=\"paragraph-203683\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Prepare and maintain a State Emergency Operations Plan for <span class=\"dictionary\">disaster<\/span> response and recovery operations that assigns primary and support responsibilities for basic emergency services functions to state agencies, organizations, and personnel as appropriate; <a id=\"paragraph-203684\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Coordinate and administer <span class=\"dictionary\">disaster<\/span> mitigation, preparedness, response, and recovery plans and programs with the proponent federal, state, and local government agencies and related groups; <a id=\"paragraph-203685\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Provide guidance and assistance to state agencies and units of local government in developing and maintaining emergency management and continuity of operations (COOP) programs, plans, and systems; <a id=\"paragraph-203686\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Make necessary recommendations to agencies of the federal, state, or local governments on preventive and preparedness measures designed to eliminate or reduce <span class=\"dictionary\">disasters<\/span> and their impact; <a id=\"paragraph-203687\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Determine requirements of the Commonwealth and its <span class=\"dictionary\">political subdivisions<\/span> for those necessities needed in the event of a declared emergency which are not otherwise readily available; <a id=\"paragraph-203688\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Assist state agencies and <span class=\"dictionary\">political subdivisions<\/span> in establishing and operating training programs and programs of public information and education regarding emergency services and <span class=\"dictionary\">disaster<\/span> preparedness activities; <a id=\"paragraph-203689\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Consult with the Board of Education regarding the development and revision of a model school crisis and emergency management plan for the purpose of assisting public schools in establishing, operating, and maintaining emergency services and <span class=\"dictionary\">disaster<\/span> preparedness activities; <a id=\"paragraph-203690\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Consult with the State Council of Higher Education in the development and revision of a model institutional crisis and emergency management plan for the purpose of assisting public and private two-year and four-year institutions of higher education in establishing, operating, and maintaining emergency services and <span class=\"dictionary\">disaster<\/span> preparedness activities and, as needed, in developing an institutional crisis and emergency management plan pursuant to &#xA7; <a class=\"law\" title=\"Institutional crisis and emergency management plan\" href=\"\/23.1-804\/\">23.1-804<\/a>; <a id=\"paragraph-203691\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Develop standards, provide guidance, and encourage the maintenance of local and state agency emergency operations plans, which shall include the requirement for a provision that the Department of Criminal Justice Services and the Virginia Criminal Injuries Compensation Fund be contacted immediately to deploy assistance in the event of an emergency as defined in the emergency response plan when there are victims as defined in &#xA7; <a class=\"law\" title=\"Crime victim and witness rights\" href=\"\/19.2-11.01\/\">19.2-11.01<\/a>. The Department of Criminal Justice Services and the Virginia Criminal Injuries Compensation Fund shall be the lead coordinating agencies for those <span class=\"dictionary\">individuals<\/span> determined to be victims, and the plan shall also contain current contact information for both agencies; <a id=\"paragraph-203692\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Prepare, maintain, coordinate, or implement emergency resource management plans and programs with federal, state, and local government agencies and related groups, and make such surveys of industries, resources, and facilities within the Commonwealth, both public and private, as are necessary to carry out the purposes of this chapter; <a id=\"paragraph-203693\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Coordinate with the federal government and any public or private agency or entity in achieving any purpose of this chapter and in implementing programs for <span class=\"dictionary\">disaster<\/span> prevention, mitigation, preparation, response, and recovery; <a id=\"paragraph-203694\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B15\" class=\"indent-1\"><p><span class=\"prefix-number\">15.<\/span> Establish guidelines pursuant to &#xA7; <a class=\"law\" title=\"Authority of Governor and agencies under his control in declared state of emergency\" href=\"\/44-146.28\/\">44-146.28<\/a>, and administer payments to eligible applicants as authorized by the Governor; <a id=\"paragraph-203695\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B16\" class=\"indent-1\"><p><span class=\"prefix-number\">16.<\/span> Coordinate and be responsible for the receipt, evaluation, and dissemination of emergency services intelligence pertaining to all probable hazards affecting the Commonwealth; <a id=\"paragraph-203696\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B17\" class=\"indent-1\"><p><span class=\"prefix-number\">17.<\/span> Coordinate intelligence activities relating to terrorism with the Department of State Police; <a id=\"paragraph-203697\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B18\" class=\"indent-1\"><p><span class=\"prefix-number\">18.<\/span> Develop an emergency response plan to address the needs of <span class=\"dictionary\">individuals<\/span> with household pets and service animals in the event of a <span class=\"dictionary\">disaster<\/span> and assist and coordinate with local agencies in developing an emergency response plan for household pets and service animals; and <a id=\"paragraph-203698\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B18\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B19\" class=\"indent-1\"><p><span class=\"prefix-number\">19.<\/span> Establish and maintain an Emergency Management <span class=\"dictionary\">Equity<\/span> Working Group (the Working Group) to ensure that emergency management programs and plans provide support to at-risk <span class=\"dictionary\">individuals<\/span> and populations disproportionately impacted by <span class=\"dictionary\">disasters<\/span>. The Working Group shall include experts from (i) the Governor&#8217;s Office of Diversity, <span class=\"dictionary\">Equity<\/span>, and Inclusion and other state agencies; (ii) the public at large; and (iii) the private sector who have expertise related to at-risk and vulnerable populations and the threats faced by such populations during a <span class=\"dictionary\">disaster<\/span>.\n\t\t\t\tThe Department of Emergency Management shall ensure that all such plans, assessments, and programs required by this subsection include specific preparedness for, and response to, <span class=\"dictionary\">disasters<\/span> resulting from electromagnetic pulses and geomagnetic disturbances. <a id=\"paragraph-203699\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#B19\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The Department of Emergency Management shall during a period of impending emergency or declared emergency be responsible for: <a id=\"paragraph-203700\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The receipt, evaluation, and dissemination of intelligence pertaining to an impending or actual <span class=\"dictionary\">disaster<\/span>; <a id=\"paragraph-203701\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Providing facilities from which state agencies and supporting organizations may conduct emergency operations; <a id=\"paragraph-203702\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Providing an adequate communications and warning system capable of notifying all <span class=\"dictionary\">political subdivisions<\/span> in the Commonwealth of an impending <span class=\"dictionary\">disaster<\/span> within a reasonable time; <a id=\"paragraph-203703\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Establishing and maintaining liaison with affected <span class=\"dictionary\">political subdivisions<\/span>; <a id=\"paragraph-203704\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Determining requirements for <span class=\"dictionary\">disaster<\/span> relief and recovery assistance; <a id=\"paragraph-203705\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Coordinating <span class=\"dictionary\">disaster<\/span> response actions of federal, state and volunteer relief agencies; and <a id=\"paragraph-203706\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Coordinating and providing guidance and assistance to affected <span class=\"dictionary\">political subdivisions<\/span> to ensure orderly and timely response to and recovery from <span class=\"dictionary\">disaster<\/span> effects. <a id=\"paragraph-203707\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#C7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The Department of Emergency Management shall be provided the necessary facilities and equipment needed to perform its normal day-to-day activities and coordinate disaster-related activities of the various federal, state, and other agencies during a <span class=\"dictionary\">state of emergency<\/span> declaration by the Governor or following a <span class=\"dictionary\">major disaster<\/span> declaration by the President. <a id=\"paragraph-203708\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The Department of Emergency Management is authorized to enter into all <span class=\"dictionary\">contracts<\/span> and agreements necessary or incidental to performance of any of its duties stated in this section or otherwise assigned to it by <span class=\"dictionary\">law<\/span>, including <span class=\"dictionary\">contracts<\/span> with the United States, other states, agencies and government subdivisions of the Commonwealth, and other appropriate public and private entities. <a id=\"paragraph-203709\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The Department of Emergency Management shall encourage private industries whose goods and services are deemed vital to the public good to provide annually updated preparedness assessments to the local coordinator of emergency management on or before April 1 of each year, to facilitate overall Commonwealth preparedness. For the purposes of this section, &#8220;<span class=\"dictionary\">private industry<\/span>&#8221; means companies, private hospitals, and other businesses or organizations deemed by the State Coordinator of Emergency Management to be essential to the public safety and well-being of the citizens of the Commonwealth. <a id=\"paragraph-203710\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The Department of Emergency Management shall establish a Coordinator of Search and Rescue. Powers and duties of the Coordinator shall include: <a id=\"paragraph-203711\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Coordinating the search and rescue function of the Department of Emergency Management; <a id=\"paragraph-203712\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Coordinating with local, state, and federal agencies involved in search and rescue; <a id=\"paragraph-203713\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Coordinating the activities of search and rescue organizations involved in search and rescue; <a id=\"paragraph-203714\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Maintaining a register of search and rescue certifications, training, and responses; <a id=\"paragraph-203715\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Establishing a <span class=\"dictionary\">memorandum<\/span> of understanding with the Virginia Search and Rescue Council and its respective member agencies regarding search and rescue efforts; <a id=\"paragraph-203716\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Providing on-scene search and rescue coordination when requested by an authorized person; <a id=\"paragraph-203717\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Providing specialized search and rescue training to police, fire-rescue, EMS, emergency managers, volunteer search and rescue responders, and others who might have a duty to respond to a search and rescue emergency; <a id=\"paragraph-203718\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Gathering and maintaining statistics on search and rescue in the Commonwealth; <a id=\"paragraph-203719\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Compiling, maintaining, and making available an inventory of search and rescue resources available in the Commonwealth; and <a id=\"paragraph-203720\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Periodically reviewing search and rescue cases and developing best professional practices.\n\t\t\t\tNothing in this chapter shall be construed as authorizing the Department of Emergency Management to take direct operational responsibilities from local, state, or federal <span class=\"dictionary\">law<\/span> enforcement in the course of search and rescue or missing person cases. <a id=\"paragraph-203721\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/44-146.18\/#G10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDEPARTMENT OF EMERGENCY MANAGEMENT; ADMINISTRATION AND OPERATIONAL CONTROL;\nCOORDINATOR AND OTHER PERSONNEL; POWERS AND DUTIES (\u00a7 44-146.18)\n\nA. The State Office of Emergency Services is continued and shall hereafter be\nknown as the Department of Emergency Management (the Department). Wherever the\nwords &#8220;State Department of Emergency Services&#8221; are used in any law\nof the Commonwealth, they shall mean the Department of Emergency Management.\nDuring a declared emergency this Department shall revert to the operational\ncontrol of the Governor. The Department shall have a coordinator who shall be\nappointed by and serve at the pleasure of the Governor and also serve as State\nEmergency Planning Director. The Department shall employ the professional,\ntechnical, secretarial, and clerical employees necessary for the performance of\nits functions.\n\nB. The Department shall in the administration of emergency services and disaster\npreparedness programs:\n\n   1. In coordination with political subdivisions and state agencies, ensure that\n   the Commonwealth has up-to-date assessments and preparedness plans to prevent,\n   respond to, and recover from all disasters including acts of terrorism;\n\n   2. Conduct a statewide emergency management assessment in cooperation with\n   political subdivisions, private industry, and other public and private\n   entities deemed vital to preparedness, public safety, and security. The\n   assessment shall include a review of emergency response plans, which include\n   the variety of hazards, natural and man-made. The assessment shall be updated\n   annually;\n\n   3. Promulgate plans and programs that are conducive to adequate disaster\n   mitigation preparedness, response, and recovery programs;\n\n   4. Prepare and maintain a State Emergency Operations Plan for disaster\n   response and recovery operations that assigns primary and support\n   responsibilities for basic emergency services functions to state agencies,\n   organizations, and personnel as appropriate;\n\n   5. Coordinate and administer disaster mitigation, preparedness, response, and\n   recovery plans and programs with the proponent federal, state, and local\n   government agencies and related groups;\n\n   6. Provide guidance and assistance to state agencies and units of local\n   government in developing and maintaining emergency management and continuity\n   of operations (COOP) programs, plans, and systems;\n\n   7. Make necessary recommendations to agencies of the federal, state, or local\n   governments on preventive and preparedness measures designed to eliminate or\n   reduce disasters and their impact;\n\n   8. Determine requirements of the Commonwealth and its political subdivisions\n   for those necessities needed in the event of a declared emergency which are\n   not otherwise readily available;\n\n   9. Assist state agencies and political subdivisions in establishing and\n   operating training programs and programs of public information and education\n   regarding emergency services and disaster preparedness activities;\n\n   10. Consult with the Board of Education regarding the development and revision\n   of a model school crisis and emergency management plan for the purpose of\n   assisting public schools in establishing, operating, and maintaining emergency\n   services and disaster preparedness activities;\n\n   11. Consult with the State Council of Higher Education in the development and\n   revision of a model institutional crisis and emergency management plan for the\n   purpose of assisting public and private two-year and four-year institutions of\n   higher education in establishing, operating, and maintaining emergency\n   services and disaster preparedness activities and, as needed, in developing an\n   institutional crisis and emergency management plan pursuant to &#xA7;\n   23.1-804;\n\n   12. Develop standards, provide guidance, and encourage the maintenance of\n   local and state agency emergency operations plans, which shall include the\n   requirement for a provision that the Department of Criminal Justice Services\n   and the Virginia Criminal Injuries Compensation Fund be contacted immediately\n   to deploy assistance in the event of an emergency as defined in the emergency\n   response plan when there are victims as defined in &#xA7; 19.2-11.01. The\n   Department of Criminal Justice Services and the Virginia Criminal Injuries\n   Compensation Fund shall be the lead coordinating agencies for those\n   individuals determined to be victims, and the plan shall also contain current\n   contact information for both agencies;\n\n   13.
