I, c. 387; 2025, cc. 91, 109.","full_text":"A\n\nPrior to commencing mining activity, the operator of a coal mine or his agent shall make or cause to be made, unless already made and filed, an accurate map of such mine. Such map shall be submitted to the Chief prior to producing coal at the mine. All maps shall be presented on the Virginia Coordinate System of 2022, South Zone, unless otherwise approved by the Chief. At intervals not to exceed 12 months and when a coal mine is abandoned, the operator shall submit to the Chief copies of an up-to-date map of the entire mine in an electronic format approved by the Chief. The operator shall also submit to the Chief revisions that show directional changes whenever mine projections deviate more than 600 feet from the approved mine map. Only maps in an electronic format shall be accepted unless otherwise approved by the Chief. If there are no changes in the information required to be submitted pursuant to this section at the time an updated map is due, the operator may submit a notice that there are no changes to the map in lieu of submitting an updated map to the Department.B\n\nUnderground coal mine maps shall show:1\n\nThe active workings;2\n\nAll pillared, worked out, and abandoned areas, except as provided in this section;3\n\nEntries and air courses with the quantity of airflow, direction of airflow indicated by arrows, and ventilation controls;4\n\nContour lines of all elevations;5\n\nDip of the coalbed;6\n\nEscapeways;7\n\nThe locations that are known or should be known of (i) adjacent mine workings within 1,000 feet, (ii) mines above or below, and (iii) water pools above;8\n\nEither producing or abandoned oil and gas wells located within 500 feet of such mine and in any underground area of such mine; and9\n\nOther information the Chief requires.\n\t\t\t\tSuch map shall identify those areas of the mine that have been pillared, worked out, or abandoned that are inaccessible or that cannot be entered safely.C\n\nAdditional information required to be shown on underground coal mine maps includes:1\n\nThe mine name, company name, mine index number, and name of the person responsible for information on the map;2\n\nThe scale and orientation of the map and symbols used on the map;3\n\nThe property or boundary lines of the mine;4\n\nAll known drill holes that penetrate the coalbed being mined;5\n\nAll shaft, slope, drift, and tunnel openings and auger and strip mined areas of the coalbed being mined;6\n\nThe location of all surface mine ventilation fans. The location may be designated on the mine map by symbols;7\n\nThe location of railroad tracks and public highways leading to the mine and mine buildings of a permanent nature with identifying names shown;8\n\nThe location and description of a least two permanent base line points coordinated with the underground and surface mine traverses and the location and description of at least two permanent elevation bench marks used in connection with establishing or referencing mine elevation surveys;9\n\nThe location and elevation of any body of water dammed or held back in any portion of the mine; however, such bodies of water may be shown on overlays or tracings attached to the mine maps used to show contour lines as provided under subdivision 12;10\n\nThe elevations of tops and bottoms of shafts and slopes and the floor at the entrance to drift and tunnel openings;11\n\nThe elevation of the floor at intervals of not more than 200 feet in (i) at least one entry of each working section and main and cross entries; (ii) the last line of open crosscuts of each working section, and main and cross entries before such sections and main and cross entries that are abandoned; and (iii) rooms advancing toward or adjacent to property or boundary lines or adjacent mines; and12\n\nContour lines passing through whole number elevations of the coalbed being mined. The spacing of such lines shall not exceed 10-foot elevation levels, except that a broader spacing of contour lines may be approved by the Chief for steeply pitching coalbeds. Contour lines may be placed on overlays or tracings attached to mine maps.D\n\nUnderground coal mine maps submitted to the Chief shall be on a scale of not less than 100 or more than 500 feet to the inch. Mapping of the underground mine works shall be completed by a closed loop survey method of traversing or other equally accurate methods of traversing. All closed loop surveys shall meet a minimum accuracy standard of one part in 5,000. Elevations shall be tied to either the United States Geological Survey or the National Geodetic Survey bench mark system. A registered engineer or licensed land surveyor shall certify that the map of the mine workings is accurate.E\n\nUnderground coal mine maps shall be kept up to date by temporary notations and revised and supplemented at intervals not to exceed six months based on a survey made and certified by a registered engineer or licensed land surveyor who has exercised complete direction and control over the work to which it is affixed. Temporary notations shall include:1\n\nThe location of each working face of each working place;2\n\nPillars mined or other such second mining;3\n\nPermanent ventilation controls constructed or removed, such as seals, overcasts, undercasts, regulators, and permanent stoppings, and the direction of air currents indicated; and4\n\nEscapeways designated by means of symbols.F\n\nAt underground coal mines, an accurate map of the mine showing clearly all avenues of ingress and egress in case of fire shall be posted in a place accessible to all miners.G\n\nSurface coal mine maps shall show:1\n\nThe name and address of the mine;2\n\nThe property or boundary lines of the active areas of the mine;3\n\nContour lines passing through whole number elevations of the coalbed being mined. The spacing of such lines shall not exceed 25-foot elevation levels, except that a broader spacing of contour lines may be approved by the Chief for steeply pitching coalbeds. The Chief may approve alternate means of delineating seam elevations where multiple seams are being mined. Contour lines may be placed on overlays or tracings attached to mine maps;4\n\nThe general elevation of each coalbed being mined and the general elevation of the surface;5\n\nEach producing or abandoned gas or oil well or gas transmission line located on the mine property;6\n\nThe location and elevation of any body of water dammed or held back in any portion of the mine; however, such body of water may be shown on overlays or tracings attached to the mine maps;7\n\nEvery prospect drill hole that penetrates a coalbed being mined on the mine property;8\n\nEvery auger or surface-mined area of a coalbed being mined on the mine property together with the line of maximum depth of holes drilled during auger mining operations;9\n\nAll worked out and abandoned areas;10\n\nThe location of railroad tracks and public highways leading to the mine and mine buildings of a permanent nature with identifying names shown;11\n\nUnderground coal mine workings underlying and within 1,000 feet of any active area of the mine;12\n\nThe location and description of at least two permanent baseline points and the location and description of at least two permanent elevation bench marks used in connection with establishing or referencing mine elevation surveys;13\n\nThe scale of the map; and14\n\nOther information required by the Chief.H\n\nSurface coal mine maps shall be kept up to date by temporary notations and revised and supplemented at intervals not to exceed six months based on a survey made and certified by a registered engineer or licensed land surveyor who has exercised complete direction and control over the work to which it is affixed. The spacing of such lines shall not exceed 10-foot elevation levels, except that a broader spacing of contour lines may be approved by the <span class=\"dictionary\">Chief<\/span> for steeply pitching coalbeds. Contour lines may be placed on overlays or tracings attached to mine maps. <a id=\"paragraph-220483\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#C12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Underground coal mine maps submitted to the <span class=\"dictionary\">Chief<\/span> shall be on a scale of not less than 100 or more than 500 feet to the inch. Mapping of the underground mine works shall be completed by a closed loop survey method of traversing or other equally accurate methods of traversing. All closed loop surveys shall meet a minimum accuracy standard of one part in 5,000. Elevations shall be tied to either the United States Geological Survey or the National Geodetic Survey bench mark system. A registered engineer or licensed land surveyor shall certify that the map of the mine workings is accurate. <a id=\"paragraph-220484\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Underground coal mine maps shall be kept up to date by temporary notations and revised and supplemented at intervals not to exceed six months based on a survey made and certified by a registered engineer or licensed land surveyor who has exercised complete direction and control over the work to which it is affixed. Temporary notations shall include: <a id=\"paragraph-220485\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The location of each working face of each working place; <a id=\"paragraph-220486\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Pillars mined or other such second mining; <a id=\"paragraph-220487\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Permanent ventilation controls constructed or removed, such as seals, overcasts, undercasts, regulators, and permanent stoppings, and the direction of air currents indicated; and <a id=\"paragraph-220488\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#E3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Escapeways designated by means of symbols. <a id=\"paragraph-220489\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#E4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> At underground coal mines, an accurate map of the mine showing clearly all avenues of ingress and egress in case of fire shall be posted in a place accessible to all miners. <a id=\"paragraph-220490\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Surface coal mine maps shall show: <a id=\"paragraph-220491\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The name and address of the mine; <a id=\"paragraph-220492\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The property or boundary lines of the active areas of the mine; <a id=\"paragraph-220493\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Contour lines passing through whole number elevations of the coalbed being mined. The spacing of such lines shall not exceed 25-foot elevation levels, except that a broader spacing of contour lines may be approved by the <span class=\"dictionary\">Chief<\/span> for steeply pitching coalbeds. The <span class=\"dictionary\">Chief<\/span> may approve alternate means of delineating seam elevations where multiple seams are being mined. Contour lines may be placed on overlays or tracings attached to mine maps; <a id=\"paragraph-220494\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> The general elevation of each coalbed being mined and the general elevation of the surface; <a id=\"paragraph-220495\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Each producing or abandoned gas or oil well or gas transmission line located on the mine property; <a id=\"paragraph-220496\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> The location and elevation of any body of water dammed or held back in any portion of the mine; however, such body of water may be shown on overlays or tracings attached to the mine maps; <a id=\"paragraph-220497\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Every prospect drill hole that penetrates a coalbed being mined on the mine property; <a id=\"paragraph-220498\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Every auger or surface-mined area of a coalbed being mined on the mine property together with the line of maximum depth of holes drilled during auger mining operations; <a id=\"paragraph-220499\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> All worked out and abandoned areas; <a id=\"paragraph-220500\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> The location of railroad tracks and public highways leading to the mine and mine buildings of a permanent nature with identifying names shown; <a id=\"paragraph-220501\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Underground coal mine workings underlying and within 1,000 feet of any active area of the mine; <a id=\"paragraph-220502\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> The location and description of at least two permanent baseline points and the location and description of at least two permanent elevation bench marks used in connection with establishing or referencing mine elevation surveys; <a id=\"paragraph-220503\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> The scale of the map; and <a id=\"paragraph-220504\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> Other information required by the <span class=\"dictionary\">Chief<\/span>. <a id=\"paragraph-220505\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#G14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Surface coal mine maps shall be kept up to date by temporary notations and revised and supplemented at intervals not to exceed six months based on a survey made and certified by a registered engineer or licensed land surveyor who has exercised complete direction and control over the work to which it is affixed. The monuments shall be clearly referenced on the mine map. Elevations shall be tied to either the United States Geological Survey or the National Geodetic Survey bench mark system. <a id=\"paragraph-220510\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> The original map, or a true copy thereof, shall be left by the operator at the active mine, open at all reasonable times for the examination and use of the mine inspector. <a id=\"paragraph-220511\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> Such maps may be used by the <span class=\"dictionary\">Department<\/span> for the evaluation of the coal resources of the Commonwealth. <a id=\"paragraph-220512\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"L\"><p><span class=\"prefix-number\">L.<\/span> The map shall be filed and preserved among the records of the <span class=\"dictionary\">Department<\/span> and copies of such maps shall be made available at a reasonable cost. <a id=\"paragraph-220513\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#L\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"M\"><p><span class=\"prefix-number\">M.<\/span> Any person who has conducted mining operations or prepared mine maps and who has a map or surveying data of any worked out or abandoned underground coal mine shall on request make such map or data available to the <span class=\"dictionary\">Department<\/span> to copy or reproduce. <a id=\"paragraph-220514\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/45.2-542\/#M\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(FOR CONTINGENT EFFECTIVE DATE, SEE ACTS 2025, CC. 91 AND 109, CL. 2) MAPS OF\nMINES REQUIRED TO BE MADE; CONTENTS; EXTENSION AND PRESERVATION; USE BY\nDEPARTMENT; RELEASE; POSTING OF MAP (\u00a7 45.2-542)\n\nA. Prior to commencing mining activity, the operator of a coal mine or his agent\nshall make or cause to be made, unless already made and filed, an accurate map\nof such mine. Such map shall be submitted to the Chief prior to producing coal\nat the mine. All maps shall be presented on the Virginia Coordinate System of\n2022, South Zone, unless otherwise approved by the Chief. At intervals not to\nexceed 12 months and when a coal mine is abandoned, the operator shall submit to\nthe Chief copies of an up-to-date map of the entire mine in an electronic format\napproved by the Chief. The operator shall also submit to the Chief revisions\nthat show directional changes whenever mine projections deviate more than 600\nfeet from the approved mine map. Only maps in an electronic format shall be\naccepted unless otherwise approved by the Chief. If there are no changes in the\ninformation required to be submitted pursuant to this section at the time an\nupdated map is due, the operator may submit a notice that there are no changes\nto the map in lieu of submitting an updated map to the Department.\n\nB. Underground coal mine maps shall show:\n\n   1. The active workings;\n\n   2. All pillared, worked out, and abandoned areas, except as provided in this\n   section;\n\n   3. Entries and air courses with the quantity of airflow, direction of airflow\n   indicated by arrows, and ventilation controls;\n\n   4. Contour lines of all elevations;\n\n   5. Dip of the coalbed;\n\n   6. Escapeways;\n\n   7. The locations that are known or should be known of (i) adjacent mine\n   workings within 1,000 feet, (ii) mines above or below, and (iii) water pools\n   above;\n\n   8. Either producing or abandoned oil and gas wells located within 500 feet of\n   such mine and in any underground area of such mine; and\n\n   9. Other information the Chief requires.\n   \t\t\t\tSuch map shall identify those areas of the mine that have been pillared,\n   worked out, or abandoned that are inaccessible or that cannot be entered\n   safely.\n\nC. Additional information required to be shown on underground coal mine maps\nincludes:\n\n   1. The mine name, company name, mine index number, and name of the person\n   responsible for information on the map;\n\n   2. The scale and orientation of the map and symbols used on the map;\n\n   3. The property or boundary lines of the mine;\n\n   4. All known drill holes that penetrate the coalbed being mined;\n\n   5. All shaft, slope, drift, and tunnel openings and auger and strip mined\n   areas of the coalbed being mined;\n\n   6. The location of all surface mine ventilation fans. The location may be\n   designated on the mine map by symbols;\n\n   7. The location of railroad tracks and public highways leading to the mine and\n   mine buildings of a permanent nature with identifying names shown;\n\n   8. The location and description of a least two permanent base line points\n   coordinated with the underground and surface mine traverses and the location\n   and description of at least two permanent elevation bench marks used in\n   connection with establishing or referencing mine elevation surveys;\n\n   9. The location and elevation of any body of water dammed or held back in any\n   portion of the mine; however, such bodies of water may be shown on overlays or\n   tracings attached to the mine maps used to show contour lines as provided\n   under subdivision 12;\n\n   10. The elevations of tops and bottoms of shafts and slopes and the floor at\n   the entrance to drift and tunnel openings;\n\n   11. The elevation of the floor at intervals of not more than 200 feet in (i)\n   at least one entry of each working section and main and cross entries; (ii)\n   the last line of open crosscuts of each working section, and main and cross\n   entries before such sections and main and cross entries that are abandoned;\n   and (iii) rooms advancing toward or adjacent to property or boundary lines or\n   adjacent mines; and\n\n   12. Contour lines passing through whole number elevations of the coalbed being\n   mined. The spacing of such lines shall not exceed 10-foot elevation levels,\n   except that a broader spacing of contour lines may be approved by the Chief\n   for steeply pitching coalbeds. Contour lines may be placed on overlays or\n   tracings attached to mine maps.\n\nD. Underground coal mine maps submitted to the Chief shall be on a scale of not\nless than 100 or more than 500 feet to the inch. Mapping of the underground mine\nworks shall be completed by a closed loop survey method of traversing or other\nequally accurate methods of traversing. All closed loop surveys shall meet a\nminimum accuracy standard of one part in 5,000. Elevations shall be tied to\neither the United States Geological Survey or the National Geodetic Survey bench\nmark system.
