I, cc. 45, 51.","full_text":"A\n\nAs used in this article, unless the context requires a different meaning:\n\t\t\t&#8220;Front side windows&#8221; means those windows located adjacent to and forward of the driver&#8217;s seat.\n\t\t\t&#8220;Holographic effect&#8221; means a picture or image that may remain constant or change as the viewing angle is changed.\n\t\t\t&#8220;Multipurpose passenger vehicle&#8221; means any motor vehicle that is (i) designed to carry no more than 10 persons and (ii) constructed either on a truck chassis or with special features for occasional off-road use.\n\t\t\t&#8220;Prism effect&#8221; means a visual, iridescent, or rainbow-like effect that separates light into various colored components that may change depending on viewing angle.\n\t\t\t&#8220;Rear side windows&#8221; means those windows located to the rear of the driver&#8217;s seat.\n\t\t\t&#8220;Rear window&#8221; or &#8220;rear windows&#8221; means those windows that are located to the rear of the passenger compartment of a motor vehicle and that are approximately parallel to the windshield.B\n\nExcept as otherwise provided in this article or permitted by federal law, it shall be unlawful for any person to operate any motor vehicle on a highway with any sign, poster, colored or tinted film, sun-shading material, or other colored material on the windshield, front or rear side windows, or rear windows of such motor vehicle. This provision, however, shall not apply to any certificate or other paper required by law or permitted by the Superintendent to be placed on a motor vehicle&#8217;s windshield or window.\n\t\t\tThe size of stickers or decals used by counties, cities, and towns in lieu of license plates shall be in compliance with regulations promulgated by the Superintendent. Such stickers shall be affixed on the windshield at a location designated by the Superintendent.C\n\nNotwithstanding the foregoing provisions of this section, whenever a motor vehicle is equipped with a mirror on each side of such vehicle, so located as to reflect to the driver of such vehicle a view of the highway for at least 200 feet to the rear of such vehicle, any or all of the following shall be lawful:1\n\nTo drive a motor vehicle equipped with one optically grooved clear plastic right-angle rear view lens attached to one rear window of such motor vehicle, not exceeding 18 inches in diameter in the case of a circular lens or not exceeding 11 inches by 14 inches in the case of a rectangular lens, which enables the driver of the motor vehicle to view below the line of sight as viewed through the rear window;2\n\nTo have affixed to the rear side windows, rear window or windows of a motor vehicle any sticker or stickers, regardless of size; or3\n\nTo drive a motor vehicle when the driver&#8217;s clear view of the highway through the rear window or windows is otherwise obstructed.D\n\nExcept as provided in \u00a7 46.2-1053, but notwithstanding the foregoing provisions of this section, no sun-shading or tinting film may be applied or affixed to any window of a motor vehicle unless such motor vehicle is equipped with a mirror on each side of such motor vehicle, so located as to reflect to the driver of the vehicle a view of the highway for at least 200 feet to the rear of such vehicle, and the sun-shading or tinting film is applied or affixed in accordance with the following:1\n\nNo sun-shading or tinting films may be applied or affixed to the rear side windows or rear window or windows of any motor vehicle operated on the highways of the Commonwealth that reduce the total light transmittance of such window to less than 35 percent;2\n\nNo sun-shading or tinting films may be applied or affixed to the front side windows of any motor vehicle operated on the highways of the Commonwealth that reduce total light transmittance of such window to less than 50 percent;3\n\nNo sun-shading or tinting films shall be applied or affixed to any window of a motor vehicle that (i) have a reflectance of light exceeding 20 percent or (ii) produce a holographic or prism effect.\n\t\t\t\tAny person who operates a motor vehicle on the highways of the Commonwealth with sun-shading or tinting films that (i) have a total light transmittance less than that required by subdivisions 1 and 2, (ii) have a reflectance of light exceeding 20 percent, or (iii) produce holographic or prism effects is guilty of a traffic infraction but shall not be awarded any demerit points by the Commissioner for the violation.\n\t\t\t\tAny person or firm who applies or affixes to the windows of any motor vehicle in Virginia sun-shading or tinting films that (i) reduce the light transmittance to levels less than that allowed in subdivisions 1 and 2, (ii) have a reflectance of light exceeding 20 percent, or (iii) produce holographic or prism effects is guilty of a Class 3 misdemeanor for the first offense and of a Class 2 misdemeanor for any subsequent offense.E\n\nThe Division of Purchases and Supply, pursuant to &#xA7; 2.2-1112, shall determine the proper standards for equipment or devices used to measure light transmittance through windows of motor vehicles. Law-enforcement officers shall use only such equipment or devices to measure light transmittance through windows that meet the standards established by the Division. Such measurements made by law-enforcement officers shall be given a tolerance of minus seven percentage points.F\n\nNo film or darkening material may be applied on the windshield except to replace the sunshield in the uppermost area as installed by the manufacturer of the vehicle.G\n\nNothing in this section shall prohibit the affixing to the rear window of a motor vehicle of a single sticker no larger than 20 square inches if such sticker is totally contained within the lower five inches of the glass of the rear window, nor shall subsection C apply to a motor vehicle to which but one such sticker is so affixed.H\n\nNothing in this section shall prohibit applying to the rear side windows or rear window of any multipurpose passenger vehicle or pickup truck sun-shading or tinting films that reduce the total light transmittance of such window or windows below 35 percent.I\n\nNotwithstanding the foregoing provisions of this section, sun-shading material which was applied or installed prior to July 1, 1987, in a manner and on which windows not then in violation of Virginia law, shall continue to be lawful, provided that it can be shown by appropriate receipts that such material was installed prior to July 1, 1987.J\n\nWhere a person is convicted within one year of a second or subsequent violation of this section involving the operation of the same vehicle having a tinted or smoked windshield, the court, in addition to any other penalty, may order the person so convicted to remove such tinted or smoked windshield from the vehicle.K\n\nThe provisions of this section shall not apply to law-enforcement vehicles.L\n\nThe provisions of this section shall not apply to the rear windows or rear side windows of any emergency medical services vehicle used to transport patients.M\n\nThe provisions of subdivisions D 1, 2, and 3 shall not apply to vehicles operated in the performance of private security duties by a security canine handler as defined in &#xA7; 9.1-138 and licensed in accordance with &#xA7; 9.1-139.N\n\nThe provisions of subdivision D 1 shall not apply to sight-seeing carriers as defined in &#xA7; 46.2-2000 and contract passenger carriers as defined in &#xA7; 46.2-2000.O\n\nFor any summons issued for a violation of this section, the court may, in its discretion, dismiss the summons, where proof of compliance with this section is provided to the court on or before the court date.P\n\nNo law-enforcement officer shall stop a motor vehicle for a violation of this section. means those windows located adjacent to and forward of the <span class=\"dictionary\">driver<\/span>&#8217;s seat.\n\t\t\t&#8220;<span class=\"dictionary\">Holographic effect<\/span>&#8221; means a picture or image that may remain constant or change as the viewing angle is changed.\n\t\t\t&#8220;<span class=\"dictionary\">Multipurpose passenger vehicle<\/span>&#8221; means any <span class=\"dictionary\">motor vehicle<\/span> that is (i) designed to carry no more than 10 persons and (ii) constructed either on a <span class=\"dictionary\">truck<\/span> chassis or with special features for occasional off-road use.\n\t\t\t&#8220;<span class=\"dictionary\">Prism effect<\/span>&#8221; means a visual, iridescent, or rainbow-like effect that separates <span class=\"dictionary\">light<\/span> into various colored components that may change depending on viewing angle.\n\t\t\t&#8220;<span class=\"dictionary\">Rear side windows<\/span>&#8221; means those windows located to the rear of the <span class=\"dictionary\">driver<\/span>&#8217;s seat.\n\t\t\t&#8220;<span class=\"dictionary\">Rear window<\/span>&#8221; or &#8220;<span class=\"dictionary\"><span class=\"dictionary\">rear windows<\/span><\/span>&#8221; means those windows that are located to the rear of the passenger compartment of a <span class=\"dictionary\">motor vehicle<\/span> and that are approximately parallel to the windshield. <a id=\"paragraph-255850\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Except as otherwise provided in this article or permitted by federal <span class=\"dictionary\">law<\/span>, it shall be unlawful for any person to operate any <span class=\"dictionary\">motor vehicle<\/span> on a <span class=\"dictionary\">highway<\/span> with any sign, poster, colored or tinted film, sun-shading <span class=\"dictionary\">material<\/span>, or other colored <span class=\"dictionary\">material<\/span> on the windshield, front or <span class=\"dictionary\">rear side windows<\/span>, or <span class=\"dictionary\"><span class=\"dictionary\">rear windows<\/span><\/span> of such <span class=\"dictionary\">motor vehicle<\/span>. This provision, however, shall not apply to any certificate or other paper required by <span class=\"dictionary\">law<\/span> or permitted by the <span class=\"dictionary\">Superintendent<\/span> to be placed on a <span class=\"dictionary\">motor vehicle<\/span>&#8217;s windshield or window.\n\t\t\tThe size of stickers or <span class=\"dictionary\">decals<\/span> used by counties, cities, and towns in lieu of <span class=\"dictionary\">license plates<\/span> shall be in compliance with regulations promulgated by the <span class=\"dictionary\">Superintendent<\/span>. Such stickers shall be affixed on the windshield at a location designated by the <span class=\"dictionary\">Superintendent<\/span>. <a id=\"paragraph-255851\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Notwithstanding the foregoing provisions of this section, whenever a <span class=\"dictionary\">motor vehicle<\/span> is equipped with a mirror on each side of such vehicle, so located as to reflect to the <span class=\"dictionary\">driver<\/span> of such vehicle a view of the <span class=\"dictionary\">highway<\/span> for at least 200 feet to the rear of such vehicle, any or all of the following shall be lawful: <a id=\"paragraph-255852\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> To drive a <span class=\"dictionary\">motor vehicle<\/span> equipped with one optically grooved clear plastic right-angle rear view lens attached to one <span class=\"dictionary\">rear window<\/span> of such <span class=\"dictionary\">motor vehicle<\/span>, not exceeding 18 inches in diameter in the case of a circular lens or not exceeding 11 inches by 14 inches in the case of a rectangular lens, which enables the <span class=\"dictionary\">driver<\/span> of the <span class=\"dictionary\">motor vehicle<\/span> to view below the line of sight as viewed through the <span class=\"dictionary\">rear window<\/span>; <a id=\"paragraph-255853\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> To have affixed to the <span class=\"dictionary\">rear side windows<\/span>, <span class=\"dictionary\">rear window<\/span> or windows of a <span class=\"dictionary\">motor vehicle<\/span> any sticker or stickers, regardless of size; or <a id=\"paragraph-255854\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> To drive a <span class=\"dictionary\">motor vehicle<\/span> when the <span class=\"dictionary\">driver<\/span>&#8217;s clear view of the <span class=\"dictionary\">highway<\/span> through the <span class=\"dictionary\">rear window<\/span> or windows is otherwise obstructed. <a id=\"paragraph-255855\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Except as provided in \u00a7&nbsp;<a class=\"law\" title=\"Equipping certain motor vehicles with sun-shading or tinting films or applications\" href=\"\/46.2-1053\/\">46.2-1053<\/a>, but notwithstanding the foregoing provisions of this section, no sun-shading or tinting film may be applied or affixed to any window of a <span class=\"dictionary\">motor vehicle<\/span> unless such <span class=\"dictionary\">motor vehicle<\/span> is equipped with a mirror on each side of such <span class=\"dictionary\">motor vehicle<\/span>, so located as to reflect to the <span class=\"dictionary\">driver<\/span> of the vehicle a view of the <span class=\"dictionary\">highway<\/span> for at least 200 feet to the rear of such vehicle, and the sun-shading or tinting film is applied or affixed in accordance with the following: <a id=\"paragraph-255856\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> No sun-shading or tinting films may be applied or affixed to the <span class=\"dictionary\">rear side windows<\/span> or <span class=\"dictionary\">rear window<\/span> or windows of any <span class=\"dictionary\">motor vehicle<\/span> operated on the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> of the Commonwealth that reduce the total <span class=\"dictionary\">light<\/span> transmittance of such window to less than 35 percent; <a id=\"paragraph-255857\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> No sun-shading or tinting films may be applied or affixed to the <span class=\"dictionary\">front side windows<\/span> of any <span class=\"dictionary\">motor vehicle<\/span> operated on the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> of the Commonwealth that reduce total <span class=\"dictionary\">light<\/span> transmittance of such window to less than 50 percent; <a id=\"paragraph-255858\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> No sun-shading or tinting films shall be applied or affixed to any window of a <span class=\"dictionary\">motor vehicle<\/span> that (i) have a reflectance of <span class=\"dictionary\">light<\/span> exceeding 20 percent or (ii) produce a holographic or <span class=\"dictionary\">prism effect<\/span>.\n\t\t\t\tAny person who operates a <span class=\"dictionary\">motor vehicle<\/span> on the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> of the Commonwealth with sun-shading or tinting films that (i) have a total <span class=\"dictionary\">light<\/span> transmittance less than that required by subdivisions 1 and 2, (ii) have a reflectance of <span class=\"dictionary\">light<\/span> exceeding 20 percent, or (iii) produce holographic or <span class=\"dictionary\">prism effects<\/span> is guilty of a <span class=\"dictionary\">traffic infraction<\/span> but shall not be awarded any demerit points by the <span class=\"dictionary\">Commissioner<\/span> for the violation.\n\t\t\t\tAny person or firm who applies or affixes to the windows of any <span class=\"dictionary\">motor vehicle<\/span> in Virginia sun-shading or tinting films that (i) reduce the <span class=\"dictionary\">light<\/span> transmittance to levels less than that allowed in subdivisions 1 and 2, (ii) have a reflectance of <span class=\"dictionary\">light<\/span> exceeding 20 percent, or (iii) produce holographic or <span class=\"dictionary\">prism effects<\/span> is guilty of a Class 3 <span class=\"dictionary\">misdemeanor<\/span> for the first <span class=\"dictionary\">offense<\/span> and of a Class 2 <span class=\"dictionary\">misdemeanor<\/span> for any subsequent <span class=\"dictionary\">offense<\/span>. <a id=\"paragraph-255859\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The Division of Purchases and Supply, pursuant to &#xA7; <a class=\"law\" title=\"Standardization of materials, equipment and supplies\" href=\"\/2.2-1112\/\">2.2-1112<\/a>, shall determine the proper standards for equipment or devices used to measure <span class=\"dictionary\">light<\/span> transmittance through windows of <span class=\"dictionary\">motor vehicles<\/span>. <span class=\"dictionary\"><span class=\"dictionary\">Law<\/span>-enforcement officers<\/span> shall use only such equipment or devices to measure <span class=\"dictionary\">light<\/span> transmittance through windows that meet the standards established by the Division. Such measurements made by <span class=\"dictionary\"><span class=\"dictionary\">law<\/span>-enforcement officers<\/span> shall be given a tolerance of minus seven percentage points. <a id=\"paragraph-255860\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> No film or darkening <span class=\"dictionary\">material<\/span> may be applied on the windshield except to replace the sunshield in the uppermost area as installed by the manufacturer of the vehicle. <a id=\"paragraph-255861\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Nothing in this section shall prohibit the affixing to the <span class=\"dictionary\">rear window<\/span> of a <span class=\"dictionary\">motor vehicle<\/span> of a single sticker no larger than 20 square inches if such sticker is totally contained within the lower five inches of the glass of the <span class=\"dictionary\">rear window<\/span>, nor shall subsection C apply to a <span class=\"dictionary\">motor vehicle<\/span> to which but one such sticker is so affixed. <a id=\"paragraph-255862\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Nothing in this section shall prohibit applying to the <span class=\"dictionary\">rear side windows<\/span> or <span class=\"dictionary\">rear window<\/span> of any <span class=\"dictionary\">multipurpose passenger vehicle<\/span> or pickup <span class=\"dictionary\">truck<\/span> sun-shading or tinting films that reduce the total <span class=\"dictionary\">light<\/span> transmittance of such window or windows below 35 percent. <a id=\"paragraph-255863\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> Notwithstanding the foregoing provisions of this section, sun-shading <span class=\"dictionary\">material<\/span> which was applied or installed prior to July 1, 1987, in a manner and on which windows not then in violation of Virginia <span class=\"dictionary\">law<\/span>, shall continue to be lawful, provided that it can be shown by appropriate receipts that such <span class=\"dictionary\">material<\/span> was installed prior to July 1, 1987. <a id=\"paragraph-255864\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> Where a person is convicted within one year of a second or subsequent violation of this section involving the operation of the same vehicle having a tinted or smoked windshield, the <span class=\"dictionary\">court<\/span>, in addition to any other <span class=\"dictionary\">penalty<\/span>, may <span class=\"dictionary\">order<\/span> the person so convicted to remove such tinted or smoked windshield from the vehicle. <a id=\"paragraph-255865\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> The provisions of this section shall not apply to <span class=\"dictionary\">law<\/span>-enforcement vehicles. <a id=\"paragraph-255866\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"L\"><p><span class=\"prefix-number\">L.<\/span> The provisions of this section shall not apply to the <span class=\"dictionary\"><span class=\"dictionary\">rear windows<\/span><\/span> or <span class=\"dictionary\">rear side windows<\/span> of any emergency medical services vehicle used to transport patients. <a id=\"paragraph-255867\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#L\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"M\"><p><span class=\"prefix-number\">M.<\/span> The provisions of subdivisions D 1, 2, and 3 shall not apply to vehicles operated in the performance of private security duties by a security canine handler as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/9.1-138\/\">9.1-138<\/a> and licensed in accordance with &#xA7; <a class=\"law\" title=\"Licensing, certification, and registration required; qualifications; temporary licenses\" href=\"\/9.1-139\/\">9.1-139<\/a>. <a id=\"paragraph-255868\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#M\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"N\"><p><span class=\"prefix-number\">N.<\/span> The provisions of subdivision D 1 shall not apply to sight-seeing carriers as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/46.2-2000\/\">46.2-2000<\/a> and <span class=\"dictionary\">contract<\/span> passenger carriers as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/46.2-2000\/\">46.2-2000<\/a>. <a id=\"paragraph-255869\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#N\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"O\"><p><span class=\"prefix-number\">O.<\/span> For any <span class=\"dictionary\">summons<\/span> issued for a violation of this section, the <span class=\"dictionary\">court<\/span> may, in its discretion, dismiss the <span class=\"dictionary\">summons<\/span>, where proof of compliance with this section is provided to the <span class=\"dictionary\">court<\/span> on or before the <span class=\"dictionary\">court<\/span> date. <a id=\"paragraph-255870\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#O\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"P\"><p><span class=\"prefix-number\">P.<\/span> No <span class=\"dictionary\"><span class=\"dictionary\">law<\/span>-enforcement officer<\/span> shall stop a <span class=\"dictionary\">motor vehicle<\/span> for a violation of this section. No <span class=\"dictionary\">evidence<\/span> discovered or obtained as the result of a stop in violation of this subsection, including <span class=\"dictionary\">evidence<\/span> discovered or obtained with the <span class=\"dictionary\">operator<\/span>&#8217;s consent, shall be <span class=\"dictionary\">admissible<\/span> in any <span class=\"dictionary\">trial<\/span>, <span class=\"dictionary\">hearing<\/span>, or other proceeding. <a id=\"paragraph-255871\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1052\/#P\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nTINTING FILMS, SIGNS, DECALS, AND STICKERS ON WINDSHIELDS, ETC.; PENALTIES (\u00a7\n46.2-1052)\n\nA. Except as provided in \u00a7 46.2-1053, but notwithstanding the foregoing\nprovisions of this section, no sun-shading or tinting film may be applied or\naffixed to any window of a motor vehicle unless such motor vehicle is equipped\nwith a mirror on each side of such motor vehicle, so located as to reflect to\nthe driver of the vehicle a view of the highway for at least 200 feet to the\nrear of such vehicle, and the sun-shading or tinting film is applied or affixed\nin accordance with the following:\n\n   1. No sun-shading or tinting films may be applied or affixed to the rear side\n   windows or rear window or windows of any motor vehicle operated on the\n   highways of the Commonwealth that reduce the total light transmittance of such\n   window to less than 35 percent;\n\n   2. No sun-shading or tinting films may be applied or affixed to the front side\n   windows of any motor vehicle operated on the highways of the Commonwealth that\n   reduce total light transmittance of such window to less than 50 percent;\n\n   3. No sun-shading or tinting films shall be applied or affixed to any window\n   of a motor vehicle that (i) have a reflectance of light exceeding 20 percent\n   or (ii) produce a holographic or prism effect.\n   \t\t\t\tAny person who operates a motor vehicle on the highways of the\n   Commonwealth with sun-shading or tinting films that (i) have a total light\n   transmittance less than that required by subdivisions 1 and 2, (ii) have a\n   reflectance of light exceeding 20 percent, or (iii) produce holographic or\n   prism effects is guilty of a traffic infraction but shall not be awarded any\n   demerit points by the Commissioner for the violation.\n   \t\t\t\tAny person or firm who applies or affixes to the windows of any motor\n   vehicle in Virginia sun-shading or tinting films that (i) reduce the light\n   transmittance to levels less than that allowed in subdivisions 1 and 2, (ii)\n   have a reflectance of light exceeding 20 percent, or (iii) produce holographic\n   or prism effects is guilty of a Class 3 misdemeanor for the first offense and\n   of a Class 2 misdemeanor for any subsequent offense.\n\nE. The Division of Purchases and Supply, pursuant to &#xA7; 2.2-1112, shall\ndetermine the proper standards for equipment or devices used to measure light\ntransmittance through windows of motor vehicles. Law-enforcement officers shall\nuse only such equipment or devices to measure light transmittance through\nwindows that meet the standards established by the Division. Such measurements\nmade by law-enforcement officers shall be given a tolerance of minus seven\npercentage points.\n\nF. No film or darkening material may be applied on the windshield except to\nreplace the sunshield in the uppermost area as installed by the manufacturer of\nthe vehicle.\n\nG. Nothing in this section shall prohibit the affixing to the rear window of a\nmotor vehicle of a single sticker no larger than 20 square inches if such\nsticker is totally contained within the lower five inches of the glass of the\nrear window, nor shall subsection C apply to a motor vehicle to which but one\nsuch sticker is so affixed.\n\nH. Nothing in this section shall prohibit applying to the rear side windows or\nrear window of any multipurpose passenger vehicle or pickup truck sun-shading or\ntinting films that reduce the total light transmittance of such window or\nwindows below 35 percent.\n\nI. Notwithstanding the foregoing provisions of this section, sun-shading\nmaterial which was applied or installed prior to July 1, 1987, in a manner and\non which windows not then in violation of Virginia law, shall continue to be\nlawful, provided that it can be shown by appropriate receipts that such material\nwas installed prior to July 1, 1987.\n\nJ. Where a person is convicted within one year of a second or subsequent\nviolation of this section involving the operation of the same vehicle having a\ntinted or smoked windshield, the court, in addition to any other penalty, may\norder the person so convicted to remove such tinted or smoked windshield from\nthe vehicle.\n\nK. The provisions of this section shall not apply to law-enforcement vehicles.\n\nL. The provisions of this section shall not apply to the rear windows or rear\nside windows of any emergency medical services vehicle used to transport\npatients.\n\nM. The provisions of subdivisions D 1, 2, and 3 shall not apply to vehicles\noperated in the performance of private security duties by a security canine\nhandler as defined in &#xA7; 9.1-138 and licensed in accordance with &#xA7;\n9.1-139.\n\nN. The provisions of subdivision D 1 shall not apply to sight-seeing carriers as\ndefined in &#xA7; 46.2-2000 and contract passenger carriers as defined in &#xA7;\n46.2-2000.\n\nO. For any summons issued for a violation of this section, the court may, in its\ndiscretion, dismiss the summons, where proof of compliance with this section is\nprovided to the court on or before the court date.\n\nP. No law-enforcement officer shall stop a motor vehicle for a violation of this\nsection.
