No vehicles other than those displaying disabled parking license plates, organizational removable windshield placards, permanent removable windshield placards, or temporary removable windshield placards issued under \u00a7 46.2-1241, or DV disabled parking license plates issued under subsection B of \u00a7 46.2-739, shall be parked in any parking spaces reserved for persons with disabilities.2\n\nNo person without a disability that limits or impairs his ability to walk shall park a vehicle with disabled parking license plates, organizational removable windshield placards, permanent removable windshield placards, temporary removable windshield placards, or DV disabled parking license plates issued under subsection B of &#xA7; 46.2-739 in a parking space reserved for persons with disabilities that limit or impair their ability to walk except when transporting a disabled person in the vehicle.3\n\nNo vehicle shall be parked in any striped access aisle adjacent to a parking space reserved for persons with disabilities.4\n\nA summons or parking ticket for the offense may be issued by law-enforcement officers, uniformed law-enforcement department employees, or volunteers acting pursuant to &#xA7; 46.2-1244 without the necessity of a warrant&#8217;s being obtained by the owner of any private parking area.5\n\nParking a vehicle in a space reserved for persons with disabilities or in a striped access aisle in violation of this section shall be punishable by a fine of not less than $100 nor more than $500.B\n\nThe governing body of any county, city, or town may, by ordinance, provide that it shall be unlawful for a vehicle not displaying disabled parking license plates, an organizational removable windshield placard, a permanent removable windshield placard, or a temporary removable windshield placard issued under \u00a7 46.2-1241, or DV disabled parking license plates issued under subsection B of \u00a7 46.2-739, to be parked in a parking space reserved for persons with disabilities that limit or impair their ability to walk or for a person who is not limited or impaired in his ability to walk to park a vehicle in a parking space so designated except when transporting a person with such a disability in the vehicle. If there is a placard within a vehicle utilizing a parking space reserved for persons with disabilities, but that placard is not displayed as required pursuant to subsection E of \u00a7 46.2-1241, such ordinance may provide for a fine less than that imposed under this section. The <span class=\"dictionary\">governing body<\/span> of any county, city, or town may, by <span class=\"dictionary\">ordinance<\/span>, provide that no <span class=\"dictionary\">vehicle<\/span> shall be parked in any striped access aisle adjacent to a parking space reserved for persons with disabilities. <a id=\"paragraph-229030\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1242\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Any local <span class=\"dictionary\">governing body<\/span>, by such <span class=\"dictionary\">ordinance<\/span>, may assess and retain a fine of not less than $100 nor more than $500 for its violation. <a id=\"paragraph-229031\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1242\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The <span class=\"dictionary\">ordinance<\/span> may further provide that a <span class=\"dictionary\">summons<\/span> or parking ticket for the <span class=\"dictionary\">offense<\/span> may be issued by <span class=\"dictionary\"><span class=\"dictionary\">law<\/span>-enforcement officers<\/span>, volunteers serving in units established pursuant to &#xA7; <a class=\"law\" title=\"Volunteer disabled parking enforcement units\" href=\"\/46.2-1244\/\">46.2-1244<\/a>, and other uniformed personnel employed by the locality to enforce parking regulations without the necessity of a warrant&#8217;s being obtained by the <span class=\"dictionary\">owner<\/span> of the private parking area. <a id=\"paragraph-229032\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1242\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> In any <span class=\"dictionary\">prosecution<\/span> charging a violation of this section or an <span class=\"dictionary\">ordinance<\/span> adopted pursuant to this section, proof that the <span class=\"dictionary\">vehicle<\/span> described in the complaint, <span class=\"dictionary\">summons<\/span>, parking ticket, <span class=\"dictionary\">citation<\/span>, or warrant was parked in violation of this section or the <span class=\"dictionary\">ordinance<\/span>, together with proof that the <span class=\"dictionary\">defendant<\/span> was at the time the registered <span class=\"dictionary\">owner<\/span> of the <span class=\"dictionary\">vehicle<\/span>, as required by Chapter 6 (&#xA7; <a class=\"law\" title=\"Owner to secure registration and certificate of title or certificate of ownership\" href=\"\/46.2-600\/\">46.2-600<\/a> et seq.), shall constitute prima facie <span class=\"dictionary\">evidence<\/span> that the registered <span class=\"dictionary\">owner<\/span> of the <span class=\"dictionary\">vehicle<\/span> was the person who committed the violation. <a id=\"paragraph-229033\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1242\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> No violation of this section or an <span class=\"dictionary\">ordinance<\/span> adopted pursuant to this section shall be dismissed for a property <span class=\"dictionary\">owner<\/span>&#8217;s failure to comply strictly with the requirements for disabled parking signs set forth in &#xA7; <a class=\"law\" title=\"Identification of disabled parking spaces by above grade signage\" href=\"\/36-99.11\/\">36-99.11<\/a>, provided the space is clearly distinguishable as a parking space reserved for persons with disabilities that limit or impair their ability to walk. <a id=\"paragraph-229034\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1242\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPARKING IN SPACES RESERVED FOR PERSONS WITH DISABILITIES; LOCAL ORDINANCES;\nPENALTY (\u00a7 46.2-1242)\n\nA. 1. No vehicles other than those displaying disabled parking license plates,\norganizational removable windshield placards, permanent removable windshield\nplacards, or temporary removable windshield placards issued under \u00a7 46.2-1241,\nor DV disabled parking license plates issued under subsection B of \u00a7 46.2-739,\nshall be parked in any parking spaces reserved for persons with disabilities.\n\n   2. No person without a disability that limits or impairs his ability to walk\n   shall park a vehicle with disabled parking license plates, organizational\n   removable windshield placards, permanent removable windshield placards,\n   temporary removable windshield placards, or DV disabled parking license plates\n   issued under subsection B of &#xA7; 46.2-739 in a parking space reserved for\n   persons with disabilities that limit or impair their ability to walk except\n   when transporting a disabled person in the vehicle.\n\n   3. No vehicle shall be parked in any striped access aisle adjacent to a\n   parking space reserved for persons with disabilities.\n\n   4. A summons or parking ticket for the offense may be issued by\n   law-enforcement officers, uniformed law-enforcement department employees, or\n   volunteers acting pursuant to &#xA7; 46.2-1244 without the necessity of a\n   warrant&#8217;s being obtained by the owner of any private parking area.\n\n   5. Parking a vehicle in a space reserved for persons with disabilities or in a\n   striped access aisle in violation of this section shall be punishable by a\n   fine of not less than $100 nor more than $500.\n\nB. The governing body of any county, city, or town may, by ordinance, provide\nthat it shall be unlawful for a vehicle not displaying disabled parking license\nplates, an organizational removable windshield placard, a permanent removable\nwindshield placard, or a temporary removable windshield placard issued under \u00a7\n46.2-1241, or DV disabled parking license plates issued under subsection B of \u00a7\n46.2-739, to be parked in a parking space reserved for persons with disabilities\nthat limit or impair their ability to walk or for a person who is not limited or\nimpaired in his ability to walk to park a vehicle in a parking space so\ndesignated except when transporting a person with such a disability in the\nvehicle. If there is a placard within a vehicle utilizing a parking space\nreserved for persons with disabilities, but that placard is not displayed as\nrequired pursuant to subsection E of \u00a7 46.2-1241, such ordinance may provide\nfor a fine less than that imposed under this section. The governing body of any\ncounty, city, or town may, by ordinance, provide that no vehicle shall be parked\nin any striped access aisle adjacent to a parking space reserved for persons\nwith disabilities.\n\n   1. Any local governing body, by such ordinance, may assess and retain a fine\n   of not less than $100 nor more than $500 for its violation.\n\n   2. The ordinance may further provide that a summons or parking ticket for the\n   offense may be issued by law-enforcement officers, volunteers serving in units\n   established pursuant to &#xA7; 46.2-1244, and other uniformed personnel\n   employed by the locality to enforce parking regulations without the necessity\n   of a warrant&#8217;s being obtained by the owner of the private parking area.\n\nC. In any prosecution charging a violation of this section or an ordinance\nadopted pursuant to this section, proof that the vehicle described in the\ncomplaint, summons, parking ticket, citation, or warrant was parked in violation\nof this section or the ordinance, together with proof that the defendant was at\nthe time the registered owner of the vehicle, as required by Chapter 6 (&#xA7;\n46.2-600 et seq.), shall constitute prima facie evidence that the registered\nowner of the vehicle was the person who committed the violation.\n\nD.
