In addition to the contractual agreement, the licensed auto recycler shall be required to comply with the Department&#8217;s procedures for securely accessing and updating the Department&#8217;s records; and2\n\nNotifying the Department that a motor vehicle is being demolished or dismantled or of the intention to demolish, dismantle, or reduce the motor vehicle to a state where it can no longer be considered a motor vehicle. Licensed auto recyclers shall electronically notify the Department of the demolished or dismantled vehicle&#8217;s certificate of title, salvage certificate, or nonrepairable certificate number and vehicle identification number.B\n\nLicensed auto recyclers in possession of the certificate of title, salvage certificate, or nonrepairable certificate from the Commonwealth may demolish or dismantle the subject motor vehicle. Licensed auto recyclers shall electronically notify the Department in a manner prescribed by the Commissioner of the demolished or dismantled vehicle&#8217;s certificate of title, salvage certificate, or nonrepairable certificate number and vehicle identification number within required time frames pursuant to subsection D of &#xA7; 46.2-1603.1.C\n\nLicensed auto recyclers in possession of a certificate of title issued by another state may demolish or dismantle the subject motor vehicle. Licensed auto recyclers shall electronically notify the Department of the demolished or dismantled vehicle&#8217;s certificate of title number, vehicle identification number, year, make, and model within required time frames pursuant to subsection D of &#xA7; 46.2-1603.1.D\n\nLicensed auto recyclers that do not possess a certificate of title, salvage certificate, or nonrepairable certificate may demolish the subject motor vehicle if the motor vehicle is a model year that is at least 10 years older than the current model year. The licensed auto recycler shall provide electronically to the Department the vehicle identification number and the year, make, and model of the motor vehicle and shall remit to the Department the fees set out in &#xA7; 46.2-627 and an additional $10 transaction fee. Upon receipt of such notification, the Department shall check the records of a nationally recognized crime database and the records of a nationally recognized vehicle title database for owner and lienholder information. The licensed auto recycler may not demolish or dismantle the vehicle until the Department has notified the licensed auto recycler of the results of that inquiry. If a licensed <span class=\"dictionary\">auto recycler<\/span> is not in <span class=\"dictionary\">possession<\/span> of the certificate of title, <span class=\"dictionary\">salvage certificate<\/span>, or <span class=\"dictionary\">nonrepairable certificate<\/span> and the subject <span class=\"dictionary\">motor vehicle<\/span> is of the current model year or of a model year that is nine years old or less, that vehicle shall be processed in accordance with &#xA7; <a class=\"law\" title=\"Search for owner and secured party; notice\" href=\"\/46.2-1202\/\">46.2-1202<\/a>. <a id=\"paragraph-278642\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1608.2\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Nothing in this section shall release a licensed <span class=\"dictionary\">auto recycler<\/span> from complying with the provisions of &#xA7;&#xA7; <a class=\"law\" title=\"Duties of licensees\" href=\"\/46.2-1603.1\/\">46.2-1603.1<\/a>, <a class=\"law\" title=\"Maintenance and contents of records\" href=\"\/46.2-1608\/\">46.2-1608<\/a>, and <a class=\"law\" title=\"Reports to police department; local ordinance; holding period; penalty\" href=\"\/46.2-1608.1\/\">46.2-1608.1<\/a>. <a id=\"paragraph-278643\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-1608.2\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nLICENSEES TO UPDATE RECORDS OF THE DEPARTMENT FOR MOTOR VEHICLES THAT ARE TO BE\nDEMOLISHED OR DISMANTLED (\u00a7 46.2-1608.2)\n\nA. A licensed auto recycler may be exempted from the waiting period in\nsubsection B of \u00a7 46.2-1608.1 by:\n\n   1. Entering into a contractual agreement with the Department to update records\n   of motor vehicles to be demolished or dismantled if such motor vehicles either\n   have been issued a certificate of title, salvage certificate, or nonrepairable\n   certificate in the Commonwealth or are titled in another state. In addition to\n   the contractual agreement, the licensed auto recycler shall be required to\n   comply with the Department&#8217;s procedures for securely accessing and\n   updating the Department&#8217;s records; and\n\n   2. Notifying the Department that a motor vehicle is being demolished or\n   dismantled or of the intention to demolish, dismantle, or reduce the motor\n   vehicle to a state where it can no longer be considered a motor vehicle.\n   Licensed auto recyclers shall electronically notify the Department of the\n   demolished or dismantled vehicle&#8217;s certificate of title, salvage\n   certificate, or nonrepairable certificate number and vehicle identification\n   number.\n\nB. Licensed auto recyclers in possession of the certificate of title, salvage\ncertificate, or nonrepairable certificate from the Commonwealth may demolish or\ndismantle the subject motor vehicle. Licensed auto recyclers shall\nelectronically notify the Department in a manner prescribed by the Commissioner\nof the demolished or dismantled vehicle&#8217;s certificate of title, salvage\ncertificate, or nonrepairable certificate number and vehicle identification\nnumber within required time frames pursuant to subsection D of &#xA7;\n46.2-1603.1.\n\nC. Licensed auto recyclers in possession of a certificate of title issued by\nanother state may demolish or dismantle the subject motor vehicle. Licensed auto\nrecyclers shall electronically notify the Department of the demolished or\ndismantled vehicle&#8217;s certificate of title number, vehicle identification\nnumber, year, make, and model within required time frames pursuant to subsection\nD of &#xA7; 46.2-1603.1.\n\nD. Licensed auto recyclers that do not possess a certificate of title, salvage\ncertificate, or nonrepairable certificate may demolish the subject motor vehicle\nif the motor vehicle is a model year that is at least 10 years older than the\ncurrent model year. The licensed auto recycler shall provide electronically to\nthe Department the vehicle identification number and the year, make, and model\nof the motor vehicle and shall remit to the Department the fees set out in\n&#xA7; 46.2-627 and an additional $10 transaction fee. Upon receipt of such\nnotification, the Department shall check the records of a nationally recognized\ncrime database and the records of a nationally recognized vehicle title database\nfor owner and lienholder information. The licensed auto recycler may not\ndemolish or dismantle the vehicle until the Department has notified the licensed\nauto recycler of the results of that inquiry. If a licensed auto recycler is not\nin possession of the certificate of title, salvage certificate, or nonrepairable\ncertificate and the subject motor vehicle is of the current model year or of a\nmodel year that is nine years old or less, that vehicle shall be processed in\naccordance with &#xA7; 46.2-1202.\n\nE.
