this chapter may be denied, suspended, or revoked on any one or more of the following grounds, where applicable:\n\n1\n\nMaterial misstatement or omission in application for license, certificate, permit, identification marker, or vehicle registration;2\n\nFailure to comply subsequent to receipt of a written warning from the Department or any willful failure to comply with a lawful order, any provision of this chapter or any regulation promulgated by the Department under this chapter, or any term, condition, or restriction of a license, permit, or certificate;3\n\nFailure to comply with zoning or other land use regulations, ordinances, or statutes;4\n\nUse of deceptive business acts or practices;5\n\nKnowingly advertising by any means any assertion, representation, or statement of fact that is untrue, misleading, or deceptive relating to the conduct of the business for which a license, certificate, permit, identification marker, or vehicle registration is held or sought;6\n\nHaving been found, through a judicial or administrative hearing, to have committed fraudulent or deceptive acts in connection with the business for which a license, permit, or certificate is held or sought or any consumer-related fraud;7\n\nHaving been convicted of any criminal act involving the business for which a license, permit, or certificate is held or sought;8\n\nFailure to comply with § 46.2-2056 or any regulation promulgated pursuant thereto;9\n\nImproper leasing, renting, lending, or otherwise allowing the improper use of a license, certificate, permit, identification marker, or vehicle registration;10\n\nHaving been convicted of a felony;11\n\nHaving been convicted of any misdemeanor involving lying, cheating, stealing, or moral turpitude;12\n\nFailure to submit to the Department any tax, fees, dues, fines, or penalties owed to the Department;13\n\nFailure to furnish the Department information, documentation, or records required or requested pursuant to statute or regulation;14\n\nKnowingly and willfully filing any false report, account, record, or memorandum;15\n\nFailure to meet or maintain application certifications or requirements of public convenience and necessity, character, fitness, and financial responsibility pursuant to this chapter;16\n\nWillfully altering or changing the appearance or wording of any license, permit, certificate, identification marker, license plate, or vehicle registration;17\n\nFailure to provide services in accordance with license, permit, or certificate terms, limitations, conditions, or requirements;18\n\nFailure to maintain and keep on file with the Department motor carrier liability insurance, issued by a company licensed to do business in the Commonwealth, or a bond, certificate of insurance, certificate of self-insurance, or unconditional letter of credit in accordance with this chapter, with respect to each motor vehicle operated in the Commonwealth;19\n\nFailure to comply with the Workers’ Compensation Act of Title 65.2;20\n\nFailure to properly register a motor vehicle under this title;21\n\nFailure to comply with any federal motor carrier statute, rule, or regulation;22\n\nFailure to comply with the requirements of the Americans with Disabilities Act or the Virginians with Disabilities Act (§ 51.5-1 et seq.);23\n\nInactivity of a motor carrier as may be evidenced by the absence of a motor vehicle registered to operate under such certificate or permit for a period of greater than three months; or24\n\nFailure to comply with any provision regarding the A license<\/span>, permit<\/span>, or certificate<\/span> issued pursuant to this chapter may be denied, suspended, or revoked on any one or more of the following grounds, where applicable:<\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> Material<\/span> misstatement or omission in application for license<\/span>, certificate<\/span>, permit<\/span>, identification marker<\/span>, or vehicle<\/span> registration; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> Failure to comply subsequent to receipt of a written warning from the Department<\/span> or any willful failure to comply with a lawful order<\/span>, any provision of this chapter or any regulation promulgated by the Department<\/span> under this chapter, or any term, condition, or restriction of a license<\/span>, permit<\/span>, or certificate<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> Failure to comply with zoning or other land use regulations, ordinances<\/span>, or statutes<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

4.<\/span> Use of deceptive business acts or practices; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

5.<\/span> Knowingly advertising by any means any assertion, representation, or statement of fact<\/span> that is untrue, misleading, or deceptive relating to the conduct of the business for which a license<\/span>, certificate<\/span>, permit<\/span>, identification marker<\/span>, or vehicle<\/span> registration is held or sought; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

6.<\/span> Having been found, through a judicial or administrative hearing<\/span>, to have committed fraudulent or deceptive acts in connection with the business for which a license<\/span>, permit<\/span>, or certificate<\/span> is held or sought or any consumer-related fraud<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

7.<\/span> Having been convicted of any criminal act involving the business for which a license<\/span>, permit<\/span>, or certificate<\/span> is held or sought; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

8.<\/span> Failure to comply with § 46.2-2056<\/a> or any regulation promulgated pursuant thereto; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

9.<\/span> Improper leasing, renting, lending, or otherwise allowing the improper use of a license<\/span>, certificate<\/span>, permit<\/span>, identification marker<\/span>, or vehicle<\/span> registration; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

10.<\/span> Having been convicted of a felony<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

11.<\/span> Having been convicted of any misdemeanor<\/span> involving lying, cheating, stealing, or moral turpitude<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

12.<\/span> Failure to submit to the Department<\/span> any tax, fees, dues, fines, or penalties owed to the Department<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

13.<\/span> Failure to furnish the Department<\/span> information, documentation, or records required or requested pursuant to statute<\/span> or regulation; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

14.<\/span> Knowingly and willfully filing any false report, account, record, or memorandum<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

15.<\/span> Failure to meet or maintain application certifications or requirements of public convenience and necessity, character, fitness, and financial responsibility<\/span> pursuant to this chapter; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

16.<\/span> Willfully altering or changing the appearance<\/span> or wording of any license, permit<\/span>, certificate<\/span>, identification marker<\/span>, license plate<\/span>, or vehicle<\/span> registration; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

17.<\/span> Failure to provide services in accordance with license, permit<\/span>, or certificate<\/span> terms, limitations, conditions, or requirements; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

18.<\/span> Failure to maintain and keep on file with the Department<\/span> motor carrier<\/span> liability insurance, issued by a company licensed to do business in the Commonwealth, or a bond<\/span>, certificate<\/span> of insurance, certificate<\/span> of self-insurance, or unconditional letter of credit in accordance with this chapter, with respect to each motor vehicle<\/span> operated in the Commonwealth; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

19.<\/span> Failure to comply with the Workers’ Compensation Act of Title 65.2; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

20.<\/span> Failure to properly register a motor vehicle<\/span> under this title; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

21.<\/span> Failure to comply with any federal motor carrier<\/span> statute<\/span>, rule, or regulation; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

22.<\/span> Failure to comply with the requirements of the Americans with Disabilities Act or the Virginians with Disabilities Act (§ 51.5-1<\/a> et seq.); <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

23.<\/span> Inactivity of a motor carrier<\/span> as may be evidenced by the absence of a motor vehicle<\/span> registered to operate under such certificate<\/span> or permit<\/span> for a period of greater than three months; or <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t
