may be denied, suspended, or revoked on any one or more of the following grounds, where applicable:\n\n1\n\nMaterial misstatement or omission in application for certificate of fitness or vehicle registration;2\n\nFailure to comply subsequent to receipt of a written warning from the Department or any willful failure to comply with a lawful order, any provision of this chapter or any regulation promulgated by the Department under this chapter, or any term or condition of any certificate of fitness;3\n\nUse of deceptive business acts or practices;4\n\nKnowingly advertising by any means any assertion, representation, or statement of fact that is untrue, misleading, or deceptive relating to the conduct of the business for which a certificate of fitness or vehicle registration is held or sought;5\n\nHaving been found, through a judicial or administrative hearing, to have committed fraudulent or deceptive acts in connection with the business for which a certificate of fitness is held or sought or any consumer-related fraud;6\n\nHaving been convicted of any criminal act involving the business for which a certificate of fitness is held or sought;7\n\nImproper leasing, renting, lending, or otherwise allowing the improper use of a certificate of fitness, identification marker issued by the Department, or vehicle registration;8\n\nHaving been convicted of a felony;9\n\nHaving been convicted of any misdemeanor involving lying, cheating, stealing, or moral turpitude;10\n\nFailure to submit to the Department any tax, fees, dues, fines, or penalties owed to the Department;11\n\nFailure to furnish the Department information, documentation, or records required or requested pursuant to statute or regulation;12\n\nKnowingly and willfully filing any false report, account, record, or memorandum;13\n\nFailure to meet or maintain application certifications or requirements of character, fitness, and financial responsibility pursuant to this chapter;14\n\nWillfully altering or changing the appearance or wording of any license, certificate, identification marker issued by the Department, license plate, or vehicle registration;15\n\nFailure to provide services in accordance with certificate of fitness terms, limitations, conditions, or requirements;16\n\nFailure to maintain and keep on file with the Department motor carrier liability insurance or cargo insurance, issued by a company licensed to do business in the Commonwealth, or a bond, certificate of insurance, certificate of self-insurance, or unconditional letter of credit in accordance with this chapter, with respect to each motor vehicle operated in the Commonwealth;17\n\nFailure to comply with the Workers’ Compensation Act of Title 65.2;18\n\nFailure to properly register a motor vehicle under this title;19\n\nFailure to comply with any federal motor carrier statute, rule, or regulation; or20\n\nInactivity of a motor carrier as may be evidenced by the absence of a motor 11.<\/span> Failure to furnish the Department<\/span> information, documentation, or records required or requested pursuant to statute<\/span> or regulation; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

12.<\/span> Knowingly and willfully filing any false report, account, record, or memorandum<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

13.<\/span> Failure to meet or maintain application certifications or requirements of character, fitness, and financial responsibility<\/span> pursuant to this chapter; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

14.<\/span> Willfully altering or changing the appearance<\/span> or wording of any license, certificate, identification marker issued by the Department<\/span>, license plate<\/span>, or vehicle<\/span> registration; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

15.<\/span> Failure to provide services<\/span> in accordance with certificate of fitness<\/span> terms, limitations, conditions, or requirements; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

16.<\/span> Failure to maintain and keep on file with the Department<\/span> motor carrier<\/span> liability insurance or cargo insurance, issued by a company licensed to do business in the Commonwealth, or a bond<\/span>, certificate of insurance, certificate of self-insurance, or unconditional letter of credit in accordance with this chapter, with respect to each motor vehicle<\/span> operated in the Commonwealth; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

17.<\/span> Failure to comply with the Workers’ Compensation Act of Title 65.2; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

18.<\/span> Failure to properly register a motor vehicle<\/span> under this title; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

19.<\/span> Failure to comply with any federal motor carrier<\/span> statute<\/span>, rule, or regulation; or <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

20.<\/span> Inactivity of a motor carrier<\/span> as may be evidenced by the absence of a motor vehicle<\/span> registered to operate under such certificate for a period of greater than three months. <\/i><\/a><\/p><\/section>","plain_text":" CODE OF VIRGINIA\n\nGROUNDS FOR DENYING, SUSPENDING, OR REVOKING CERTIFICATES (\u00a7 46.2-2133)\n\nA certificate of fitness issued under this chapter may be denied, suspended, or\nrevoked on any one or more of the following grounds, where applicable:\n\n1. Material misstatement or omission in application for certificate of fitness\nor vehicle registration;\n\n2. Failure to comply subsequent to receipt of a written warning from the\nDepartment or any willful failure to comply with a lawful order, any provision\nof this chapter or any regulation promulgated by the Department under this\nchapter, or any term or condition of any certificate of fitness;\n\n3. Use of deceptive business acts or practices;\n\n4. Knowingly advertising by any means any assertion, representation, or\nstatement of fact that is untrue, misleading, or deceptive relating to the\nconduct of the business for which a certificate of fitness or vehicle\nregistration is held or sought;\n\n5. Having been found, through a judicial or administrative hearing, to have\ncommitted fraudulent or deceptive acts in connection with the business for which\na certificate of fitness is held or sought or any consumer-related fraud;\n\n6. Having been convicted of any criminal act involving the business for which a\ncertificate of fitness is held or sought;\n\n7. Improper leasing, renting, lending, or otherwise allowing the improper use of\na certificate of fitness, identification marker issued by the Department, or\nvehicle registration;\n\n8. Having been convicted of a felony;\n\n9. Having been convicted of any misdemeanor involving lying, cheating, stealing,\nor moral turpitude;\n\n10.
