Insurers of the personal automobile insurance policy of neither a person acting for or on behalf of the motor carrier nor the vehicle&#8217;s owner shall have the duty to defend or indemnify the activities of a person acting for or on behalf of a motor carrier in connection with the motor carrier unless such policy expressly provides otherwise for the period of time to which subsection A of &#xA7; 46.2-2143.1 is applicable or the policy contains an amendment or endorsement to provide that coverage.E\n\nCoverage under a motor carrier&#8217;s insurance policy shall not be dependent on a personal automobile policy&#8217;s first denying a claim, nor shall a personal automobile insurance policy be required to first deny a claim.F\n\nNothing in this section shall be construed to require a personal automobile insurance policy to provide primary or excess coverage. The personal automobile insurance policy of neither a person acting for or on behalf of the motor carrier nor the vehicle&#8217;s owner shall provide coverage for activities in connection with the motor carrier to such person acting for or on behalf of the motor carrier, the vehicle owner, or any third party unless such policy expressly provides otherwise for the period of time to which subsection A of &#xA7; 46.2-2143.1 is applicable or the policy contains an amendment or endorsement to provide that coverage.G\n\nIn every instance where motor carrier insurance maintained by a person other than the motor carrier to fulfill the insurance obligations of subsection B of &#xA7; 46.2-2143.1 has lapsed or ceased to exist, the motor carrier shall provide the coverage required by that subsection beginning with the first dollar of a claim.H\n\nThis section shall not limit the liability of a motor carrier arising out of an accident involving a person acting for or on behalf of the carrier in any action for damages against a motor carrier for an amount above the required insurance coverage.I\n\nAny person, or an attorney acting on his behalf, who suffers a loss in an automobile accident with a reasonable belief that the accident involves a vehicle operated by a person acting for or on behalf of a motor carrier and who provides the motor carrier with the date, approximate time, and location of the accident, the name of the vehicle operator, if available, and the accident report, if available, may request in writing from the motor carrier information relating to the insurance coverage and the company providing the coverage. The motor carrier shall respond electronically or in writing within 30 days. The personal automobile insurance policy of neither a <span class=\"dictionary\">person<\/span> acting for or on behalf of the <span class=\"dictionary\">motor carrier<\/span> nor the <span class=\"dictionary\">vehicle<\/span>&#8217;s <span class=\"dictionary\">owner<\/span> shall provide coverage for activities in connection with the <span class=\"dictionary\">motor carrier<\/span> to such <span class=\"dictionary\">person<\/span> acting for or on behalf of the <span class=\"dictionary\">motor carrier<\/span>, the <span class=\"dictionary\">vehicle<\/span> <span class=\"dictionary\">owner<\/span>, or any third <span class=\"dictionary\">party<\/span> unless such policy expressly provides otherwise for the period of time to which subsection A of &#xA7; <a class=\"law\" title=\"Insurance requirement for motor carriers\" href=\"\/46.2-2143.1\/\">46.2-2143.1<\/a> is applicable or the policy contains an amendment or endorsement to provide that coverage. <a id=\"paragraph-200387\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> In every instance where <span class=\"dictionary\">motor carrier<\/span> insurance maintained by a <span class=\"dictionary\">person<\/span> other than the <span class=\"dictionary\">motor carrier<\/span> to fulfill the insurance obligations of subsection B of &#xA7; <a class=\"law\" title=\"Insurance requirement for motor carriers\" href=\"\/46.2-2143.1\/\">46.2-2143.1<\/a> has lapsed or ceased to exist, the <span class=\"dictionary\">motor carrier<\/span> shall provide the coverage required by that subsection beginning with the first dollar of a claim. <a id=\"paragraph-200388\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> This section shall not limit the liability of a <span class=\"dictionary\">motor carrier<\/span> arising out of an accident involving a <span class=\"dictionary\">person<\/span> acting for or on behalf of the carrier in any action for <span class=\"dictionary\">damages<\/span> against a <span class=\"dictionary\">motor carrier<\/span> for an amount above the required insurance coverage. <a id=\"paragraph-200389\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> Any <span class=\"dictionary\">person<\/span>, or an attorney acting on his behalf, who suffers a loss in an automobile accident with a reasonable belief that the accident involves a <span class=\"dictionary\">vehicle<\/span> operated by a <span class=\"dictionary\">person<\/span> acting for or on behalf of a <span class=\"dictionary\">motor carrier<\/span> and who provides the <span class=\"dictionary\">motor carrier<\/span> with the date, approximate time, and location of the accident, the name of the <span class=\"dictionary\">vehicle<\/span> <span class=\"dictionary\">operator<\/span>, if available, and the accident report, if available, may request in writing from the <span class=\"dictionary\">motor carrier<\/span> information relating to the insurance coverage and the company providing the coverage. The <span class=\"dictionary\">motor carrier<\/span> shall respond electronically or in writing within 30 days. The <span class=\"dictionary\">motor carrier<\/span>&#8217;s response shall contain the following information: (i) whether, at the approximate time of the accident, the <span class=\"dictionary\">vehicle<\/span> was being operated for or on behalf of the <span class=\"dictionary\">motor carrier<\/span>; (ii) the name of the insurance carrier providing primary coverage; and (iii) the identity and last known address of the <span class=\"dictionary\">vehicle<\/span> <span class=\"dictionary\">operator<\/span>. <a id=\"paragraph-200390\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> Any insurance required by subsection B of &#xA7; <a class=\"law\" title=\"Insurance requirement for motor carriers\" href=\"\/46.2-2143.1\/\">46.2-2143.1<\/a> may be placed with an insurer that has been admitted in Virginia or with an insurer providing surplus lines insurance as defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/38.2-4805.2\/\">38.2-4805.2<\/a>. <a id=\"paragraph-200391\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> Any insurance policy required by subsection B of &#xA7; <a class=\"law\" title=\"Insurance requirement for motor carriers\" href=\"\/46.2-2143.1\/\">46.2-2143.1<\/a> shall satisfy the <span class=\"dictionary\">financial responsibility<\/span> requirement for a <span class=\"dictionary\">motor vehicle<\/span> under &#xA7; <a class=\"law\" title=\"Proof of insurance required of applicants for registration of motor vehicles; verification of insurance; suspension of driver&#039;s license, registration certificates, and license plates for certain violations\" href=\"\/46.2-706\/\">46.2-706<\/a> during the period such vehicle is being operated for or on behalf of a <span class=\"dictionary\">motor carrier<\/span>. <a id=\"paragraph-200392\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"L\"><p><span class=\"prefix-number\">L.<\/span> If a vehicle operated by a <span class=\"dictionary\">person<\/span> acting for or on behalf of a <span class=\"dictionary\">motor carrier<\/span> is insured under a personal automobile insurance policy that does not exclude coverage, then such policy shall provide primary coverage and an insurance policy maintained by the <span class=\"dictionary\">motor carrier<\/span> under &#xA7; <a class=\"law\" title=\"Insurance requirement for motor carriers\" href=\"\/46.2-2143.1\/\">46.2-2143.1<\/a> shall provide excess coverage up to at least the limits required by &#xA7; <a class=\"law\" title=\"Insurance requirement for motor carriers\" href=\"\/46.2-2143.1\/\">46.2-2143.1<\/a>. <a id=\"paragraph-200393\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#L\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"M\"><p><span class=\"prefix-number\">M.<\/span> In a claims coverage investigation, a <span class=\"dictionary\">motor carrier<\/span> and its insurer shall cooperate with insurers involved in the claims coverage investigation to facilitate the exchange of information, including the date and time of any accident involving a vehicle operated for or on behalf of the <span class=\"dictionary\">motor carrier<\/span> and the precise times that the vehicle was being operated for or on behalf of the <span class=\"dictionary\">motor carrier<\/span>. <a id=\"paragraph-200394\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-2143.2\/#M\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nSPECIAL INSURANCE PROVISIONS FOR CERTAIN CARRIERS (\u00a7 46.2-2143.2)\n\nA. The provisions of this section shall apply only to motor carriers exempt\nunder subdivision 6 of &#xA7; 46.2-2101 and insurance policies maintained by\nsuch carriers pursuant to this article.\n\nB. Insurance coverage for motor carriers shall be primary, and the requirements\nof \u00a7 46.2-2143.1 may be satisfied by any of the following:\n\n   1. Insurance maintained by the motor carrier;\n\n   2. Insurance maintained by another person on behalf of the motor carrier; or\n\n   3. Any combination of subdivisions 1 and 2.\n\nC. A motor carrier may meet its obligation under subsection B of &#xA7;\n46.2-2143.1 through a policy obtained by a person other than the carrier under\nsubdivision B 2 or 3 only if the motor carrier verifies that the policy is\nmaintained by such other person.\n\nD. Insurers providing coverage under subsection B of &#xA7; 46.2-2143.1 shall\nhave the exclusive duty to defend any liability claim, including any claim\nagainst a motor carrier or person acting for or on behalf of the motor carrier,\narising from an accident occurring within the time period specified in\nsubsection A of &#xA7; 46.2-2143.1. Insurers of the personal automobile\ninsurance policy of neither a person acting for or on behalf of the motor\ncarrier nor the vehicle&#8217;s owner shall have the duty to defend or indemnify\nthe activities of a person acting for or on behalf of a motor carrier in\nconnection with the motor carrier unless such policy expressly provides\notherwise for the period of time to which subsection A of &#xA7; 46.2-2143.1 is\napplicable or the policy contains an amendment or endorsement to provide that\ncoverage.\n\nE. Coverage under a motor carrier&#8217;s insurance policy shall not be\ndependent on a personal automobile policy&#8217;s first denying a claim, nor\nshall a personal automobile insurance policy be required to first deny a claim.\n\nF. Nothing in this section shall be construed to require a personal automobile\ninsurance policy to provide primary or excess coverage. The personal automobile\ninsurance policy of neither a person acting for or on behalf of the motor\ncarrier nor the vehicle&#8217;s owner shall provide coverage for activities in\nconnection with the motor carrier to such person acting for or on behalf of the\nmotor carrier, the vehicle owner, or any third party unless such policy\nexpressly provides otherwise for the period of time to which subsection A of\n&#xA7; 46.2-2143.1 is applicable or the policy contains an amendment or\nendorsement to provide that coverage.\n\nG. In every instance where motor carrier insurance maintained by a person other\nthan the motor carrier to fulfill the insurance obligations of subsection B of\n&#xA7; 46.2-2143.1 has lapsed or ceased to exist, the motor carrier shall\nprovide the coverage required by that subsection beginning with the first dollar\nof a claim.\n\nH. This section shall not limit the liability of a motor carrier arising out of\nan accident involving a person acting for or on behalf of the carrier in any\naction for damages against a motor carrier for an amount above the required\ninsurance coverage.\n\nI. Any person, or an attorney acting on his behalf, who suffers a loss in an\nautomobile accident with a reasonable belief that the accident involves a\nvehicle operated by a person acting for or on behalf of a motor carrier and who\nprovides the motor carrier with the date, approximate time, and location of the\naccident, the name of the vehicle operator, if available, and the accident\nreport, if available, may request in writing from the motor carrier information\nrelating to the insurance coverage and the company providing the coverage. The\nmotor carrier shall respond electronically or in writing within 30 days. The\nmotor carrier&#8217;s response shall contain the following information: (i)\nwhether, at the approximate time of the accident, the vehicle was being operated\nfor or on behalf of the motor carrier; (ii) the name of the insurance carrier\nproviding primary coverage; and (iii) the identity and last known address of the\nvehicle operator.\n\nJ. Any insurance required by subsection B of &#xA7; 46.2-2143.1 may be placed\nwith an insurer that has been admitted in Virginia or with an insurer providing\nsurplus lines insurance as defined in &#xA7; 38.2-4805.2.\n\nK. Any insurance policy required by subsection B of &#xA7; 46.2-2143.1 shall\nsatisfy the financial responsibility requirement for a motor vehicle under\n&#xA7; 46.2-706 during the period such vehicle is being operated for or on\nbehalf of a motor carrier.\n\nL. If a vehicle operated by a person acting for or on behalf of a motor carrier\nis insured under a personal automobile insurance policy that does not exclude\ncoverage, then such policy shall provide primary coverage and an insurance\npolicy maintained by the motor carrier under &#xA7; 46.2-2143.1 shall provide\nexcess coverage up to at least the limits required by &#xA7; 46.2-2143.1.\n\nM.
