An individual is not required to complete an entry-level driver training course related to the license, classification, or endorsement he is applying for if he is exempted from such requirements under 49 C.F.R. &#xA7; 380.603.B\n\nEvery application to the Department for a commercial driver&#8217;s license or commercial learner&#8217;s permit shall be made upon a form approved and furnished by the Department, and the applicant shall write his usual signature in ink in the space provided. The applicant shall provide the following information:1\n\nFull legal name;2\n\nCurrent mailing and residential addresses;3\n\nPhysical description including sex, height, weight, and eye and hair color;4\n\nYear, month, and date of birth;5\n\nSocial security number;6\n\nDomicile or, if not domiciled in the Commonwealth, proof of status as a member of the active duty military, military reserves, National Guard, active duty United States Coast Guard, or Coast Guard Auxiliary pursuant to 49 U.S.C. &#xA7; 31311(a)(12); and7\n\nAny other information required on the application form.\n\t\t\t\tApplicants shall be permitted to choose between &#8220;male,&#8221; &#8220;female,&#8221; or &#8220;non-binary&#8221; when designating the applicant&#8217;s sex on the commercial driver&#8217;s license or commercial learner&#8217;s permit application form.\n\t\t\t\tThe applicant&#8217;s social security number shall be provided to the Commercial Driver&#8217;s License Information System as required by 49 C.F.R. &#xA7; 383.153.C\n\nEvery applicant for a commercial driver&#8217;s license or commercial learner&#8217;s permit shall also submit to the Department the following:1\n\nA consent to release driving record information;2\n\nCertifications that:\n\t\t\t\ta. He either meets the federal qualification requirements of 49 C.F.R. Parts 383 and 391, or he is exempt from or is not subject to such federal requirements;\n\t\t\t\tb. He either meets the state qualification requirements established pursuant to &#xA7; 52-8.4, or he is exempt from or is not subject to such requirements;\n\t\t\t\tc. The motor vehicle in which the applicant takes the skills test is representative of the class and, if applicable, the type of motor vehicle for which the applicant seeks to be licensed;\n\t\t\t\td. He is not subject to any disqualification, suspension, revocation or cancellation of his driving privileges;\n\t\t\t\te. He does not have more than one driver&#8217;s license;3\n\nOther certifications required by the Department;4\n\nAny evidence required by the Department to establish proof of identity, citizenship or lawful permanent residency, domicile, and social security number notwithstanding the provisions of &#xA7; 46.2-328.1 and pursuant to 49 C.F.R. Part 383;5\n\nA statement indicating whether (i) the applicant has previously been licensed to drive any type of motor vehicle during the previous 10 years and, if so, all states that licensed the applicant and the dates he was licensed, and (ii) whether or not he has ever been disqualified, or his license suspended, revoked or canceled and, if so, the date of and reason therefor; and6\n\nAn unexpired employment authorization document (EAD) issued by the U.S. Citizenship and Immigration Services (USCIS) or an unexpired foreign passport accompanied by an approved Form I-94 documenting the applicant&#8217;s most recent admittance into the United States for persons applying for a nondomiciled commercial driver&#8217;s license or nondomiciled commercial learner&#8217;s permit.D\n\nEvery application for a commercial driver&#8217;s license shall include a photograph of the applicant supplied under arrangements made therefor by the Department in accordance with &#xA7; 46.2-323.E\n\nThe Department shall disqualify any commercial driver for a period of one year when the records of the Department clearly show to the satisfaction of the Commissioner that such person has made a material false statement on any application or certification made for a commercial driver&#8217;s license or commercial learner&#8217;s permit. The Department shall take such action within 30 days after discovering such falsification.F\n\nThe Department shall review the driving record of any person who applies for a Virginia commercial driver&#8217;s license or commercial learner&#8217;s permit, for the renewal or reinstatement of such license or permit or for an additional commercial classification or endorsement, including the driving record from all jurisdictions where, during the previous 10 years, the applicant was licensed to drive any type of motor vehicle. Such review shall include checking the photograph on record whenever the applicant or holder appears in person to renew, upgrade, transfer, reinstate, or obtain a duplicate commercial driver&#8217;s license or to renew, upgrade, reinstate, or obtain a duplicate commercial learner&#8217;s permit. If appropriate, the Department shall incorporate information from such other jurisdictions&#8217; records into the applicant&#8217;s Virginia driving record, and shall make a notation on the applicant&#8217;s driving record confirming that such review has been completed and the date it was completed. The Department&#8217;s review shall include (i) research through the Commercial Driver&#8217;s License Information System established pursuant to the Commercial Motor Vehicle Safety Act and the National Driver Register Problem Driver Pointer System in addition to the driver record maintained by the applicant&#8217;s previous jurisdictions of licensure and (ii) requesting information from the Drug and Alcohol Clearinghouse in accordance with 49 C.F.R. \u00a7 382.725. This research shall be completed prior to the issuance, renewal, transfer, or reinstatement of a commercial learner&#8217;s permit, commercial driver&#8217;s license or additional commercial classification or endorsement.1\n\nIf the information the Department receives from the Drug and Alcohol Clearinghouse indicates that the applicant is prohibited from operating a commercial motor vehicle, the Department shall deny the application. If the applicant currently holds a commercial driver&#8217;s license or a commercial learner&#8217;s permit, the Department must initiate a CDL downgrade of the applicant&#8217;s commercial driver&#8217;s license or commercial learner&#8217;s permit as defined in 49 C.F.R. &#xA7; 383.5.2\n\nIf the FMCSA notifies the Department that an existing holder of a commercial driver&#8217;s license or commercial learner&#8217;s permit is prohibited from operating a commercial motor vehicle pursuant to 49 C.F.R. &#xA7; 382.501(a), the Department shall initiate a CDL downgrade of the driver&#8217;s commercial driver&#8217;s license or commercial learner&#8217;s permit as defined in 49 C.F.R. &#xA7; 383.5 and record the CDL downgrade on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System within 60 days of receiving the notification.3\n\nIf the FMCSA notifies the Department that an existing holder of a commercial driver&#8217;s license or commercial learner&#8217;s permit was erroneously identified as prohibited from operating a commercial motor vehicle, the Department shall both reinstate the driver&#8217;s commercial driver&#8217;s license or commercial learner&#8217;s permit privilege and remove any reference to the driver&#8217;s erroneous prohibited status from the driver&#8217;s record on the Commercial Driver&#8217;s License Information System as expeditiously as possible, but no later than 10 days from receiving such notification from the FMCSA.G\n\nThe Department shall verify the name, date of birth, and social security number provided by the applicant with the information on file with the Social Security Administration for initial issuance of a commercial learner&#8217;s permit or transfer of a commercial driver&#8217;s license from another state. The Department shall make a notation in the driver&#8217;s record confirming that the necessary verification has been completed and noting the date it was done. The Department shall also make a notation confirming that proof of citizenship or lawful permanent residency has been presented and the date it was done.H\n\nEvery new applicant for a commercial driver&#8217;s license or commercial learner&#8217;s permit, including any person applying for a commercial driver&#8217;s license or permit after revocation of his driving privileges, who certifies that he will operate a commercial motor vehicle in non-excepted interstate or intrastate commerce shall provide the Department with an original or certified copy of a medical examiner&#8217;s certificate prepared by a medical examiner as defined in 49 C.F.R. &#xA7; 390.5. Upon receipt of an appropriate medical examiner&#8217;s certificate, the Department shall post a certification status of &#8220;certified&#8221; on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System. Any new applicant for a commercial driver&#8217;s license or commercial learner&#8217;s permit who fails to comply with the requirements of this subsection shall be denied the issuance of a commercial driver&#8217;s license or commercial learner&#8217;s permit by the Department.I\n\nEvery existing holder of a commercial driver&#8217;s license or commercial learner&#8217;s permit who certifies that he will operate a commercial motor vehicle in non-excepted interstate or intrastate commerce shall provide the Department with an original or certified copy of a medical examiner&#8217;s certificate prepared by a medical examiner as defined in 49 C.F.R. &#xA7; 390.5. Upon receipt of an appropriate medical examiner&#8217;s certificate, the Department shall post a certification status of &#8220;certified&#8221; and any other necessary information on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System. If an existing holder of a commercial driver&#8217;s license fails to provide the Department with a medical certificate as required by this subsection, the Department shall post a certification status of &#8220;noncertified&#8221; on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System and initiate a CDL downgrade of his commercial driver&#8217;s license as defined in 49 C.F.R. &#xA7; 383.5.J\n\nAny person who provides a medical certificate to the Department pursuant to the requirements of subsections H and I shall keep the medical certificate information current and shall notify the Department of any change in the status of the medical certificate. If the Department determines that the medical certificate is no longer valid, the Department shall initiate a CDL downgrade of the driver&#8217;s commercial driver&#8217;s license as defined in 49 C.F.R. &#xA7; 383.5.K\n\nIf the Department receives notice that the holder of a commercial driver&#8217;s license has been issued a medical variance as defined in 49 C.F.R. &#xA7; 390.5, the Department shall indicate the existence of such medical variance on the commercial driver&#8217;s license document of the driver and on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System using the restriction code &#8220;V.&#8221;L\n\nAny holder of a commercial driver&#8217;s license who has been issued a medical variance shall keep the medical variance information current and shall notify the Department of any change in the status of the medical variance. If the Department determines that the medical variance is no longer valid, the Department shall initiate a CDL downgrade of the driver&#8217;s commercial driver&#8217;s license as defined in 49 C.F.R. &#xA7; 383.5.M\n\nAny applicant applying for a hazardous materials endorsement must comply with Transportation Security Administration requirements in 49 C.F.R. Part 1572. He either meets the federal qualification requirements of 49 C.F.R. Parts 383 and 391, or he is exempt from or is not subject to such federal requirements;\n\t\t\t\tb. He either meets the <span class=\"dictionary\">state<\/span> qualification requirements established pursuant to &#xA7; <a class=\"law\" title=\"Powers and duties to promulgate regulations; inspection of certain records\" href=\"\/52-8.4\/\">52-8.4<\/a>, or he is exempt from or is not subject to such requirements;\n\t\t\t\tc. The <span class=\"dictionary\">motor vehicle<\/span> in which the <span class=\"dictionary\">applicant<\/span> takes the skills test is representative of the class and, if applicable, the type of <span class=\"dictionary\">motor vehicle<\/span> for which the <span class=\"dictionary\">applicant<\/span> seeks to be licensed;\n\t\t\t\td. He is not subject to any <span class=\"dictionary\">disqualification<\/span>, <span class=\"dictionary\">suspension<\/span>, <span class=\"dictionary\">revocation<\/span> or <span class=\"dictionary\">cancellation<\/span> of his driving <span class=\"dictionary\">privileges<\/span>;\n\t\t\t\te. He does not have more than one driver&#8217;s license; <a id=\"paragraph-262425\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Other certifications required by the <span class=\"dictionary\">Department<\/span>; <a id=\"paragraph-262426\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Any <span class=\"dictionary\">evidence<\/span> required by the <span class=\"dictionary\">Department<\/span> to establish proof of identity, citizenship or lawful permanent residency, <span class=\"dictionary\">domicile<\/span>, and social security number notwithstanding the provisions of &#xA7; <a class=\"law\" title=\"Licenses, permits, and special identification cards to be issued only to United States citizens, legal permanent resident aliens, or holders of valid unexpired nonimmigrant visas; exceptions; renewal, duplication, or reissuance\" href=\"\/46.2-328.1\/\">46.2-328.1<\/a> and pursuant to 49 C.F.R. Part 383; <a id=\"paragraph-262427\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> A statement indicating whether (i) the <span class=\"dictionary\">applicant<\/span> has previously been licensed to drive any type of <span class=\"dictionary\">motor vehicle<\/span> during the previous 10 years and, if so, all <span class=\"dictionary\">states<\/span> that licensed the <span class=\"dictionary\">applicant<\/span> and the dates he was licensed, and (ii) whether or not he has ever been disqualified, or his license suspended, revoked or canceled and, if so, the date of and reason therefor; and <a id=\"paragraph-262428\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> An unexpired employment authorization document (EAD) issued by the U.S. Citizenship and Immigration Services (USCIS) or an unexpired foreign passport accompanied by an approved Form I-94 documenting the <span class=\"dictionary\">applicant<\/span>&#8217;s most recent admittance into the United <span class=\"dictionary\">States<\/span> for <span class=\"dictionary\">persons<\/span> applying for a nondomiciled commercial driver&#8217;s license or nondomiciled commercial learner&#8217;s permit. <a id=\"paragraph-262429\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#C6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Every application for a commercial driver&#8217;s license shall include a photograph of the <span class=\"dictionary\">applicant<\/span> supplied under arrangements made therefor by the <span class=\"dictionary\">Department<\/span> in accordance with &#xA7; <a class=\"law\" title=\"Application for driver&#039;s license; proof of completion of driver education program; penalty\" href=\"\/46.2-323\/\">46.2-323<\/a>. <a id=\"paragraph-262430\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Department<\/span> shall disqualify any commercial driver for a period of one year when the records of the <span class=\"dictionary\">Department<\/span> clearly show to the satisfaction of the <span class=\"dictionary\">Commissioner<\/span> that such <span class=\"dictionary\">person<\/span> has made a <span class=\"dictionary\">material<\/span> false statement on any application or certification made for a commercial driver&#8217;s license or commercial learner&#8217;s permit. The <span class=\"dictionary\">Department<\/span> shall take such action within 30 days after discovering such falsification. <a id=\"paragraph-262431\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The <span class=\"dictionary\">Department<\/span> shall review the driving record of any <span class=\"dictionary\">person<\/span> who applies for a Virginia commercial driver&#8217;s license or commercial learner&#8217;s permit, for the renewal or reinstatement of such license or permit or for an additional commercial classification or <span class=\"dictionary\">endorsement<\/span>, including the driving record from all <span class=\"dictionary\">jurisdictions<\/span> where, during the previous 10 years, the <span class=\"dictionary\">applicant<\/span> was licensed to drive any type of motor vehicle. Such review shall include checking the photograph on record whenever the <span class=\"dictionary\">applicant<\/span> or holder appears in <span class=\"dictionary\">person<\/span> to renew, upgrade, transfer, reinstate, or obtain a duplicate commercial driver&#8217;s license or to renew, upgrade, reinstate, or obtain a duplicate commercial learner&#8217;s permit. If appropriate, the <span class=\"dictionary\">Department<\/span> shall incorporate information from such other <span class=\"dictionary\">jurisdictions<\/span>&#8217; records into the <span class=\"dictionary\">applicant<\/span>&#8217;s Virginia driving record, and shall make a notation on the <span class=\"dictionary\">applicant<\/span>&#8217;s driving record confirming that such review has been completed and the date it was completed. The <span class=\"dictionary\">Department<\/span>&#8217;s review shall include (i) research through the Commercial Driver&#8217;s License Information System established pursuant to the <span class=\"dictionary\">Commercial Motor Vehicle Safety Act<\/span> and the National Driver Register Problem Driver Pointer System in addition to the driver record maintained by the <span class=\"dictionary\">applicant<\/span>&#8217;s previous <span class=\"dictionary\">jurisdictions<\/span> of licensure and (ii) requesting information from the Drug and Alcohol Clearinghouse in accordance with 49 C.F.R. \u00a7&nbsp;382.725. This research shall be completed prior to the issuance, renewal, transfer, or reinstatement of a commercial learner&#8217;s permit, commercial driver&#8217;s license or additional commercial classification or <span class=\"dictionary\">endorsement<\/span>. <a id=\"paragraph-262432\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> If the information the <span class=\"dictionary\">Department<\/span> receives from the Drug and Alcohol Clearinghouse indicates that the <span class=\"dictionary\">applicant<\/span> is prohibited from operating a commercial motor vehicle, the <span class=\"dictionary\">Department<\/span> shall deny the application. If the <span class=\"dictionary\">applicant<\/span> currently holds a commercial driver&#8217;s license or a commercial learner&#8217;s permit, the <span class=\"dictionary\">Department<\/span> must initiate a CDL downgrade of the <span class=\"dictionary\">applicant<\/span>&#8217;s commercial driver&#8217;s license or commercial learner&#8217;s permit as defined in 49 C.F.R. &#xA7; 383.5. <a id=\"paragraph-262433\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#F1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> If the <span class=\"dictionary\">FMCSA<\/span> notifies the <span class=\"dictionary\">Department<\/span> that an existing holder of a commercial driver&#8217;s license or commercial learner&#8217;s permit is prohibited from operating a commercial motor vehicle pursuant to 49 C.F.R. &#xA7; 382.501(a), the <span class=\"dictionary\">Department<\/span> shall initiate a CDL downgrade of the driver&#8217;s commercial driver&#8217;s license or commercial learner&#8217;s permit as defined in 49 C.F.R. &#xA7; 383.5 and record the CDL downgrade on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System within 60 days of receiving the notification. <a id=\"paragraph-262434\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#F2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> If the <span class=\"dictionary\">FMCSA<\/span> notifies the <span class=\"dictionary\">Department<\/span> that an existing holder of a commercial driver&#8217;s license or commercial learner&#8217;s permit was erroneously identified as prohibited from operating a commercial motor vehicle, the <span class=\"dictionary\">Department<\/span> shall both reinstate the driver&#8217;s commercial driver&#8217;s license or commercial learner&#8217;s permit <span class=\"dictionary\">privilege<\/span> and remove any reference to the driver&#8217;s erroneous prohibited status from the driver&#8217;s record on the Commercial Driver&#8217;s License Information System as expeditiously as possible, but no later than 10 days from receiving such notification from the <span class=\"dictionary\">FMCSA<\/span>. <a id=\"paragraph-262435\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#F3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The <span class=\"dictionary\">Department<\/span> shall verify the name, date of birth, and social security number provided by the <span class=\"dictionary\">applicant<\/span> with the information on file with the Social Security Administration for initial issuance of a commercial learner&#8217;s permit or transfer of a commercial driver&#8217;s license from another <span class=\"dictionary\">state<\/span>. The <span class=\"dictionary\">Department<\/span> shall make a notation in the driver&#8217;s record confirming that the necessary verification has been completed and noting the date it was done. The <span class=\"dictionary\">Department<\/span> shall also make a notation confirming that proof of citizenship or lawful permanent residency has been presented and the date it was done. <a id=\"paragraph-262436\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> Every new <span class=\"dictionary\">applicant<\/span> for a commercial driver&#8217;s license or commercial learner&#8217;s permit, including any <span class=\"dictionary\">person<\/span> applying for a commercial driver&#8217;s license or permit after <span class=\"dictionary\">revocation<\/span> of his driving <span class=\"dictionary\">privileges<\/span>, who certifies that he will operate a commercial motor vehicle in non-excepted interstate or intrastate commerce shall provide the <span class=\"dictionary\">Department<\/span> with an original or certified copy of a medical examiner&#8217;s certificate prepared by a medical examiner as defined in 49 C.F.R. &#xA7; 390.5. Upon receipt of an appropriate medical examiner&#8217;s certificate, the <span class=\"dictionary\">Department<\/span> shall post a certification status of &#8220;certified&#8221; on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System. Any new <span class=\"dictionary\">applicant<\/span> for a commercial driver&#8217;s license or commercial learner&#8217;s permit who fails to comply with the requirements of this subsection shall be denied the issuance of a commercial driver&#8217;s license or commercial learner&#8217;s permit by the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-262437\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"I\"><p><span class=\"prefix-number\">I.<\/span> Every existing holder of a commercial driver&#8217;s license or commercial learner&#8217;s permit who certifies that he will operate a commercial motor vehicle in non-excepted interstate or intrastate commerce shall provide the <span class=\"dictionary\">Department<\/span> with an original or certified copy of a medical examiner&#8217;s certificate prepared by a medical examiner as defined in 49 C.F.R. &#xA7; 390.5. Upon receipt of an appropriate medical examiner&#8217;s certificate, the <span class=\"dictionary\">Department<\/span> shall post a certification status of &#8220;certified&#8221; and any other necessary information on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System. If an existing holder of a commercial driver&#8217;s license fails to provide the <span class=\"dictionary\">Department<\/span> with a medical certificate as required by this subsection, the <span class=\"dictionary\">Department<\/span> shall post a certification status of &#8220;noncertified&#8221; on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System and initiate a CDL downgrade of his commercial driver&#8217;s license as defined in 49 C.F.R. &#xA7; 383.5. <a id=\"paragraph-262438\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#I\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"J\"><p><span class=\"prefix-number\">J.<\/span> Any <span class=\"dictionary\">person<\/span> who provides a medical certificate to the <span class=\"dictionary\">Department<\/span> pursuant to the requirements of subsections H and I shall keep the medical certificate information current and shall notify the <span class=\"dictionary\">Department<\/span> of any change in the status of the medical certificate. If the <span class=\"dictionary\">Department<\/span> determines that the medical certificate is no longer valid, the <span class=\"dictionary\">Department<\/span> shall initiate a CDL downgrade of the driver&#8217;s commercial driver&#8217;s license as defined in 49 C.F.R. &#xA7; 383.5. <a id=\"paragraph-262439\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#J\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"K\"><p><span class=\"prefix-number\">K.<\/span> If the <span class=\"dictionary\">Department<\/span> receives notice that the holder of a commercial driver&#8217;s license has been issued a medical variance as defined in 49 C.F.R. &#xA7; 390.5, the <span class=\"dictionary\">Department<\/span> shall indicate the existence of such medical variance on the commercial driver&#8217;s license document of the driver and on the driver&#8217;s record on the Commercial Driver&#8217;s License Information System using the <span class=\"dictionary\">restriction<\/span> code &#8220;V.&#8221; <a id=\"paragraph-262440\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#K\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"L\"><p><span class=\"prefix-number\">L.<\/span> Any holder of a commercial driver&#8217;s license who has been issued a medical variance shall keep the medical variance information current and shall notify the <span class=\"dictionary\">Department<\/span> of any change in the status of the medical variance. If the <span class=\"dictionary\">Department<\/span> determines that the medical variance is no longer valid, the <span class=\"dictionary\">Department<\/span> shall initiate a CDL downgrade of the driver&#8217;s commercial driver&#8217;s license as defined in 49 C.F.R. &#xA7; 383.5. <a id=\"paragraph-262441\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#L\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"M\"><p><span class=\"prefix-number\">M.<\/span> Any <span class=\"dictionary\">applicant<\/span> applying for a <span class=\"dictionary\">hazardous materials<\/span> <span class=\"dictionary\">endorsement<\/span> must comply with Transportation Security Administration requirements in 49 C.F.R. Part 1572. A lawful permanent resident of the United <span class=\"dictionary\">States<\/span> requesting a <span class=\"dictionary\">hazardous materials<\/span> <span class=\"dictionary\">endorsement<\/span> must additionally provide his U.S. Citizenship and Immigration Services (USCIS) alien registration number. <a id=\"paragraph-262442\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#M\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"N\"><p><span class=\"prefix-number\">N.<\/span> Notwithstanding the provisions of &#xA7; <a class=\"law\" title=\"Records of Department; when open for inspection; release of privileged information\" href=\"\/46.2-208\/\">46.2-208<\/a>, the <span class=\"dictionary\">Department<\/span> may release to the <span class=\"dictionary\">FMCSA<\/span> medical information relating to the issuance of a commercial driver&#8217;s license or a commercial learner&#8217;s permit collected by the <span class=\"dictionary\">Department<\/span> pursuant to the provisions of subsections F, G, H, I, J, and K. <a id=\"paragraph-262443\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.12\/#N\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nAPPLICATION FOR COMMERCIAL DRIVER&#8217;S LICENSE OR COMMERCIAL LEARNER&#8217;S\nPERMIT (\u00a7 46.2-341.12)\n\nA. No entry-level driver shall be eligible to (i) apply for a Virginia Class A\nor Class B commercial driver&#8217;s license for the first time, (ii) upgrade to\na Class A or Class B commercial driver&#8217;s license for the first time, or\n(iii) apply for a hazardous materials, passenger, or school bus endorsement for\nthe first time, unless he has completed an entry-level driver training course\nrelated to the license, classification, or endorsement he is applying for and\nthe training is provided by a training provider. An individual is not required\nto complete an entry-level driver training course related to the license,\nclassification, or endorsement he is applying for if he is exempted from such\nrequirements under 49 C.F.R. &#xA7; 380.603.\n\nB. Every application to the Department for a commercial driver&#8217;s license\nor commercial learner&#8217;s permit shall be made upon a form approved and\nfurnished by the Department, and the applicant shall write his usual signature\nin ink in the space provided. The applicant shall provide the following\ninformation:\n\n   1. Full legal name;\n\n   2. Current mailing and residential addresses;\n\n   3. Physical description including sex, height, weight, and eye and hair color;\n\n   4. Year, month, and date of birth;\n\n   5. Social security number;\n\n   6. Domicile or, if not domiciled in the Commonwealth, proof of status as a\n   member of the active duty military, military reserves, National Guard, active\n   duty United States Coast Guard, or Coast Guard Auxiliary pursuant to 49 U.S.C.\n   &#xA7; 31311(a)(12); and\n\n   7. Any other information required on the application form.\n   \t\t\t\tApplicants shall be permitted to choose between &#8220;male,&#8221;\n   &#8220;female,&#8221; or &#8220;non-binary&#8221; when designating the\n   applicant&#8217;s sex on the commercial driver&#8217;s license or commercial\n   learner&#8217;s permit application form.\n   \t\t\t\tThe applicant&#8217;s social security number shall be provided to the\n   Commercial Driver&#8217;s License Information System as required by 49 C.F.R.\n   &#xA7; 383.153.\n\nC. Every applicant for a commercial driver&#8217;s license or commercial\nlearner&#8217;s permit shall also submit to the Department the following:\n\n   1. A consent to release driving record information;\n\n   2. Certifications that:\n   \t\t\t\ta. He either meets the federal qualification requirements of 49 C.F.R.\n   Parts 383 and 391, or he is exempt from or is not subject to such federal\n   requirements;\n   \t\t\t\tb. He either meets the state qualification requirements established\n   pursuant to &#xA7; 52-8.4, or he is exempt from or is not subject to such\n   requirements;\n   \t\t\t\tc. The motor vehicle in which the applicant takes the skills test is\n   representative of the class and, if applicable, the type of motor vehicle for\n   which the applicant seeks to be licensed;\n   \t\t\t\td. He is not subject to any disqualification, suspension, revocation or\n   cancellation of his driving privileges;\n   \t\t\t\te. He does not have more than one driver&#8217;s license;\n\n   3. Other certifications required by the Department;\n\n   4. Any evidence required by the Department to establish proof of identity,\n   citizenship or lawful permanent residency, domicile, and social security\n   number notwithstanding the provisions of &#xA7; 46.2-328.1 and pursuant to 49\n   C.F.R. Part 383;\n\n   5. A statement indicating whether (i) the applicant has previously been\n   licensed to drive any type of motor vehicle during the previous 10 years and,\n   if so, all states that licensed the applicant and the dates he was licensed,\n   and (ii) whether or not he has ever been disqualified, or his license\n   suspended, revoked or canceled and, if so, the date of and reason therefor;\n   and\n\n   6. An unexpired employment authorization document (EAD) issued by the U.S.\n   Citizenship and Immigration Services (USCIS) or an unexpired foreign passport\n   accompanied by an approved Form I-94 documenting the applicant&#8217;s most\n   recent admittance into the United States for persons applying for a\n   nondomiciled commercial driver&#8217;s license or nondomiciled commercial\n   learner&#8217;s permit.\n\nD. Every application for a commercial driver&#8217;s license shall include a\nphotograph of the applicant supplied under arrangements made therefor by the\nDepartment in accordance with &#xA7; 46.2-323.\n\nE. The Department shall disqualify any commercial driver for a period of one\nyear when the records of the Department clearly show to the satisfaction of the\nCommissioner that such person has made a material false statement on any\napplication or certification made for a commercial driver&#8217;s license or\ncommercial learner&#8217;s permit. The Department shall take such action within\n30 days after discovering such falsification.\n\nF. The Department shall review the driving record of any person who applies for\na Virginia commercial driver&#8217;s license or commercial learner&#8217;s\npermit, for the renewal or reinstatement of such license or permit or for an\nadditional commercial classification or endorsement, including the driving\nrecord from all jurisdictions where, during the previous 10 years, the applicant\nwas licensed to drive any type of motor vehicle. Such review shall include\nchecking the photograph on record whenever the applicant or holder appears in\nperson to renew, upgrade, transfer, reinstate, or obtain a duplicate commercial\ndriver&#8217;s license or to renew, upgrade, reinstate, or obtain a duplicate\ncommercial learner&#8217;s permit. If appropriate, the Department shall\nincorporate information from such other jurisdictions&#8217; records into the\napplicant&#8217;s Virginia driving record, and shall make a notation on the\napplicant&#8217;s driving record confirming that such review has been completed\nand the date it was completed. The Department&#8217;s review shall include (i)\nresearch through the Commercial Driver&#8217;s License Information System\nestablished pursuant to the Commercial Motor Vehicle Safety Act and the National\nDriver Register Problem Driver Pointer System in addition to the driver record\nmaintained by the applicant&#8217;s previous jurisdictions of licensure and (ii)\nrequesting information from the Drug and Alcohol Clearinghouse in accordance\nwith 49 C.F.R. \u00a7 382.725. This research shall be completed prior to the\nissuance, renewal, transfer, or reinstatement of a commercial learner&#8217;s\npermit, commercial driver&#8217;s license or additional commercial\nclassification or endorsement.\n\n   1. If the information the Department receives from the Drug and Alcohol\n   Clearinghouse indicates that the applicant is prohibited from operating a\n   commercial motor vehicle, the Department shall deny the application. If the\n   applicant currently holds a commercial driver&#8217;s license or a commercial\n   learner&#8217;s permit, the Department must initiate a CDL downgrade of the\n   applicant&#8217;s commercial driver&#8217;s license or commercial\n   learner&#8217;s permit as defined in 49 C.F.R. &#xA7; 383.5.\n\n   2. If the FMCSA notifies the Department that an existing holder of a\n   commercial driver&#8217;s license or commercial learner&#8217;s permit is\n   prohibited from operating a commercial motor vehicle pursuant to 49 C.F.R.\n   &#xA7; 382.501(a), the Department shall initiate a CDL downgrade of the\n   driver&#8217;s commercial driver&#8217;s license or commercial learner&#8217;s\n   permit as defined in 49 C.F.R. &#xA7; 383.5 and record the CDL downgrade on\n   the driver&#8217;s record on the Commercial Driver&#8217;s License Information\n   System within 60 days of receiving the notification.\n\n   3. If the FMCSA notifies the Department that an existing holder of a\n   commercial driver&#8217;s license or commercial learner&#8217;s permit was\n   erroneously identified as prohibited from operating a commercial motor\n   vehicle, the Department shall both reinstate the driver&#8217;s commercial\n   driver&#8217;s license or commercial learner&#8217;s permit privilege and\n   remove any reference to the driver&#8217;s erroneous prohibited status from\n   the driver&#8217;s record on the Commercial Driver&#8217;s License Information\n   System as expeditiously as possible, but no later than 10 days from receiving\n   such notification from the FMCSA.\n\nG. The Department shall verify the name, date of birth, and social security\nnumber provided by the applicant with the information on file with the Social\nSecurity Administration for initial issuance of a commercial learner&#8217;s\npermit or transfer of a commercial driver&#8217;s license from another state.\nThe Department shall make a notation in the driver&#8217;s record confirming\nthat the necessary verification has been completed and noting the date it was\ndone. The Department shall also make a notation confirming that proof of\ncitizenship or lawful permanent residency has been presented and the date it was\ndone.\n\nH. Every new applicant for a commercial driver&#8217;s license or commercial\nlearner&#8217;s permit, including any person applying for a commercial\ndriver&#8217;s license or permit after revocation of his driving privileges, who\ncertifies that he will operate a commercial motor vehicle in non-excepted\ninterstate or intrastate commerce shall provide the Department with an original\nor certified copy of a medical examiner&#8217;s certificate prepared by a\nmedical examiner as defined in 49 C.F.R. &#xA7; 390.5. Upon receipt of an\nappropriate medical examiner&#8217;s certificate, the Department shall post a\ncertification status of &#8220;certified&#8221; on the driver&#8217;s record on\nthe Commercial Driver&#8217;s License Information System. Any new applicant for\na commercial driver&#8217;s license or commercial learner&#8217;s permit who\nfails to comply with the requirements of this subsection shall be denied the\nissuance of a commercial driver&#8217;s license or commercial learner&#8217;s\npermit by the Department.\n\nI. Every existing holder of a commercial driver&#8217;s license or commercial\nlearner&#8217;s permit who certifies that he will operate a commercial motor\nvehicle in non-excepted interstate or intrastate commerce shall provide the\nDepartment with an original or certified copy of a medical examiner&#8217;s\ncertificate prepared by a medical examiner as defined in 49 C.F.R. &#xA7; 390.5.\nUpon receipt of an appropriate medical examiner&#8217;s certificate, the\nDepartment shall post a certification status of &#8220;certified&#8221; and any\nother necessary information on the driver&#8217;s record on the Commercial\nDriver&#8217;s License Information System. If an existing holder of a commercial\ndriver&#8217;s license fails to provide the Department with a medical\ncertificate as required by this subsection, the Department shall post a\ncertification status of &#8220;noncertified&#8221; on the driver&#8217;s record\non the Commercial Driver&#8217;s License Information System and initiate a CDL\ndowngrade of his commercial driver&#8217;s license as defined in 49 C.F.R.\n&#xA7; 383.5.\n\nJ. Any person who provides a medical certificate to the Department pursuant to\nthe requirements of subsections H and I shall keep the medical certificate\ninformation current and shall notify the Department of any change in the status\nof the medical certificate. If the Department determines that the medical\ncertificate is no longer valid, the Department shall initiate a CDL downgrade of\nthe driver&#8217;s commercial driver&#8217;s license as defined in 49 C.F.R.\n&#xA7; 383.5.\n\nK. If the Department receives notice that the holder of a commercial\ndriver&#8217;s license has been issued a medical variance as defined in 49\nC.F.R. &#xA7; 390.5, the Department shall indicate the existence of such medical\nvariance on the commercial driver&#8217;s license document of the driver and on\nthe driver&#8217;s record on the Commercial Driver&#8217;s License Information\nSystem using the restriction code &#8220;V.&#8221;\n\nL. Any holder of a commercial driver&#8217;s license who has been issued a\nmedical variance shall keep the medical variance information current and shall\nnotify the Department of any change in the status of the medical variance. If\nthe Department determines that the medical variance is no longer valid, the\nDepartment shall initiate a CDL downgrade of the driver&#8217;s commercial\ndriver&#8217;s license as defined in 49 C.F.R. &#xA7; 383.5.\n\nM. Any applicant applying for a hazardous materials endorsement must comply with\nTransportation Security Administration requirements in 49 C.F.R. Part 1572. A\nlawful permanent resident of the United States requesting a hazardous materials\nendorsement must additionally provide his U.S. Citizenship and Immigration\nServices (USCIS) alien registration number.\n\nN.
