I, c. 136.","full_text":"A\n\nExcept as otherwise provided in this section and in \u00a7 46.2-341.18:01, the Commissioner shall disqualify for a period of one year any person whose record, as maintained by the Department of Motor Vehicles, shows that he has been convicted of any of the following offenses, if such offense was committed while operating a commercial motor vehicle:1\n\nA violation of any provision of &#xA7; 46.2-341.21 or a violation of any federal law or the law of another jurisdiction substantially similar to &#xA7; 46.2-341.21;2\n\nA violation of any provision of &#xA7; 46.2-341.24 or a violation of any federal law or the law of another state substantially similar to &#xA7; 46.2-341.24;3\n\nA violation of any provision of &#xA7; 18.2-51.4 or 18.2-266 or a violation of a local ordinance paralleling or substantially similar to &#xA7; 18.2-51.4 or 18.2-266, or a violation of any federal, state or local law or ordinance substantially similar to &#xA7; 18.2-51.4 or 18.2-266;4\n\nRefusal to submit to a chemical test to determine the alcohol or drug content of the person&#8217;s blood or breath in accordance with &#xA7;&#xA7; 18.2-268.1 through 18.2-268.12 or this article, or the comparable laws of any other state or jurisdiction;5\n\nFailure of the driver whose vehicle is involved in an accident to stop and disclose his identity at the scene of the accident; or6\n\nCommission of any crime punishable as a felony in the commission of which a motor vehicle is used, other than a felony described in &#xA7; 46.2-341.19.B\n\nThe Commissioner shall disqualify any such person for a period of three years if any offense listed in subsection A was committed while driving a commercial motor vehicle used in the transportation of hazardous materials required to be placarded under federal Hazardous Materials Regulations (49 C.F.R. Part 172, Subpart F).C\n\nBeginning September 30, 2005, the Commissioner shall disqualify for a period of one year any person whose record, as maintained by the Department, shows that he has been convicted of any of the following offenses committed while operating a noncommercial motor vehicle, provided that the person was, at the time of the offense, the holder of a commercial driver&#8217;s license, and provided further that the offense was committed on or after September 30, 2005:1\n\nA violation of any provision of &#xA7; 18.2-51.4, 18.2-266, or a violation of a local ordinance paralleling or substantially similar to &#xA7; 18.2-51.4 or 18.2-266, or a violation of any federal, state, or local law or ordinance, or law of any other jurisdiction, substantially similar to &#xA7; 18.2-51.4 or 18.2-266;2\n\nRefusal to submit to a chemical test to determine the alcohol or drug content of the person&#8217;s blood or breath in accordance with &#xA7;&#xA7; 18.2-268.1 through 18.2-268.12, or the comparable laws of any other state or jurisdiction;3\n\nFailure of the driver whose vehicle is involved in an accident to stop and disclose his identity at the scene of the accident; or4\n\nCommission of any crime punishable as a felony in the commission of which a motor vehicle is used.D\n\nThe Commissioner shall disqualify for life any person whose record, as maintained by the Department, shows that he has been convicted of two or more violations of any of the offenses listed in subsection A or C, if each offense arose from a separate incident, except that if all of the offenses are for violation of an out-of-service order, the disqualification shall be for five years. <a class=\"law\" title=\"Chemical testing to determine alcohol or drug content of blood; definitions\" href=\"\/18.2-268.1\/\">18.2-268.1<\/a> through <a class=\"law\" title=\"Ordinances\" href=\"\/18.2-268.12\/\">18.2-268.12<\/a> or this article, or the comparable <span class=\"dictionary\">laws<\/span> of any other <span class=\"dictionary\">state<\/span> or <span class=\"dictionary\">jurisdiction<\/span>; <a id=\"paragraph-309217\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Failure of the <span class=\"dictionary\">driver<\/span> whose vehicle is involved in an accident to stop and disclose his identity at the scene of the accident; or <a id=\"paragraph-309218\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> <span class=\"dictionary\">Commission<\/span> of any <span class=\"dictionary\">crime<\/span> punishable as a <span class=\"dictionary\">felony<\/span> in the <span class=\"dictionary\">commission<\/span> of which a <span class=\"dictionary\">motor vehicle<\/span> is used, other than a <span class=\"dictionary\">felony<\/span> described in &#xA7; <a class=\"law\" title=\"Controlled substance felony; disqualification\" href=\"\/46.2-341.19\/\">46.2-341.19<\/a>. <a id=\"paragraph-309219\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The <span class=\"dictionary\">Commissioner<\/span> shall disqualify any such <span class=\"dictionary\">person<\/span> for a period of three years if any <span class=\"dictionary\">offense<\/span> listed in subsection A was committed while driving a commercial <span class=\"dictionary\">motor vehicle<\/span> used in the transportation of <span class=\"dictionary\">hazardous materials<\/span> required to be placarded under federal <span class=\"dictionary\">Hazardous Materials<\/span> Regulations (49 C.F.R. Part 172, Subpart F). <a id=\"paragraph-309220\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Beginning September 30, 2005, the <span class=\"dictionary\">Commissioner<\/span> shall disqualify for a period of one year any <span class=\"dictionary\">person<\/span> whose record, as maintained by the <span class=\"dictionary\">Department<\/span>, shows that he has been convicted of any of the following <span class=\"dictionary\">offenses<\/span> committed while operating a noncommercial <span class=\"dictionary\">motor vehicle<\/span>, provided that the <span class=\"dictionary\">person<\/span> was, at the time of the <span class=\"dictionary\">offense<\/span>, the holder of a commercial <span class=\"dictionary\">driver<\/span>&#8217;s license, and provided further that the <span class=\"dictionary\">offense<\/span> was committed on or after September 30, 2005: <a id=\"paragraph-309221\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> A violation of any provision of &#xA7; <a class=\"law\" title=\"Maiming, etc., of another resulting from driving while intoxicated\" href=\"\/18.2-51.4\/\">18.2-51.4<\/a>, <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a>, or a violation of a local <span class=\"dictionary\">ordinance<\/span> paralleling or substantially similar to &#xA7; <a class=\"law\" title=\"Maiming, etc., of another resulting from driving while intoxicated\" href=\"\/18.2-51.4\/\">18.2-51.4<\/a> or <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a>, or a violation of any federal, <span class=\"dictionary\">state<\/span>, or local <span class=\"dictionary\">law<\/span> or <span class=\"dictionary\">ordinance<\/span>, or <span class=\"dictionary\">law<\/span> of any other <span class=\"dictionary\">jurisdiction<\/span>, substantially similar to &#xA7; <a class=\"law\" title=\"Maiming, etc., of another resulting from driving while intoxicated\" href=\"\/18.2-51.4\/\">18.2-51.4<\/a> or <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a>; <a class=\"law\" title=\"Chemical testing to determine alcohol or drug content of blood; definitions\" href=\"\/18.2-268.1\/\">18.2-268.1<\/a> through <a class=\"law\" title=\"Ordinances\" href=\"\/18.2-268.12\/\">18.2-268.12<\/a>, or the comparable <span class=\"dictionary\">laws<\/span> of any other <span class=\"dictionary\">state<\/span> or <span class=\"dictionary\">jurisdiction<\/span>; <a id=\"paragraph-309223\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Failure of the <span class=\"dictionary\">driver<\/span> whose vehicle is involved in an accident to stop and disclose his identity at the scene of the accident; or <a id=\"paragraph-309224\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> <span class=\"dictionary\">Commission<\/span> of any <span class=\"dictionary\">crime<\/span> punishable as a <span class=\"dictionary\">felony<\/span> in the <span class=\"dictionary\">commission<\/span> of which a <span class=\"dictionary\">motor vehicle<\/span> is used. <a id=\"paragraph-309225\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">Commissioner<\/span> shall disqualify for life any <span class=\"dictionary\">person<\/span> whose record, as maintained by the <span class=\"dictionary\">Department<\/span>, shows that he has been convicted of two or more violations of any of the <span class=\"dictionary\">offenses<\/span> listed in subsection A or C, if each <span class=\"dictionary\">offense<\/span> arose from a separate incident, except that if all of the <span class=\"dictionary\">offenses<\/span> are for violation of an <span class=\"dictionary\">out-of-service order<\/span>, the <span class=\"dictionary\">disqualification<\/span> shall be for five years. If two or more such <span class=\"dictionary\">disqualification<\/span> <span class=\"dictionary\">offenses<\/span> arise from the same incident, the <span class=\"dictionary\">disqualification<\/span> periods imposed pursuant to subsection A, B, or C shall run consecutively and not concurrently. <a id=\"paragraph-309226\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Commissioner<\/span> shall disqualify for a period of five years a <span class=\"dictionary\">person<\/span> who is convicted of voluntary or <span class=\"dictionary\">involuntary manslaughter<\/span>, where the death occurred as a direct result of the operation of a commercial <span class=\"dictionary\">motor vehicle<\/span>. <a id=\"paragraph-309227\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The <span class=\"dictionary\">Commissioner<\/span> shall disqualify for life a <span class=\"dictionary\">person<\/span> who is convicted of a <span class=\"dictionary\">felony<\/span> involving an act or practice of severe forms of trafficking in <span class=\"dictionary\">persons<\/span> as defined in 22 U.S.C. &#xA7; 7102(11) while driving a commercial <span class=\"dictionary\">motor vehicle<\/span>, including any local, <span class=\"dictionary\">state<\/span>, or federal <span class=\"dictionary\">law<\/span> substantially similar to or fitting the definition of severe forms of trafficking in <span class=\"dictionary\">persons<\/span>. <a id=\"paragraph-309228\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The <span class=\"dictionary\">Department<\/span> may <span class=\"dictionary\">issue<\/span>, if permitted by federal <span class=\"dictionary\">law<\/span>, regulations establishing guidelines, including conditions, under which a <span class=\"dictionary\">disqualification<\/span> for life under subsection D may be reduced to a period of not less than 10 years. <a id=\"paragraph-309229\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-341.18\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDISQUALIFICATION FOR CERTAIN OFFENSES (\u00a7 46.2-341.18)\n\nA. Except as otherwise provided in this section and in \u00a7 46.2-341.18:01, the\nCommissioner shall disqualify for a period of one year any person whose record,\nas maintained by the Department of Motor Vehicles, shows that he has been\nconvicted of any of the following offenses, if such offense was committed while\noperating a commercial motor vehicle:\n\n   1. A violation of any provision of &#xA7; 46.2-341.21 or a violation of any\n   federal law or the law of another jurisdiction substantially similar to &#xA7;\n   46.2-341.21;\n\n   2. A violation of any provision of &#xA7; 46.2-341.24 or a violation of any\n   federal law or the law of another state substantially similar to &#xA7;\n   46.2-341.24;\n\n   3. A violation of any provision of &#xA7; 18.2-51.4 or 18.2-266 or a violation\n   of a local ordinance paralleling or substantially similar to &#xA7; 18.2-51.4\n   or 18.2-266, or a violation of any federal, state or local law or ordinance\n   substantially similar to &#xA7; 18.2-51.4 or 18.2-266;\n\n   4. Refusal to submit to a chemical test to determine the alcohol or drug\n   content of the person&#8217;s blood or breath in accordance with &#xA7;&#xA7;\n   18.2-268.1 through 18.2-268.12 or this article, or the comparable laws of any\n   other state or jurisdiction;\n\n   5. Failure of the driver whose vehicle is involved in an accident to stop and\n   disclose his identity at the scene of the accident; or\n\n   6. Commission of any crime punishable as a felony in the commission of which a\n   motor vehicle is used, other than a felony described in &#xA7; 46.2-341.19.\n\nB. The Commissioner shall disqualify any such person for a period of three years\nif any offense listed in subsection A was committed while driving a commercial\nmotor vehicle used in the transportation of hazardous materials required to be\nplacarded under federal Hazardous Materials Regulations (49 C.F.R. Part 172,\nSubpart F).\n\nC. Beginning September 30, 2005, the Commissioner shall disqualify for a period\nof one year any person whose record, as maintained by the Department, shows that\nhe has been convicted of any of the following offenses committed while operating\na noncommercial motor vehicle, provided that the person was, at the time of the\noffense, the holder of a commercial driver&#8217;s license, and provided further\nthat the offense was committed on or after September 30, 2005:\n\n   1. A violation of any provision of &#xA7; 18.2-51.4, 18.2-266, or a violation\n   of a local ordinance paralleling or substantially similar to &#xA7; 18.2-51.4\n   or 18.2-266, or a violation of any federal, state, or local law or ordinance,\n   or law of any other jurisdiction, substantially similar to &#xA7; 18.2-51.4 or\n   18.2-266;\n\n   2. Refusal to submit to a chemical test to determine the alcohol or drug\n   content of the person&#8217;s blood or breath in accordance with &#xA7;&#xA7;\n   18.2-268.1 through 18.2-268.12, or the comparable laws of any other state or\n   jurisdiction;\n\n   3. Failure of the driver whose vehicle is involved in an accident to stop and\n   disclose his identity at the scene of the accident; or\n\n   4. Commission of any crime punishable as a felony in the commission of which a\n   motor vehicle is used.\n\nD. The Commissioner shall disqualify for life any person whose record, as\nmaintained by the Department, shows that he has been convicted of two or more\nviolations of any of the offenses listed in subsection A or C, if each offense\narose from a separate incident, except that if all of the offenses are for\nviolation of an out-of-service order, the disqualification shall be for five\nyears. If two or more such disqualification offenses arise from the same\nincident, the disqualification periods imposed pursuant to subsection A, B, or C\nshall run consecutively and not concurrently.\n\nE. The Commissioner shall disqualify for a period of five years a person who is\nconvicted of voluntary or involuntary manslaughter, where the death occurred as\na direct result of the operation of a commercial motor vehicle.\n\nF. The Commissioner shall disqualify for life a person who is convicted of a\nfelony involving an act or practice of severe forms of trafficking in persons as\ndefined in 22 U.S.C. &#xA7; 7102(11) while driving a commercial motor vehicle,\nincluding any local, state, or federal law substantially similar to or fitting\nthe definition of severe forms of trafficking in persons.\n\nG.
