In case of conviction the court shall order the surrender of the license to the court where it shall be disposed of in accordance with the provisions of &#xA7; 46.2-398. If the person so convicted has not obtained a license required by this chapter or is a nonresident, the court shall direct in the judgment of conviction that the person shall not drive any motor vehicle in the Commonwealth for a period of not less than 60 days nor more than six months.B\n\nThe court may, in its discretion and for good cause shown, provide that such person be issued a restricted permit to operate a motor vehicle during the period of suspension for any of the purposes set forth in subsection E of &#xA7; 18.2-271.1. The court shall forward to the Commissioner a copy of its order entered pursuant to this section, which shall specifically enumerate the restrictions imposed and contain such information regarding the person to whom such a permit is issued as is reasonably necessary to identify such person. The court shall also provide a copy of its order to the person who may operate a motor vehicle on the order until receipt from the Commissioner of a restricted license. A copy of such order and, after receipt thereof, the restricted license shall be carried at all times while operating a motor vehicle. Any person who operates a motor vehicle in violation of any restrictions imposed pursuant to this section shall be punished as provided in subsection C of &#xA7; 46.2-301. No restricted license issued pursuant to this section shall permit any person to operate a commercial motor vehicle as defined in the Virginia Commercial Driver&#8217;s License Act (&#xA7; 46.2-341.1 et seq.).C\n\nNotwithstanding the provisions of subsection A, when any person is convicted of reckless driving pursuant to &#xA7; 46.2-861 or 46.2-862, in addition to any penalties provided by law and as an alternative to suspending such person&#8217;s driver&#8217;s license, the court may, in its discretion and for good cause shown, require that such person enroll in the Intelligent Speed Assistance Program established pursuant to &#xA7; 46.2-507 for a period of not less than 60 days nor more than six months. However, if such person was convicted of reckless driving pursuant to &#xA7; 46.2-862 and was found to have been driving on the highways of the Commonwealth in excess of 100 miles per hour, the court shall order such enrollment for such period of time, unless the court has ordered suspension of such person&#8217;s driver&#8217;s license pursuant to subsection A. The <span class=\"dictionary\">court<\/span> shall forward to the <span class=\"dictionary\">Commissioner<\/span> a copy of its <span class=\"dictionary\">order<\/span> entered pursuant to this section, which shall specifically enumerate the restrictions imposed and contain such information regarding the person to whom such a permit is issued as is reasonably necessary to identify such person. The <span class=\"dictionary\">court<\/span> shall also provide a copy of its <span class=\"dictionary\">order<\/span> to the person who may operate a <span class=\"dictionary\">motor vehicle<\/span> on the <span class=\"dictionary\">order<\/span> until receipt from the <span class=\"dictionary\">Commissioner<\/span> of a restricted license. A copy of such <span class=\"dictionary\">order<\/span> and, after receipt thereof, the restricted license shall be carried at all times while operating a <span class=\"dictionary\">motor vehicle<\/span>. Any person who operates a <span class=\"dictionary\">motor vehicle<\/span> in violation of any restrictions imposed pursuant to this section shall be punished as provided in subsection C of &#xA7; <a class=\"law\" title=\"Driving while license, permit, or privilege to drive suspended or revoked\" href=\"\/46.2-301\/\">46.2-301<\/a>. No restricted license issued pursuant to this section shall permit any person to operate a commercial <span class=\"dictionary\">motor vehicle<\/span> as defined in the Virginia Commercial <span class=\"dictionary\">Driver<\/span>&#8217;s License Act (&#xA7; <a class=\"law\" title=\"Title\" href=\"\/46.2-341.1\/\">46.2-341.1<\/a> et seq.). <a id=\"paragraph-260395\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-393\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Notwithstanding the provisions of subsection A, when any person is convicted of <span class=\"dictionary\">reckless driving<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Driving too fast for highway and traffic conditions\" href=\"\/46.2-861\/\">46.2-861<\/a> or <a class=\"law\" title=\"Exceeding speed limit\" href=\"\/46.2-862\/\">46.2-862<\/a>, in addition to any penalties provided by <span class=\"dictionary\">law<\/span> and as an alternative to suspending such person&#8217;s <span class=\"dictionary\">driver<\/span>&#8217;s license, the <span class=\"dictionary\">court<\/span> may, in its discretion and for good cause shown, require that such person enroll in the Intelligent Speed Assistance Program established pursuant to &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Establishment of Intelligent Speed Assistance Program; penalty\" href=\"\/46.2-507\/\">46.2-507<\/a> for a period of not less than 60 days nor more than six months. However, if such person was convicted of <span class=\"dictionary\">reckless driving<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Exceeding speed limit\" href=\"\/46.2-862\/\">46.2-862<\/a> and was found to have been driving on the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> of the Commonwealth in excess of 100 miles per hour, the <span class=\"dictionary\">court<\/span> shall <span class=\"dictionary\">order<\/span> such enrollment for such period of time, unless the <span class=\"dictionary\">court<\/span> has ordered <span class=\"dictionary\">suspension<\/span> of such person&#8217;s <span class=\"dictionary\">driver<\/span>&#8217;s license pursuant to subsection A. No restricted license issued nor enrollment in the Intelligent Speed Assistance Program required pursuant to this section shall permit any person to operate a commercial <span class=\"dictionary\">motor vehicle<\/span>, as that term is defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/46.2-341.4\/\">46.2-341.4<\/a>. <a id=\"paragraph-260396\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-393\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(EFFECTIVE JULY 1, 2026) SUSPENSION OF LICENSE ON CONVICTION OF CERTAIN RECKLESS\nOFFENSES; RESTRICTED LICENSES (\u00a7 46.2-393)\n\nA. When any person is convicted of reckless driving as provided in &#xA7;&#xA7;\n46.2-853 through 46.2-864, in addition to any penalties provided by law, the\ndriver&#8217;s license of the person may be suspended by the court for a period\nof not less than 60 days nor more than six months. In case of conviction the\ncourt shall order the surrender of the license to the court where it shall be\ndisposed of in accordance with the provisions of &#xA7; 46.2-398. If the person\nso convicted has not obtained a license required by this chapter or is a\nnonresident, the court shall direct in the judgment of conviction that the\nperson shall not drive any motor vehicle in the Commonwealth for a period of not\nless than 60 days nor more than six months.\n\nB. The court may, in its discretion and for good cause shown, provide that such\nperson be issued a restricted permit to operate a motor vehicle during the\nperiod of suspension for any of the purposes set forth in subsection E of &#xA7;\n18.2-271.1. The court shall forward to the Commissioner a copy of its order\nentered pursuant to this section, which shall specifically enumerate the\nrestrictions imposed and contain such information regarding the person to whom\nsuch a permit is issued as is reasonably necessary to identify such person. The\ncourt shall also provide a copy of its order to the person who may operate a\nmotor vehicle on the order until receipt from the Commissioner of a restricted\nlicense. A copy of such order and, after receipt thereof, the restricted license\nshall be carried at all times while operating a motor vehicle. Any person who\noperates a motor vehicle in violation of any restrictions imposed pursuant to\nthis section shall be punished as provided in subsection C of &#xA7; 46.2-301.\nNo restricted license issued pursuant to this section shall permit any person to\noperate a commercial motor vehicle as defined in the Virginia Commercial\nDriver&#8217;s License Act (&#xA7; 46.2-341.1 et seq.).\n\nC. Notwithstanding the provisions of subsection A, when any person is convicted\nof reckless driving pursuant to &#xA7; 46.2-861 or 46.2-862, in addition to any\npenalties provided by law and as an alternative to suspending such\nperson&#8217;s driver&#8217;s license, the court may, in its discretion and for\ngood cause shown, require that such person enroll in the Intelligent Speed\nAssistance Program established pursuant to &#xA7; 46.2-507 for a period of not\nless than 60 days nor more than six months. However, if such person was\nconvicted of reckless driving pursuant to &#xA7; 46.2-862 and was found to have\nbeen driving on the highways of the Commonwealth in excess of 100 miles per\nhour, the court shall order such enrollment for such period of time, unless the\ncourt has ordered suspension of such person&#8217;s driver&#8217;s license\npursuant to subsection A.
