The court shall make a separate finding on this issue and note such finding on the conviction record.D\n\nThe Uniform Demerit Point System standard for rating convictions of traffic offenses shall be based on the severity of the offense and the potential hazardous exposure to other users of the highways and streets. The <span class=\"dictionary\">court<\/span> shall make a separate <span class=\"dictionary\">finding<\/span> on this <span class=\"dictionary\">issue<\/span> and note such <span class=\"dictionary\">finding<\/span> on the <span class=\"dictionary\">conviction<\/span> record. <a id=\"paragraph-217395\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-492\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The Uniform Demerit Point System standard for rating <span class=\"dictionary\">convictions<\/span> of traffic <span class=\"dictionary\">offenses<\/span> shall be based on the severity of the <span class=\"dictionary\">offense<\/span> and the potential hazardous exposure to other users of the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> and streets. The <span class=\"dictionary\">Commissioner<\/span> shall designate the point values assigned to <span class=\"dictionary\">convictions<\/span>, or <span class=\"dictionary\">findings<\/span> of not innocent in the case of a juvenile, on a graduated scale not to exceed six demerit points for any single <span class=\"dictionary\">conviction<\/span>. The <span class=\"dictionary\">Commissioner<\/span> shall develop point system assignments as follows: <a id=\"paragraph-217396\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-492\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Serious traffic <span class=\"dictionary\">offenses<\/span> such as driving while intoxicated in violation of &#xA7; <a class=\"law\" title=\"Driving motor vehicle, engine, etc., while intoxicated, etc\" href=\"\/18.2-266\/\">18.2-266<\/a>, persons under age twenty-one driving after illegally consuming alcohol in violation of &#xA7; <a class=\"law\" title=\"Persons under age 21 driving after illegally consuming alcohol; penalty\" href=\"\/18.2-266.1\/\">18.2-266.1<\/a>, <span class=\"dictionary\">reckless driving<\/span> in violation of &#xA7; <a class=\"law\" title=\"Reckless driving; general rule\" href=\"\/46.2-852\/\">46.2-852<\/a>, speeding twenty or more miles per hour above the posted speed limit, racing in violation of &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Racing or exhibition driving; definitions; penalties\" href=\"\/46.2-865\/\">46.2-865<\/a>, and other serious traffic <span class=\"dictionary\">offenses<\/span> as the <span class=\"dictionary\">Commissioner<\/span> may designate, shall be assigned six demerit points. <a id=\"paragraph-217397\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-492\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Relatively serious traffic <span class=\"dictionary\">offenses<\/span> such as failure to yield the right-of-way in violation of &#xA7;&#xA7; <a class=\"law\" title=\"Right-of-way at uncontrolled intersections, generally\" href=\"\/46.2-820\/\">46.2-820<\/a> through <a class=\"law\" title=\"Unlawful speed forfeits right-of-way\" href=\"\/46.2-823\/\">46.2-823<\/a>, speeding between ten and nineteen miles per hour above the posted speed limit, following too closely in violation of &#xA7; <a class=\"law\" title=\"Following too closely\" href=\"\/46.2-816\/\">46.2-816<\/a>, failure to stop when entering a <span class=\"dictionary\">highway<\/span> in violation of &#xA7; <a class=\"law\" title=\"Failure to yield right-of-way\" href=\"\/46.2-863\/\">46.2-863<\/a>, aggressive driving in violation of &#xA7; <a class=\"law\" title=\"Aggressive driving; penalties\" href=\"\/46.2-868.1\/\">46.2-868.1<\/a> and other relatively serious traffic <span class=\"dictionary\">offenses<\/span> as the <span class=\"dictionary\">Commissioner<\/span> may designate, shall be assigned four demerit points. <a id=\"paragraph-217398\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-492\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Traffic <span class=\"dictionary\">offenses<\/span> of a less serious nature such as improper driving in violation of &#xA7; <a class=\"law\" title=\"Improper driving; penalty\" href=\"\/46.2-869\/\">46.2-869<\/a>, speeding between one and nine miles per hour above the posted speed limit, improper passing in violation of &#xA7; <a class=\"law\" title=\"Passing when overtaking a vehicle\" href=\"\/46.2-838\/\">46.2-838<\/a>, failure to obey a <span class=\"dictionary\">highway<\/span> sign in violation of &#xA7; <a class=\"law\" title=\"Uniform traffic control devices on highways; drivers to obey traffic control devices; enforcement of section\" href=\"\/46.2-830\/\">46.2-830<\/a> and other <span class=\"dictionary\">offenses<\/span> of a less serious nature as the <span class=\"dictionary\">Commissioner<\/span> may designate, shall be assigned three demerit points. <a id=\"paragraph-217399\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-492\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> When a person is convicted of two or more traffic <span class=\"dictionary\">offenses<\/span> committed on a single occasion, he shall be assessed points for one <span class=\"dictionary\">offense<\/span> only and if the <span class=\"dictionary\">offenses<\/span> involved have different point values, he shall be assessed points for the <span class=\"dictionary\">offense<\/span> having the greater point value. <a id=\"paragraph-217400\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-492\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nUNIFORM DEMERIT POINT SYSTEM (\u00a7 46.2-492)\n\nA. The Commissioner shall assign point values to those convictions, or findings\nof not innocent in the case of a juvenile, which are required to be reported to\nthe Department in accordance with &#xA7; 46.2-383 for traffic offenses committed\nin violation of the laws of the Commonwealth or any county, city, or town\nordinance paralleling and substantially conforming to state law, provided that\nno conviction, or finding of not innocent in the case of a juvenile for any\noffense, relating to registration, insurance, or equipment shall be included\nexcept as otherwise provided by this title.\n\nB. The Commissioner shall assign point values to those convictions received from\nany other state of the United States, the United States, Canada or its\nprovinces, or any territorial subdivision of any of them, of an offense therein,\nwhich if committed in this Commonwealth, would be required to be reported to the\nDepartment by &#xA7; 46.2-383.\n\nC. No point assignment shall be made for any conviction which results from a\nvehicle having been parked or stopped, in order for the driver to sleep or rest,\non the shoulder or other portion of a highway not ordinarily used for vehicular\ntraffic. The court shall make a separate finding on this issue and note such\nfinding on the conviction record.\n\nD. The Uniform Demerit Point System standard for rating convictions of traffic\noffenses shall be based on the severity of the offense and the potential\nhazardous exposure to other users of the highways and streets. The Commissioner\nshall designate the point values assigned to convictions, or findings of not\ninnocent in the case of a juvenile, on a graduated scale not to exceed six\ndemerit points for any single conviction. The Commissioner shall develop point\nsystem assignments as follows:\n\n   1. Serious traffic offenses such as driving while intoxicated in violation of\n   &#xA7; 18.2-266, persons under age twenty-one driving after illegally\n   consuming alcohol in violation of &#xA7; 18.2-266.1, reckless driving in\n   violation of &#xA7; 46.2-852, speeding twenty or more miles per hour above the\n   posted speed limit, racing in violation of &#xA7; 46.2-865, and other serious\n   traffic offenses as the Commissioner may designate, shall be assigned six\n   demerit points.\n\n   2. Relatively serious traffic offenses such as failure to yield the\n   right-of-way in violation of &#xA7;&#xA7; 46.2-820 through 46.2-823, speeding\n   between ten and nineteen miles per hour above the posted speed limit,\n   following too closely in violation of &#xA7; 46.2-816, failure to stop when\n   entering a highway in violation of &#xA7; 46.2-863, aggressive driving in\n   violation of &#xA7; 46.2-868.1 and other relatively serious traffic offenses\n   as the Commissioner may designate, shall be assigned four demerit points.\n\n   3. Traffic offenses of a less serious nature such as improper driving in\n   violation of &#xA7; 46.2-869, speeding between one and nine miles per hour\n   above the posted speed limit, improper passing in violation of &#xA7;\n   46.2-838, failure to obey a highway sign in violation of &#xA7; 46.2-830 and\n   other offenses of a less serious nature as the Commissioner may designate,\n   shall be assigned three demerit points.\n\nE.
