A converter shall be considered a manufacturer responsible under 49 U.S.C. &#xA7; 30112 for compliance of the motorcycle with Federal Motor Vehicle Safety Standards and the certification of compliance required by those standards.\n\t\t\t&#8220;Federal Motor Vehicle Safety Standards&#8221; means the standards prescribed by 49 C.F.R. Part 571.\n\t\t\t&#8220;Manufacturer&#8221; means a person manufacturing or assembling motor vehicles or motor vehicle equipment.\n\t\t\t&#8220;Motor vehicle equipment&#8221; means (i) any system, part, or component of a motor vehicle as originally manufactured or (ii) any similar part or component manufactured or sold for replacement or improvement of a system, part, or component, or as an accessory or addition to a motor vehicle.\n\t\t\t&#8220;Off-road motorcycle converted to on-road use&#8221; means every off-road motorcycle that has been converted for use on the public highways with the addition of such necessary equipment to meet all applicable Federal Motor Vehicle Safety Standards for new motorcycles for the year in which it is converted.B\n\nEach converter shall certify in accordance with the requirements of subsection E that the off-road motorcycle converted to on-road use meets all applicable Federal Motor Vehicle Safety Standards for new motorcycles for the year in which it is converted. If the converter is unavailable or unknown, the owner shall certify that the converter is unavailable or unknown and that he assumes responsibility for all duties and corresponding liabilities under the Federal Motor Vehicle Safety Act. If a converter or owner fails or refuses to provide the required certification, the vehicle shall remain an off-road motorcycle.C\n\nEach converter, or owner if the converter is unavailable or unknown, shall permanently affix to each vehicle a label containing the following: (i) the name of manufacturer, (ii) the month and year of manufacture, (iii) the gross vehicle weight rating, (iv) the gross axle weight rating, (v) certification that the vehicle conforms to all applicable Federal Motor Vehicle Safety Standards in effect on the date of manufacture in the year in which it is converted, (vi) the vehicle identification number, and (vii) the motorcycle vehicle classification. Such label shall meet the requirements set forth in 49 C.F.R. &#xA7; 567.4.D\n\nUpon receipt of an application and such evidence of ownership as required by the Commissioner pursuant to &#xA7; 46.2-625, the Department shall issue a certificate of title for an off-road motorcycle converted to on-road use. Such label shall meet the requirements set forth in 49 C.F.R. &#xA7; 567.4. <a id=\"paragraph-213293\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-602.4\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Upon receipt of an application and such <span class=\"dictionary\">evidence<\/span> of ownership as required by the <span class=\"dictionary\">Commissioner<\/span> pursuant to &#xA7; <a class=\"law\" title=\"Specially constructed, reconstructed, replica, converted electric, or foreign vehicles\" href=\"\/46.2-625\/\">46.2-625<\/a>, the <span class=\"dictionary\">Department<\/span> shall <span class=\"dictionary\">issue<\/span> a certificate of title for an <span class=\"dictionary\">off-road motorcycle converted to on-road use<\/span>. The first certificate of title issued for an <span class=\"dictionary\">off-road motorcycle converted to on-road use<\/span> shall be an original certificate of title, regardless of the submission of a Virginia certificate of title issued for the off-road motorcycle prior to conversion. <a id=\"paragraph-213294\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-602.4\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> No <span class=\"dictionary\">off-road motorcycle converted to on-road use<\/span> shall be registered or operated on the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> of the Commonwealth until the <span class=\"dictionary\">owner<\/span> submits to the <span class=\"dictionary\">Department<\/span>, upon a form approved and furnished by the <span class=\"dictionary\">Department<\/span>, (i) certification that the motor vehicle has passed the motor vehicle safety inspection subsequent to the conversion; (ii) certification from the <span class=\"dictionary\">converter<\/span>, or <span class=\"dictionary\">owner<\/span> if the <span class=\"dictionary\">converter<\/span> is unavailable or unknown, that the motor vehicle meets all applicable <span class=\"dictionary\">Federal Motor Vehicle Safety Standards<\/span>; and (iii) certification that the motor vehicle has been labeled in accordance with subsection C. <a id=\"paragraph-213295\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-602.4\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> When necessary and upon application, the <span class=\"dictionary\">Department<\/span> shall <span class=\"dictionary\">issue<\/span> temporary trip permits in accordance with &#xA7; <a class=\"law\" title=\"Trip permits; regulations; fees\" href=\"\/46.2-651\/\">46.2-651<\/a> for the purpose of transporting the <span class=\"dictionary\">off-road motorcycle converted to on-road use<\/span> to and from an official motor vehicle safety inspection station. <a id=\"paragraph-213296\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-602.4\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Notwithstanding &#xA7;&#xA7; <a class=\"law\" title=\"Making false affidavit or swearing falsely, perjury\" href=\"\/46.2-105\/\">46.2-105<\/a> and <a class=\"law\" title=\"Altering or forging certificate of title, salvage\/nonrepairable certificate, or registration card; penalty\" href=\"\/46.2-605\/\">46.2-605<\/a>, any certification required by this section found to be knowingly given falsely is punishable as a Class 1 <span class=\"dictionary\">misdemeanor<\/span>. <a id=\"paragraph-213297\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-602.4\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nTITLING AND REGISTRATION OF OFF-ROAD MOTORCYCLE CONVERTED TO ON-ROAD USE (\u00a7\n46.2-602.4)\n\nA. For the purpose of this section:\n\t\t\t&#8220;Converter&#8221; means a person who, through the act of conversion,\nalters an off-road motorcycle for on-road use on the highways by the addition,\nsubstitution, or removal of motor vehicle equipment, creating a motor vehicle to\nwhich Federal Motor Vehicle Safety Standards for new motorcycles will become\napplicable at the time of the conversion. A converter shall be considered a\nmanufacturer responsible under 49 U.S.C. &#xA7; 30112 for compliance of the\nmotorcycle with Federal Motor Vehicle Safety Standards and the certification of\ncompliance required by those standards.\n\t\t\t&#8220;Federal Motor Vehicle Safety Standards&#8221; means the standards\nprescribed by 49 C.F.R. Part 571.\n\t\t\t&#8220;Manufacturer&#8221; means a person manufacturing or assembling motor\nvehicles or motor vehicle equipment.\n\t\t\t&#8220;Motor vehicle equipment&#8221; means (i) any system, part, or\ncomponent of a motor vehicle as originally manufactured or (ii) any similar part\nor component manufactured or sold for replacement or improvement of a system,\npart, or component, or as an accessory or addition to a motor vehicle.\n\t\t\t&#8220;Off-road motorcycle converted to on-road use&#8221; means every\noff-road motorcycle that has been converted for use on the public highways with\nthe addition of such necessary equipment to meet all applicable Federal Motor\nVehicle Safety Standards for new motorcycles for the year in which it is\nconverted.\n\nB. Each converter shall certify in accordance with the requirements of\nsubsection E that the off-road motorcycle converted to on-road use meets all\napplicable Federal Motor Vehicle Safety Standards for new motorcycles for the\nyear in which it is converted. If the converter is unavailable or unknown, the\nowner shall certify that the converter is unavailable or unknown and that he\nassumes responsibility for all duties and corresponding liabilities under the\nFederal Motor Vehicle Safety Act. If a converter or owner fails or refuses to\nprovide the required certification, the vehicle shall remain an off-road\nmotorcycle.\n\nC. Each converter, or owner if the converter is unavailable or unknown, shall\npermanently affix to each vehicle a label containing the following: (i) the name\nof manufacturer, (ii) the month and year of manufacture, (iii) the gross vehicle\nweight rating, (iv) the gross axle weight rating, (v) certification that the\nvehicle conforms to all applicable Federal Motor Vehicle Safety Standards in\neffect on the date of manufacture in the year in which it is converted, (vi) the\nvehicle identification number, and (vii) the motorcycle vehicle classification.\nSuch label shall meet the requirements set forth in 49 C.F.R. &#xA7; 567.4.\n\nD. Upon receipt of an application and such evidence of ownership as required by\nthe Commissioner pursuant to &#xA7; 46.2-625, the Department shall issue a\ncertificate of title for an off-road motorcycle converted to on-road use. The\nfirst certificate of title issued for an off-road motorcycle converted to\non-road use shall be an original certificate of title, regardless of the\nsubmission of a Virginia certificate of title issued for the off-road motorcycle\nprior to conversion.\n\nE. No off-road motorcycle converted to on-road use shall be registered or\noperated on the highways of the Commonwealth until the owner submits to the\nDepartment, upon a form approved and furnished by the Department, (i)\ncertification that the motor vehicle has passed the motor vehicle safety\ninspection subsequent to the conversion; (ii) certification from the converter,\nor owner if the converter is unavailable or unknown, that the motor vehicle\nmeets all applicable Federal Motor Vehicle Safety Standards; and (iii)\ncertification that the motor vehicle has been labeled in accordance with\nsubsection C.\n\nF. When necessary and upon application, the Department shall issue temporary\ntrip permits in accordance with &#xA7; 46.2-651 for the purpose of transporting\nthe off-road motorcycle converted to on-road use to and from an official motor\nvehicle safety inspection station.\n\nG.
