Except as provided in &#xA7;&#xA7; 58.1-3219.5 and 58.1-3219.9, and for the purposes stated in &#xA7;&#xA7; 58.1-3219.5 and 58.1-3219.9, the provisions of this section constitute the only manner by which a manufactured home owner may convert a manufactured home to real property.B\n\nA manufactured home owner who wishes to convert the home to real property shall submit a sworn affidavit to the Department that the wheels and other equipment previously used for mobility have been removed from the manufactured home and the unit has been attached to real property owned by the manufactured home owner. If such manufactured home owner is not listed on the title as the owner of such manufactured home, such owner shall also submit to the Department (i) any deed, court order or decree, or other legal document or record establishing that the manufactured home was transferred by the owner listed on the title in the records of the Department to the current manufactured home owner or, if not a direct transfer, records to establish a chain of successive ownership of the manufactured home; (ii) documentation establishing that an existing lien on the vehicle record has been released by the secured party or, if no release is available, that the loan issued by the secured party has been satisfied; and (iii) if available, the original title, duplicate title, or certificate of origin for such manufactured home.\n\t\t\tThe affidavit must be in a form approved by the Commissioner. Upon compliance by the owner with the procedure for surrender of title, the Department shall rescind and cancel the Virginia title. The Department shall not cancel the title if a security interest has been recorded on the title and not released by the secured party, except that, in the absence of a lien release, documentation establishing that the loan issued by the secured party has been satisfied shall be acceptable as proof of such release. After canceling the title, the Department shall provide written confirmation to the owner that the title has been surrendered and has been canceled by the Department.\n\t\t\tUpon receipt of confirmation that the title has been surrendered and has been canceled by the Department, the owner shall file a sworn affidavit of affixation with the circuit court of the locality where the real property is located. The affidavit shall include all of the following information:1\n\nThe manufacturer and, if applicable, the model name of the manufactured home.2\n\nThe vehicle identification number and serial number of the manufactured home.3\n\nThe legal description of the real property on which the manufactured home is placed, including the property address, stating that the owner of the manufactured home also owns the real property.4\n\nCertification that there are no security interests in the manufactured home that have not been released by the secured party.5\n\nThe homeowner&#8217;s statement that the title has been surrendered and has been canceled by the Department and that the home is intended to be a permanent fixture and improvement to the land, to the same extent as any site-built home, and assessed and taxed with the land as real property.\n\t\t\t\tIn addition, a copy of the confirmation provided by the Department that the title has been surrendered and canceled by the Department shall be attached to and filed with the affidavit.\n\t\t\t\tUpon filing the affidavit of affixation, the manufactured home shall then be deemed to be real estate and shall thereafter be conveyed and encumbered only as real estate is conveyed and encumbered, except when the home is thereafter physically severed from the real property and a new title issued in accordance with subsection C.\n\t\t\t\tA security interest in a manufactured home is perfected against the rights of judicial lien creditors, execution creditors, and purchasers for value on and after the date such security interest attaches. The Commissioner shall have prepared a list of all titles canceled pursuant to this section and furnish it, in conjunction with the reports submitted pursuant to &#xA7; 46.2-210, to the commissioner of the revenue of each county and city without cost.C\n\nIf the owner of a manufactured home whose certificate of title has been canceled under this section subsequently seeks to sever the manufactured home from the real property, the owner may apply for a new certificate of title in accordance with the provisions of this section.1\n\nThe owner shall file with the circuit court where the real property is located an affidavit that includes or provides for all of the following information:\n\t\t\t\ta. The manufacturer and, if applicable, the model name of the manufactured home.\n\t\t\t\tb. The vehicle identification number and serial number of the manufactured home.\n\t\t\t\tc. Confirmation of severance by the commissioner of the revenue where the real property is located shall constitute acceptable evidence that the unit has been severed from the real property.\n\t\t\t\tUpon receipt of the information required in subdivision C 2, together with a title application and required fee, the Department is authorized to issue a new title for the manufactured home. The <span class=\"dictionary\">affidavit<\/span> shall include all of the following information: <a id=\"paragraph-262293\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The manufacturer and, if applicable, the model name of the <span class=\"dictionary\">manufactured home<\/span>. <a id=\"paragraph-262294\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The <span class=\"dictionary\">vehicle<\/span> identification number and serial number of the <span class=\"dictionary\">manufactured home<\/span>. <a id=\"paragraph-262295\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> The legal description of the real property on which the <span class=\"dictionary\">manufactured home<\/span> is placed, including the property address, stating that the <span class=\"dictionary\">owner<\/span> of the <span class=\"dictionary\">manufactured home<\/span> also owns the real property. <a id=\"paragraph-262296\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Certification that there are no security interests in the <span class=\"dictionary\">manufactured home<\/span> that have not been released by the secured <span class=\"dictionary\">party<\/span>. <a id=\"paragraph-262297\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#B4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> The homeowner&#8217;s statement that the title has been surrendered and has been canceled by the <span class=\"dictionary\">Department<\/span> and that the home is intended to be a permanent fixture and improvement to the land, to the same extent as any site-built home, and assessed and taxed with the land as real property.\n\t\t\t\tIn addition, a copy of the confirmation provided by the <span class=\"dictionary\">Department<\/span> that the title has been surrendered and canceled by the <span class=\"dictionary\">Department<\/span> shall be attached to and filed with the <span class=\"dictionary\">affidavit<\/span>.\n\t\t\t\tUpon filing the <span class=\"dictionary\">affidavit<\/span> of affixation, the <span class=\"dictionary\">manufactured home<\/span> shall then be deemed to be real estate and shall thereafter be conveyed and encumbered only as real estate is conveyed and encumbered, except when the home is thereafter physically severed from the real property and a new title issued in accordance with subsection C.\n\t\t\t\tA security interest in a <span class=\"dictionary\">manufactured home<\/span> is perfected against the rights of judicial <span class=\"dictionary\">lien<\/span> <span class=\"dictionary\">creditors<\/span>, execution <span class=\"dictionary\">creditors<\/span>, and purchasers for value on and after the date such security interest attaches. The <span class=\"dictionary\">Commissioner<\/span> shall have prepared a list of all titles canceled pursuant to this section and furnish it, in conjunction with the reports submitted pursuant to &#xA7; <a class=\"law\" title=\"List of registrations and titles\" href=\"\/46.2-210\/\">46.2-210<\/a>, to the <span class=\"dictionary\">commissioner<\/span> of the revenue of each county and city without cost. <a id=\"paragraph-262298\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#B5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> If the <span class=\"dictionary\">owner<\/span> of a <span class=\"dictionary\">manufactured home<\/span> whose certificate of title has been canceled under this section subsequently seeks to sever the <span class=\"dictionary\">manufactured home<\/span> from the real property, the <span class=\"dictionary\">owner<\/span> may apply for a new certificate of title in accordance with the provisions of this section. <a id=\"paragraph-262299\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The <span class=\"dictionary\">owner<\/span> shall file with the <span class=\"dictionary\">circuit<\/span> court where the real property is located an <span class=\"dictionary\">affidavit<\/span> that includes or provides for all of the following information:\n\t\t\t\ta. The manufacturer and, if applicable, the model name of the <span class=\"dictionary\">manufactured home<\/span>.\n\t\t\t\tb. The <span class=\"dictionary\">vehicle<\/span> identification number and serial number of the <span class=\"dictionary\">manufactured home<\/span>.\n\t\t\t\tc. The legal description of the real property on which the <span class=\"dictionary\">manufactured home<\/span> is or was placed, stating that the <span class=\"dictionary\">owner<\/span> of the <span class=\"dictionary\">manufactured home<\/span> also owns the real property.\n\t\t\t\td. Certification that there are no security interests in the <span class=\"dictionary\">manufactured home<\/span> that have not been released by the secured <span class=\"dictionary\">party<\/span>.\n\t\t\t\te. The homeowner&#8217;s statement that the home has been or will be physically severed from the real property. <a id=\"paragraph-262300\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The <span class=\"dictionary\">owner<\/span> must submit the following to the <span class=\"dictionary\">Department<\/span>:\n\t\t\t\ta. A copy of the <span class=\"dictionary\">affidavit<\/span> filed in accordance with subdivision C 1.\n\t\t\t\tb. Verification that the <span class=\"dictionary\">manufactured home<\/span> has been severed from the real property. Confirmation of severance by the <span class=\"dictionary\">commissioner<\/span> of the revenue where the real property is located shall constitute acceptable <span class=\"dictionary\">evidence<\/span> that the unit has been severed from the real property.\n\t\t\t\tUpon receipt of the information required in subdivision C 2, together with a title application and required fee, the <span class=\"dictionary\">Department<\/span> is authorized to <span class=\"dictionary\">issue<\/span> a new title for the <span class=\"dictionary\">manufactured home<\/span>. The initial title issued under the provisions of this subsection shall contain no security interests, provided however, that nothing contained herein shall be construed to prevent a subsequent security interest from being recorded on the title. <a id=\"paragraph-262301\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-653.1\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCONVERSION OF MANUFACTURED HOME TO REAL PROPERTY (\u00a7 46.2-653.1)\n\nA. After a manufactured home has been titled in the Commonwealth and at such\ntime as the wheels and other equipment previously used for mobility have been\nremoved and the unit has been attached to real property owned by the\nmanufactured home owner, the owner may convert the home to real property in\naccordance with the provisions of subsection B. Except as provided in\n&#xA7;&#xA7; 58.1-3219.5 and 58.1-3219.9, and for the purposes stated in\n&#xA7;&#xA7; 58.1-3219.5 and 58.1-3219.9, the provisions of this section\nconstitute the only manner by which a manufactured home owner may convert a\nmanufactured home to real property.\n\nB. A manufactured home owner who wishes to convert the home to real property\nshall submit a sworn affidavit to the Department that the wheels and other\nequipment previously used for mobility have been removed from the manufactured\nhome and the unit has been attached to real property owned by the manufactured\nhome owner. If such manufactured home owner is not listed on the title as the\nowner of such manufactured home, such owner shall also submit to the Department\n(i) any deed, court order or decree, or other legal document or record\nestablishing that the manufactured home was transferred by the owner listed on\nthe title in the records of the Department to the current manufactured home\nowner or, if not a direct transfer, records to establish a chain of successive\nownership of the manufactured home; (ii) documentation establishing that an\nexisting lien on the vehicle record has been released by the secured party or,\nif no release is available, that the loan issued by the secured party has been\nsatisfied; and (iii) if available, the original title, duplicate title, or\ncertificate of origin for such manufactured home.\n\t\t\tThe affidavit must be in a form approved by the Commissioner. Upon compliance\nby the owner with the procedure for surrender of title, the Department shall\nrescind and cancel the Virginia title. The Department shall not cancel the title\nif a security interest has been recorded on the title and not released by the\nsecured party, except that, in the absence of a lien release, documentation\nestablishing that the loan issued by the secured party has been satisfied shall\nbe acceptable as proof of such release. After canceling the title, the\nDepartment shall provide written confirmation to the owner that the title has\nbeen surrendered and has been canceled by the Department.\n\t\t\tUpon receipt of confirmation that the title has been surrendered and has been\ncanceled by the Department, the owner shall file a sworn affidavit of affixation\nwith the circuit court of the locality where the real property is located. The\naffidavit shall include all of the following information:\n\n   1. The manufacturer and, if applicable, the model name of the manufactured\n   home.\n\n   2. The vehicle identification number and serial number of the manufactured\n   home.\n\n   3. The legal description of the real property on which the manufactured home\n   is placed, including the property address, stating that the owner of the\n   manufactured home also owns the real property.\n\n   4. Certification that there are no security interests in the manufactured home\n   that have not been released by the secured party.\n\n   5. The homeowner&#8217;s statement that the title has been surrendered and has\n   been canceled by the Department and that the home is intended to be a\n   permanent fixture and improvement to the land, to the same extent as any\n   site-built home, and assessed and taxed with the land as real property.\n   \t\t\t\tIn addition, a copy of the confirmation provided by the Department that\n   the title has been surrendered and canceled by the Department shall be\n   attached to and filed with the affidavit.\n   \t\t\t\tUpon filing the affidavit of affixation, the manufactured home shall then\n   be deemed to be real estate and shall thereafter be conveyed and encumbered\n   only as real estate is conveyed and encumbered, except when the home is\n   thereafter physically severed from the real property and a new title issued in\n   accordance with subsection C.\n   \t\t\t\tA security interest in a manufactured home is perfected against the rights\n   of judicial lien creditors, execution creditors, and purchasers for value on\n   and after the date such security interest attaches. The Commissioner shall\n   have prepared a list of all titles canceled pursuant to this section and\n   furnish it, in conjunction with the reports submitted pursuant to &#xA7;\n   46.2-210, to the commissioner of the revenue of each county and city without\n   cost.\n\nC. If the owner of a manufactured home whose certificate of title has been\ncanceled under this section subsequently seeks to sever the manufactured home\nfrom the real property, the owner may apply for a new certificate of title in\naccordance with the provisions of this section.\n\n   1. The owner shall file with the circuit court where the real property is\n   located an affidavit that includes or provides for all of the following\n   information:\n   \t\t\t\ta. The manufacturer and, if applicable, the model name of the manufactured\n   home.\n   \t\t\t\tb. The vehicle identification number and serial number of the manufactured\n   home.\n   \t\t\t\tc. The legal description of the real property on which the manufactured\n   home is or was placed, stating that the owner of the manufactured home also\n   owns the real property.\n   \t\t\t\td. Certification that there are no security interests in the manufactured\n   home that have not been released by the secured party.\n   \t\t\t\te. The homeowner&#8217;s statement that the home has been or will be\n   physically severed from the real property.\n\n   2. The owner must submit the following to the Department:\n   \t\t\t\ta. A copy of the affidavit filed in accordance with subdivision C 1.\n   \t\t\t\tb. Verification that the manufactured home has been severed from the real\n   property. Confirmation of severance by the commissioner of the revenue where\n   the real property is located shall constitute acceptable evidence that the\n   unit has been severed from the real property.\n   \t\t\t\tUpon receipt of the information required in subdivision C 2, together with\n   a title application and required fee, the Department is authorized to issue a\n   new title for the manufactured home.
