Notwithstanding &#xA7;&#xA7; 46.2-706, 46.2-707, and 46.2-708, an individual 18 years of age or older whose driver&#8217;s license and vehicle registration have been suspended pursuant to &#xA7; 46.2-706, 46.2-707, or 46.2-708 may apply to the Department to enter into a payment plan agreement with a duration of no more than three years from the agreement date, referred to in this section as the &#8220;payment plan period.&#8221;B\n\nTo be eligible to enter into the payment plan, the individual must (i) have one or more outstanding suspensions of driving privileges pursuant to the provisions of &#xA7; 46.2-706, 46.2-707, or 46.2-708 and have no other outstanding suspensions or revocations; (ii) meet all other conditions for reinstatement of driving privileges; and (iii) have not defaulted twice on the same uninsured motor vehicle payment plan agreement.C\n\nAn eligible individual who pays a $25 administrative fee when entering into a payment plan agreement or when reentering into a payment plan agreement with the Department, and pays the reinstatement fee pursuant to &#xA7;&#xA7; 46.2-333.1 and 46.2-411, if required, shall be eligible to have his driving privileges reinstated by the Department.D\n\nThe amount and frequency of each payment and the duration of the payment plan shall be described in the payment plan agreement signed by the Department and the individual. Payments may be made in person, online, by telephone, or by mail. The full fee must be paid in no more than three years from the agreement date; however, an individual may repay the balance of the fee at any time during the payment plan period with no penalty.E\n\nIf an individual defaults on the payment plan agreement, the Commissioner shall suspend the driver&#8217;s license and all registration certificates and license plates issued to the owner of the motor vehicle determined to be uninsured. The <span class=\"dictionary\">Commissioner<\/span> may extend the due date of any installment payment for not more than 30 days if the <span class=\"dictionary\">Department<\/span> is unable to process an installment payment due to circumstances beyond its control. <a id=\"paragraph-299020\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-707.1\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> When all fees are paid, the individual shall continue to furnish proof of <span class=\"dictionary\">financial responsibility in the future<\/span> pursuant to Article 15 (&#xA7; <a class=\"law\" title=\"Proof of financial responsibility to be furnished for each vehicle\" href=\"\/46.2-435\/\">46.2-435<\/a> et seq.) of Chapter 3 and &#xA7; <a class=\"law\" title=\"Requiring other proof of financial responsibility in the future; suspended driver&#039;s license, registration certificate and license plates to be returned to Commissioner; Commissioner may take possession thereof\" href=\"\/46.2-709\/\">46.2-709<\/a>. <a id=\"paragraph-299021\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-707.1\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Installment payments of the fee with respect to the motor vehicle determined to be uninsured shall be disposed of pursuant to &#xA7; <a class=\"law\" title=\"Disposition of funds collected\" href=\"\/46.2-710\/\">46.2-710<\/a>. The administrative fee shall be paid to the <span class=\"dictionary\">Commissioner<\/span> and deposited into the state treasury account set aside in a special fund to be used to meet the necessary expenses incurred by the <span class=\"dictionary\">Department<\/span>. <a id=\"paragraph-299022\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-707.1\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nNONCOMPLIANCE FEE PAYMENT PLAN (\u00a7 46.2-707.1)\n\nA. The Department may establish a noncompliance fee payment plan to allow\nindividuals to pay the fees for a motor vehicle determined to be uninsured as\nprescribed in &#xA7; 46.2-706, 46.2-707, or 46.2-708. Notwithstanding\n&#xA7;&#xA7; 46.2-706, 46.2-707, and 46.2-708, an individual 18 years of age or\nolder whose driver&#8217;s license and vehicle registration have been suspended\npursuant to &#xA7; 46.2-706, 46.2-707, or 46.2-708 may apply to the Department\nto enter into a payment plan agreement with a duration of no more than three\nyears from the agreement date, referred to in this section as the &#8220;payment\nplan period.&#8221;\n\nB. To be eligible to enter into the payment plan, the individual must (i) have\none or more outstanding suspensions of driving privileges pursuant to the\nprovisions of &#xA7; 46.2-706, 46.2-707, or 46.2-708 and have no other\noutstanding suspensions or revocations; (ii) meet all other conditions for\nreinstatement of driving privileges; and (iii) have not defaulted twice on the\nsame uninsured motor vehicle payment plan agreement.\n\nC. An eligible individual who pays a $25 administrative fee when entering into a\npayment plan agreement or when reentering into a payment plan agreement with the\nDepartment, and pays the reinstatement fee pursuant to &#xA7;&#xA7; 46.2-333.1\nand 46.2-411, if required, shall be eligible to have his driving privileges\nreinstated by the Department.\n\nD. The amount and frequency of each payment and the duration of the payment plan\nshall be described in the payment plan agreement signed by the Department and\nthe individual. Payments may be made in person, online, by telephone, or by\nmail. The full fee must be paid in no more than three years from the agreement\ndate; however, an individual may repay the balance of the fee at any time during\nthe payment plan period with no penalty.\n\nE. If an individual defaults on the payment plan agreement, the Commissioner\nshall suspend the driver&#8217;s license and all registration certificates and\nlicense plates issued to the owner of the motor vehicle determined to be\nuninsured. Such driver&#8217;s license, registration certificates, and license\nplates shall remain suspended until the individual pays the balance of the fee\napplicable to his offense as prescribed in &#xA7; 46.2-706, 46.2-707, or\n46.2-708 and furnishes proof of financial responsibility in the future as\nprescribed by Article 15 (&#xA7; 46.2-435 et seq.) of Chapter 3. An individual\nis in default if he (i) pays an installment payment late as defined in the\npayment plan agreement or (ii) fails to make an installment payment as agreed to\nin the payment plan agreement. If an individual is in default and is ineligible\nto reenter the payment plan, full payment of the balance of the fee shall be due\nas agreed to in the payment plan agreement.
