In the case of conviction, the court shall order the surrender of the license to the court where it shall be disposed of in accordance with the provisions of &#xA7; 46.2-398. No restricted license issued nor enrollment in the Intelligent Speed Assistance Program required pursuant to this section shall permit any person to operate a commercial motor vehicle, as that term is defined in &#xA7; 46.2-341.4.G\n\nWhen any person is convicted of an offense of reckless driving under subsection C, in addition to any other penalties provided by law, the driver&#8217;s license of such person shall be suspended by the court for a period of up to six months. or <a id=\"paragraph-252436\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Transporting a passenger on the hood or roof of the <span class=\"dictionary\">motor vehicle<\/span>. <a id=\"paragraph-252437\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> Any person who engages in a race between two or more <span class=\"dictionary\">motor vehicles<\/span> on the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> in the Commonwealth or on any driveway or premises of a church, school, recreational facility, or business property open to the public in the Commonwealth is guilty of <span class=\"dictionary\">reckless driving<\/span>, unless authorized by the <span class=\"dictionary\">owner<\/span> of the property or his <span class=\"dictionary\">agent<\/span>. <a id=\"paragraph-252438\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Any person who engages in <span class=\"dictionary\">exhibition driving<\/span> on the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> in the Commonwealth or on any driveway or premises of a church, school, recreational facility, or business property open to the public in the Commonwealth is guilty of <span class=\"dictionary\">reckless driving<\/span>, unless authorized by the <span class=\"dictionary\">owner<\/span> of the property or his <span class=\"dictionary\">agent<\/span>. <a id=\"paragraph-252439\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Any person who purposefully rides as a passenger on the hood or roof during any race or <span class=\"dictionary\">exhibition driving<\/span> in violation of subsection B or C is guilty of a Class 3 <span class=\"dictionary\">misdemeanor<\/span>. <a id=\"paragraph-252440\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Any person who purposefully slows, stops, or impedes, or attempts to slow, stop, or impede, the movement of traffic, including pedestrian traffic, for the purpose of a race or <span class=\"dictionary\">exhibition driving<\/span> in violation of subsection B or C is guilty of a Class 1 <span class=\"dictionary\">misdemeanor<\/span>. <a id=\"paragraph-252441\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> When any person is convicted of <span class=\"dictionary\">reckless driving<\/span> under subsection B, in addition to any other penalties provided by <span class=\"dictionary\">law<\/span>, the <span class=\"dictionary\">driver<\/span>&#8217;s license of such person shall be suspended by the <span class=\"dictionary\">court<\/span> for a period of not less than six months nor more than two years or the <span class=\"dictionary\">court<\/span> may, in its discretion and for good cause shown, require that such person enroll in the Intelligent Speed Assistance Program established pursuant to &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Establishment of Intelligent Speed Assistance Program; penalty\" href=\"\/46.2-507\/\">46.2-507<\/a> for a period of not less than six months nor more than two years. In the case of <span class=\"dictionary\">conviction<\/span>, the <span class=\"dictionary\">court<\/span> shall <span class=\"dictionary\">order<\/span> the surrender of the license to the <span class=\"dictionary\">court<\/span> where it shall be disposed of in accordance with the provisions of &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Disposition of surrendered licenses on revocation or suspension\" href=\"\/46.2-398\/\">46.2-398<\/a>. No restricted license issued nor enrollment in the Intelligent Speed Assistance Program required pursuant to this section shall permit any person to operate a commercial <span class=\"dictionary\">motor vehicle<\/span>, as that term is defined in &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/46.2-341.4\/\">46.2-341.4<\/a>. <a id=\"paragraph-252442\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> When any person is convicted of an <span class=\"dictionary\">offense<\/span> of <span class=\"dictionary\">reckless driving<\/span> under subsection C, in addition to any other penalties provided by <span class=\"dictionary\">law<\/span>, the <span class=\"dictionary\">driver<\/span>&#8217;s license of such person shall be suspended by the <span class=\"dictionary\">court<\/span> for a period of up to six months. In the case of <span class=\"dictionary\">conviction<\/span>, the <span class=\"dictionary\">court<\/span> shall <span class=\"dictionary\">order<\/span> the surrender of the license to the <span class=\"dictionary\">court<\/span> where it shall be disposed of in accordance with the provisions of &#xA7; <a class=\"law\" title=\"(Effective July 1, 2026) Disposition of surrendered licenses on revocation or suspension\" href=\"\/46.2-398\/\">46.2-398<\/a>. <a id=\"paragraph-252443\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-865\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\n(EFFECTIVE JULY 1, 2026) RACING OR EXHIBITION DRIVING; DEFINITIONS; PENALTIES\n(\u00a7 46.2-865)\n\nA. As used in this article, unless the context requires a different meaning:\n\t\t\t&#8220;Exhibition driving&#8221; means the intentional performance of any of\nthe following in close proximity to a group of two or more people:\n\n   1. Maintaining a motor vehicle in a stationary position by using the brake\n   pedal or parking brake of such vehicle while simultaneously engaging the gas\n   pedal, causing one set of wheels to spin or lose contact with the pavement;\n\n   2. Operating a motor vehicle in an unnecessary manner that causes such vehicle\n   to move in a manner inconsistent with the normal operation of such vehicle,\n   such as zigzagging or spinning around in a circular pattern. &#8220;Exhibition\n   driving&#8221; does not include operating a motor vehicle in an otherwise\n   lawful manner and engaging in such described conduct as necessary to avoid\n   collision, damage, or injury;\n\n   3. Operating one or more motor vehicles, for the purpose of exhibiting the\n   speed or power of such vehicle or vehicles, from a designated starting point\n   to a designated ending point or over a common selected course, including drag\n   racing; or\n\n   4. Transporting a passenger on the hood or roof of the motor vehicle.\n\nB. Any person who engages in a race between two or more motor vehicles on the\nhighways in the Commonwealth or on any driveway or premises of a church, school,\nrecreational facility, or business property open to the public in the\nCommonwealth is guilty of reckless driving, unless authorized by the owner of\nthe property or his agent.\n\nC. Any person who engages in exhibition driving on the highways in the\nCommonwealth or on any driveway or premises of a church, school, recreational\nfacility, or business property open to the public in the Commonwealth is guilty\nof reckless driving, unless authorized by the owner of the property or his\nagent.\n\nD. Any person who purposefully rides as a passenger on the hood or roof during\nany race or exhibition driving in violation of subsection B or C is guilty of a\nClass 3 misdemeanor.\n\nE. Any person who purposefully slows, stops, or impedes, or attempts to slow,\nstop, or impede, the movement of traffic, including pedestrian traffic, for the\npurpose of a race or exhibition driving in violation of subsection B or C is\nguilty of a Class 1 misdemeanor.\n\nF. When any person is convicted of reckless driving under subsection B, in\naddition to any other penalties provided by law, the driver&#8217;s license of\nsuch person shall be suspended by the court for a period of not less than six\nmonths nor more than two years or the court may, in its discretion and for good\ncause shown, require that such person enroll in the Intelligent Speed Assistance\nProgram established pursuant to &#xA7; 46.2-507 for a period of not less than\nsix months nor more than two years. In the case of conviction, the court shall\norder the surrender of the license to the court where it shall be disposed of in\naccordance with the provisions of &#xA7; 46.2-398. No restricted license issued\nnor enrollment in the Intelligent Speed Assistance Program required pursuant to\nthis section shall permit any person to operate a commercial motor vehicle, as\nthat term is defined in &#xA7; 46.2-341.4.\n\nG. When any person is convicted of an offense of reckless driving under\nsubsection C, in addition to any other penalties provided by law, the\ndriver&#8217;s license of such person shall be suspended by the court for a\nperiod of up to six months.
