Any operator of a motor vehicle who fails to comply with the signs installed pursuant to this subsection is guilty of a traffic infraction punishable by a fine of no less than $100 or more than $500. The Department of Transportation shall develop criteria for the design, location, and installation of such signs. The provisions of this section shall not apply to any limited access highway.E\n\nWhere a shared-use path crosses a highway at a clearly marked crosswalk and there are no traffic control signals at such crossing, the local governing body may by ordinance require pedestrians, cyclists, and any other users of such shared-used path to come to a complete stop prior to entering such crosswalk. Such local ordinance may provide for a fine not to exceed $100 for violations. Any locality adopting such an ordinance shall install and maintain stop signs, consistent with standards adopted by the Commonwealth Transportation Board and to the extent necessary in coordination with the Department of Transportation. penalty\" href=\"\/46.2-816.1\/\">46.2-816.1<\/a>, who is lawfully crossing a <span class=\"dictionary\">highway<\/span> is a Class 1 <span class=\"dictionary\">misdemeanor<\/span>. <a id=\"paragraph-231374\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-924\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> When a <span class=\"dictionary\">vehicle<\/span> is stopped pursuant to subsection A, the <span class=\"dictionary\">driver<\/span> of any other <span class=\"dictionary\">vehicle<\/span> approaching from an adjacent <span class=\"dictionary\">lane<\/span> or from behind the stopped <span class=\"dictionary\">vehicle<\/span> shall not overtake and pass such stopped <span class=\"dictionary\">vehicle<\/span>. <a id=\"paragraph-231375\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-924\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Notwithstanding the provisions of subsection A, at <span class=\"dictionary\">intersections<\/span> or <span class=\"dictionary\">crosswalks<\/span> where the movement of traffic is being regulated by <span class=\"dictionary\"><span class=\"dictionary\">law<\/span>-enforcement officers<\/span> or <span class=\"dictionary\">traffic control devices<\/span>, the <span class=\"dictionary\">driver<\/span> shall yield according to the direction of the <span class=\"dictionary\"><span class=\"dictionary\">law<\/span>-enforcement officer<\/span> or device.\n\t\t\tNo pedestrian shall enter or cross an <span class=\"dictionary\">intersection<\/span> in disregard of approaching traffic.\n\t\t\tThe <span class=\"dictionary\">drivers<\/span> of <span class=\"dictionary\">vehicles<\/span> entering, crossing, or turning at <span class=\"dictionary\">intersections<\/span> shall change their course, slow down, or stop if necessary to permit pedestrians to cross such <span class=\"dictionary\">intersections<\/span> safely and expeditiously.\n\t\t\tPedestrians crossing <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> at <span class=\"dictionary\">intersections<\/span> shall at all times have the right-of-way over <span class=\"dictionary\">vehicles<\/span> making turns into the <span class=\"dictionary\"><span class=\"dictionary\">highways<\/span><\/span> being crossed by the pedestrians. <a id=\"paragraph-231376\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-924\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">governing body<\/span> of Arlington County, Fairfax County, Loudoun County and any town therein, the City of Alexandria, the City of Fairfax, the City of Falls Church, and the Town of Ashland may by <span class=\"dictionary\">ordinance<\/span> provide for the installation and maintenance of <span class=\"dictionary\">highway<\/span> signs at marked <span class=\"dictionary\">crosswalks<\/span> specifically requiring <span class=\"dictionary\">operators<\/span> of <span class=\"dictionary\">motor vehicles<\/span>, at the locations where such signs are installed, to yield the right-of-way to or stop for pedestrians crossing or attempting to cross the <span class=\"dictionary\">highway<\/span>. Any <span class=\"dictionary\">operator<\/span> of a <span class=\"dictionary\">motor vehicle<\/span> who fails to comply with the signs installed pursuant to this subsection is guilty of a <span class=\"dictionary\">traffic infraction<\/span> punishable by a fine of no less than $100 or more than $500. The <span class=\"dictionary\">Department<\/span> of Transportation shall develop criteria for the design, location, and installation of such signs. The provisions of this section shall not apply to any limited access <span class=\"dictionary\">highway<\/span>. <a id=\"paragraph-231377\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-924\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> Where a <span class=\"dictionary\">shared-use path<\/span> crosses a <span class=\"dictionary\">highway<\/span> at a clearly marked <span class=\"dictionary\">crosswalk<\/span> and there are no traffic control signals at such crossing, the local <span class=\"dictionary\">governing body<\/span> may by <span class=\"dictionary\">ordinance<\/span> require pedestrians, cyclists, and any other users of such shared-used path to come to a complete stop prior to entering such <span class=\"dictionary\">crosswalk<\/span>. Such local <span class=\"dictionary\">ordinance<\/span> may provide for a fine not to exceed $100 for violations. Any locality adopting such an <span class=\"dictionary\">ordinance<\/span> shall install and maintain stop signs, consistent with standards adopted by the Commonwealth Transportation Board and to the extent necessary in coordination with the <span class=\"dictionary\">Department<\/span> of Transportation. At such <span class=\"dictionary\">crosswalks<\/span>, no user of such <span class=\"dictionary\">shared-use path<\/span> shall enter the <span class=\"dictionary\">crosswalk<\/span> in disregard of approaching traffic. <a id=\"paragraph-231378\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-924\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> A locality adopting an <span class=\"dictionary\">ordinance<\/span> under subsection E shall coordinate the enforcement and placement of any stop signs affecting a <span class=\"dictionary\">shared-use path<\/span> owned and operated by a park authority formed under Chapter 57 (&#xA7; <a class=\"law\" title=\"Short title; application\" href=\"\/15.2-5700\/\">15.2-5700<\/a> et seq.) of Title 15.2 with such authority. <a id=\"paragraph-231379\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/46.2-924\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDRIVERS TO STOP FOR PEDESTRIANS; INSTALLATION OF CERTAIN SIGNS; PENALTIES (\u00a7\n46.2-924)\n\nA. The driver of any vehicle on a highway shall stop when any pedestrian\ncrossing such highway is within the driver&#8217;s lane or within an adjacent\nlane and approaching the driver&#8217;s lane until such pedestrian has passed\nthe lane in which the vehicle is stopped:\n\n   1. At any clearly marked crosswalk, whether at midblock or at the end of any\n   block;\n\n   2. At any regular pedestrian crossing included in the prolongation of the\n   lateral boundary lines of the adjacent sidewalk at the end of a block; or\n\n   3. At any intersection when the driver is approaching on a highway where the\n   speed limit is not more than 35 miles per hour.\n   \t\t\t\tA violation of this section is a traffic infraction, except that a\n   violation of this section that results in serious bodily injury, as defined in\n   &#xA7; 18.2-51.4, to or the death of a vulnerable road user, as defined in\n   &#xA7; 46.2-816.1, who is lawfully crossing a highway is a Class 1\n   misdemeanor.\n\nB. When a vehicle is stopped pursuant to subsection A, the driver of any other\nvehicle approaching from an adjacent lane or from behind the stopped vehicle\nshall not overtake and pass such stopped vehicle.\n\nC. Notwithstanding the provisions of subsection A, at intersections or\ncrosswalks where the movement of traffic is being regulated by law-enforcement\nofficers or traffic control devices, the driver shall yield according to the\ndirection of the law-enforcement officer or device.\n\t\t\tNo pedestrian shall enter or cross an intersection in disregard of\napproaching traffic.\n\t\t\tThe drivers of vehicles entering, crossing, or turning at intersections shall\nchange their course, slow down, or stop if necessary to permit pedestrians to\ncross such intersections safely and expeditiously.\n\t\t\tPedestrians crossing highways at intersections shall at all times have the\nright-of-way over vehicles making turns into the highways being crossed by the\npedestrians.\n\nD. The governing body of Arlington County, Fairfax County, Loudoun County and\nany town therein, the City of Alexandria, the City of Fairfax, the City of Falls\nChurch, and the Town of Ashland may by ordinance provide for the installation\nand maintenance of highway signs at marked crosswalks specifically requiring\noperators of motor vehicles, at the locations where such signs are installed, to\nyield the right-of-way to or stop for pedestrians crossing or attempting to\ncross the highway. Any operator of a motor vehicle who fails to comply with the\nsigns installed pursuant to this subsection is guilty of a traffic infraction\npunishable by a fine of no less than $100 or more than $500.
