{"formats":[{"name":"JSON","format":"json","url":"\/downloads\/2025\/code-json\/5.1-157.json"},{"name":"Plain Text","format":"text","url":"\/downloads\/2025\/code-text\/5.1-157.txt"},{"name":"XML","format":"xml","url":"\/downloads\/2025\/code-xml\/5.1-157.xml"},{"name":"HTML","format":"html","url":"\/downloads\/2025\/code-html\/5.1-157.html"}],"law_id":59093,"edition_id":1,"section_id":59093,"structure_id":13864,"section_number":"5.1-157","catch_line":"Authority rules and regulations; penalty","history":"2001, c. 342.","full_text":"A\n\nThe Authority shall have the power to adopt, amend, and repeal rules and regulations pertaining to use, maintenance and operation of its facilities and governing the conduct of persons and organizations using its facilities.B\n\nUnless the Authority shall by unanimous vote of all members present determine that an emergency exists, the Authority shall, prior to the adoption of any rule or regulation or alteration, amendment or modification thereof:1\n\nMake such rule, regulation, alteration, amendment, or modification in convenient form available for public inspection in the office of the Authority for at least ten days;2\n\nPublish a notice in a newspaper or newspapers of general circulation in the District of Columbia and in the local political subdivisions of the Commonwealth where the Authority Facilities are located declaring the Authority&#8217;s intention to consider adopting such rule, regulation, alteration, amendment, or modification and informing the public that the Authority will hold a public hearing at which any person may appear and be heard for or against the adoption of such rule or regulation or such alteration, amendment, or modification, on a day and at a time to be specified in the notice, after the expiration of at least ten days from the day of the publication thereof; and3\n\nHold the public hearing on the day and at the time specified in such notice or any adjournment thereof, and hear persons appearing for or against such rule, regulation, alteration, amendment or modification.C\n\nThe Authority&#8217;s rules and regulations shall be available for public inspection in the Authority&#8217;s principal office.D\n\nThe Authority&#8217;s rules and regulations relating to:i\n\nAir operations and motor vehicle traffic, including but not limited to, motor vehicle speed limits and the location of and payment for public parking;ii\n\nAccess to and use of Authority Facilities, including but not limited to, solicitation, handbilling, picketing and the conduct of commercial activities; andiii\n\nAircraft operation and maintenance; shall have the force and effect of law, as shall any other rule or regulation of the Authority which shall contain a determination by the Authority that it is necessary to accord the same force and effect of law in the public interest; provided, however, that with respect to motor vehicle traffic rules and regulations, the Authority shall obtain the approval of the traffic engineer or comparable official of the local political subdivision in which such rules or regulations are to be enforced.E\n\nThe violation of any rule or regulation of the Authority establishing a noise limitation on aircraft that operate at the Authority Facilities shall subject the violator, in the discretion of the circuit court of any political subdivision where the facility is located, to a civil penalty not to exceed $5,000 for each violation. Such penalty shall be paid to the Authority. With the consent of the violator or the accused violator of a rule establishing aircraft noise limits, the Authority may provide, in an order issued against the violator or accused violator, for the payment of civil charges in specific sums not to exceed the limit that could be imposed by the court. Such civil charge when paid shall be in lieu of any civil penalty which could be imposed by the court. Any court proceeding shall be within the exclusive jurisdiction of the circuit court and shall be a civil proceeding at law brought by the Authority.F\n\nThe violation of any Authority rule or regulation, having the force and effect of law, shall be a Class 1 misdemeanor unless otherwise specified by this chapter or unless a lesser penalty is set by the Authority in the rule or regulation. violations occurring at Ronald Reagan Washington National Airport shall be within the jurisdiction of the courts for Arlington County;2\n\nThe attorney for the Commonwealth shall have authority to prosecute those offenses in the name of the Commonwealth or local government as appropriate; shall have the force and effect of <span class=\"dictionary\">law<\/span>, as shall any other rule or regulation of the Authority which shall contain a determination by the Authority that it is necessary to accord the same force and effect of <span class=\"dictionary\">law<\/span> in the public interest; provided, however, that with respect to motor vehicle traffic rules and regulations, the Authority shall obtain the approval of the traffic engineer or comparable official of the local political subdivision in which such rules or regulations are to be enforced. <a id=\"paragraph-216721\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#Diiii\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The violation of any rule or regulation of the Authority establishing a noise limitation on <span class=\"dictionary\">aircraft<\/span> that operate at the Authority Facilities shall subject the violator, in the discretion of the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> of any political subdivision where the facility is located, to a civil <span class=\"dictionary\">penalty<\/span> not to exceed $5,000 for each violation. Such <span class=\"dictionary\">penalty<\/span> shall be paid to the Authority. With the consent of the violator or the <span class=\"dictionary\">accused<\/span> violator of a rule establishing <span class=\"dictionary\">aircraft<\/span> noise limits, the Authority may provide, in an <span class=\"dictionary\">order<\/span> issued against the violator or <span class=\"dictionary\">accused<\/span> violator, for the payment of civil charges in specific sums not to exceed the limit that could be imposed by the <span class=\"dictionary\">court<\/span>. Such civil charge when paid shall be in lieu of any civil <span class=\"dictionary\">penalty<\/span> which could be imposed by the <span class=\"dictionary\">court<\/span>. Any <span class=\"dictionary\">court<\/span> proceeding shall be within the exclusive <span class=\"dictionary\">jurisdiction<\/span> of the <span class=\"dictionary\">circuit<\/span> <span class=\"dictionary\">court<\/span> and shall be a civil proceeding at <span class=\"dictionary\">law<\/span> brought by the Authority. <a id=\"paragraph-216722\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The violation of any Authority rule or regulation, having the force and effect of <span class=\"dictionary\">law<\/span>, shall be a Class 1 <span class=\"dictionary\">misdemeanor<\/span> unless otherwise specified by this chapter or unless a lesser <span class=\"dictionary\">penalty<\/span> is set by the Authority in the rule or regulation. The rules of criminal procedure and <span class=\"dictionary\">evidence<\/span> that apply throughout the Commonwealth shall apply to the adjudication of any case involving the violation of any Authority rule or regulation having the force and effect of <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-216723\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> The <span class=\"dictionary\">courts<\/span> of this Commonwealth shall take judicial notice of the Authority&#8217;s regularly adopted rules and regulations. For the convenience of the <span class=\"dictionary\">courts<\/span> which may regularly hear cases arising under the Authority&#8217;s rules and regulations, the Authority may certify to the clerk of such <span class=\"dictionary\">court<\/span> a copy of its rules and regulations. Any such certification, when signed by the chairman of the Metropolitan Washington <span class=\"dictionary\">Airports<\/span> Authority, shall be accepted as <span class=\"dictionary\">evidence<\/span> of the <span class=\"dictionary\">facts<\/span> therein stated. <a id=\"paragraph-216724\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> With respect to the violation of any <span class=\"dictionary\">statute<\/span> of the Commonwealth, local <span class=\"dictionary\">ordinance<\/span> or Authority rule or regulation having the force and effect of <span class=\"dictionary\">law<\/span> occurring at the Authority Facilities: <a id=\"paragraph-216725\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The matter shall be within the <span class=\"dictionary\">jurisdiction<\/span> of the state <span class=\"dictionary\">courts<\/span> of the political subdivision where the violation occurred; violations occurring at Ronald Reagan Washington National <span class=\"dictionary\">Airport<\/span> shall be within the <span class=\"dictionary\">jurisdiction<\/span> of the <span class=\"dictionary\">courts<\/span> for Arlington County; <a id=\"paragraph-216726\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#H1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The attorney for the Commonwealth shall have authority to <span class=\"dictionary\">prosecute<\/span> those <span class=\"dictionary\">offenses<\/span> in the name of the Commonwealth or local government as appropriate; and the county or city attorney, if otherwise authorized to <span class=\"dictionary\">prosecute<\/span> <span class=\"dictionary\">offenses<\/span> in the name of the county or city, shall have authority to <span class=\"dictionary\">prosecute<\/span> those <span class=\"dictionary\">offenses<\/span> in the name of the county or city; and <a id=\"paragraph-216727\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#H2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Sheriffs and clerks of the <span class=\"dictionary\">court<\/span> shall provide those same services and exercise those same powers with respect to the Authority Facilities within their <span class=\"dictionary\">jurisdiction<\/span> as for their political subdivisions. <a id=\"paragraph-216728\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/5.1-157\/#H3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nAUTHORITY RULES AND REGULATIONS; PENALTY (\u00a7 5.1-157)\n\nA. The Authority shall have the power to adopt, amend, and repeal rules and\nregulations pertaining to use, maintenance and operation of its facilities and\ngoverning the conduct of persons and organizations using its facilities.\n\nB. Unless the Authority shall by unanimous vote of all members present determine\nthat an emergency exists, the Authority shall, prior to the adoption of any rule\nor regulation or alteration, amendment or modification thereof:\n\n   1. Make such rule, regulation, alteration, amendment, or modification in\n   convenient form available for public inspection in the office of the Authority\n   for at least ten days;\n\n   2. Publish a notice in a newspaper or newspapers of general circulation in the\n   District of Columbia and in the local political subdivisions of the\n   Commonwealth where the Authority Facilities are located declaring the\n   Authority&#8217;s intention to consider adopting such rule, regulation,\n   alteration, amendment, or modification and informing the public that the\n   Authority will hold a public hearing at which any person may appear and be\n   heard for or against the adoption of such rule or regulation or such\n   alteration, amendment, or modification, on a day and at a time to be specified\n   in the notice, after the expiration of at least ten days from the day of the\n   publication thereof; and\n\n   3. Hold the public hearing on the day and at the time specified in such notice\n   or any adjournment thereof, and hear persons appearing for or against such\n   rule, regulation, alteration, amendment or modification.\n\nC. The Authority&#8217;s rules and regulations shall be available for public\ninspection in the Authority&#8217;s principal office.\n\nD. The Authority&#8217;s rules and regulations relating to:\n\n   i. Air operations and motor vehicle traffic, including but not limited to,\n   motor vehicle speed limits and the location of and payment for public parking;\n\n      ii. Access to and use of Authority Facilities, including but not limited to,\n      solicitation, handbilling, picketing and the conduct of commercial\n      activities; and\n\n      iii. Aircraft operation and maintenance; shall have the force and effect of\n      law, as shall any other rule or regulation of the Authority which shall\n      contain a determination by the Authority that it is necessary to accord the\n      same force and effect of law in the public interest; provided, however, that\n      with respect to motor vehicle traffic rules and regulations, the Authority\n      shall obtain the approval of the traffic engineer or comparable official of\n      the local political subdivision in which such rules or regulations are to be\n      enforced.\n\nE. The violation of any rule or regulation of the Authority establishing a noise\nlimitation on aircraft that operate at the Authority Facilities shall subject\nthe violator, in the discretion of the circuit court of any political\nsubdivision where the facility is located, to a civil penalty not to exceed\n$5,000 for each violation. Such penalty shall be paid to the Authority. With the\nconsent of the violator or the accused violator of a rule establishing aircraft\nnoise limits, the Authority may provide, in an order issued against the violator\nor accused violator, for the payment of civil charges in specific sums not to\nexceed the limit that could be imposed by the court. Such civil charge when paid\nshall be in lieu of any civil penalty which could be imposed by the court. Any\ncourt proceeding shall be within the exclusive jurisdiction of the circuit court\nand shall be a civil proceeding at law brought by the Authority.\n\nF.
