The Board shall also cause actuarial gain\/loss analyses to be made in conjunction with each actuarial valuation of the System. Pursuant to such investigations and analyses, the Board shall periodically revise the actuarial assumptions used in the computation of employer contribution rates.5\n\nCausing a biennial actuarial valuation to be made of the assets and liabilities of the Retirement System with respect to each employer. Pursuant to the results of such valuations, the Board shall prepare a statement as to the employer contribution rates applicable to each employer.6\n\nPublishing the results of each actuarial valuation of the assets and liabilities.7\n\nPublishing annual financial statements of the Retirement System or annual reports in accordance with &#xA7;&#xA7; 51.1-1000 through 51.1-1003.8\n\nPromulgating regulations and procedures and making determinations necessary to carry out the provisions of this title.9\n\nPurchasing insurance to insure against losses suffered by the Retirement System if any member of the Board or of any advisory committee breaches the standard of care in &#xA7; 51.1-124.30.10\n\nAdopting rules and policies that bring the Retirement System into compliance with any applicable law or regulation of this Commonwealth or the United States.11\n\nEstablishing and administering, for the officers and employees of the Retirement System, (i) a compensation plan which is consistent with the provisions set forth in the general appropriations act for this purpose and (ii) a grievance procedure which is consistent with the provisions of &#xA7; 2.2-1202.1 and any regulations promulgated pursuant thereto.12\n\nInvesting in real estate to be held as a nonrevenue producing asset and used by the Retirement System for administrative offices.13\n\nCharging and collecting administrative fees to pay actual costs incurred by the Retirement System in administering and overseeing any retirement plan or service award fund other than the Virginia Retirement System (&#xA7; 51.1-124.1 et seq.), the State Police Officers&#8217; Retirement System (&#xA7; 51.1-200 et seq.), the Virginia Law Officers&#8217; Retirement System (&#xA7; 51.1-211 et seq.), or the Judicial Retirement System (&#xA7; 51.1-300 et seq.), for which it is responsible from the Commonwealth or participating political subdivisions whose employees benefit under such retirement plans. Any fee charged under the authority granted herein shall be for costs incurred directly related to the administration and oversight of the retirement plan or service award fund, as determined by the Board. Such fee shall be charged to the employer whose employees benefit under the retirement plan and to the service award fund in the case of costs incurred in administering and overseeing service award funds. powers and duties","Type":"Text","Format":"text\/html","Identifier":"\u00a7 51.1-124.22","Relation":"Code of Virginia"},"html":"\n\t\t\t\t\t\t<section id=\"A\"><p><span class=\"prefix-number\">A.<\/span> The <span class=\"dictionary\">Retirement System<\/span> shall be administered by the <span class=\"dictionary\">Board<\/span> of Trustees, whose powers and duties include but are not limited to: <a id=\"paragraph-281925\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Appointing a director, who shall not be a <span class=\"dictionary\">member<\/span> of the <span class=\"dictionary\">Board<\/span>, to serve as the chief administrative officer of the <span class=\"dictionary\">Retirement System<\/span> at the pleasure of the <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-281926\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Maintaining records of all of its proceedings and making such records available for inspection by the public. <a id=\"paragraph-281927\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Employing an actuary as its technical advisor and employing other persons and incurring expenditures as it deems necessary for the efficient administration of the <span class=\"dictionary\">Retirement System<\/span>. <a id=\"paragraph-281928\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Causing an actuarial investigation to be made of all the experience under the <span class=\"dictionary\">Retirement System<\/span> at least once in each four-year period. The <span class=\"dictionary\">Board<\/span> shall also cause actuarial gain\/loss analyses to be made in conjunction with each actuarial valuation of the System. Pursuant to such investigations and analyses, the <span class=\"dictionary\">Board<\/span> shall periodically revise the actuarial assumptions used in the computation of <span class=\"dictionary\">employer<\/span> contribution rates. <a id=\"paragraph-281929\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Causing a biennial actuarial valuation to be made of the <span class=\"dictionary\">assets<\/span> and liabilities of the <span class=\"dictionary\">Retirement System<\/span> with respect to each <span class=\"dictionary\">employer<\/span>. Pursuant to the results of such valuations, the <span class=\"dictionary\">Board<\/span> shall prepare a statement as to the <span class=\"dictionary\">employer<\/span> contribution rates applicable to each <span class=\"dictionary\">employer<\/span>. <a id=\"paragraph-281930\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Publishing the results of each actuarial valuation of the <span class=\"dictionary\">assets<\/span> and liabilities. <a id=\"paragraph-281931\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Publishing annual financial statements of the <span class=\"dictionary\">Retirement System<\/span> or annual reports in accordance with &#xA7;&#xA7; <a class=\"law\" title=\"All state and local plans included\" href=\"\/51.1-1000\/\">51.1-1000<\/a> through <a class=\"law\" title=\"Financial reports by retirement systems; auditor to promulgate standards\" href=\"\/51.1-1003\/\">51.1-1003<\/a>. <a id=\"paragraph-281932\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Promulgating regulations and procedures and making determinations necessary to carry out the provisions of this title. <a id=\"paragraph-281933\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Purchasing insurance to insure against losses suffered by the <span class=\"dictionary\">Retirement System<\/span> if any <span class=\"dictionary\">member<\/span> of the <span class=\"dictionary\">Board<\/span> or of any advisory committee breaches the standard of care in &#xA7; <a class=\"law\" title=\"Board as trustee of funds; investments; standard of care; liability for losses\" href=\"\/51.1-124.30\/\">51.1-124.30<\/a>. <a id=\"paragraph-281934\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A10\" class=\"indent-1\"><p><span class=\"prefix-number\">10.<\/span> Adopting rules and policies that bring the <span class=\"dictionary\">Retirement System<\/span> into compliance with any applicable <span class=\"dictionary\">law<\/span> or regulation of this Commonwealth or the United States. <a id=\"paragraph-281935\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A11\" class=\"indent-1\"><p><span class=\"prefix-number\">11.<\/span> Establishing and administering, for the officers and <span class=\"dictionary\">employees<\/span> of the <span class=\"dictionary\">Retirement System<\/span>, (i) a compensation plan which is consistent with the provisions set forth in the general appropriations act for this purpose and (ii) a grievance procedure which is consistent with the provisions of &#xA7; <a class=\"law\" title=\"Additional powers and duties of Director; employment dispute resolution\" href=\"\/2.2-1202.1\/\">2.2-1202.1<\/a> and any regulations promulgated pursuant thereto. <a id=\"paragraph-281936\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A12\" class=\"indent-1\"><p><span class=\"prefix-number\">12.<\/span> Investing in real estate to be held as a nonrevenue producing asset and used by the <span class=\"dictionary\">Retirement System<\/span> for administrative offices. <a id=\"paragraph-281937\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A13\" class=\"indent-1\"><p><span class=\"prefix-number\">13.<\/span> Charging and collecting administrative fees to pay actual costs incurred by the <span class=\"dictionary\">Retirement System<\/span> in administering and overseeing any retirement plan or <span class=\"dictionary\">service<\/span> award fund other than the Virginia <span class=\"dictionary\">Retirement System<\/span> (&#xA7; <a class=\"law\" title=\"Virginia Retirement System established\" href=\"\/51.1-124.1\/\">51.1-124.1<\/a> et seq.), the State Police Officers&#8217; <span class=\"dictionary\">Retirement System<\/span> (&#xA7; <a class=\"law\" title=\"State Police Officers&#039; Retirement System continued; administration; application of provisions of Virginia Retirement System\" href=\"\/51.1-200\/\">51.1-200<\/a> et seq.), the Virginia <span class=\"dictionary\">Law<\/span> Officers&#8217; <span class=\"dictionary\">Retirement System<\/span> (&#xA7; <a class=\"law\" title=\"Virginia Law Officers&#039; Retirement System; application of provisions of Virginia Retirement System\" href=\"\/51.1-211\/\">51.1-211<\/a> et seq.), or the Judicial <span class=\"dictionary\">Retirement System<\/span> (&#xA7; <a class=\"law\" title=\"Judicial Retirement System continued; administration; application of provisions of Virginia Retirement System\" href=\"\/51.1-300\/\">51.1-300<\/a> et seq.), for which it is responsible from the Commonwealth or participating <span class=\"dictionary\">political subdivisions<\/span> whose <span class=\"dictionary\">employees<\/span> benefit under such retirement plans. Any fee charged under the authority granted herein shall be for costs incurred directly related to the administration and oversight of the retirement plan or <span class=\"dictionary\">service<\/span> award fund, as determined by the <span class=\"dictionary\">Board<\/span>. Such fee shall be charged to the <span class=\"dictionary\">employer<\/span> whose <span class=\"dictionary\">employees<\/span> benefit under the retirement plan and to the <span class=\"dictionary\">service<\/span> award fund in the case of costs incurred in administering and overseeing <span class=\"dictionary\">service<\/span> award funds. Overpayments from benefits received under the Virginia <span class=\"dictionary\">Retirement System<\/span>, the State Police Officers&#8217; <span class=\"dictionary\">Retirement System<\/span>, the Virginia <span class=\"dictionary\">Law<\/span> Officers&#8217; <span class=\"dictionary\">Retirement System<\/span>, the Judicial <span class=\"dictionary\">Retirement System<\/span>, the Virginia Sickness and Disability Program under Chapter 11 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/51.1-1100\/\">51.1-1100<\/a> et seq.), the Disability Program for Hybrid Retirement Program Participants under Chapter 11.1 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/51.1-1150\/\">51.1-1150<\/a> et seq.), or Health Insurance Credits for Certain Retirees under Chapter 14 (&#xA7; <a class=\"law\" title=\"Health insurance credits for retired state employees\" href=\"\/51.1-1400\/\">51.1-1400<\/a> et seq.) may be deducted from life insurance benefits payable under Chapter 5 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/51.1-500\/\">51.1-500<\/a> et seq.). <a id=\"paragraph-281938\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A14\" class=\"indent-1\"><p><span class=\"prefix-number\">14.<\/span> The <span class=\"dictionary\">Board<\/span> is authorized to charge and collect from participating <span class=\"dictionary\">employers<\/span> any penalties, interest, compliance fees, or other charges charged to the <span class=\"dictionary\">Retirement System<\/span> by the Internal Revenue <span class=\"dictionary\">Service<\/span> or other regulatory body. <a id=\"paragraph-281939\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#A14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> The <span class=\"dictionary\">Board<\/span> shall be vested with the powers and duties of the <span class=\"dictionary\">Board<\/span> of Trustees of the <span class=\"dictionary\">abolished system<\/span> to the extent necessary for the payment of vested rights and the return of <span class=\"dictionary\">accumulated contributions<\/span>. <a id=\"paragraph-281940\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The Commonwealth, the <span class=\"dictionary\">Board<\/span>, <span class=\"dictionary\">employees<\/span> of the <span class=\"dictionary\">Retirement System<\/span>, the Investment Advisory Committee of the <span class=\"dictionary\">Retirement System<\/span>, and any other advisory committee established by the <span class=\"dictionary\">Board<\/span> shall not incur any liability for any losses suffered by the deferred compensation, the cash match, or the defined contribution retirement plans established or administered under the authority of this title, except as provided in &#xA7; <a class=\"law\" title=\"Board as trustee of funds; investments; standard of care; liability for losses\" href=\"\/51.1-124.30\/\">51.1-124.30<\/a>. <a id=\"paragraph-281941\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/51.1-124.22\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nBOARD TO ADMINISTER RETIREMENT SYSTEM; POWERS AND DUTIES (\u00a7 51.1-124.22)\n\nA. Purchasing insurance to insure against losses suffered by the Retirement\n   System if any member of the Board or of any advisory committee breaches the\n   standard of care in &#xA7; 51.1-124.30.\n\n   10. Adopting rules and policies that bring the Retirement System into\n   compliance with any applicable law or regulation of this Commonwealth or the\n   United States.\n\n   11.
