In addition, the <span class=\"dictionary\">Board<\/span> shall (i) require a <span class=\"dictionary\">contractor<\/span> to appropriately classify all workers as employees or independent <span class=\"dictionary\">contractors<\/span>, as provided by <span class=\"dictionary\">law<\/span> and (ii) provide that any <span class=\"dictionary\">contractor<\/span> who is found to have intentionally misclassified any worker is subject to <span class=\"dictionary\">sanction<\/span> by the <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-240509\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The <span class=\"dictionary\">Board<\/span> may adopt regulations requiring all Class A, B, and C residential <span class=\"dictionary\">contractors<\/span>, excluding subcontractors to the contracting parties and those who engage in routine maintenance or service <span class=\"dictionary\">contracts<\/span>, to use legible written <span class=\"dictionary\">contracts<\/span> including the following terms and conditions: <a id=\"paragraph-240510\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> General description of the work to be performed; <a id=\"paragraph-240511\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Fixed price or an estimate of the total cost of the work, the amounts and schedule of progress payments, a listing of specific <span class=\"dictionary\">materials<\/span> requested by the consumer and the amount of down payment; <a id=\"paragraph-240512\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Estimates of time of commencement and completion of the work; and <a id=\"paragraph-240513\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> <span class=\"dictionary\">Contractor<\/span>&#8217;s name, address, office telephone number and license or certification number and class.\n\t\t\t\tIn transactions involving door-to-door solicitations, the <span class=\"dictionary\">Board<\/span> may require that a statement of protections be provided by the <span class=\"dictionary\">contractor<\/span> to the homeowner, consumer or buyer, as the case may be. <a id=\"paragraph-240514\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The <span class=\"dictionary\">Board<\/span> shall adopt a seal with the words &#8220;<span class=\"dictionary\">Board<\/span> for <span class=\"dictionary\">Contractors<\/span>, Commonwealth of Virginia.&#8221; The <span class=\"dictionary\">Director<\/span> shall have charge, care and <span class=\"dictionary\">custody<\/span> of the seal. <a id=\"paragraph-240515\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The <span class=\"dictionary\">Director<\/span> shall maintain a record of the proceedings of the <span class=\"dictionary\">Board<\/span>. <a id=\"paragraph-240516\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-1102\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nBOARD FOR CONTRACTORS MEMBERSHIP; OFFICES; MEETINGS; SEAL; RECORD (\u00a7 54.1-1102)\n\nA. The Board for Contractors shall be composed of 16 members as follows: one\nmember shall be a licensed Class A general contractor; the larger part of the\nbusiness of one member shall be the construction of utilities; the larger part\nof the business of one member shall be the construction of commercial and\nindustrial buildings; the larger part of the business of one member shall be the\nconstruction of single-family residences; the larger part of the business of one\nmember shall be the construction of home improvements; one member shall be a\nsubcontractor as generally regarded in the construction industry; one member\nshall be in the business of sales of construction materials and supplies; one\nmember shall be a local building official; one member shall be a licensed\nplumbing contractor; one member shall be a licensed electrical contractor; one\nmember shall be a licensed heating, ventilation and air conditioning contractor;\none member shall be a certified elevator mechanic or a licensed elevator\ncontractor; one member shall be a certified water well systems provider; one\nmember shall be a professional engineer licensed in accordance with Chapter 4\n(&#xA7; 54.1-400 et seq.); and two members shall be nonlegislative citizen\nmembers. The terms of the Board members shall be four years.\n\t\t\tThe Board shall meet at least once each year and at such other times as may\nbe deemed necessary. Annually, the Board shall elect from its membership a\nchairman and a vice-chairman to serve for a one-year term. Nine members of the\nBoard shall constitute a quorum.\n\nB. The Board shall promulgate regulations not inconsistent with statute\nnecessary for the licensure of contractors and tradesmen and the certification\nof backflow prevention device workers, and for the relicensure of contractors\nand tradesmen and for the recertification of backflow prevention device workers,\nafter license or certificate suspension or revocation. The Board shall include\nin its regulations a requirement that as a condition for initial licensure as a\ncontractor, the designated employee or a member of the responsible management\npersonnel of the contractor shall have successfully completed a Board-approved\nbasic business course, which shall not exceed eight hours of classroom\ninstruction.
