Board regulations relating to initial licensure shall include the following requirements:1\n\nEvery applicant for an initial license as a real estate salesperson shall have:\n\t\t\t\ta. At a minimum, a high school diploma or its equivalent; and\n\t\t\t\tb. Completed a course in the principles of real estate that carried an academic credit of at least four semester hours, but not less than 60 hours of classroom, correspondence, or other distance learning instruction, offered by an accredited institution of higher education, high school offering adult distributive education courses, or other school or educational institution offering an equivalent course.2\n\nEvery applicant for an initial license as a real estate broker shall have:\n\t\t\t\ta. At a minimum, a high school diploma or its equivalent; and\n\t\t\t\tb. Completed not less than 12 semester hours of classroom or correspondence or other distance learning instruction in real estate courses offered by an accredited institution of higher education or other school or educational institution offering equivalent courses.3\n\nEvery applicant for a license by reciprocity as a real estate salesperson or real estate broker shall have:\n\t\t\t\ta. Completed a course in the principles of real estate that is comparable in content and duration and scope to that required in subdivision 1 or 12 semester hours of classroom or correspondence or other distance learning instruction in real estate courses that are comparable in content and duration and scope to that required in subdivision 2; and\n\t\t\t\tb. If currently licensed by another state as a real estate salesperson or broker, passed Virginia&#8217;s examination.C\n\nThe Board may waive any requirement under the regulations relating to education or experience when the broker or salesperson is found to have education or experience equivalent to that required. No regulation imposing educational requirements for initial licensure beyond those specified by law shall apply to any person who was licensed prior to July 1, 1975, and who has been continuously licensed since that time, except that licensure as a salesperson prior to such time shall not exempt a salesperson who seeks to be licensed as a broker from the educational requirements established for brokers.D\n\nThe Board shall establish criteria to ensure that prelicensure and broker licensure courses meet the standards of quality deemed by the Board to be necessary to protect the public interests. For correspondence and other distance learning instruction offered by an approved provider, such criteria may include appropriate testing procedures. Completed not less than 12 semester hours of classroom or correspondence or other <span class=\"dictionary\">distance learning<\/span> instruction in real estate courses offered by an accredited institution of higher education or other school or educational institution offering equivalent courses. <a id=\"paragraph-209864\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2105\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Every applicant for a license by reciprocity as a <span class=\"dictionary\">real estate salesperson<\/span> or <span class=\"dictionary\">real estate broker<\/span> shall have:\n\t\t\t\ta. Completed a course in the principles of real estate that is comparable in content and duration and scope to that required in subdivision 1 or 12 semester hours of classroom or correspondence or other <span class=\"dictionary\">distance learning<\/span> instruction in real estate courses that are comparable in content and duration and scope to that required in subdivision 2; and\n\t\t\t\tb. If currently licensed by another state as a <span class=\"dictionary\">real estate salesperson<\/span> or broker, passed Virginia&#8217;s examination. <a id=\"paragraph-209865\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2105\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The Board may <span class=\"dictionary\">waive<\/span> any requirement under the regulations relating to education or experience when the broker or salesperson is found to have education or experience equivalent to that required. No regulation imposing educational requirements for initial licensure beyond those specified by <span class=\"dictionary\">law<\/span> shall apply to any person who was licensed prior to July 1, 1975, and who has been continuously licensed since that time, except that licensure as a salesperson prior to such time shall not exempt a salesperson who seeks to be licensed as a broker from the educational requirements established for brokers. <a id=\"paragraph-209866\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2105\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> The Board shall establish criteria to ensure that prelicensure and broker licensure courses meet the standards of quality deemed by the Board to be necessary to protect the public interests. For correspondence and other <span class=\"dictionary\">distance learning<\/span> instruction offered by an approved provider, such criteria may include appropriate testing procedures. The Board may establish procedures to ensure the quality of the courses.\n\t\t\tNoncollegiate institutions shall not be authorized to grant collegiate semester hours for academic credit.\n\t\t\tThe specific content of the real estate courses shall be in real estate brokerage, real estate finance, real estate appraisal, real estate <span class=\"dictionary\">law<\/span>, and such related subjects as are approved by the Board. <a id=\"paragraph-209867\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2105\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> The Board may establish criteria delineating the permitted activities of unlicensed individuals employed by, or affiliated as an independent contractor with, real estate licensees or under the supervision of a <span class=\"dictionary\">real estate broker<\/span>. <a id=\"paragraph-209868\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2105\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> The Board may take a disciplinary case against a licensee under advisement, defer a <span class=\"dictionary\">finding<\/span> in such case, and dismiss such action upon terms and conditions set by the Board. <a id=\"paragraph-209869\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2105\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> Notwithstanding any other provision of <span class=\"dictionary\">law<\/span>, the Board shall not charge a fee to a licensee for the transfer of such licensee between offices within a licensed real estate firm, including from such firm&#8217;s primary <span class=\"dictionary\">place of business<\/span> to one of its <span class=\"dictionary\">branch offices<\/span>, or from a <span class=\"dictionary\">branch office<\/span> to another <span class=\"dictionary\">branch office<\/span> under the same primary <span class=\"dictionary\">place of business<\/span>. <a id=\"paragraph-209870\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2105\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nGENERAL POWERS OF REAL ESTATE BOARD; REGULATIONS; EDUCATIONAL AND EXPERIENCE\nREQUIREMENTS FOR LICENSURE (\u00a7 54.1-2105)\n\nA.
