The supervising broker shall exercise reasonable and adequate supervision of the provision of real estate brokerage services by associate brokers and salespersons assigned to the branch office or real estate team. The supervising broker may designate another broker to assist in administering the provisions required by this section, but such designation shall not relieve the supervising broker of responsibility for the supervision of the acts of all licensees assigned to the branch office or real estate team.B\n\nAs used in this section, &#8220;reasonable and adequate supervision&#8221; by the supervising broker shall include the following:1\n\nBeing available to all licensees under his supervision at reasonable times to review and approve all documents, including leases, contracts, brokerage agreements, and advertising as may affect the firm&#8217;s clients and business;2\n\nEnsuring the availability of training opportunities and that the office has written procedures and policies that provide clear guidance in the following areas:\n\t\t\t\ta. Handling of escrow deposits in compliance with law and regulation;\n\t\t\t\tb. Complying with federal and state fair housing laws and regulations if the firm engages in residential brokerage, residential leasing, or residential property management;\n\t\t\t\tc. Advertising and marketing of the brokerage firm and any affiliated real estate teams or business entities;\n\t\t\t\td. Negotiating and drafting of contracts, leases, and brokerage agreements;\n\t\t\t\te. Exercising appropriate oversight and limitations on the use of unlicensed assistants, whether as part of a team arrangement or otherwise;\n\t\t\t\tf. Creating agency or independent contractor relationships and elements thereof;\n\t\t\t\tg. Distributing information on new or amended laws or regulations; and\n\t\t\t\th. Disclosing required information relating to the physical condition of real property;3\n\nEnsuring that the brokerage services are carried out competently and in accordance with the provisions of this chapter;4\n\nUndertaking reasonable steps to ensure compliance by all licensees assigned to a branch office with the provisions of this chapter and applicable Board regulations, including ensuring that licensees possess a current license issued by the Board;5\n\nEnsuring that affiliated real estate teams or business entities are operating in accordance with the provisions of this chapter and applicable Board regulations;6\n\nEnsuring that brokerage agreements include the name and contact information of the supervising broker; and7\n\nMaintaining the records required by this subsection for three years. The records shall be furnished to the Board&#8217;s agent upon request. <a id=\"paragraph-244578\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2110.1\/#B7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> Any <span class=\"dictionary\">supervising broker<\/span> who resides more than 50 miles from a <span class=\"dictionary\">branch office<\/span> under his supervision, having licensees who regularly conduct business assigned to such <span class=\"dictionary\">branch office<\/span>, shall certify in writing quarterly on a form provided by the Board that the <span class=\"dictionary\">supervising broker<\/span> has complied with the requirements of this section. <a id=\"paragraph-244579\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2110.1\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> As a condition of the renewal of a <span class=\"dictionary\">branch office<\/span> license, the <span class=\"dictionary\">supervising broker<\/span> shall provide to the Board the name and license number of each real estate licensee affiliated with the <span class=\"dictionary\">branch office<\/span> at the time of the renewal in a format deemed acceptable by the Board. <a id=\"paragraph-244580\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2110.1\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nDUTIES OF SUPERVISING BROKER (\u00a7 54.1-2110.1)\n\nA. Each place of business, each branch office, and each real estate team shall\nbe supervised by a supervising broker. The supervising broker shall exercise\nreasonable and adequate supervision of the provision of real estate brokerage\nservices by associate brokers and salespersons assigned to the branch office or\nreal estate team. The supervising broker may designate another broker to assist\nin administering the provisions required by this section, but such designation\nshall not relieve the supervising broker of responsibility for the supervision\nof the acts of all licensees assigned to the branch office or real estate team.\n\nB. As used in this section, &#8220;reasonable and adequate supervision&#8221; by\nthe supervising broker shall include the following:\n\n   1. Being available to all licensees under his supervision at reasonable times\n   to review and approve all documents, including leases, contracts, brokerage\n   agreements, and advertising as may affect the firm&#8217;s clients and\n   business;\n\n   2. Ensuring the availability of training opportunities and that the office has\n   written procedures and policies that provide clear guidance in the following\n   areas:\n   \t\t\t\ta. Handling of escrow deposits in compliance with law and regulation;\n   \t\t\t\tb. Complying with federal and state fair housing laws and regulations if\n   the firm engages in residential brokerage, residential leasing, or residential\n   property management;\n   \t\t\t\tc. Advertising and marketing of the brokerage firm and any affiliated real\n   estate teams or business entities;\n   \t\t\t\td. Negotiating and drafting of contracts, leases, and brokerage\n   agreements;\n   \t\t\t\te. Exercising appropriate oversight and limitations on the use of\n   unlicensed assistants, whether as part of a team arrangement or otherwise;\n   \t\t\t\tf. Creating agency or independent contractor relationships and elements\n   thereof;\n   \t\t\t\tg. Distributing information on new or amended laws or regulations; and\n   \t\t\t\th. Disclosing required information relating to the physical condition of\n   real property;\n\n   3. Ensuring that the brokerage services are carried out competently and in\n   accordance with the provisions of this chapter;\n\n   4. Undertaking reasonable steps to ensure compliance by all licensees assigned\n   to a branch office with the provisions of this chapter and applicable Board\n   regulations, including ensuring that licensees possess a current license\n   issued by the Board;\n\n   5. Ensuring that affiliated real estate teams or business entities are\n   operating in accordance with the provisions of this chapter and applicable\n   Board regulations;\n\n   6. Ensuring that brokerage agreements include the name and contact information\n   of the supervising broker; and\n\n   7. Maintaining the records required by this subsection for three years. The\n   records shall be furnished to the Board&#8217;s agent upon request.\n\nC. Any supervising broker who resides more than 50 miles from a branch office\nunder his supervision, having licensees who regularly conduct business assigned\nto such branch office, shall certify in writing quarterly on a form provided by\nthe Board that the supervising broker has complied with the requirements of this\nsection.\n\nD.
