A licensee may act as a dual agent or dual representative in a commercial\nreal estate transaction only with the written consent of all clients to the\ntransaction. A dual agent has an agency relationship under the brokerage\nagreements with the clients. A dual representative has an independent contractor\nrelationship under the brokerage agreements with the clients. The obligation to make the disclosures required by this section shall not\nrelieve the licensee of the obligations set out in subsection C of &#xA7;\n54.1-2137 requiring all brokerage relationships to be set out in a written\nagreement between the licensee and the client.\n\nD. No cause of action shall arise against a dual representative for making\ndisclosures of brokerage relationships as provided by this article. A dual\nrepresentative does not terminate any brokerage relationship by the making of\nany such allowed or required disclosures of dual representation.\n\nE.
