In addition to the provisions of \u00a7\u00a7 54.1-201 and 54.1-202, the Board shall:1\n\nPromulgate regulations necessary to carry out the requirements of this article in accordance with the provisions of the Administrative Process Act (&#xA7; 2.2-4000 et seq.), including the prescription of fees, procedures, and qualifications for the issuance and renewal of common interest community manager licenses. Upon application for license and each renewal thereof, the applicant shall pay a fee established by the Board, which shall be placed to the credit of the Common Interest Community Management Information Fund established pursuant to &#xA7; 54.1-2354.2;2\n\nEstablish criteria for the licensure of common interest community managers to ensure the appropriate training and educational credentials for the provision of management services to common interest communities. Such criteria may include experiential requirements and shall include designation as an Accredited Association Management Company by the Community Associations Institute. As an additional alternative to such designation, the Board shall have authority, by regulation, to include one of the following: (i) successful completion of another Board-approved training program and certifying examination or (ii) successful completion of a Virginia testing program to determine the quality of the training and educational credentials for and competence of common interest community managers;3\n\nEstablish criteria for the certification of the employees of common interest community managers who have principal responsibility for management services provided to a common interest community or who have supervisory responsibility for employees who participate directly in the provision of management services to a common interest community to ensure the person possesses the character and minimum skills to engage properly in the provision of management services to a common interest community. Such criteria shall include designation as a Certified Manager of Community Associations by the Community Association Managers International Certification Board, designation as an Association Management Specialist by the Community Associations Institute, or designation as a Professional Community Association Manager by the Community Associations Institute. As an additional alternative to such designations, the Board shall have authority, by regulation, to include one of the following: (i) successful completion of another Board-approved training program as developed by the Virginia Association of Realtors or other organization, and certifying examination, or (ii) successful completion of a Virginia testing program to determine the quality of the training and educational credentials for and competence of the employees of common interest community managers who participate directly in the provision of management services to a common interest community. The fee paid to the Board for the issuance of such certificate shall be paid to the Common Interest Community Management Information Fund established pursuant to &#xA7; 54.1-2354.2;4\n\nApprove the criteria for accredited common interest community manager training programs;5\n\nApprove accredited common interest community manager training programs;6\n\nEstablish, by regulation, standards of conduct for common interest community managers and for employees of common interest community managers certified in accordance with the provisions of this article;7\n\nEstablish, by regulation, an education-based certification program for persons who are involved in the business or activity of providing management services for compensation to common interest communities. The Board shall have the authority to approve training courses and instructors in furtherance of the provisions of this article;8\n\nIssue a certificate of registration to each association that has properly filed in accordance with this chapter; and9\n\nDevelop and publish best practices for the content of declarations consistent with the requirements of the Property Owners&#8217; Association Act (&#xA7; 55.1-1800 et seq.).B\n\n1. The Board shall have the sole responsibility for the administration of this article and for the promulgation of regulations to carry out the requirements thereof.2\n\nThe Board shall also be responsible for the enforcement of this article, provided that the Real Estate Board shall have the sole responsibility for the enforcement of this article with respect to a real estate broker, real estate salesperson, or real estate brokerage firm licensed in accordance with Chapter 21 (&#xA7; 54.1-2100 et seq.) who is also licensed as a common interest community manager.3\n\nFor purposes of enforcement of this article or the Property Owners&#8217; Association Act (&#xA7; 55.1-1800 et seq.), the Virginia Condominium Act (&#xA7; 55.1-1900 et seq.), the Virginia Real Estate Cooperative Act (&#xA7; 55.1-2100 et seq.), the Virginia Real Estate Time-Share Act (&#xA7; 55.1-2200 et seq.), or the Resale Disclosure Act (&#xA7; 55.1-2307 et seq.), any requirement for the conduct of a hearing shall be satisfied by an informal fact-finding proceeding convened and conducted pursuant to &#xA7; 2.2-4019 of the Administrative Process Act (&#xA7; 2.2-4000 et seq.).C\n\nThe Board is authorized to obtain criminal history record information from any state or federal law-enforcement agency relating to an applicant for licensure or certification. In addition to the provisions of \u00a7\u00a7&nbsp;<a class=\"law\" title=\"Powers and duties of regulatory boards\" href=\"\/54.1-201\/\">54.1-201<\/a> and <a class=\"law\" title=\"Monetary penalty; delegation to Director of authority enter consent agreements\" href=\"\/54.1-202\/\">54.1-202<\/a>, the <span class=\"dictionary\">Board<\/span> shall: <a id=\"paragraph-270625\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Promulgate regulations necessary to carry out the requirements of this article in accordance with the provisions of the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.), including the prescription of fees, procedures, and qualifications for the issuance and renewal of <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> manager<\/span> licenses. Upon application for license and each renewal thereof, the applicant shall pay a fee established by the <span class=\"dictionary\">Board<\/span>, which shall be placed to the credit of the <span class=\"dictionary\">Common Interest Community<\/span> Management Information Fund established pursuant to &#xA7; <a class=\"law\" title=\"Common Interest Community Management Information Fund\" href=\"\/54.1-2354.2\/\">54.1-2354.2<\/a>; <a id=\"paragraph-270626\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Establish criteria for the licensure of <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> managers<\/span> to ensure the appropriate training and educational credentials for the provision of <span class=\"dictionary\">management services<\/span> to common interest communities. Such criteria may include experiential requirements and shall include designation as an Accredited <span class=\"dictionary\">Association<\/span> Management Company by the Community <span class=\"dictionary\">Associations<\/span> Institute. As an additional alternative to such designation, the <span class=\"dictionary\">Board<\/span> shall have authority, by regulation, to include one of the following: (i) successful completion of another <span class=\"dictionary\">Board<\/span>-approved training program and certifying examination or (ii) successful completion of a Virginia testing program to determine the quality of the training and educational credentials for and competence of <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> managers<\/span>; <a id=\"paragraph-270627\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Establish criteria for the certification of the employees of <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> managers<\/span> who have principal responsibility for <span class=\"dictionary\">management services<\/span> provided to a <span class=\"dictionary\">common interest community<\/span> or who have supervisory responsibility for employees who participate directly in the provision of <span class=\"dictionary\">management services<\/span> to a <span class=\"dictionary\">common interest community<\/span> to ensure the person possesses the character and minimum skills to engage properly in the provision of <span class=\"dictionary\">management services<\/span> to a <span class=\"dictionary\">common interest community<\/span>. Such criteria shall include designation as a Certified Manager of Community <span class=\"dictionary\">Associations<\/span> by the Community <span class=\"dictionary\">Association<\/span> Managers International Certification <span class=\"dictionary\">Board<\/span>, designation as an <span class=\"dictionary\">Association<\/span> Management Specialist by the Community <span class=\"dictionary\">Associations<\/span> Institute, or designation as a Professional Community <span class=\"dictionary\">Association<\/span> Manager by the Community <span class=\"dictionary\">Associations<\/span> Institute. As an additional alternative to such designations, the <span class=\"dictionary\">Board<\/span> shall have authority, by regulation, to include one of the following: (i) successful completion of another <span class=\"dictionary\">Board<\/span>-approved training program as developed by the Virginia <span class=\"dictionary\">Association<\/span> of Realtors or other organization, and certifying examination, or (ii) successful completion of a Virginia testing program to determine the quality of the training and educational credentials for and competence of the employees of <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> managers<\/span> who participate directly in the provision of <span class=\"dictionary\">management services<\/span> to a <span class=\"dictionary\">common interest community<\/span>. The fee paid to the <span class=\"dictionary\">Board<\/span> for the issuance of such certificate shall be paid to the <span class=\"dictionary\">Common Interest Community<\/span> Management Information Fund established pursuant to &#xA7; <a class=\"law\" title=\"Common Interest Community Management Information Fund\" href=\"\/54.1-2354.2\/\">54.1-2354.2<\/a>; <a id=\"paragraph-270628\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Approve the criteria for accredited <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> manager<\/span> training programs; <a id=\"paragraph-270629\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Approve accredited <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> manager<\/span> training programs; <a id=\"paragraph-270630\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Establish, by regulation, standards of conduct for <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> managers<\/span> and for employees of <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> managers<\/span> certified in accordance with the provisions of this article; <a id=\"paragraph-270631\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Establish, by regulation, an education-based certification program for persons who are involved in the business or activity of providing <span class=\"dictionary\">management services<\/span> for compensation to common interest communities. The <span class=\"dictionary\">Board<\/span> shall have the authority to approve training courses and instructors in furtherance of the provisions of this article; <a id=\"paragraph-270632\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> <span class=\"dictionary\">Issue<\/span> a certificate of registration to each <span class=\"dictionary\">association<\/span> that has properly filed in accordance with this chapter; and <a id=\"paragraph-270633\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A9\" class=\"indent-1\"><p><span class=\"prefix-number\">9.<\/span> Develop and publish best practices for the content of <span class=\"dictionary\">declarations<\/span> consistent with the requirements of the Property Owners&#8217; <span class=\"dictionary\">Association<\/span> Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-1800\/\">55.1-1800<\/a> et seq.). <a id=\"paragraph-270634\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#A9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> 1. The <span class=\"dictionary\">Board<\/span> shall have the sole responsibility for the administration of this article and for the promulgation of regulations to carry out the requirements thereof. <a id=\"paragraph-270635\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The <span class=\"dictionary\">Board<\/span> shall also be responsible for the enforcement of this article, provided that the Real Estate <span class=\"dictionary\">Board<\/span> shall have the sole responsibility for the enforcement of this article with respect to a real estate broker, real estate salesperson, or real estate brokerage firm licensed in accordance with Chapter 21 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/54.1-2100\/\">54.1-2100<\/a> et seq.) who is also licensed as a <span class=\"dictionary\"><span class=\"dictionary\">common interest community<\/span> manager<\/span>. <a id=\"paragraph-270636\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> For purposes of enforcement of this article or the Property Owners&#8217; <span class=\"dictionary\">Association<\/span> Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-1800\/\">55.1-1800<\/a> et seq.), the Virginia Condominium Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-1900\/\">55.1-1900<\/a> et seq.), the Virginia Real Estate Cooperative Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-2100\/\">55.1-2100<\/a> et seq.), the Virginia Real Estate Time-Share Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-2200\/\">55.1-2200<\/a> et seq.), or the Resale Disclosure Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-2307\/\">55.1-2307<\/a> et seq.), any requirement for the conduct of a <span class=\"dictionary\">hearing<\/span> shall be satisfied by an informal <span class=\"dictionary\">fact<\/span>-<span class=\"dictionary\">finding<\/span> proceeding convened and conducted pursuant to &#xA7; <a class=\"law\" title=\"Informal fact finding proceedings\" href=\"\/2.2-4019\/\">2.2-4019<\/a> of the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.). <a id=\"paragraph-270637\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#B3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> The <span class=\"dictionary\">Board<\/span> is authorized to obtain criminal history record information from any state or federal <span class=\"dictionary\">law<\/span>-enforcement agency relating to an applicant for licensure or certification. Any information so obtained is for the exclusive use of the <span class=\"dictionary\">Board<\/span> and shall not be released to any other person or agency except in furtherance of the investigation of the applicant or with the authorization of the applicant or upon <span class=\"dictionary\">court order<\/span>. <a id=\"paragraph-270638\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Notwithstanding the provisions of subsection A of &#xA7; <a class=\"law\" title=\"Association complaint procedures; final adverse decisions\" href=\"\/54.1-2354.4\/\">54.1-2354.4<\/a>, the <span class=\"dictionary\">Board<\/span> may receive a complaint directly from any person aggrieved by an <span class=\"dictionary\">association<\/span>&#8217;s failure to deliver a resale certificate in accordance with Chapter 23.1 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/55.1-2307\/\">55.1-2307<\/a> et seq.) of Title 55.1. <a id=\"paragraph-270639\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2349\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPOWERS AND DUTIES OF THE BOARD (\u00a7 54.1-2349)\n\nA. The Board shall administer and enforce the provisions of this article. In\naddition to the provisions of \u00a7\u00a7 54.1-201 and 54.1-202, the Board shall:\n\n   1. The fee paid to the Board for the\n   issuance of such certificate shall be paid to the Common Interest Community\n   Management Information Fund established pursuant to &#xA7; 54.1-2354.2;\n\n   4. Approve the criteria for accredited common interest community manager\n   training programs;\n\n   5. Approve accredited common interest community manager training programs;\n\n   6. Establish, by regulation, standards of conduct for common interest\n   community managers and for employees of common interest community managers\n   certified in accordance with the provisions of this article;\n\n   7. Establish, by regulation, an education-based certification program for\n   persons who are involved in the business or activity of providing management\n   services for compensation to common interest communities. The Board shall have\n   the authority to approve training courses and instructors in furtherance of\n   the provisions of this article;\n\n   8. Issue a certificate of registration to each association that has properly\n   filed in accordance with this chapter; and\n\n   9. Develop and publish best practices for the content of declarations\n   consistent with the requirements of the Property Owners&#8217; Association Act\n   (&#xA7; 55.1-1800 et seq.).\n\nB. 1. The Board shall have the sole responsibility for the administration of\nthis article and for the promulgation of regulations to carry out the\nrequirements thereof.\n\n   2. The Board shall also be responsible for the enforcement of this article,\n   provided that the Real Estate Board shall have the sole responsibility for the\n   enforcement of this article with respect to a real estate broker, real estate\n   salesperson, or real estate brokerage firm licensed in accordance with Chapter\n   21 (&#xA7; 54.1-2100 et seq.) who is also licensed as a common interest\n   community manager.\n\n   3. For purposes of enforcement of this article or the Property Owners&#8217;\n   Association Act (&#xA7; 55.1-1800 et seq.), the Virginia Condominium Act\n   (&#xA7; 55.1-1900 et seq.), the Virginia Real Estate Cooperative Act (&#xA7;\n   55.1-2100 et seq.), the Virginia Real Estate Time-Share Act (&#xA7; 55.1-2200\n   et seq.), or the Resale Disclosure Act (&#xA7; 55.1-2307 et seq.), any\n   requirement for the conduct of a hearing shall be satisfied by an informal\n   fact-finding proceeding convened and conducted pursuant to &#xA7; 2.2-4019 of\n   the Administrative Process Act (&#xA7; 2.2-4000 et seq.).\n\nC. The Board is authorized to obtain criminal history record information from\nany state or federal law-enforcement agency relating to an applicant for\nlicensure or certification. Any information so obtained is for the exclusive use\nof the Board and shall not be released to any other person or agency except in\nfurtherance of the investigation of the applicant or with the authorization of\nthe applicant or upon court order.\n\nD.
