Such fees shall be held exclusively to cover the expenses of the health regulatory boards, the Health Practitioners&#8217; Monitoring Program, and the Department and shall not be transferred to any agency other than the Department, except as provided in &#xA7;&#xA7; 54.1-3011.1 and 54.1-3011.2;11\n\nTo make and enter into all contracts and agreements necessary or incidental to the performance of his duties and the execution of his powers, including, but not limited to, contracts with the United States, other states, and agencies and governmental subdivisions of the Commonwealth;12\n\nTo accept grants from the United States government, its agencies and instrumentalities, and any other source. The Director shall have the power to comply with conditions and execute agreements as may be necessary, convenient, or desirable;13\n\nTo promulgate and revise regulations necessary for the administration of the Department and such regulations as are necessary for the implementation of the Health Practitioners&#8217; Monitoring Program pursuant to Chapter 25.1 (&#xA7; 54.1-2515 et seq.) and subdivision 18;14\n\nTo report promptly, after consultation with the presiding officer of the appropriate health regulatory board or his designee, to the Attorney General or the appropriate attorney for the Commonwealth any information the Department obtains which, upon appropriate investigation, indicates, in the judgment of the Director, that a person licensed by any of the health regulatory boards has violated any provision of criminal law, including the laws relating to manufacturing, distributing, dispensing, prescribing, or administering drugs other than drugs classified as Schedule VI drugs. When necessary, the Attorney General or the attorney for the Commonwealth shall request that the Department of Health Professions or the Department of State Police conduct any subsequent investigation of such report. Upon request and affidavit from an attorney for the Commonwealth, the Director shall provide documents material to a criminal investigation of a person licensed by a health regulatory board; however, peer review documents shall not be released and shall remain privileged pursuant to &#xA7; 8.01-581.17. For the purpose of this section, the terms manufacturing, distributing, dispensing, prescribing, or administering drugs shall not include minor administrative or clerical errors that do not affect the inventory of drugs required by the Drug Control Act (&#xA7; 54.1-3400 et seq.) and do not indicate a pattern of criminal behavior;15\n\nTo keep records of the names and qualifications of registered, certified, or licensed persons;16\n\nTo exercise other powers and perform other duties required of the Director by the Governor;17\n\nTo issue subpoenas in accordance with the Administrative Process Act (&#xA7; 2.2-4000 et seq.) for any informal fact finding or formal proceeding within the jurisdiction of the Department or any regulatory board;18\n\nTo establish, and revise as necessary, a health practitioners&#8217; monitoring program pursuant to Chapter 25.1 (&#xA7; 54.1-2515 et seq.);19\n\nTo establish, and revise as necessary, with such federal funds, grants, or general funds as may be appropriated or made available for this program, the Prescription Monitoring Program pursuant to Chapter 25.2 (&#xA7; 54.1-2519 et seq.);20\n\nTo assess a civil penalty against any person who is not licensed by a health regulatory board for failing to report a violation pursuant to &#xA7; 54.1-2400.6 or 54.1-2909;21\n\nTo evaluate, at the request of the General Assembly, health care professions and occupations in the Commonwealth and to consider whether each such profession or occupation should be regulated and the degree of regulation to be imposed;22\n\nTo receive, review, and forward to the appropriate health regulatory board any departmental investigative reports relating to complaints of violations by practitioners of the Practitioner Self-Referral Act (&#xA7; 54.1-2410 et seq.);23\n\nTo determine compliance with, violations of, and grant exceptions to the prohibitions set forth in the Practitioner Self-Referral Act (&#xA7; 54.1-2410 et seq.); and24\n\nTo take appropriate actions against entities, other than practitioners, for violations of the Practitioner Self-Referral Act (&#xA7; <a id=\"paragraph-229660\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"2\"><p><span class=\"prefix-number\">2.<\/span> To perform or consolidate such administrative services or functions as may assist the operation of the boards; <a id=\"paragraph-229661\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"3\"><p><span class=\"prefix-number\">3.<\/span> To prepare, approve, and submit to the Governor, after consultation with the boards, all requests for appropriations and be responsible for all expenditures pursuant to appropriations; <a id=\"paragraph-229662\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"4\"><p><span class=\"prefix-number\">4.<\/span> To provide such office facilities as will allow the boards to carry out their duties; <a id=\"paragraph-229663\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"5\"><p><span class=\"prefix-number\">5.<\/span> To employ personnel as required for the proper performance of the responsibilities of the <span class=\"dictionary\">Department<\/span> subject to the Virginia Personnel Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-2900\/\">2.2-2900<\/a> et seq.) within the limits of appropriations made by <span class=\"dictionary\">law<\/span>; <a id=\"paragraph-229664\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"6\"><p><span class=\"prefix-number\">6.<\/span> To receive all complaints made against regulated health care professionals; <a id=\"paragraph-229665\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"7\"><p><span class=\"prefix-number\">7.<\/span> To develop administrative policies and procedures governing the receipt and recording of complaints; <a id=\"paragraph-229666\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"8\"><p><span class=\"prefix-number\">8.<\/span> To monitor the status of actions taken under the auspices of the boards regarding complaints until the closure of each case; <a id=\"paragraph-229667\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"9\"><p><span class=\"prefix-number\">9.<\/span> To provide investigative and such other services as needed by the boards to enforce their respective <span class=\"dictionary\">statutes<\/span> and regulations; <a id=\"paragraph-229668\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#9\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"10\"><p><span class=\"prefix-number\">10.<\/span> To collect and account for all fees to be paid into each board and account for and deposit the moneys so collected into a special fund from which the expenses of the <span class=\"dictionary\">health regulatory boards<\/span>, the Health Practitioners&#8217; Monitoring Program, and the <span class=\"dictionary\">Department<\/span> shall be paid. Such fees shall be held exclusively to cover the expenses of the <span class=\"dictionary\">health regulatory boards<\/span>, the Health Practitioners&#8217; Monitoring Program, and the <span class=\"dictionary\">Department<\/span> and shall not be transferred to any agency other than the <span class=\"dictionary\">Department<\/span>, except as provided in &#xA7;&#xA7; <a class=\"law\" title=\"Additional fee required for licensure of certain practitioners\" href=\"\/54.1-3011.1\/\">54.1-3011.1<\/a> and <a class=\"law\" title=\"Nursing Scholarship and Loan Repayment Fund\" href=\"\/54.1-3011.2\/\">54.1-3011.2<\/a>; <a id=\"paragraph-229669\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#10\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"11\"><p><span class=\"prefix-number\">11.<\/span> To make and enter into all <span class=\"dictionary\">contracts<\/span> and agreements necessary or incidental to the performance of his duties and the execution of his powers, including, but not limited to, <span class=\"dictionary\">contracts<\/span> with the United States, other states, and agencies and governmental subdivisions of the Commonwealth; <a id=\"paragraph-229670\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#11\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"12\"><p><span class=\"prefix-number\">12.<\/span> To accept grants from the United States government, its agencies and instrumentalities, and any other source. The <span class=\"dictionary\">Director<\/span> shall have the power to comply with conditions and execute agreements as may be necessary, convenient, or desirable; <a id=\"paragraph-229671\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#12\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"13\"><p><span class=\"prefix-number\">13.<\/span> To promulgate and revise regulations necessary for the administration of the <span class=\"dictionary\">Department<\/span> and such regulations as are necessary for the implementation of the Health Practitioners&#8217; Monitoring Program pursuant to Chapter 25.1 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/54.1-2515\/\">54.1-2515<\/a> et seq.) and subdivision 18; <a id=\"paragraph-229672\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#13\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"14\"><p><span class=\"prefix-number\">14.<\/span> To report promptly, after consultation with the presiding officer of the appropriate <span class=\"dictionary\">health regulatory board<\/span> or his designee, to the <span class=\"dictionary\">Attorney General<\/span> or the appropriate attorney for the Commonwealth any information the <span class=\"dictionary\">Department<\/span> obtains which, upon appropriate investigation, indicates, in the <span class=\"dictionary\">judgment<\/span> of the <span class=\"dictionary\">Director<\/span>, that a person licensed by any of the <span class=\"dictionary\">health regulatory boards<\/span> has violated any provision of criminal <span class=\"dictionary\">law<\/span>, including the <span class=\"dictionary\">laws<\/span> relating to manufacturing, distributing, dispensing, prescribing, or administering drugs other than drugs classified as Schedule VI drugs. When necessary, the <span class=\"dictionary\">Attorney General<\/span> or the attorney for the Commonwealth shall request that the <span class=\"dictionary\">Department<\/span> of Health Professions or the <span class=\"dictionary\">Department<\/span> of State Police conduct any subsequent investigation of such report. Upon request and <span class=\"dictionary\">affidavit<\/span> from an attorney for the Commonwealth, the <span class=\"dictionary\">Director<\/span> shall provide documents <span class=\"dictionary\">material<\/span> to a criminal investigation of a person licensed by a <span class=\"dictionary\">health regulatory board<\/span>; however, peer review documents shall not be released and shall remain privileged pursuant to &#xA7; <a class=\"law\" title=\"Privileged communications of certain committees and entities\" href=\"\/8.01-581.17\/\">8.01-581.17<\/a>. For the purpose of this section, the terms manufacturing, distributing, dispensing, prescribing, or administering drugs shall not include <span class=\"dictionary\">minor<\/span> administrative or clerical errors that do not affect the inventory of drugs required by the Drug Control Act (&#xA7; <a class=\"law\" title=\"Citation\" href=\"\/54.1-3400\/\">54.1-3400<\/a> et seq.) and do not indicate a pattern of criminal behavior; <a id=\"paragraph-229673\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#14\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"15\"><p><span class=\"prefix-number\">15.<\/span> To keep records of the names and qualifications of registered, certified, or licensed persons; <a id=\"paragraph-229674\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#15\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"16\"><p><span class=\"prefix-number\">16.<\/span> To exercise other powers and perform other duties required of the <span class=\"dictionary\">Director<\/span> by the Governor; <a id=\"paragraph-229675\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#16\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"17\"><p><span class=\"prefix-number\">17.<\/span> To <span class=\"dictionary\">issue<\/span> <span class=\"dictionary\">subpoenas<\/span> in accordance with the Administrative Process Act (&#xA7; <a class=\"law\" title=\"Short title; purpose\" href=\"\/2.2-4000\/\">2.2-4000<\/a> et seq.) for any informal <span class=\"dictionary\">fact<\/span> <span class=\"dictionary\">finding<\/span> or formal proceeding within the <span class=\"dictionary\">jurisdiction<\/span> of the <span class=\"dictionary\">Department<\/span> or any regulatory board; <a id=\"paragraph-229676\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#17\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"18\"><p><span class=\"prefix-number\">18.<\/span> To establish, and revise as necessary, a health practitioners&#8217; monitoring program pursuant to Chapter 25.1 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/54.1-2515\/\">54.1-2515<\/a> et seq.); <a id=\"paragraph-229677\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#18\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"19\"><p><span class=\"prefix-number\">19.<\/span> To establish, and revise as necessary, with such federal funds, grants, or general funds as may be appropriated or made available for this program, the Prescription Monitoring Program pursuant to Chapter 25.2 (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/54.1-2519\/\">54.1-2519<\/a> et seq.); <a id=\"paragraph-229678\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#19\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"20\"><p><span class=\"prefix-number\">20.<\/span> To assess a civil <span class=\"dictionary\">penalty<\/span> against any person who is not licensed by a <span class=\"dictionary\">health regulatory board<\/span> for failing to report a violation pursuant to &#xA7; <a class=\"law\" title=\"Hospitals, other health care institutions, home health and hospice organizations, and assisted living facilities required to report disciplinary actions against and certain disorders of health professionals; immunity from liability; failure to report\" href=\"\/54.1-2400.6\/\">54.1-2400.6<\/a> or <a class=\"law\" title=\"Further reporting requirements; civil penalty; disciplinary action\" href=\"\/54.1-2909\/\">54.1-2909<\/a>; <a id=\"paragraph-229679\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#20\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"21\"><p><span class=\"prefix-number\">21.<\/span> To evaluate, at the request of the General Assembly, health care professions and occupations in the Commonwealth and to consider whether each such profession or occupation should be regulated and the degree of regulation to be imposed; <a id=\"paragraph-229680\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#21\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"22\"><p><span class=\"prefix-number\">22.<\/span> To receive, review, and forward to the appropriate <span class=\"dictionary\">health regulatory board<\/span> any departmental investigative reports relating to complaints of violations by practitioners of the Practitioner Self-Referral Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/54.1-2410\/\">54.1-2410<\/a> et seq.); <a id=\"paragraph-229681\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#22\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"23\"><p><span class=\"prefix-number\">23.<\/span> To determine compliance with, violations of, and grant exceptions to the prohibitions set forth in the Practitioner Self-Referral Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/54.1-2410\/\">54.1-2410<\/a> et seq.); and <a id=\"paragraph-229682\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#23\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"24\"><p><span class=\"prefix-number\">24.<\/span> To take appropriate actions against entities, other than practitioners, for violations of the Practitioner Self-Referral Act (&#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/54.1-2410\/\">54.1-2410<\/a> et seq.). <a id=\"paragraph-229683\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-2505\/#24\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nPOWERS AND DUTIES OF DIRECTOR OF DEPARTMENT (\u00a7 54.1-2505)\n\nThe Director of the Department shall have the following powers and duties:\n\n1.
