Such review shall include screening for potential drug therapy problems due to therapeutic duplication, drug-disease contraindications, drug-drug interactions, including serious interactions with nonprescription or over-the-counter drugs, incorrect drug dosage or duration of drug treatment, drug-allergy interactions, and clinical abuse or misuse. A pharmacist may conduct a prospective drug review before refilling a prescription to the extent the pharmacist deems appropriate in his professional judgment.B\n\nA pharmacist shall offer to counsel any person who presents a new prescription for filling. The offer to counsel may be made in any manner the pharmacist deems appropriate in his professional judgment, and may include any one or a combination of the following:1\n\nFace-to-face communication with the pharmacist or the pharmacist&#8217;s designee;2\n\nA sign posted in such a manner that it can be seen by patients;3\n\nA notation affixed to or written on the bag in which the prescription is to be delivered;4\n\nA notation contained on the prescription container; or5\n\nBy telephone.\n\t\t\t\tFor the purposes of medical assistance and other third-party reimbursement or payment programs, any of the above methods, or a combination thereof, shall constitute an acceptable offer to provide counseling, except to the extent this subsection is inconsistent with regulations promulgated by the federal Health Care Financing Administration governing 42 U.S.C. &#xA7; 1396r-8 (g)(2)(A)(ii). A pharmacist may offer to counsel any person who receives a refill of a prescription to the extent deemed appropriate by the pharmacist in his professional judgment.C\n\nIf the offer to counsel is accepted, the pharmacist shall counsel the person presenting the prescription to the extent the pharmacist deems appropriate in his professional judgment. Such counseling shall be performed by the pharmacist himself and may, but need not, include the following:1\n\nThe name and description of the medication;2\n\nThe dosage form, dosage, route of administration, and duration of drug therapy;3\n\nSpecial directions and precautions for preparation, administration, and use by the patient;4\n\nCommon adverse or severe side effects or interactions and therapeutic contraindications that may be encountered, including their avoidance, and the action required if they occur;5\n\nTechniques for self-monitoring drug therapy;6\n\nProper storage and disposal;7\n\nPrescription refill information; and8\n\nAction to be taken in the event of a missed dose.\n\t\t\t\tNothing in this section shall be construed as requiring a pharmacist to provide counseling when the person presenting the prescription fails to accept the pharmacist&#8217;s offer to counsel. If the prescription is delivered to a person residing outside of the local telephone calling area of the pharmacy, the pharmacist shall either provide a toll-free telephone number or accept reasonable collect calls from such person.D\n\nReasonable efforts shall be made to obtain, record, and maintain the following patient information generated at the individual pharmacy:1\n\nName, address, telephone number, date of birth or age, and gender;2\n\nIndividual history where significant, including known allergies and drug reactions, and a comprehensive list of medications and relevant devices; and3\n\nAny additional comments relevant to the patient&#8217;s drug use, including any failure to accept the pharmacist&#8217;s offer to counsel.\n\t\t\t\tSuch information may be recorded in the patient&#8217;s manual or electronic profile, or in the prescription signature log, or in any other system of records and may be considered by the pharmacist in the exercise of his professional judgment concerning both the offer to counsel and content of counseling. Such counseling shall be performed by the <span class=\"dictionary\">pharmacist<\/span> himself and may, but need not, include the following: <a id=\"paragraph-236099\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> The name and description of the medication; <a id=\"paragraph-236100\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> The dosage form, dosage, route of administration, and duration of drug therapy; <a id=\"paragraph-236101\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Special directions and precautions for preparation, administration, and use by the patient; <a id=\"paragraph-236102\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C4\" class=\"indent-1\"><p><span class=\"prefix-number\">4.<\/span> Common adverse or severe side effects or interactions and therapeutic contraindications that may be encountered, including their avoidance, and the action required if they occur; <a id=\"paragraph-236103\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C4\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C5\" class=\"indent-1\"><p><span class=\"prefix-number\">5.<\/span> Techniques for self-monitoring drug therapy; <a id=\"paragraph-236104\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C5\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C6\" class=\"indent-1\"><p><span class=\"prefix-number\">6.<\/span> Proper storage and disposal; <a id=\"paragraph-236105\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C6\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C7\" class=\"indent-1\"><p><span class=\"prefix-number\">7.<\/span> Prescription refill information; and <a id=\"paragraph-236106\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C7\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C8\" class=\"indent-1\"><p><span class=\"prefix-number\">8.<\/span> Action to be taken in the event of a missed dose.\n\t\t\t\tNothing in this section shall be construed as requiring a <span class=\"dictionary\">pharmacist<\/span> to provide counseling when the person presenting the prescription fails to accept the <span class=\"dictionary\">pharmacist<\/span>&#8217;s offer to <span class=\"dictionary\">counsel<\/span>. If the prescription is delivered to a person residing outside of the local telephone calling area of the <span class=\"dictionary\">pharmacy<\/span>, the <span class=\"dictionary\">pharmacist<\/span> shall either provide a toll-free telephone number or accept reasonable collect calls from such person. <a id=\"paragraph-236107\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#C8\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Reasonable efforts shall be made to obtain, record, and maintain the following patient information generated at the individual <span class=\"dictionary\">pharmacy<\/span>: <a id=\"paragraph-236108\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Name, address, telephone number, date of birth or age, and gender; <a id=\"paragraph-236109\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#D1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Individual history where significant, including known allergies and drug reactions, and a comprehensive list of medications and relevant devices; and <a id=\"paragraph-236110\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#D2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Any additional comments relevant to the patient&#8217;s drug use, including any failure to accept the <span class=\"dictionary\">pharmacist<\/span>&#8217;s offer to <span class=\"dictionary\">counsel<\/span>.\n\t\t\t\tSuch information may be recorded in the patient&#8217;s manual or electronic profile, or in the prescription signature log, or in any other system of records and may be considered by the <span class=\"dictionary\">pharmacist<\/span> in the exercise of his professional <span class=\"dictionary\">judgment<\/span> concerning both the offer to <span class=\"dictionary\">counsel<\/span> and content of counseling. The absence of any record of a failure to accept the <span class=\"dictionary\">pharmacist<\/span>&#8217;s offer to <span class=\"dictionary\">counsel<\/span> shall be presumed to signify that such offer was accepted and that such counseling was provided. <a id=\"paragraph-236111\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#D3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> This section shall not apply to any drug dispensed to an inpatient of a hospital or nursing home, except to the extent required by regulations promulgated by the federal Health Care Financing Administration implementing 42 U.S.C. &#xA7; 1396r-8 (g)(2)(A). <a id=\"paragraph-236112\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3319\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nCOUNSELING (\u00a7 54.1-3319)\n\nA. A pharmacist shall conduct a prospective drug review before each new\nprescription is dispensed or delivered to a patient or a person acting on behalf\nof the patient. Such review shall include screening for potential drug therapy\nproblems due to therapeutic duplication, drug-disease contraindications,\ndrug-drug interactions, including serious interactions with nonprescription or\nover-the-counter drugs, incorrect drug dosage or duration of drug treatment,\ndrug-allergy interactions, and clinical abuse or misuse. A pharmacist may\nconduct a prospective drug review before refilling a prescription to the extent\nthe pharmacist deems appropriate in his professional judgment.\n\nB. A pharmacist shall offer to counsel any person who presents a new\nprescription for filling. The offer to counsel may be made in any manner the\npharmacist deems appropriate in his professional judgment, and may include any\none or a combination of the following:\n\n   1. Face-to-face communication with the pharmacist or the pharmacist&#8217;s\n   designee;\n\n   2. A sign posted in such a manner that it can be seen by patients;\n\n   3. A notation affixed to or written on the bag in which the prescription is to\n   be delivered;\n\n   4. A notation contained on the prescription container; or\n\n   5. By telephone.\n   \t\t\t\tFor the purposes of medical assistance and other third-party reimbursement\n   or payment programs, any of the above methods, or a combination thereof, shall\n   constitute an acceptable offer to provide counseling, except to the extent\n   this subsection is inconsistent with regulations promulgated by the federal\n   Health Care Financing Administration governing 42 U.S.C. &#xA7; 1396r-8\n   (g)(2)(A)(ii). A pharmacist may offer to counsel any person who receives a\n   refill of a prescription to the extent deemed appropriate by the pharmacist in\n   his professional judgment.\n\nC. If the offer to counsel is accepted, the pharmacist shall counsel the person\npresenting the prescription to the extent the pharmacist deems appropriate in\nhis professional judgment.
