If the prescription is for an animal, it shall state the species of animal for which the drug is prescribed;2\n\nIn emergency situations, Schedule II drugs may be dispensed pursuant to an oral prescription in accordance with the Board&#8217;s regulations;3\n\nWhenever a pharmacist dispenses any drug listed within Schedule II on a prescription issued by a prescriber, he shall affix to the container in which such drug is dispensed, a label showing the prescription serial number or name of the drug; the date of initial filling; his name and address, or the name and address of the pharmacy; the name of the patient or, if the patient is an animal, the name of the owner of the animal and the species of the animal; the name of the prescriber by whom the prescription was written, except for those drugs dispensed to a patient in a hospital pursuant to a chart order; and such directions as may be stated on the prescription.B\n\nA drug controlled by Schedules III through VI or a device controlled by Schedule VI shall be dispensed upon receipt of a written or oral prescription as follows:1\n\nIf the prescription is written, it shall be properly executed, dated and signed by the person prescribing on the day when issued and bear the full name and address of the patient for whom, or of the owner of the animal for which, the drug is dispensed, and the full name and address of the person prescribing. If the prescription is for an animal, it shall state the species of animal for which the drug is prescribed. If the prescription is for expedited partner therapy pursuant to &#xA7; 54.1-3303 and the contact patient&#8217;s name and address are unavailable, the prescription shall state &#8220;Expedited Partner Therapy&#8221; or &#8220;EPT&#8221; in lieu of the full name and address of the contact patient.2\n\nIf the prescription is oral, the prescriber shall furnish the pharmacist with the same information as is required by law in the case of a written prescription for drugs and devices, except for the signature of the prescriber.\n\t\t\t\tA pharmacist who dispenses a Schedule III through VI drug or device shall label the drug or device as required in subdivision A 3 of this section. However, if the pharmacist dispenses a Schedule III through VI drug or device for expedited partner therapy pursuant to &#xA7; 54.1-3303 and the contact patient&#8217;s name and address are unavailable, the prescription shall state &#8220;Expedited Partner Therapy&#8221; or &#8220;EPT&#8221; in lieu of the full name and address of the contact patient.C\n\nA drug controlled by Schedule VI may be refilled without authorization from the prescriber if, after reasonable effort has been made to contact him, the pharmacist ascertains that he is not available and the patient&#8217;s health would be in imminent danger without the benefits of the drug. The refill shall be made in compliance with the provisions of &#xA7; 54.1-3411.\n\t\t\tIf the written or oral prescription is for a Schedule VI drug or device and does not contain the address or registry number of the prescriber, or the address of the patient, the pharmacist need not reduce such information to writing if such information is readily retrievable within the pharmacy. If the <span class=\"dictionary\">prescription<\/span> is for an <span class=\"dictionary\">animal<\/span>, it shall state the species of <span class=\"dictionary\">animal<\/span> for which the <span class=\"dictionary\">drug<\/span> is prescribed; <a id=\"paragraph-300161\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#A1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> In emergency situations, Schedule II <span class=\"dictionary\">drugs<\/span> may be dispensed pursuant to an oral <span class=\"dictionary\">prescription<\/span> in accordance with the <span class=\"dictionary\">Board<\/span>&#8217;s regulations; <a id=\"paragraph-300162\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#A2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"A3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> Whenever a pharmacist <span class=\"dictionary\">dispenses<\/span> any <span class=\"dictionary\">drug<\/span> listed within Schedule II on a <span class=\"dictionary\">prescription<\/span> issued by a <span class=\"dictionary\">prescriber<\/span>, he shall affix to the container in which such <span class=\"dictionary\">drug<\/span> is dispensed, a <span class=\"dictionary\">label<\/span> showing the <span class=\"dictionary\">prescription<\/span> serial number or name of the <span class=\"dictionary\">drug<\/span>; the date of initial filling; his name and address, or the name and address of the pharmacy; the name of the patient or, if the patient is an <span class=\"dictionary\">animal<\/span>, the name of the owner of the <span class=\"dictionary\">animal<\/span> and the species of the <span class=\"dictionary\">animal<\/span>; the name of the <span class=\"dictionary\">prescriber<\/span> by whom the <span class=\"dictionary\">prescription<\/span> was written, except for those <span class=\"dictionary\">drugs<\/span> dispensed to a patient in a hospital pursuant to a chart <span class=\"dictionary\">order<\/span>; and such directions as may be stated on the <span class=\"dictionary\">prescription<\/span>. <a id=\"paragraph-300163\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#A3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B\"><p><span class=\"prefix-number\">B.<\/span> A <span class=\"dictionary\">drug<\/span> controlled by <span class=\"dictionary\">Schedules<\/span> III through VI or a <span class=\"dictionary\">device<\/span> controlled by Schedule VI shall be dispensed upon receipt of a written or oral <span class=\"dictionary\">prescription<\/span> as follows: <a id=\"paragraph-300164\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#B\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> If the <span class=\"dictionary\">prescription<\/span> is written, it shall be properly executed, dated and signed by the <span class=\"dictionary\">person<\/span> prescribing on the day when issued and bear the full name and address of the patient for whom, or of the owner of the <span class=\"dictionary\">animal<\/span> for which, the <span class=\"dictionary\">drug<\/span> is dispensed, and the full name and address of the <span class=\"dictionary\">person<\/span> prescribing. If the <span class=\"dictionary\">prescription<\/span> is for an <span class=\"dictionary\">animal<\/span>, it shall state the species of <span class=\"dictionary\">animal<\/span> for which the <span class=\"dictionary\">drug<\/span> is prescribed. If the <span class=\"dictionary\">prescription<\/span> is for expedited partner therapy pursuant to &#xA7; <a class=\"law\" title=\"Prescriptions to be issued and drugs to be dispensed for medical or therapeutic purposes only\" href=\"\/54.1-3303\/\">54.1-3303<\/a> and the contact patient&#8217;s name and address are unavailable, the <span class=\"dictionary\">prescription<\/span> shall state &#8220;Expedited Partner Therapy&#8221; or &#8220;EPT&#8221; in lieu of the full name and address of the contact patient. <a id=\"paragraph-300165\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#B1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"B2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> If the <span class=\"dictionary\">prescription<\/span> is oral, the <span class=\"dictionary\">prescriber<\/span> shall furnish the pharmacist with the same information as is required by <span class=\"dictionary\">law<\/span> in the case of a written <span class=\"dictionary\">prescription<\/span> for <span class=\"dictionary\">drugs<\/span> and <span class=\"dictionary\">devices<\/span>, except for the signature of the <span class=\"dictionary\">prescriber<\/span>.\n\t\t\t\tA pharmacist who <span class=\"dictionary\">dispenses<\/span> a Schedule III through VI <span class=\"dictionary\">drug<\/span> or <span class=\"dictionary\">device<\/span> shall <span class=\"dictionary\">label<\/span> the <span class=\"dictionary\">drug<\/span> or <span class=\"dictionary\">device<\/span> as required in subdivision A 3 of this section. However, if the pharmacist <span class=\"dictionary\">dispenses<\/span> a Schedule III through VI <span class=\"dictionary\">drug<\/span> or <span class=\"dictionary\">device<\/span> for expedited partner therapy pursuant to &#xA7; <a class=\"law\" title=\"Prescriptions to be issued and drugs to be dispensed for medical or therapeutic purposes only\" href=\"\/54.1-3303\/\">54.1-3303<\/a> and the contact patient&#8217;s name and address are unavailable, the <span class=\"dictionary\">prescription<\/span> shall state &#8220;Expedited Partner Therapy&#8221; or &#8220;EPT&#8221; in lieu of the full name and address of the contact patient. <a id=\"paragraph-300166\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#B2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"C\"><p><span class=\"prefix-number\">C.<\/span> A <span class=\"dictionary\">drug<\/span> controlled by Schedule VI may be refilled without authorization from the <span class=\"dictionary\">prescriber<\/span> if, after reasonable effort has been made to contact him, the pharmacist ascertains that he is not available and the patient&#8217;s health would be in imminent danger without the benefits of the <span class=\"dictionary\">drug<\/span>. The refill shall be made in compliance with the provisions of &#xA7; <a class=\"law\" title=\"When prescriptions may be refilled\" href=\"\/54.1-3411\/\">54.1-3411<\/a>.\n\t\t\tIf the written or oral <span class=\"dictionary\">prescription<\/span> is for a Schedule VI <span class=\"dictionary\">drug<\/span> or <span class=\"dictionary\">device<\/span> and does not contain the address or registry number of the <span class=\"dictionary\">prescriber<\/span>, or the address of the patient, the pharmacist need not reduce such information to writing if such information is readily retrievable within the pharmacy. If the <span class=\"dictionary\">prescription<\/span> is for a Schedule VI <span class=\"dictionary\">drug<\/span> or <span class=\"dictionary\">device<\/span> for expedited partner therapy pursuant to &#xA7; <a class=\"law\" title=\"Prescriptions to be issued and drugs to be dispensed for medical or therapeutic purposes only\" href=\"\/54.1-3303\/\">54.1-3303<\/a> and the contact patient&#8217;s name and address are unavailable, then <span class=\"dictionary\">labeling<\/span> the name and address of the contact patient is not required. <a id=\"paragraph-300167\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#C\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"D\"><p><span class=\"prefix-number\">D.<\/span> Pursuant to authorization of the <span class=\"dictionary\">prescriber<\/span>, an <span class=\"dictionary\">agent<\/span> of the <span class=\"dictionary\">prescriber<\/span> on his behalf may orally transmit a <span class=\"dictionary\">prescription<\/span> for a <span class=\"dictionary\">drug<\/span> classified in <span class=\"dictionary\">Schedules<\/span> III through VI if, in such cases, the written record of the <span class=\"dictionary\">prescription<\/span> required by this subsection specifies the full name of the <span class=\"dictionary\">agent<\/span> of the <span class=\"dictionary\">prescriber<\/span> transmitting the <span class=\"dictionary\">prescription<\/span>. <a id=\"paragraph-300168\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#D\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E\"><p><span class=\"prefix-number\">E.<\/span> A <span class=\"dictionary\">dispenser<\/span> who receives a non-<span class=\"dictionary\">electronic prescription<\/span> for a <span class=\"dictionary\">controlled substance<\/span> containing an opioid is not required to verify that one of the exceptions set forth in &#xA7; <a class=\"law\" title=\"Transmission of prescriptions\" href=\"\/54.1-3408.02\/\">54.1-3408.02<\/a> applies and may <span class=\"dictionary\">dispense<\/span> such <span class=\"dictionary\">controlled substance<\/span> pursuant to such prescription and applicable <span class=\"dictionary\">law<\/span>. <a id=\"paragraph-300169\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/54.1-3410\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nWHEN PHARMACIST MAY SELL AND DISPENSE DRUGS (\u00a7 54.1-3410)\n\nA. A pharmacist, acting in good faith, may sell and dispense drugs and devices\nto any person pursuant to a prescription of a prescriber as follows:\n\n   1. A drug listed in Schedule II shall be dispensed only upon receipt of a\n   written prescription that is properly executed, dated and signed by the person\n   prescribing on the day when issued and bearing the full name and address of\n   the patient for whom, or of the owner of the animal for which, the drug is\n   dispensed, and the full name, address, and registry number under the federal\n   laws of the person prescribing, if he is required by those laws to be so\n   registered. If the prescription is for an animal, it shall state the species\n   of animal for which the drug is prescribed;\n\n   2. In emergency situations, Schedule II drugs may be dispensed pursuant to an\n   oral prescription in accordance with the Board&#8217;s regulations;\n\n   3. Whenever a pharmacist dispenses any drug listed within Schedule II on a\n   prescription issued by a prescriber, he shall affix to the container in which\n   such drug is dispensed, a label showing the prescription serial number or name\n   of the drug; the date of initial filling; his name and address, or the name\n   and address of the pharmacy; the name of the patient or, if the patient is an\n   animal, the name of the owner of the animal and the species of the animal; the\n   name of the prescriber by whom the prescription was written, except for those\n   drugs dispensed to a patient in a hospital pursuant to a chart order; and such\n   directions as may be stated on the prescription.\n\nB. A drug controlled by Schedules III through VI or a device controlled by\nSchedule VI shall be dispensed upon receipt of a written or oral prescription as\nfollows:\n\n   1. If the prescription is written, it shall be properly executed, dated and\n   signed by the person prescribing on the day when issued and bear the full name\n   and address of the patient for whom, or of the owner of the animal for which,\n   the drug is dispensed, and the full name and address of the person\n   prescribing. If the prescription is for an animal, it shall state the species\n   of animal for which the drug is prescribed. If the prescription is for\n   expedited partner therapy pursuant to &#xA7; 54.1-3303 and the contact\n   patient&#8217;s name and address are unavailable, the prescription shall state\n   &#8220;Expedited Partner Therapy&#8221; or &#8220;EPT&#8221; in lieu of the\n   full name and address of the contact patient.\n\n   2. If the prescription is oral, the prescriber shall furnish the pharmacist\n   with the same information as is required by law in the case of a written\n   prescription for drugs and devices, except for the signature of the\n   prescriber.\n   \t\t\t\tA pharmacist who dispenses a Schedule III through VI drug or device shall\n   label the drug or device as required in subdivision A 3 of this section.\n   However, if the pharmacist dispenses a Schedule III through VI drug or device\n   for expedited partner therapy pursuant to &#xA7; 54.1-3303 and the contact\n   patient&#8217;s name and address are unavailable, the prescription shall state\n   &#8220;Expedited Partner Therapy&#8221; or &#8220;EPT&#8221; in lieu of the\n   full name and address of the contact patient.\n\nC. A drug controlled by Schedule VI may be refilled without authorization from\nthe prescriber if, after reasonable effort has been made to contact him, the\npharmacist ascertains that he is not available and the patient&#8217;s health\nwould be in imminent danger without the benefits of the drug. The refill shall\nbe made in compliance with the provisions of &#xA7; 54.1-3411.\n\t\t\tIf the written or oral prescription is for a Schedule VI drug or device and\ndoes not contain the address or registry number of the prescriber, or the\naddress of the patient, the pharmacist need not reduce such information to\nwriting if such information is readily retrievable within the pharmacy. If the\nprescription is for a Schedule VI drug or device for expedited partner therapy\npursuant to &#xA7; 54.1-3303 and the contact patient&#8217;s name and address\nare unavailable, then labeling the name and address of the contact patient is\nnot required.\n\nD. Pursuant to authorization of the prescriber, an agent of the prescriber on\nhis behalf may orally transmit a prescription for a drug classified in Schedules\nIII through VI if, in such cases, the written record of the prescription\nrequired by this subsection specifies the full name of the agent of the\nprescriber transmitting the prescription.\n\nE.
